A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH,
CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON WEDNESDAY, OCTOBER 19, 2022, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW.
WHEREAS, a Special Municipal Election was held and conducted in the City of Redondo Beach, California, on Wednesday, October 19, 2022, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted by All-Mail Ballot and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the City Charter and California State law; and
WHEREAS, the City Clerk canvassed the returns of the election and has certified the results to the City Council, which are received, attached, and made a part hereof as Exhibit “A”.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the whole number of ballots cast by mail voter ballots (VBM) was 14,935 ballots cast in the City.
SECTION 2. That the canvass of the ballots cast in the Special Municipal Election of October 19, 2022 is confirmed for the question voted upon as follows:
CITYWIDE (ALL DISTRICTS)
MEASURE E
AN INITIATIVE ORDINANCE TO (1) ALLOW A MAXIMUM
OF THREE CANNABIS RETAILERS IN REDONDO BEACH;
(2) REPEAL THE CITY’S PROHIBITION ON COMMERCIAL
CANNABIS ACTIVITY (EXCEPT FOR DELIVERIES OF
MEDICINAL CANNABIS) AND ALLOW THE CITY COUNCIL
DISCRETION TO LEGALIZE OTHER CANNABIS USES;
AND (3) IMPOSE OPERATIONAL, DESIGN, AND
LOCATION REQUIREMENTS ON SUCH BUSINESSES.
Shall a measure repealing Redondo Beach’s existing
prohibition of all commercial cannabis activity; allowing three cannabis retailers within city limits; allowing the Redondo Beach City Council discretion to legalize other cannabis uses; and imposing operational, design, and location
requirements on such businesses, be adopted?

AND, FOR DISTRICT 4 ONLY, THAT VOTES WERE ALSO CAST FOR THE QUESTION AS FOLLOWS:

Shall Zein Obagi, Jr. be recalled (removed) from the office of Member of the Redondo Beach City Council representing District 4?

SECTION 3. That the number of votes given at each precinct in the City to the questions and the candidate for the above-named office should a recall prevail are as listed in Exhibit “A” attached hereto and incorporated herein.
SECTION 4. That the City Council does declare and determine that as a result of the election Measure E - Cannabis Regulation was unsuccessful, and shall not be deemed adopted and ratified.
That as a result of the election, the recall of Zein Obagi, Jr. from the office of Member of Redondo Beach City Council representing District 4 was unsuccessful and Zein Obagi, Jr. shall continue in his present term.
That as a result of the unsuccessful recall measure, the question of filling a vacancy is not applicable.
SECTION 5. That the City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The measure(s) voted upon; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person, and for and against each measure(s); (5) The total number of votes given to each person, and for and against each measure. (Exhibit “A”)
SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
