REDONDO BEACH APPROVING AN EXEMPTION DECLARATION,
CONDITIONAL USE PERMIT, AND COASTAL DEVELOPMENT
PERMIT TO ALLOW THE OPERATION OF A CHILD DAY CARE
CENTER, WITH INFANT CARE, WITHIN AN EXISTING
COMMERCIAL OFFICE BUILDING LOCATED WITHIN A COASTAL
COMMERCIAL ( CC- 2) ZONE, IN THE COASTAL ZONE AT 109
WEST TORRANCE BOULEVARD
WHEREAS, an application was filed by the applicant/operator of the proposed project on behalf of the owners of property (City of Redondo Beach) located at 109 W.
Torrance Boulevard for approval of an Exemption Declaration, Conditional Use Permit, and Coastal Development Permit to allow the operation of a Child Day Care Center, with infant care, within an existing commercial office building located within a Coastal Commercial (CC- 2) zone, in the Coastal Zone; and
WHEREAS, notice of the time and place of the public hearing where the Exemption Declaration, Conditional Use Permit, and Coastal Development Permit ("the application") would be considered was given pursuant to State law and local ordinances by publication in the Easy Reader, by posting the subject property, and by mailing notices to property owners within 300 feet and occupants within 100 feet of the exterior boundaries of the subject property; and
WHEREAS, the Harbor Commission of the City of Redondo Beach has considered evidence presented by the applicant, the Planning Division, the Waterfront Economic Development Department, and other interested parties at the public hearing held on the 10th day of October, 2022, with respect thereto.
NOW, THEREFORE, THE HARBOR COMMISSION OF THE CITY OF
REDONDO BEACH DOES HEREBY FIND:
1. In accordance with Section 10- 5. 810 of the Redondo Beach Municipal Code, Zoning Ordinance for the Coastal Zone, the proposed Child Day Care Center, with Infant Care, is conditionally permitted within the Coastal Commercial ( CC- 2) zone.
2. In accordance with Section 10- 5. 2506 ( b) of the Redondo Beach Municipal Code, Zoning Ordinance for the Coastal Zone, the applicant's request for a Conditional Use Permit is consistent with the criteria set forth therein for the following reasons:
a. The proposed use is conditionally permitted in the land use district in which the site is located, the site is adequate in size and shape to accommodate the use and the parking necessary to accommodate the use, as demonstrated by a parking survey and memorandum dated August 12, 2022, and the project, which proposes to occupy an existing commercial office building with no addition, no RESOLUTION NO. 2022- 10- HCR-02

exterior alterations, and only minor interior changes is consistent with the requirements of Chapter 5, Title 10 of the Redondo Beach Municipal Code, to adjust the use with the land and uses in the neighborhood. b. The site of the project has adequate access to a public street or highway of adequate width and pavement to carry the quantity and kind of traffic generated by the use.
c. The use of the site will have no adverse effect upon abutting property or the permitted use thereof, subject to the conditions of approval. d. That approval of the Conditional Use Permit request, as submitted and conditioned, is in accordance with the objectives, policies, and purposes of the City of Redondo Beach General Plan and Coastal Land Use Plan, in that the area is designated as Coastal Commercial ( CC- 2) and the proposed use is identified as a conditionally permitted use and is compatible with the broad purposes of Section 10- 5. 102 of the Zoning Ordinance for the Coastal Zone and with objectives and policies within the General Plan Land Use Element that support the development of commercial uses which provide for the needs of existing and future residents.
e. That the proposed use will not have an adverse impact upon abutting properties, the neighborhood, or the City, and the use will be designed and operated in a manner to protect the public health, safety, convenience, interest and general welfare, in that the conditions of project approval appropriately limit the intensity and operations of the activity to maintain compatibility with surrounding uses.
3. In accordance with Section 10- 5. 2218 ( a) and ( c) of the Redondo Beach Municipal Code, Zoning Ordinance for the Coastal Zone, the applicant's request for a Coastal Development Permit is consistent with the criteria and required findings for approval set forth therein for the following reasons:
a. The proposed and conditioned Child Day Care Center, with infant care, is an identified conditionally permitted use within the Coastal Commercial ( CC-2) zone and conforms with all development standards and general purposes of the zoning ordinance for the coastal zone by achieving progressively the arrangement of land uses described in the General Plan and Coastal Land Use Plan and as conditioned ensures compatibility between land uses. b. The proposed use is located between the sea and the first public road paralleling the sea and as such is required to be in conformity with the public access and public recreation policies of Chapter 3 of Division 20 of the Public Resources Code and as this proposed use is within an existing commercial office building with no additions or expansion proposed it is therefore not reducing public access or opportunities for public recreation and is bringing more families to the sea, pier, and waterfront area and therefor this finding is made in the affirmative.
