EXECUTIVE SUMMARY
Pursuant to recommendations of the City Council-appointed Charter Review Advisory Committee (“Committee”) to amend certain sections of the City Charter, adoption of this Resolution adds three (3) specific proposed Charter Amendment questions to the March 7, 2023 General Municipal Election ballot.
Charter Sections Recommended for Revision
8.3(a). Mayor, presiding officer. (forthcoming on 12/6/22, if needed)
19. Public works, contracts.
19.1. Competitive bidding, when not required.
19.7. Contracts, progress payments.
N.5., File # 22-5164 Meeting Date: 11/15/2022
19.9. Municipal purchases.
20.1. Approval of demands.
The Committee also recommended amending the Charter to reflect general neutral language throughout.
The City Council is asked to review and/or revise the drafted Ballot Questions as they see fit (limited to no more than 75 words) pursuant to the Committee’s recommendations, to assign a Ballot Measure letter(s) designations to each question, designate an author(s) to write the argument(s) in support of these Ballot Measures, and subsequently adopt the Resolutions.
An amendment to Section 8.3(c) delegating signature authority to the City Manager or designee was included; however, the Committee broadened the scope to include the signing of Resolutions and Ordinances, which may impede the Mayor’s power to veto any action of the City Council (Section 8.4 Mayor: veto power). of the Charter, which may be an unintended consequence. The proposed charter change reflects only written contracts whereas the proposed action, per the Committee, mentions inclusion of ordinances and resolutions. Please refer to the Committee’s first report (attached.)
