N.1. DISCUSSION AND POSSIBLE ACTION ON THE PROPOSED CANNABIS LICENSING
APPLICATION PROCESS AND ASSOCIATED COST RECOVERY FEES
CONTACT: ELIZABETH HAUSE, ASSISTANT TO THE CITY MANAGER
BRANDY FORBES, COMMUNITY DEVELOPMENT DIRECTOR
Community Development Director Forbes narrated a PowerPoint presentation with details of the Administrative Report including a draft Commercial Cannabis Business (CCB) permit process, phases of application processing and procedures, an appeals process and fees. Additionally, she addressed revisions incorporated into the process based on prior City Council direction and commented on City Council discussion and possible action.
Councilmember Nehrenheim spoke about harmonizing the selection process and the City ordinance; commented on distinguishing between the application process and how the winner is chosen as well as ensuring success in operations and enforcement; referenced a discussion regarding the requirement for a location in question and asked whether that was resolved.
City Attorney Webb mentioned that is one of the questions City Council has to answer; agreed the ordinance should be harmonized with the process; noted the ordinance talks about subsequently finding a location that is acceptable to City Council; added that HDL is no longer available to the City to assist in scoring applicants and the Community Development Director is leaving; spoke about having a large number of applicants if having an acceptable location is not a criteria; reported the previous Council chose not to make location a basis and said that HDL indicated location is a more objective criteria to score than other factors.
Community Development Director Forbes commented on a conceptual location not requiring specific details; spoke about locations being next to residential uses and stated City Council would be limiting scoring criteria if a location is not specified.
MINUTES - CITY COUNCIL
Tuesday, September 5, 2023
Discussion followed regarding ensuring the selection process is cleaned up with the existing ordinance to minimize risk and realizing that the chosen location will be out of City Council’s hands if location is not included as part of the process.
In reply to Councilmember Behrendt’s question regarding HDL, City Manager Witzansky reported that a key staff member in the unit that would support the next phase of the selection process has left the company and has not been replaced and stated they have indicated they are incapable of staffing the effort at present.
Councilmember Behrendt commented on the need for objectivity, generating revenue and decreasing the likelihood of litigation.
Discussion followed regarding concerns about the impact this will have on City staff, whether HDL has completed their obligation under their contract, sections in the ordinance in conflict with the proposed process and procedures, options provided by HDL, insulating the City from lawsuits and amending either the ordinance or the application process to ensure harmonization.
City Manager Witzansky noted City Council must consider short-term and long-term risks.
Community Development Director Forbes noted the version of the procedure document in the agenda packet was old and highlighted changes, noting revisions will be submitted to City Council.
City Attorney Webb spoke about doing a fuller review of litigation risks; discussed changes by HDL based on a lawsuit in the City of Long Beach and noted the need to balance risks.
Councilmember Behrendt commented on a change in the law (AB 195) allowing track and trace for outside deliveries into Redondo Beach and suggested that may be a way to generate taxes from deliveries as a stopgap measure. In terms of location, he felt it would be a good idea to put the ACAAP off limits.
City Manager Witzansky reported staff will evaluate it and see if it is something the City can utilize and suggested making changes to the current ordinance to ensure consistency and that the City does not create a legal challenge by the ordinance.
Discussion followed regarding buffer zones, the possibility of finding another consultant to help the City with the matter, challenges with finding someone who advocates for the City, independently, capitalizing on AB 195 opportunities, setting the tax rate and challenges going forward.
Acting Mayor Pro Tem Kaluderovic invited public comments on this item.

Motion by Councilmember Nehrenheim, seconded by Acting Mayor Pro Tem Kaluderovic, to receive and file Mr. Cvetko’s document submittal. There being no objections, Acting Mayor Pro Tem Kaluderovic so ordered.
Mr. Cvetko responded to questions from City Council regarding his intent to file an application in Redondo Beach, his experience in the cannabis industry and licenses held, reduced sales taxes, the number of cannabis retailers that have not paid their taxes and City staff’s work on this item.
Joan Irvine, District 1, expressed disappointment on how the City has been handling cannabis delivery services; stated it has fostered the growth of illegal businesses; wondered what is taking so long; spoke about her degrees and qualifications; urged everyone to stop using scare tactics when it comes to licensing dispensaries in the City; discussed youth safety and commented on her years of advocacy for cannabis legalization in the City and on the hiring of HDL.
Motion by Councilmember Nehrenheim, seconded by Acting Interim Councilmember Behrendt, to receive and file Joan Irvine’s document submittal and extend her time for one minute. There being no objections, Acting Mayor Pro Tem Kaluderovic so ordered.
Joan Irvine discussed providing education and community outreach; noted prior warnings to the City about hiring HDL that were ignored; spoke about how the delays have cost loss of jobs, opportunities and money and announced she has a collaboration with the Green Nurses and Holistic Caring to provide a comprehensive program tailored to the 50+ and will be engaging with cannabis brands and multiple businesses to secure funding. She urged the City to take immediate action to implement cannabis delivery; spoke about a proven roadmap by Mr. Svetco that could be operational within a few months and encouraged Council to keep tax rates for delivery as low as possible and waive taxes on medical cannabis similar to prescriptions.
Jim Sullivan, Licensed Dispensary Owner, Los Angeles, thanked the City for bringing cannabis into the community; noted it is an important tool of medicine as well as recreational; shared that he is walking, today, because of cannabis; mentioned the City’s responsibility is to ensure the proper applicant, in the proper location, with property oversight and the proper operation to be good neighbors and with applicants that will cooperate with the Police and Fire Departments; stated there are 90 buildings in the City that would qualify and 20 that will be available for applicants; indicated the process is lengthy, expensive and should be thorough but in a timely manner and reported that once the process starts, it will benefit the City, the applicant and the community to see it to its completion.
In reply to questions from City Council, Jim Sullivan confirmed he hopes to get a license in the City of Redondo Beach and that his dispensary is in good standing in terms of paying its taxes; reported his business is Cloudi Cannabis, has been in operation for less than a year and remarked that it would be foolish for an applicant not to have everything in place, including a location.
Courtney, Cannabis Attorney, Director of the Cannabis Chamber of Commerce and Co-owner cannabis retail store in Fresno, via Zoom, spoke about Embark’s license being denied noting it was not the original property

the included in the application; reported that Riverside has not finalized their process; addressed the process in Corona; disagreed that all applications are cookie cutter; mentioned plans that can be altered at the building and planning stages and issues at the City’s discretion; felt it makes sense to require some sort of property and urged the City to ensure applicants have the funding necessary to open a cannabis retail business.

Robin Isenberg thanked City Council and staff for their effort; spoke about the need to be thorough; noted her experience in commercial real estate and commented on all landlords, gouging; reported people are constantly passing money in real estate; addressed the importance of location and leases versus letters of intent and suggested mitigating gouging through lease contingencies.

City Attorney Webb offered to look into the matter and noted there is currently no active threat of litigation.
Motion by Councilmember Nehrenheim, to direct the City Attorney’s office to look at the process that has been agreed to, so far, review the ordinance to harmonize it with the application process.
The motion died for lack of a second.
Councilmember Behrendt felt the City should start from the beginning; noted he has no confidence in the process recommended by HDL; asked that staff review the selection process in a more-objective process, review AB 195 as to how the City could collect taxes on deliveries and have the City Attorney review the legal issues and report back with his recommendations. He added that the HDL process is fundamentally flawed with too much subjectivity and may not be the right way to go.
Discussion followed regarding HDL options and recommendations, objectivity included in the criteria up to Phase 4, mitigating risks, HDL’s core competencies, revisiting the buffer maps, assigning points, the number of applications to require per property and the possibility of tabling the matter until there is a full Council; taking the time to do it right, and prescreen applicants as much as possible.
City Manager Witzansky suggested continuing the item to obtain additional information on AB 195, flag the current conflicts with the process and the ordinance and suggest additional objective criteria.
Motion by Councilmember Behrendt, seconded by Acting Mayor Pro Tem Kaluderovic to direct staff to review the cannabis selection process in a more-objective process, prescreen applicants as much as possible, review AB 195 as to how the City could collect taxes on deliveries, have the City Attorney review the legal issues and reduce risk and report back with his recommendations.
