RESOLUTION NO. CC-2311-121

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF REDONDO BEACH, CALIFORNIA, DECLARING

THE REPLACEMENT OF SIX HEATING, VENTILATION,
AND AIR CONDITIONING (“HVAC”) UNITS AT CITY
HALL AS “REPAIR” AND EXEMPTING IT FROM

BIDDING REQUIREMENTS PURSUANT TO SECTIONS
19 AND 19.1(A) OF THE CITY CHARTER OF

REDONDO BEACH
WHEREAS, Section 19 of the City Charter of Redondo Beach (“Charter”) mandates every contract for public works projects—including construction and improvements of public entities such as buildings, streets, utilities, and parks—exceeding an expenditure of two hundred thousand dollars ($200,000) be awarded either to: (1) the lowest responsible bidder, with notice published in the official newspaper at least ten (10) days prior to bid opening; or (2) the best value design-build entity or best value design-build-operate entity following a proposal request; and WHEREAS, for public works projects valued at two hundred thousand dollars ($200,000) or less, the Charter allows the City Council of the City of Redondo Beach (“City Council”) to set informal bid procedures by ordinance as described in Section 19; and WHEREAS, Section 19.1(a) of the Charter offers an exception, allowing the City Council to forgo the bidding process for projects designated as “maintenance” or “repair”, as determined by the City Council through ordinance or resolution; and WHEREAS, six HVAC units at Redondo Beach City Hall are outdated, frequently malfunctioning, and have surpassed their expected service life; and WHEREAS, the City of Redondo Beach (“City”) Public Works Department has obtained a proposal to replace these units with new, energy-efficient units; and WHEREAS, the City recognizes the replacement of the HVAC units as an essential “repair” to fix the current system; and
WHEREAS, the estimated cost for the replacement of the six HVAC units at City Hall is less than two hundred thousand dollars ($200,000), thus not exceeding the threshold that mandates formal bidding procedures as required by Section 19 of the Charter.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1. Pursuant to Section 19.1(a) of the City Charter of Redondo Beach, the City Council formally designates the described work above as "repair", thereby exempting the foregoing work from the requirements of bidding as prescribed in Section 19 of the City Charter of Redondo Beach.

SECTION 2 The City Clerk shall certify to the passage and adoption of this resolution and shall enter the same in the Book of Original Resolutions.
