Discussion followed regarding second story rear and front setbacks, the reason the Planning Commission' s suggestions were not adopted, the need for a land -use expert lawyer to advise the Planning Commission to ensure compliance with ever -evolving State laws, impacts to buildable areas, roof decks and balconies, private open space and character areas.

Mayor Brand invited public comments on this item.

Tom Wooge referenced R- 1 Single Family zones; spoke about blending indoor and outdoor living; believed design guidelines should support it but felt they contradict it; felt that to make a back yard useful, living space should be added to the second story, not the back yard and suggested pushing mass on a second story, to the front and not the back.

Motion by Councilmember Nehrenheim, seconded by Councilmember Obagi, to extend Tom Wooge' s time for one minute. There being no objections, Mayor Brand so ordered.

Tom Wooge noted the standards must be flexible as well as objective.

Jill Klausen provided a brief history of her home and surrounding properties and expressed concerns that the proposed ORS will allow future developments to be built right next to her property, blocking her air circulation and looking into her back yard and patio.

Rick Ableson, District 1, discussed his involvement with the City as well as in the Santa Monica Architectural Review Board; spoke about the need for technical understanding of the issues and suggested that City Council consider forming an Architectural Review Board or similar body.

Motion by Councilmember Nehrenheim, seconded by Councilmember Obagi, to extend Rick Ableson' s time for thirty seconds. There being no objections, Mayor Brand so ordered.

Rich Adelson addressed the need for consistency and reiterated the need for expert consideration of architectural standards.

Discussion followed regarding SB 330 relative to expediting and streamlining the application process.

Mark Stratton, District 1, spoke about the complexity of the subject; questioned the focus of the matter; expressed concerns that the work of the Planning Commission is being derailed; suggested the need for objective goals and for the language to be clear.

Mayor Brand stated Sacramento is making requirements for cities to follow; spoke about the State overtaking land uses and zoning in cities and noted consequences for not following State laws.

Matthew Kilroy, District 5, urged City Council to keep an eye on the objective; alleged it has been hijacked and spoke about needing to eliminate uncertainties and clarify the process.

Motion by Councilmember Behrendt, seconded by Councilmember Obagi, to extend Matthew Kilroy' s time for thirty seconds. There being no objections, Mayor Brand so ordered.

Matthew Kilroy thanked Councilmembers for their consideration of this item on July 18, 2023.

Xavier Rivas noted he was relieved by Council' s prior actions to remove excessive standards that went beyond objectifying the previously subjective standards; noted second -story side setbacks add construction costs; discussed pushing massing to the front of a home; objected to turning suggestions into requirements and urged Council to consider retaining design flexibility, for homes under the FAR and commented on allowing modular construction.

Lexi Kupan urged City Council not to complicate zoning, to keep it simple and not to add restrictions.

Andrew Beeli spoke about diversity in design in the TRW tracts and opposed "mansionization" ordinances as they take homeowners' rights away.

Holly Osborne, District 5, spoke about the TRW tracts having different lot size layouts than some of the other R1 Districts; believed different R1 areas should have different rules for building in the different districts and noted one size does not fit all.

Motion by Councilmember Nehrenheim, seconded by Councilmember Obagi, to extend Holly Osborne's time by thirty seconds. There being no objections, Mayor Brand so ordered.
