RESOLUTION NO. 2021- 12- HCR- 02
A RESOLUTION OF THE HARBOR COMMISSION OF THE CITY OF
REDONDO BEACH, CALIFORNIA, APPROVING AN EXEMPTION
DECLARATION AND GRANTING A CONDITIONAL USE PERMIT,
HARBOR COMMISSION DESIGN REVIEW, AND COASTAL
DEVELOPMENT PERMIT TO ALLOW THE CONSTRUCTION AND
OPERATION OF A WASTE WATER FACILITY ON PROPERTY
LOCATED WITHIN A COASTAL COMMERCIAL (CC- 3) ZONE, IN
THE COASTAL ZONE AT 350 PORTOFINO WAY
WHEREAS, an application was filed by the City of Redondo Beach — Public Works Department on November 12, 2021 requesting approval of entitlements to remove existing wastewater pump facilities and construct a new wastewater pump station building in the parking lot at 350 Portofino Way ( Seaside Lagoon parking lot); WHEREAS, notice of the time and place of the public hearing where the Exemption Declaration and the applications would be considered was given pursuant to state law and local ordinances by publication in the Easy Reader, by posting the subject property, and by mailing notices to property owners within 300 feet and occupants within 100 feet of the exterior boundaries of the subject property; and WHEREAS, the Harbor Commission of the City of Redondo Beach noted that the project is visible from surrounding parks, specifically the parkette at the intersection of Harbor Drive and Portofino Way as well as the Seaside Lagoon, but does not impede views to the marina and harbor areas; and
WHEREAS, the Harbor Commission of the City of Redondo Beach has fully considered evidence presented by the applicant, the Waterfront and Economic Development Department, the Community Development Department, and other interested parties at the public hearing held on December 13th, 2021, with respect thereto.
NOW, THEREFORE, THE HARBOR COMMISSION OF THE CITY OF
REDONDO BEACH, CALIFORNIA, DOES HEREBY FIND:
1. Pursuant to Chapter 3, Title 10 of the Redondo Beach Municipal Code, the project is categorically exempt from the preparation of environmental documents.
Sections 15302 and 15303 of the Guidelines for Implementation of the California Environmental Quality Act ( CEQA), state in part, that the replacement or reconstruction of existing utility systems and/ or facilities involving negligible or no expansion of capacity, and the construction of new small structures, do not require further environmental review. This finding is supported by the fact that the existing wastewater pump station infrastructure, including the main sewer line and force main in Portofino Way and pump station facilities currently existing in the Seaside Lagoon parking lot will have the same purpose as the existing wastewater conveyance and pumping systems. The additional wastewater pumping capacity RESOLUTION 2021- 12- HCR-02

is negligible to accommodate existing and anticipated flow increases. The facilities will be housed within a utilitarian structure designed to protect the above ground equipment from damage from vehicles or natural elements. The subject site is not located within an area designated as an environmental resource of hazardous or critical concern, or within an officially designated, state scenic highway, or within a hazardous waste site included on any list compiled pursuant to Section 65962. 5 of the Government Code.
2. Pursuant to Sections 10- 5. 810 of the Redondo Beach Municipal Code, the proposed wastewater facilities, are the primary conditionally permitted uses within the Commercial ( CC- 3) zone.
3. In accordance with Sections 10- 5. 810, 10- 5. 1614, and 10- 5. 2506 of the Redondo Beach Municipal Code, the request for a Conditional Use Permit is consistent with the criteria set forth therein for the following reasons:
a) The site for the proposed use shall be in conformity with the General Plan and the Coastal Land Use Plan and shall be adequate in size and shape to accommodate such use and all setbacks, spaces, walls and fences, parking, loading, landscaping, and other features required by this chapter to adjust such use with the land and uses in the neighborhood.
The public utility facility is conditionally permitted in the Coastal Commercial CC-3) zone. The new building replaces an existing facility. The location is adequate in size and shape to accommodate the new building including the walls/ fence and landscaping to visually screen the new structure. b) The site for the proposed use shall have adequate access to a public street or highway of adequate width and pavement to carry the quantity and kind of traffic generated by the proposed use.
The replacement facility is a wastewater pump station and will not incur any traffic. The pump facility is located in the parking lot adjacent to the Seaside Lagoon which is accessed directly from Portofino Way.
c) The proposed use shall have no adverse effect on abutting property or the permitted use thereof and the proposed use shall protect the public health, safety, convenience, interest, and general welfare.
The replacement facility will not have any adverse effects upon abutting properties or businesses. The pumps will be housed underground in wells and the controls will be installed within a building and thereby baffle any potential noise to the surroundings.
d) The conditions stated in the resolution or design considerations integrated into the project shall be deemed necessary to protect the public health, safety, and general welfare., The Harbor Commission may impose conditions of approval to insure this provision and to comply with the purposes and intent of this chapter and the General Plan, any development standards or conditions may RESOLUTION 2021- 12- HCR- 02

be imposed, including but not limited to, a dedication of land for street or park purposes and/ or time limit for development, to create orderly and proper uses.
The conditions of approval are deemed necessary to protect the general welfare of the Harbor area and further the policies of the Harbor/ Civic Center Specific Plan. As part of the project, the parking lot will be restriped to ensure that there is no net loss of parking spaces. The design of the building was modified to incorporate features from the existing Seaside Lagoon building to create a unified aesthetic.
4. In accordance with Section 10- 5. 2502 of the Redondo Beach Municipal Code, the request for Harbor Commission Design Review is consistent with the criteria set forth therein for the following reasons:
a) The design of the project shall consider the impact and the needs of the user in respect to circulation, parking, traffic, utilities, public services, noise and odor, privacy, private and common open spaces, trash collection, security and crime deterrence, energy consumption, physical barriers, and other design concerns.
The above ground project components are compatible with the neighborhood and in harmony with the size, shape, color, materials, illumination, and placement of surrounding properties because the project building was designed to match the surrounding public facilities and area. The existing Seaside Lagoon building was used as a base for the Portofino Way Pump Station design. In addition, the building size and height were minimized to have the least impact on views. The proposed replacement sewer pump facilities are housed within a building to reduce potential noise impacts, and will restripe the parking spaces in the immediate vicinity of the new building to recapture parking spaces and restore the parking space in the area of the facilities that are intended to be removed. The building is located and designed in consideration of the uses of Seaside Lagoon, as well as the Harbor and Marina area in general.
b) The location of buildings and structures shall respect the natural terrain of the site and shall be functionally integrated with any natural features of the landscape to include the preservation of existing trees, where feasible.
The location of the building has been placed as close as possible to the existing pump station so that the construction can be conducted while the existing station continues to operate. Once the new pump station is built, the old station will be decommissioned and a full transition to the new pumping station will occur. The new construction respects the natural terrain and does not require the alteration of the existing parking lot. The building form and exterior materials match the style of the Seaside Lagoon building located directly west.
In addition, the project will add native, drought tolerant plants around the project, and will not impact any existing trees.
c) The building or structure shall be harmonious and consistent within the proposed architectural style regarding roofing, materials, windows, doors, openings, textures, colors, and exterior treatment.

PAGE NO. 3
The proposed replacement sewer pump facilities are designed in a similar architectural style as the existing Seaside Lagoon building to ensure a consistent visual theme for the public buildings. The project includes added plants to beautify the area and does not impact any existing trees. d) The overall design shall be integrated and compatible with the neighborhood and shall strive to be in harmony with the scale and bulk of surrounding properties.
The proposed replacement sewer pump facilities are low in scale and strive to maintain a consistent architectural style with the neighboring building albeit smaller in scale.
e) The design of buildings and structures shall strive to provide innovation, variety, and creativity in the proposed design solution. All architectural elevations shall be designed to eliminate the appearance of flat facades or boxlike construction with varied roof planes, wall offsets, bay windows, and similar projections.
The proposed replacement sewer pump facility is designed to be reflective of existing Seaside Lagoon building. The roof form is intended to look similar to the neighboring building. The structure does not present an opportunity to incorporate any windows or articulation of walls for visual interest. f) Signs and sign programs shall meet the criteria established in Sign Regulation Criteria, Section 10- 5. 1802.
Signage is not necessary for the proposed pump station building. g) The project shall be consistent with the intent of residential design guidelines adopted by resolution of the City Council.
The proposed replacement sewer pump facilities are utilitarian in nature, located in the Coastal Commercial zone, and not subject to the Residential Design Guidelines.
h) The conditions stated in the resolution or design considerations integrated into the project shall be deemed necessary to protect the public health, safety, and general welfare.
The conditions of approval are deemed necessary to ensure public access to the coastal area while serving the needs of recreational users and visitors. The building design was modified to harmonize with the existing Seaside Lagoon building and incorporate a similar roof form and materials.
5. In accordance with Section 10- 5. 2218( c) of the Redondo Beach Municipal Code, the request for a Coastal Development Permit is consistent with the criteria set forth therein for the following reasons:
a) The proposed development is in conformity with the Certified Local Coastal Program.
RESOLUTION 2021- 12- HCR-02
350 PORTOFINO WAY
PAGE NO. 4
The proposed replacement sewer pump facilities are designed in conformance with the Local Coastal Program in that the existing supply of parking spaces in the Harbor— Pier area will not be reduced.
b) The proposed development, if located between the sea (or the shoreline of any body of water located within the coastal zone) and the first public road paralleling the sea, is in conformity with the public access and public recreation policies of Chapter 3 of Division 20 of the Public Resources Code ( commencing with Section 30200).
The proposed replacement sewer pump facilities do not impede public access to the Harbor—Pier area and supports the recreational and visitor- serving uses in the area. The project supports keeping the Harbor and Marina area as a primarily recreational and visitor-serving use location. The proposed facilities do not impede or interfere with the public' s right of access to the sea or the use of dry sand and rocky coastal areas. Adequate access to the shoreline and coast from Portofino Way exists immediately to the west and southeast of Seaside Lagoon and the pump station does not impede these accessways. The Redondo Beach Marina parking lot is one of the several locations that provides access for visitors to the Harbor, Pier and Beach areas avoiding overcrowding or overuse of any single area. The proposed pump facility supports recreational boating use, and water-oriented recreational activities. c) The decision- making body has complied with any CEQA responsibilities it may have in connection with the project, and that, in approving the proposed development, the decision- making body is not violating any CEQA prohibition that may exist on approval of projects for which there is a less environmentally damaging alternative or a feasible mitigation measure available.
The proposed replacement sewer pump facilities are categorically exempt from CEQA review and as such, there is no potential environmental impact from the project, no alternative to the project, nor applicable mitigation measures.
NOW, THEREFORE, THE HARBOR COMMISSION OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
