RESOLUTION NO. CC-XXXX-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDONDO
BEACH, CALIFORNIA, AMENDING A POLICY CONTAINED IN
RESOLUTION NUMBER CC-0102-013 REGARDING THE
INSPECTION AND COPYING OF PUBLIC RECORDS.
WHEREAS; it is the policy of the City of Redondo Beach to provide the general public with access to public records pursuant to the provisions of the California Public Records Act, Government Code Section 6250, et. seq.; and
WHEREAS, on March 20, 2001, the Redondo Beach City Council adopted a policy regarding the City’s response to requests for records pursuant to the Public Records Act which is attached hereto for reference as Exhibit “A”; and WHEREAS, there has been a significant increase in Public Records Act requests which has severely impacted the ability of the Office of the City Clerk to respond to such requests; and
WHEREAS, the Public Records Act requests have sought voluminous records which are directly related to the response times to the Public Records Act requests; and WHEREAS, section 2 of Resolution Number CC-0102-013 permitted any employee to provide certain public records to the public without first submitting a request to the Office of the City Clerk; and
WHEREAS, section 3 of Resolution Number CC-0102-013, notwithstanding the 10-day time frame under the Public Records Act, set forth a shorter, two-day response time for Public Records Act requests that sought certain nonexempt public records; and WHEREAS, all Public Records Act requests should be submitted to the Office of the City Clerk in order to efficiently track the requests and the two-day response time is infeasible in light of the increase in requests; and
WHEREAS, it is prudent to amend Resolution Number CC-0102-013 to address the issues identified above.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Redondo Beach does hereby delete section 2 of Resolution number CC-0102-013 regarding the ability of staff to provide documents to the public without submitting a formal Public Records Request to the Office of the City Clerk which is required under section 5 of Resolution number CC-0102-013.
SECTION 2. That the City Council of the City of Redondo Beach does hereby delete section 3 of Resolution number CC-0102-013 in its entirety regarding the two-day response time for certain Public Records Act requests.
