TITLE
APPROVE THIRD AMENDMENT TO CONTRACT WITH NOBLE CONSULTANTS, INC. TO

PROVIDE ENGINEERING CONSULTING SERVICES FOR THE KING HARBOR DREDGING PROJECT TO EXTEND THE CONTRACT TERM AN ADDITIONAL FIVE YEARS TO JANUARY 17, 2028.

EXECUTIVE SUMMARY
Approve Third Amendment to Contract with Noble Consultants, Inc. (Noble) to provide engineering design consultant services associated with the dredging of King Harbor. The existing contract expires on February 8, 2023 and staff is requesting approval of the Third Amendment in order to allow continued, uninterrupted work on the King Harbor Dredging Project. The Third Amendment will extend the contract term an additional five years to January 17, 2028 with no additional funding needed at this time.

BACKGROUND
On November 18, 2014, the City Council approved a contract with Noble for $501,492 to provide engineering services necessary to perform the environmental analysis and permitting of a proposed boat ramp facility and modifications to the Seaside Lagoon. The City Council then approved a first amendment to the original Agreement to extend the contract term one additional year to June 30, 2018.

On February 6, 2018, the City Council approved the Second Amendment to prepare and perform a Sea Level Rise Vulnerability Study, a King Harbor Basin III Seawall Assessment, and engineering, planning, permitting and design services associated with the dredging of King Harbor in an amount not to exceed $730,297, for a total contract amount of $1,231,789 with a contract end date of February 8, 2023. The studies for the Sea Level Rise and Basin III Seawall have been completed.

Staff is requesting approval of the third amendment in order to allow continued, uninterrupted work on the King Harbor Dredging Project.

The third amendment will extend the contract term an additional five years to January 17, 2028. The dredging project was significantly delayed due to the Regional Board’s 2-year delay in issuing a 401 certification required for the Army Corp’s permitting process. The City received the certification and the Army Corps Permit in November 2022 and is working to completed the project’s Plans and Specifications to be used for the competitive bidding process.

Years of accumulated sand deposits, carried by north to south currents through the porous breakwater, have created noticeable sandbars within the Harbor. The Harbor was last dredged in the winter of 2005. At that time sedimentation was identified for removal in the shoal behind the North Breakwater and in the Basin III entrance channel adjacent to the South Breakwater. At this time, there are three main areas that need to be dredged. The most significant area is located northwest of the Harbor near the breakwater and the Yacht Club facilities. The sandbars create a narrowing of navigational pathway to boaters from the Yacht Club and the basin as well as to the Harbor Patrol near the breakwater area. The second sandbar is located near the entrance of Basin III, which constrains maneuverability for boats that enter and exit Basin III. The third is located at the small car -top boat launch near Seaside Lagoon. All dredging will be performed to original depth specifications to restore maximum accessibility for Harbor Patrol, provide safety for boaters and fishermen and allow access to and mobility in the Harbor basins.

Noble will prepare bid-ready design Plans and Specifications under this contract. The required studies and assessments have been completed. A Bathymetric and Topographic Survey was performed for the Harbor and the potential nearshore sediment placement areas. Surveys were conducted using a combination of multi-beam, single-beam, lead line equipment and vessels. A sediment characterization study was conducted to meet regulatory requirements for sediment sampling and analysis to verify sediment compatibility and lack of contaminants for placement areas to meet the Southern California Dredged Material Management Team requirements under the management authority of the US Army Corps of Engineers and the US Environmental Protection Agency.

COORDINATION
The City Attorney’s Office prepared and approved the Third Amendment with Noble.

FISCAL IMPACT
There is no fiscal impact associated with approval of the Third Amendment to the Noble contract.

Funding has been approved and allocated under previous City Council action.
