RESOLUTION NO. CC-2311-123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDONDO BEACH, CALIFORNIA, DECLARING
THE INSTALLATION OF FIVE UMBRELLA-STYLE
SHADE STRUCTURES AT FRANKLIN PARK AS
“MAINTENANCE” AND EXEMPTING IT FROM
BIDDING REQUIREMENTS PURSUANT TO SECTIONS
19 AND 19.1(A) OF THE CITY CHARTER OF
REDONDO BEACH
WHEREAS, Section 19 of the City Charter of Redondo Beach (“Charter”) mandates every contract for public works projects—including construction and improvements of public entities such as buildings, streets, utilities, and parks—exceeding an expenditure of two hundred thousand dollars ($200,000) be awarded either to: (1) the lowest responsible bidder, with notice published in the official newspaper at least ten (10) days prior to bid opening; or (2) the best value design-build entity or best value design-build-operate entity following a proposal request; and WHEREAS, for public works projects valued at two hundred thousand dollars ($200,000) or less, the Charter allows the City Council of the City of Redondo Beach (“City Council”) to set informal bid procedures by ordinance as described in Section 19; and WHEREAS, Section 19.1(a) of the Charter offers an exception, allowing the City Council to forgo the bidding process for projects designated as “maintenance” or “repair”, as determined by the City Council through ordinance or resolution; and WHEREAS, the wooden trellis structures at Franklin Park are dilapidated and do not provide necessary shade for park users; and
WHEREAS, following the City Council’s direction, the Public Works Department obtained a proposal to replace the wooden trellis structures with five umbrella-style shade structures; and
WHEREAS, the City recognizes this replacement as essential “maintenance” to ensure the continued usability of Franklin Park; and
WHEREAS, the estimated cost for the replacement of the wooden trellis structures at Franklin Park with five umbrella-style shade structures is less than two hundred thousand dollars ($200,000), thus not exceeding the threshold that mandates formal bidding procedures as required by Section 19 of the Charter.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 19.1(a) of the City Charter of Redondo Beach, the City Council formally designates the described work above as "maintenance", thereby exempting the foregoing work from the requirements of bidding as prescribed in Section 19 of the City Charter of Redondo Beach.
