TITLE
APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH MICHAEL BAKER
INTERNATIONAL FOR DESIGN AND CONSTRUCTION SUPPORT SERVICES FOR THE AVIATION BLVD NORTHBOUND AT ARTESIA BLVD RIGHT TURN LANE PROJECT, JOB NO. 40780, FOR AN AMOUNT NOT TO EXCEED $117,070 FOR THE TERM ENDING DECEMBER 31, 2025
EXECUTIVE SUMMARY
Approval of this Agreement will authorize Michael Baker International, Inc. (MBI) to finalize the design and provide construction era support services for the Aviation Blvd Northbound at Artesia Blvd Right Turn Lane Improvements Project, Job No.40780 (Project). The Project was 95% designed by MBI, but, due to delays with right of way acquisition for the Project, the contract expired.
The right of way acquisition process is nearing completion. Approval of this Agreement would allow Michael Baker to finalize Project design, when appropriate, and provide construction and as-built support services. The not to exceed value for the proposed scope of work is $117,070 and will be funded entirely through Measure R funds.
BACKGROUND
On May 19, 2015, City Council awarded a design contract to RBF Consulting, Inc. for the environmental document and design services for the Project. The RBF Consulting, Inc. contract was for an amount not to exceed $116,114 and was set to expire in May 2017.
On July 1, 2015, RBF Consulting, Inc. finalized an Agreement and Plan of Merger with Michael Baker International, Inc. Following the merger, Michael Baker International, Inc. submitted a request to the City to assume the design services contract for the project.
On September 15, 2015, the City Council approved the consent to assignment of Agreement (C15-05 -078) for design consulting services between the City of Redondo Beach, RBF Consulting, Inc. and Michael Baker International, Inc. This action authorized the transfer of the contract from RBF Consulting, Inc. to Michael Baker International, Inc.
Complications with the acquisition of a small portion of private property necessary to build the project led to a lengthy environmental review process and delayed the design effort. Eventually, the City Council adopted a Negative Declaration and a CEQA document that was filed with the State.

Additional delays in design and Project initiation occurred due to the protracted legal process needed to acquire the property. This process is nearing conclusion and, if the City prevails in the property acquisition, will allow for project construction. Staff is bringing this item to ensure the design is completed and ready to advertise when the court makes its decision in December.
The City negotiated with MBI to complete the remaining design work, provide contract documents, and, if the court allows the project to move forward, to provide construction support and as-built preparation services for the Project at an additional cost of $117,070. The project is funded by Measure R funds on a reimbursement basis and does not impact the City’s General Fund.
The construction completion date has been conservatively estimated as December 31, 2025. In all likelihood, completion will occur sooner, but this date prevents renegotiation of the contract should legal issues continue to hold up the Project.
COORDINATION
The scope of work identified in this Agreement has been coordinated by the Public Works Department. The City Attorney’s Office approved the Agreement as to form.
FISCAL IMPACT
The City of Redondo Beach was awarded additional regional Measure R funds in the amount of $550,000 in 2023, bringing the total amount funded for the acquisition, design, and construction of a right turn lane on northbound Aviation Blvd at Artesia Blvd to $2,457,000. Funding for the contract is available through these Measure R funds.
