Other summaries of future sea -level rise scenarios have been summarized by the U. S.

Army Corps of Engineers. The Corps of Engineers report shows the wide uncertainty in forecasting the future because of issues related to accurately predicting climate change and how it will impact sea level rise over this century. The State's recommended guidelines when compared to other forecast scenarios suggest that the California guidelines may be conservative given the current level of understanding of the phenomenon. This uncertainty raises valid questions about what constitutes reasonable planning criteria at least through the middle of this century. However, it is anticipated that the EIR will need to consider potential coastal hazards associated with the selected sea -level rise projections based on the California Sea -Level Rise Guidance that was updated in 2013. The range of the potential sea level rise is listed in the following table.

Table 1. Sea -Level Rise Projection from Year 2000
Time Period South of Cape Mendocino
2000 to 2030 0. 13 to 0. 98 feet
2000 to 2050 0.39 to 2. 0 feet
2000 to 2100 1. 38 to 5.48 feet
Consultant shall superimpose the range of sea -level rise forecasts onto representative cross sections of the project site to review and assess the potential for inundation and exposure to future hazards that might impact the proposed development. The assessment shall include a review of storm generated sea and swell that could impact King Harbor and the proposed improvements.

Exposure to tsunami hazards shall be assessed by review of research conducted by the University of Southern California Tsunami Research Center and information published by the California Emergency Management Agency. The data represents possible tsunami hazards exposure resulting from propagation of distant and locally generated waves from known and theoretical under water wave source areas. Maps prepared by these agencies provide potential inland inundation limits and coastal runup elevations.

Anecdotal experiences such as the 2011 Japan tsunami that impacted King Harbor will also be reviewed to prepare a narrative of the probable tsunami hazard at the project site and its potential impact upon the proposed improvements. The astronomical peak flood tide conditions and a projection of future sea level rise, based on the recommendation from California Ocean Protection Council will be included in this assessment. Wave uprush under the extreme water level conditions including sea -level rise in 2050 and 2100 will be analyzed.

4. 5 Assessment of Small Craft Traffic Patterns and Interaction Consultant shall provide an assessment of the interaction of recreational small craft and personal watercraft utilizing the boat launch ramp. The potential for traffic conflicts and adverse interaction of the various boat and watercraft types shall be made based upon a review of the potential mix of power, sail, and paddle craft expected to navigate within the vicinity of the proposed facility and the outer harbor in general.

4.6 Coordination with EIR Project Team
Consultant shall coordinate with the Project Team via email, telephone, and informal in person meetings on an as -needed basis to discuss our findings and recommendations and respond to questions. At this time Consultant has budgeted an allowance of 64 man- hours of professional time for this purpose.

4.7 Meetings
Consultant shall allocate time to attend four meetings with the City and/ or its environmental consultant to discuss study progress and environmental impact issues related to Consultant' s technical focus.

5. 0 Regulatory Entitlements

5. 1 Permit Application
Consultant shall support the City to prepare, submit, and process permit applications for the proposed new boat launching facility and Seaside Lagoon enhancement. The following permit applications shall be prepared:
a) Department of the Army - Section 404/Section 10
b) California Regional Water Quality Control Board - Section 401 c) California Coastal Commission - Coastal Development Permit Consultant' s proposal assumes that the timing of the permit application for a boat launch facility and Seaside Lagoon enhancement will be concurrent with CenterCal' s water related features so that a single permit application package for The Waterfront's development plan can be submitted.

Consultant shall require the City to provide us with all land ownership documentation, formatted list of adjacent property owners for notification mailing including stamped envelopes, and other administrative information that may be requested by each regulatory agency. All permit fees required by the regulatory agencies shall be paid for separately by the City.

5.2 Preparation of 35% Complete Construction Plans for the Boat Launch Facility More detailed design and preliminary construction plans of the boat launch facility will be required and shall be performed to support the permit application process for the project feature. This task shall consist of the following subtasks:

5.2. 1 Site Surveys
Surveys shall be conducted by subconsultants Digital Mapping Associates and Nearshore and Wetlands Survey. Consultant shall perform a topographic and boundary survey of the upland area to map existing elevations and culture within the footprint of the proposed launch ramp parcel and its adjacent revetment section. The August 2012 bathymetric survey prepared by Fugro Consultants shall be used to describe nearshore depths. The topographic survey shall be developed from precision aerial photography flown for this project and ties to new ground control benchmarks. Corner points for the launch ramp parcel boundary survey will not be established in the field. A supplemental field survey shall be conducted to map elevations within the area defined by the revetment and nearshore bottom that cannot be covered by the aerial photography and not defined by the existing bathymetry data.

Deliverable: Launch ramp site — one set of uncontrolled files in Adobe PDF format of the aerial photography scans; one set of controlled data used on the project as well as the field completion information, cross sections, and boundary survey information; one set of digital files in AutoCad file format of the digital terrain model and mapping data.

5.2. 2 Geotechnical Engineering Evaluation
Subconsultant, Gorian and Associates, shall perform a geotechnical engineering evaluation of the project site to establish geotechnical design criteria for earthwork and site preparation work, ramp pavement, guide pile embedment, underwater fills, and shoreline protection requirements. Existing soils data from the 1955 King Harbor site exploration and other available information shall be supplemented with four to five exploratory soil borings drilled onshore to depths of 10 to 50 feet or refusal, whichever is less. Subsurface conditions shall be logged. Bulk and relatively undisturbed soil samples shall be obtained for laboratory analysis and testing. This task will conclude with a written report that describes the project's soils, geologic hazards including seismic setting and earthquake design criteria, and recommendations for site preparation, placement of underwater fills, guide pile embedment, grading, pavement design, and shoreline protection measures.

Deliverable: Geotechnical report — Introduction, Proposed development, Scope of work, Site conditions, Discussion, Conclusions and design recommendations (site preparation and grading, ramp construction, breakwater construction, pavement, seismic design, guide pile requirements. References, Appendix A (Logs of subsurface exploration), Appendix B ( Laboratory testing). One electronic digital file of deliverables 18 + O PEOOHpO

shall be furnished in Adobe PDF file format. Two hard copies shall be furnished to the City for distribution.

5. 2. 3 Basis for Design Analysis of the Alternative Boat Launch Facility In accordance with the California Division of Boating and Waterways' guidelines for boat launch facility grant review requirements, Consultant shall perform a detailed Basis for Design analysis of the alternative boat launch facility to outline the project' s design features in more detail. The purpose of the Basis for Design study shall be to refine and establish the final construction cost estimate of the project to position the City to apply for a Phase 2 construction funding grant amendment from DBW. Consultant shall be assisted by our subconsultants Hirsch and Associates, Blue Point Engineering, and Reedcorp Engineering who shall focus on the upland design elements.

The engineering analysis shall be consistent with a 35% complete milestone for design.

The task shall determine the final plan configuration and site development components of the boat launch ramp, parking, shoreline protection, landscape, utilities, and wave protection features ( if deemed necessary). Each project component shall be sufficiently detailed to support a more comprehensive construction cost analysis. If wave protection is required, alternative breakwater designs shall be evaluated to determine the most economically and environmentally feasible option from the suite of rubble -mound, vertical sheet pile, and floating options that are available for consideration.

The basis for design report shall consist of narrative text and appropriate graphics to describe the existing site conditions, relevant design criteria, alternative project layout plans ( as appropriate), wave protection component (if required), detailed cost estimate, and the final layout plan selected in collaboration with the City. The report shall be accompanied by the 35% complete construction drawings and outline specifications.

Deliverables: Basis for Design report — Executive summary, introduction, identification of needs and issues, conceptual design of improvements, final preliminary design and cost estimate, references.

questions and answers shall be provided for additional fee. The actual time it will take to complete the processing of all permits depends in part upon the volume of review comments received, the interest of interested third parties and stakeholders, and the degree of controversy that may be associated with the project proposal.

5. 4. Sediment Sampling and Analysis Plan
Enhancement of the Seaside Lagoon will entail removal of a relatively small volume of sediment from the nearshore bottom adjacent to the existing revetment as well as the interior lagoon basin. The most economical method to dispose of the excavated material will be spreading it over the enhanced lagoon beach provided that it is good quality sand. The project proposal may trigger additional permit requirements for sediment sampling and analysis to verify sediment compatibility and absence of contaminants.

The protocol is administered by the Southern California Dredged Material Management Team (SC- DMMT) under the management authority of the US Army Corps of Engineer.

The procedure involves the following steps:

1. Prepare an appropriate sediment sampling and laboratory testing plan (SAP) that is consistent with US EPA and US Army Corps of Engineers guidelines. Review the testing plan with and obtain approval of it from the SC-DMMT.

2. Collect sediment samples in the field by drilling a limited number of cores to the projected excavation depth. Vibracore drilling equipment operated from a small barge will be used. Prepare a reduced number of representative sediment composite samples from the cores for subsequent physical and chemical testing in the laboratory. Primarily sediment grain size and a list of standard contaminates (e. g. metals, hydrocarbons, pesticides) are tested for presence and concentration.

3. Present the findings and conclusions before the DMMT to confirm the suitability of the sediment for the intended nearshore, onshore, or off site upland disposal.

Subconsultant, Applied Environmental Technologies, shall prepare the SAP for the Seaside Lagoon project component, obtain the sediment samples, perform the laboratory analysis, and summarize findings in the final SAP report. The report shall be used to support the Department of the Army permit application.

cost, voluntarily make a payment, assume
any obligation, or Incur any expense, other
than for first aid, without our consent.

3. Legal Action Against Us
No person or organization has a right under this
Coverage Part
a. To join us as a party or otherwise bring us
Into a " suit" asking for damages from an Insured; or
b. To sue us on this Coverage Part unless all of
Its terms have been fully compiled with.

A person or organization may sue us to recover
on an agreed settlement or on a final judgment
against an Insured; but we will not be liable for
damages that are not payable under the terms of
this Coverage Part or that are In excess of the
applicable limit of Insurance. An agreed settlement means a settlement and release of liability signed by us, the insured and the claimant or the
claimant's legal representative.

4. Other Insurance
If other valid and collectible Insurance is available
to the Insured for a loss we cover under Coverages A or B of this Coverage Pert, our obligations are limited as follows:
a. Primary Insurance
This Insurance is primary except when b. below applies. If this Insurance Is primary, our obligations are not affected unless any of the
other insurance is also primary. Then, we will
share with all that other Insurance by the
method described in c. below.
b. Excess Insurance
This Insurance Is excess over:
1) Any of the other Insurance, whether primary, excess, contingent or on any other basis:

2) Any other primary Insurance available to
you covering liability for damages arising
out of the premises or operations for
which you have been added as an addltlonal Insured by attachment of an endorsement.

When this Insurance Is excess, we will have
no duty under Coverages A or B to defend
the insured against any "suit" If any other insurer hes a duty to defend the Insured against that "suit". If no other Insurer defends, we will
undertake to do so, but we will be entitled to
the Insured's rights against all those other insurers.

When this Insurance Is excess over other Insurance, we will pay only our share of the amount of the loss, if any, that exceeds the
sum of:
1) The total amount that all such other Insurance would pay for the loss In the absence of this insurance; and 2) The total of all deductible and self -Insured
amounts under all that other insurance.

We will share the remaining loss, If any, with
any other insurance that Is not described In
this Excess Insurance provision and was not
