Reckard J. Delgadillo: City Attorney
Office of the City Attorney
200 North Main Street, Room 800
Los Angeles, CA 90012-4131
On January 7, 2009, the Public Works Committee considered a January 2, 2009 Bureau of Street Services (BOSS) report in response to Motion (LaBonge - Huizar) relative to the creation of task force to examine ways to regulate the sale of cars on City streets. In the January 2, 2009 BOS report, it is noted that the City of Lawndale recently passed an ordinance (Ordinance No. 1017- 08) that addressed the problem of sales of vehicles on City streets without the First Amendment freedom of speech issues that led to the repeal of Los Angeles Municipal Code Section 80.75 (a copy of the pertinent report and original Motion are attached for reference).

After consideration, the Committee took a number of actions to include requesting the City Attorney to conduct a feasibility study of the of the City's adoption of an ordinance similar to the one adopted by the City of Lawndale. At this time, the Committee is requesting that this feasibility study be conducted and the findings reported to the Public Works Committee.

Please submit your report to the Committee in care of Adam Lid, City Clerk's Office, City Hall, Room 395.

Sincerely,
Adam R. Lid

PUBLIC WORKS
MOTION OCT 2 8 2008
Across the City, there is a growing problem of people selling cars on public streets.

Unfortunately, as long as the vehicles are legally parked, the City cannot regulate parking solely for cars with for sale signs. This commercial activity, however, contributes to the visual blight and reduces the vitality of residential neighborhoods in which this activity occurs. It is unfair competition to allow individuals to use public streets as used car lots. It is important for the City to find ways to remedy and enforce the regulation of car sales in residential areas.

The Bureau of Street Services (BSS)- Investigation and Enforcement Division, has oversight authority for various code enforcement programs, that are designed to improve the quality oflife for residents and visitors. Within the Division, Street Services Investigators (formerly known as Street Use Inspectors), are primarily responsible for protecting public health and safety through the proactive enforcement of ordinances and laws. The Bureau of Street Services, working with the Los Angeles Police Department designated Senior Lead Officers and the Office of the City Attorney, should examine ways to regulate the sale of cars on public streets.

I THEREFORE MOVE the Council instruct the Department of Building and Safety, Bureau of Street Services (Street Services Investigators), the Los Angeles Police Department (Senior Lead Officers) and request the Office of the City Attorney, to form a task force to examine ways to regulate the sale of cars on City streets.
