Subject: Facts from Beach Cities Health District re: the Flagler Bike Path project Date: Monday, November 21, 2022 6:15:28 PM
CAUTION: Email is from an external source; Stop, Look, and Think before opening attachments or links.
I am writing you today regarding the Flagler Bike Path project. There is incorrect information (some examples are in italics below) that has been submitted to the Torrance Traffic Commission and to local newspapers recently – here are more facts (in bold below) about Beach Cities Health District and the project.
---
“BCHD did not approach the City of Torrance to request a letter of support for the BCHD grant application.” (Memo from Craig Bilezerian, Public Works Director, City of Torrance, included in Torrance Traffic Commission Agenda Packet, Nov. 7, 2022) FACT: BCHD responded to the Torrance Traffic Commission with the following information, dated Nov. 4, 2022: “BCHD applied for Measure M Multi-Year Sub-Regional Program (MSP) funding through the South Bay Cities Council of Governments (SBCCOG) in January 2019. The staff report implies that BCHD did not outreach to the City of Torrance regarding our application. However, as part of the application process BCHD staff contacted both the cities of Redondo Beach and Torrance asking for letters of concurrence for the project. Attached you’ll see the email that BCHD staff sent on February 4, 2019, addressed to both then-City Manager LeRoy Jackson, and thenPublic Works Director Robert Beste. Redondo Beach provided a letter of concurrence, but the City of Torrance did not respond to our request. However, Robert Beste was part of the SBCCOG MSP Task Force with BCHD staff where we discussed our proposed project. Mr. Beste was also a voting member of the selection committee for the call for projects process that reviewed and recommended our project for approval to the SBCCOG Transportation Committee. The SBCCOG MSP projects, which include BCHD’s Flagler Lane project, were approved by a unanimous vote at the February 11, 2019, SBCCOG Steering Committee, where then-Torrance Councilmember Geoff Rizzo also voted in favor.”
“What we have here is (1) a single property owner in Redondo Beach seeking (2) to use land in Torrance for its own financial gain while imposing costs on Torrance homeowners and voters.” (Public comment submitted by Tim and Gini Ozenne to Redondo Beach Planning Commission, Nov. 17, 2022) FACT: (1) There are more parties involved in this project than just BCHD. The Flagler Bike Path project, while initiated by BCHD, has received support though Metro which has provided a $1.8 million Measure M grant. BCHD worked with the South Bay Council of Governments to secure this funding and continues to work with the South Bay Bicycle Coalition, which has worked for many years to create a safe bikeway from El Camino College to the beach, a goal that is attainable with the Flagler Bike Path Project. (2) BCHD will incur construction and maintenance costs as a result of this project. “Financial gain” is not a factor in the District’s decision to move forward with this project, which is intended to improve the built environment and provide a safe route for cyclists and pedestrians in our community.
“BCHD Failed to Consider Impacts on Torrance in Its EIR” (Public comment submitted by Tim and Gini Ozenne to Redondo Beach Planning Commission, Nov. 17, 2022) FACT: This statement is disingenuous. A review of the Final Environmental Impact Report for the Healthy Living Campus Master Plan shows that both the City of Torrance and the Torrance Unified School District provided comments regarding the EIR, and BCHD held a well-attended public scoping meeting at West High in Torrance. Further, the Final EIR includes the following terms, all specific to Torrance: “Towers Elementary” (mentioned 224 times); “Towers Street” (109 times); “Tomlee Avenue” (61 times); “Mildred Avenue” (32 times); “West High” (18 times); “Redbeam Avenue” (17 times); and the term “Torrance residents” (16 times). A “shade and shadow study” (cited 25 times in the EIR) prepared for the proposed Project demonstrates how “the adjacent residential structures in Torrance, including on Towers Street, Tomlee Avenue, Mildred Avenue, and Redbeam Avenue would be shaded.”
“BCHD is going to spend about $2 million of public money on a bike path.” (Letter to the Editor, Easy Reader, submitted by Mark Nelson, Nov. 17, 2022)
FACT: This statement is misleading because it omits the fact that $1.8 million in funding comes to BCHD via a grant from Metro Measure M. Yes, it is public money, but the money is coming from Metro, not BCHD’s budget, as this comment implies.
“If BCHD wants bike lanes, then give the money to the cities and let them do the work.” (Letter to the Editor, Easy Reader, submitted by Mark Nelson, Nov. 17, 2022) FACT: In 2010, BCHD was selected – by Blue Zones Project and Healthways – to implement the Blue Zones Project, a community health initiative focused on policy and environmental changes to make the healthy choice the easy choice. Through this work, BCHD has championed enhancements to walkability and bikeability in the built environment in the Beach Cities, including the adoption and implementation of the South Bay Bicycle Master Plan, Living Streets policies and supporting infrastructure projects that promote active transportation.
The Flagler Bike Path project fits with BCHD’s and the Blue Zones Project’s commitment to improving the built environment. This project would be an added benefit to the community, providing safety to cyclists and pedestrians, adding traffic-calming measures to the street, and closing an important gap in bike infrastructure to allow for more local and regional connectivity.
BCHD has taken the initiative with the Flagler Bike Lane project and is actively working with the City of Redondo Beach, the City of Torrance and Metro to bring it to fruition. Furthermore, this project has been identified as part of the South Bay Bicycle Master Plan that was adopted by seven cities in 2012. This master plan was created based on extensive community outreach based on the connectivity for routes to and from destinations.
While some residents may conflate our involvement as the lead agency for this bike project with our efforts to redevelop our Healthy Living Campus, as the staff report mentions, this is a separate project. We want to be clear that we do not have any plans or intentions to have vehicular access to the campus off Flagler Lane, and we would be willing to stipulate as such as a condition of the project approval.
---
If you have any questions regarding this information or the Bike Path project, please reach out to me or our CEO, Tom Bakaly (cc’d), anytime. We look forward to working with you. In closing, on behalf of Beach Cities Health District, best wishes to you and yours for a Happy Thanksgiving! Dan Smith

Further information is now available regarding BCHDs false claim to Metro for the purposes of receiving nearly $2M grant funding to support a bike path adjacent to its PMB LLC commercial development. The City of Torrance has confirmed that BCHD does not have authority to construct a bike lane and that Torrance will not allow the BCHD project. As such, BCHD owes the taxpayers of LA County about $300,000 in reimbursement for wasted funding plus whatever sanctions are appropriate against BCHD.
It is now clear that BCHD never had authority and I also recommend an internal investigation of Metro's vetting procedures that would allow funding to be granted to non-jurisdictional agencies.

CAUTION: Email is from an external source; Stop, Look, and Think before opening attachments or links.
BCHD's Policy Committee is apparently planning to hide taxpayer-funded employee compensation from the public. According to the Agenda Packet for BCHD's upcoming meeting, "The District is legally and morally obligated to ensure the confidentiality of personal and proprietary information ... Information considered to be confidential or proprietary includes ... compensation data." (Agenda Packet p. 43)
No other public agency hides its employee compensation data from taxpayers. BCHD spends over $2M annually on its executive compensation, and this smells like an attempt to increase salaries of executives while outside the view of the public. This act is illegal for a public agency as it attempts to operate in the shadows.

BCHD admits that it does not have the ability to evaluate benefits from community programs.
Therefore, BCHD's claim to the City Attorney that the Healthy Living Campus will "clearly" have "significant" benefits to Redondo Beach residents cannot be true.
Redondo Beach residents will receive less than 10% of the benefit of the privately owned/developed/operated RCFE by PMB LLC, less than 5% of the benefit of BCHDs allcove South Bay and less than 3% of the benefit of the PACE program. Yet, Redondo Beach residents bear 100% of the damages for 95 years.
Clearly, BCHD claim to the City Attorney is unfounded and false. --

BCHD SCHEME TO ALLOW PRIVATE DEVELOPMENT ON PUBLIC LAND
TRIGGERS A MEASURE DD VOTE
In Cain Bros. presentation for BCHD (11/10/21) Cain clearly stated that BCHD has concluded that no level of ownership in the Phase 1 project is feasible or viable. Further, BCHD and Cain have both indicated that PMB LLC (or a special purpose entity formed by PMB) will be 100% developer/owner/operator of the facility. BCHD will receive land lease payments for up to 95 years and BCHD will be lessee of space in the building.
As Cain also notes, BCHD originally proposed the project as publicly owned, but had abandoned that concept. The project will service 80% non-residents in the RCFE (per BCHD MDS Report), 91% non-residents in the allcove Beach Cities (per analysis of the contract and SPA 8 population distribution) and 95% non-residents in PACE (per data from the National PACE Association). As such, the public land will be converted to private use with 100% damages to Redondo Beach residents and very modest benefits that cannot outweigh the damages.
This development is nearly identical to the Kensington lease arrangement from RBUSD that triggered a Measure DD vote, with the exception that it is approximately 3-times larger and therefore more damaging to Redondo Beach residents.
REDONDO BEACH’S REPLY COMMENTS TO BCHD PRE-CUP FILING WERE
INCOMPLETE
There are a number of errors and omissions in the BCHD document that the City did not comment on, including:
CUP Required for PACE in C-2 Zoned Beryl & Flagler Lot
RBMC for C-2 states Adult Daycare is a conditional use. Adult daycare is a requirement of any PACE program. No mention of the required CUP was included in the “Pre-CUP”.
CUP Required for RCFE in C-2 Zoned Beryl & Flagler Lot
RBMC for C-2 states Senior Housing is a conditional use. No mention of the required CUP was included in the “Pre-CUP”.
PACE is not an Allowed “by-right” or Conditional Use for P-CF RBMC for P-CF does not include Adult Daycare as a conditional use, nor is it included as a “by-right” use. Therefore, PACE cannot be established on any P-CF zoned property.
Any Merger of the Two Lots Requires a Measure DD Vote Unless Resulting Zoning is C-2 Across the Entire Campus Parcel
If the C-2 and P-CF lots merge without a Measure DD vote, they must carry the most restrictive zoning of the parcels, which is C-2. If the C-2 lot is up-zoned to P-CF, that clearly requires a Measure DD vote.
C-2’s 0.5 FAR Cannot Support BCHD’ Proposal and the Certified EIR is Conditional in its language that NO VARIANCES are required.
BCHD certified EIR states “It should also be noted that each of the alternatives described in Section 5.0, Alternatives already meets the 0.5 FAR in the C-2 zoned parcel.” From mere inspection of the proposed square feet and the lot size, it is clear that statement is false. BCHD must provide FAR computations for both the C-2 and P-CF lots.
BCHD’s Proposed 107’-6” project height is inconsistent with the RMBC requirements in PCDR and RDGs
BCHDs proposed height does not protect privacy, character, property values, nor conform with “respect … the natural terrain” since BCHD elects to build on perimeters.
BCHD’s Proposed 300,000 sqft Phase 1 and 800,000 sqft Final project size is inconsistent with the RMBC requirements in PCDR and RDGs
BCHDs proposed Phase 1 is a single building as large as the entire existing campus. BCHD’s addition of Phase 2 is larger than the size of EVERY HOME in Beryl Heights combined.
Clearly, that does not protect privacy, character, or property values.
BCHDs Proposed Turn Lane to Flagler southbound Violated the TMC BCHD proposed a turn lane from Beryl east to Flagler south and the addition of a collector lane on Flagler. That violates TMC that prevents commercial use of residential streets.
BCHDs Deforestation Plan Removes Excessive Mature Trees in both Redondo Beach and Torrance
BCHDs aggressive deforestation of mature trees is inconsistent with City policy and environmental practices.

Mayor, Council, Planning Commissioners:
It's time for BCHD to stop shilling for PMB, the private commercial developer/owner/operator that leased our public owned and zoned land from BCHD. PMB is a private commercial developer that stands to profit handsomely from the market-based $12,000 per month assisted living rents. BCHD has 0% ownership in the proposed development. In fact, BCHD will pay more each year in rent to PMB for shiny new space than PMB pays to taxpayers for 3 acres of Redondo Beach. PMB has a 65 to 95 year lease from BCHD, so that land is now lost to 5 generations of residents.
BCHD started the environmental impact process claiming that it would be a co-owner. As time progressed, we learned that was never an option due to BCHDs financial position.
Nonetheless, BCHD self-approved the environmental impact report and is now using its status as a public agency to shill for PMB and file for various project permits.
BCHD is a public agency owned by taxpayers and a 0% owner of the for profit PMB project on our public land. BCHD's attempt to permit a 107.5-feet tall and about 300,000 sqft building would be tossed in the trash if it were filed at the City by CenterCal or AES Redondo commercial developers. We cannot allow PMB, a private commercial developer, to gain permits that clearly violate the Redondo Beach Municipal Code only because a 0% owner and shill called BCHD is the name on the application.
BCHD needs to step aside and we the public deserve to pull back the curtains and see that BCHD's Oz is just another commercial developer.

It has come to the attention of surrounding residents and property owners that BCHD plans to widen Flagler and add a collector lane for outbound traffic from the proposed private PMB LLC Development on the east and north sides of leased land on the BCHD site (Beryl and Flagler). Furthermore, BCHD is attempting to do this road widening and collector lane under the guise of a bike lane project to facilitate its commercial project. No CEQA analysis has been completed.
This is unacceptable action by BCHD.
1. Torrance residents should not be subjected to commercial traffic departing a commercial building at Flagler and Beryl. That is an illegal use of Flagler.
2. Torrance residents should not be forced to accept the liability of a road and other construction by BCHD, an inexperienced and often incompentent agency. BCHD has no road construction or major development experience.
3. Clearly the BCHD lease to a private developer is a commercial project and a private use.
Torrance cannot cooperate with any project adjacent to the Hillside Overlay that would diminish the privacy and value of the adjacent homes.
Please instruct the Public Works Department to reject BCHD plan and involvement in any road projects in Torrance. No rights of way or easement should be held by a non-jurisdictional agency like BCHD. If Torrance wishes to transfer the funds from Metro that BCHD has secured, that is an appropriate outcome that will provide for Torrance oversight and liability management.

Redondo Beach Mayor, Council, City Attorney, and Planning Commission:
The next time that BCHD falsely claims that it has made changes to the proposed PMB project based on public input - remember this -
In the June 2019 EIR NOP, BCHD proposed a project height of 60-feet above the inside courtyard of the site (90-feet above Flagler & Beryl)
In the July 2020 Board approved plan, BCHD proposed 76-feet above the inside courtyard of the site (106-feet above Flagler & Beryl)
In the March 2021 draft EIR, BCHD proposed 103-feet above the inside courtyard of the site (133- 1/2 feet above Flagler & Beryl)
During that time, ZERO comments recommended a taller complex. ZERO.
During that time, HUNDREDS of comments recommended a shorter or no complex. HUNDREDS.
It is clear that BCHD is gaslighting the public and the media - BCHD is not acting in the interest of the public or the surrounding, negatively impacted neighborhoods that will have their character DESTROYED by BCHD's proposed PRIVATELY DEVELOPED/OWNED/OPERATED PMB Project on PUBLIC LAND.

Metro has granted BCHD in Redondo Beach approximately $2M for grading, road widening, addition of a collector lane from the BCHD proposed facility, and bike path in the City of Torrance. Torrance is not within the LALAFCO sphere of influence (SOI) of BCHD. Further, BCHD had no approval to move forward in Torrance yet it has made plans for nonbike path related fundamental traffic flows within Torrance using grant funds.
According to BCHD and Metro Public Records Act Requests, the BCHD project has expended $298,892.59 of its $1,833,877.00 budget for the project with no City approvals from either Redondo Beach (in BCHD SOI) or Torrance (outside BCHD SOI).
A cursory review of the invoice support from BCHD demonstrates that it is mostly BCHD dumping its overheads for executives and contract labor, as well as wasted time on design that was completed by BCHD without authority of either City.
I request a financial and process audit of this ill-fated project by BCHD.

3. TASKS / MILESTONES ACCOMPLISHED
If the project is delayed (as described in #4), include action items that have been, or will be, undertaken to resolve the delay.
Same as Previous Quarter. The schedule presented in "Actual Schedule" above reflects the updated schedule from the funding agreement amendment.
4. PROJECT DELAY
Our team continues to be in contact with the staff from the City of Torrance to finalize construction documents and the permitting process.
Various departments at the City of Redondo Beach provided their plan review comments and the City of Redondo Beach Public Works Commission granted their approval of the design. The City of Torrance agency departments provided their initial plan review comments and clarified directions for their portion of the project. The design team began to address the city comments and refine the final design documents to achieve the best value with the available funds for the design. Coordination of design document revisions with preparation for upcoming bidding and construction phase was ongoing.
If project is delayed, describe reasons for delay (this quarter). Pay particular attention to schedule delays. If delay is for the same reason as mentioned in previous quarters, please indicate by writing "Same as Previous Quarter".
5. ACTION ITEMS TO RESOLVE DELAY
