To: MAYOR AND CITY COUNCIL
From: GREG KAPOVICH, WATERFRONT & ECONOMIC DEVELOPMENT DIRECTOR TITLE
ADOPT BY TITLE ONLY ORDINANCE NO. 3254-23, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, ADDING TITLE 12, CHAPTER 37 OF THE

REDONDO BEACH MUNICIPAL CODE ESTABLISHING REGULATIONS PERTAINING TO SKATEBOARDING AND SKATEBOARD PARKS; AND AMENDING TITLE 12, CHAPTER 2 OF THE REDONDO BEACH MUNICIPAL CODE TO ALLOW SKATEBOARDING ON PAD #10; AND AMENDING TITLE 4, CHAPTER 9 OF THE REDONDO BEACH MUNICIPAL CODE PERTAINING TO PROHIBITED ACTIVITIES IN THE REDONDO BEACH FISHERMAN’S WHARF AREA; AND AMENDING TITLE 4, CHAPTER 35 PERTAINING TO PARKS AND RECREATION FACILITIES FOR SECOND READING AND ADOPTION.

EXECUTIVE SUMMARY
The City’s project to install skate facilities at Perry Park and on Pad 10 at the Redondo Beach Pier is now under construction. To accommodate the new facility at Pad 10, certain sections of the Redondo Beach Municipal Code (RBMC) must be amended to allow for skate board use on the Pier.

Additionally, the RBMC should be updated to include other general safety regulations for skateboarding and skateboard parks. Accordingly, staff have prepared text amendments to the RBMC to allow skate board use at the Pad 10 site and to establish contemporary regulations for skateboarding facilities citywide to promote the public peace, health, safety and welfare of users.

These amendments have been included in the proposed Ordinance. The Ordinance was introduced at the February 14, 2023 City Council meeting and was updated to include language that makes clear wheelchairs are also allowed for use at City skate parks. The Ordinance is now ready for second reading and adoption.

BACKGROUND
On August 4, 2020, City Council received a presentation on the feasibility of development of skate facilities at five park locations around the City. The parks analyzed included Franklin Park, Anderson Park, Perry Park, Lilienthal Park and Czulegar Park. Czulegar Park was determined to be too close to residential properties and the Council requested that the feasibility study be updated to include another harbor adjacent location identified as Pad 10 on the Redondo Beach Pier.

On October 20, 2020, City Council received an update to the Skatepark Feasibility Study, which included consideration of a project at Pad 10. As part of the presentation, staff reported on activity and comments from the Harbor Commission meeting held on September 14, 2020, where the Harbor Commission voted in favor of siting a skate facility at the proposed location on Pad 10. At the October 20, 2020 City Council meeting, the City Council directed staff to develop a solicitation for

October 20, 2020 City Council meeting, the City Council directed staff to develop a solicitation for design build services for skate facilities at two locations, Perry Park and Pad 10, in accordance with the Skatepark Feasibility Study recommendations for those sites.

On October 5, 2021, the City Council approved a design-build contract with Spohn Ranch, Inc. to provide and install skate facilities at the two identified locations.

On February 14, 2022, the Harbor Commission provided the essential entitlements needed to implement the Pad 10 project, which included a Conditional Use Permit, Design Review, and Coastal Development Permit. The Harbor Commission also recognized that certain portions of the RBMC needed to be changed to allow for skate board use on the Pier.

On December 6, 2022, City Council amended the contract with Spohn Ranch to expand the scope of work for the skate facilities at the Perry Park and Pad 10 locations.

To facilitate lawful use of the skate features at Pad 10, staff proposes amending Title 12, Chapter 2 and Title 4, Chapter 9 of the RBMC, which both currently prohibit use of skateboards, bicycles or roller skates on any portion of the pier, International Boardwalk, wharf or parking structure. Each section would be amended to allow skateboarding and similar uses (including roller skates) on any portion of International Boardwalk Pad #10. Use of skateboards, roller skates or bicycles would remain prohibited on all other areas of International Boardwalk, as well as any other portion of the pier, wharf, and parking structure.

In addition to amending the Code to allow use of skateboards on Pad 10, staff proposes adding a new chapter to the Code establishing guidelines at all skateboarding facilities citywide in an effort to encourage safe use of the facilities. The following regulations are proposed for inclusion as part of the newly created Chapter 37:
· Only use of skateboards, scooters, roller skates or in-line skates will be allowed. All other devices are prohibited
· All persons riding a skateboard, scooter, roller skates or in-line skates shall wear a helmet, elbow pads, and knee pads
· Every person under the age of twelve (12) using the Skateboard Parks must be supervised by a parent or guardian
· All persons who use Skateboard parks do so at their own risk · No outside obstacles, ramps, rails or other similar materials or devices shall be erected or placed at the Skateboard Parks
· The Community Services Director (or designee) shall establish the hours of operation. No person shall enter the Skateboard Parks at any time when the Director has closed the Skateboard Parks
· Any violation of any provision of this chapter shall result in immediate eviction from the Skateboard Parks and/or citation
Finally, Title 4, Chapter 35 of the RBMC, which outlines regulations for skateboarding within City Parks will be amended to reference the new regulations outlined in Chapter 37 above.
