Michael Shonafelt, counsel representing the project proponent, spoke about the item being a determination of whether the Housing Accountability Act is overridden by the Coastal Act; alleged the decision should not have been made by staff in the context in which it was made; discussed " builders remedy"; reported that in order to deny the project, findings must be made based on the preponderance of the evidence and indicated findings are detailed in a letter he submitted dated February 7, 2023. He added there is nothing in the Housing Accountability Act indicating that it is superseded by the Coastal Act, but rather the two acts are to be given a harmonious co -relationship and asked that the City undertake its mandatory duty to accept and receive and process the application so that the Planning Commission and City Council will fully examine the merits of the project including benefits to the Coastal Zone.
Mayor Pro Tem Nehrenheim invited public comment.

Holly Osborne, via Zoom, spoke about similar past projects where proponents were bused in and wondered if the same is occurring once again.
City Attorney Webb referenced a letter by Michael Tsai, representing the Southwest Mountain States Regional Council of Carpenters; noted it pertained to the importance of local hire, requesting that City Council deny the appeal and affirming that the project lacks an adequate description.
Mr. Shonafelt spoke about the process in issuing a Notice of Incomplete Application; said it was not a Notice of Incomplete Application but rather a rejection, altogether, of the application noting that the application has not been received and has not been processed; listed applicable case law; felt that in this case, staff made a decision of the law stating that the Housing Accountability Act is trumped by the Coastal Act and stated that it is not staffs job to do that.

Discussion followed regarding the Community Development Director's responsibility to assess whether this is a builders remedy project or not and if so, accept and process the application.
City Attorney Webb stated the Municipal Code directs the Community Development Director with specific authority, which she cited; reported that she acted within her authority and within the constraints of the Municipal Code and following the LCP and this is the wrong application for its use and not allowed by the LCP.
Community Development Director Forbes added that this was not a denial of the application and noted staff sent the additional applications necessary to move forward with a residential project.
Discussion followed regarding the premise of builders remedy, the need for the applicant to file missing information (applications for a General Plan Amendment, LCP Amendment and Zoning Amendment), avoiding threats of lawsuits and the need to follow zoning laws, the need for a vote of the people when considering changes to local zoning and subsequent certification by the Coastal Commission.
