In accordance with Chapter 3, Title 10, Section 10-3.301(c) of the Redondo Beach Municipal Code, the above-referenced project is Exempt from the preparation of environmental review documents pursuant to:
15269 EMERGENCY PROJECTS The following emergency projects are exempt from the requirements of CEQA: (a) Projects to maintain, repair, restore, demolish, or replace property or facilities damaged or destroyed as a result of a disaster in a disaster stricken area in which a state of emergency has been proclaimed by the Governor pursuant to the California Emergency Services Act, commencing with Section 8550 of the Government Code. This includes projects that will remove, destroy, or significantly alter an historical resource when that resource represents an imminent threat to the public of bodily harm or of damage to adjacent property or when the project has received a determination by the State Office of Historic Preservation pursuant to Section 5028(b) of Public Resources Code. (c) Specific actions necessary to prevent or mitigate an emergency.
On January 4, 2023, the Governor issued a State of Emergency pursuant to the California Emergency Services Act (Govt. Code Section 8625). I he wave event of January 6, 2023 did considerable damage to facilities at several locations in the Marina, including the Sportfishing Pier which was further deteriorated by a subsequent storm. Demolition of the Sportfishing Pier is exempt as an emergency project because it presents an imminent threat to the public of bodily harm or of damage to adjacent property.
The Sportfishing Pier was identified in the Waterfront EIR (SCH#2014061071) as a potential historic resource of local significance and demolition was considered an unavoidable impact.
Recordation (report and photographs) per the Secretary of the Interior's Standards was required as a mitigation measure. Because of the present conditions of the Sportfishing Pier, it is infeasible to implement this mitigation measure with current photos, although there may be some measure of documentation with research and archived photos.
