From: LUKE SMUDE, ASSISTANT TO THE CITY MANAGER
TITLE

APPROVE THE FIRST AMENDMENT TO THE AGREEMENT WITH CHOICE MEDIATION FOR AS

NEEDED DISPUTE RESOLUTION AND HEARING OFFICER SERVICES IN THE CITY OF

REDONDO BEACH INCREASING THE MAXIMUM COMPENSATION OF THE CONTRACT BY $5,000 FOR A NEW NOT TO EXCEED AMOUNT OF $41,000 FOR THE TERM ENDING JULY 31, 2023

EXECUTIVE SUMMARY
Several City Departments utilize Choice Mediation to provide alternative dispute resolution services for members of the Redondo Beach community on an as needed basis. The Building Division of the Community Development Department has a need for the services offered by Choice Mediation, but was not included in the scope of services for the original Agreement. Staff is proposing a $5,000 increase to the Agreement to allow the Building Division the opportunity to utilize these services.

BACKGROUND
On June 21, 2022, Council approved a limited-term Agreement with Choice Mediation to serve an acute need to oversee housing program termination proceedings and housing mediation cases for Section 8 program tenants and landlords, along with regular referrals from the Police Department and the City Attorney’s Office. The City was in need of a new services partner in this area following the passing of its previous provider, Lance G. Widman of South Bay Dispute Resolution in December of 2021.

Since entering into the Agreement, the Building Division has received multiple requests for assistance from residents experiencing neighbor to neighbor disagreements that would be best sorted by an independent expert in alternative dispute resolution. In order to satisfy these building related requests, staff is recommending a First Amendment to the Agreement with Choice Mediation, to increase the not to exceed amount by $5,000, for a new total value of $41,000. All other features of the original Agreement will remain in effect.

COORDINATION
This City Manager’s Office coordinated the preparation of this report and the First Amendment with the City Attorney’s Office.
