EXECUTIVE SUMMARY
The Basin 2 Sewer Pump Out Station Upgrade Project & Harbor Patrol Dock Replacement Project, Job Nos. 50310 & 70690 respectively (Project) was awarded to Bellingham Marine Industries, Inc. (BMI) and is now complete. During construction, three change orders were issued, totaling $155,052 (5.2% of the awarded contract value), bringing the final agreement amount to $3,145,319.
The Project is now complete and ready for the City Council to accept it as complete, authorize the filing of a Notice of Completion, and to release contractor retention funds in the amount of $157,265.94 to BMI.
BACKGROUND
On December 14, 2021, the City Council awarded BMI a public works contract in the amount of $2,990,267 to complete the Basin 2 Sewer Pump Out Station Upgrade Project, Job No. 50310 and the Harbor Patrol Dock Replacement Project, Job No. 70690. During construction, three change orders were issued, totaling $155,052, bringing the final agreement amount to $3,145,319. The total amount of the change orders did not exceed the authority provided to the City Engineer by Administrative Policy and Procedure 14.1, and addressed material cost increases, additional time extension for regulatory permit modifications, and design modifications to dock lighting and seal stops. The time extension change order provided time for modifications to the regulatory authorizations to allow jetting as an approved pile installation procedure which facilitated the use of a smaller barge that minimized the impacts to the boaters in the harbor and nearby residents.
The Project design concepts were taken to the Harbor Commission on June 10, 2019 to conduct outreach and obtain comments. The comments were gathered, and additional stakeholder outreach was conducted with the Harbor Patrol, Fire Department, and County Lifeguard staff as County Lifeguards use the dock. City staff worked with these entities to refine the proposed facility improvements based on their input and needs. The revised conceptual design for the Project was presented again to the Harbor Commission on October 14, 2019 and the Commission approved a

presented again to the Harbor Commission on October 14, 2019 and the Commission approved a Categorical Exemption determination to fulfil CEQA requirements and to provide a local “approval in concept” which was required for the Coastal Development Permit Application. Following various regulatory approvals from the US Army Corps of Engineers, the California Coastal Commission, and the Regional Water Quality Control Board, the Harbor Commission later approved a Conditional Use Permit for the Project on March 9, 2020.
The new vessel pump out dock was expanded to allow operations from multiple transient vessels at one time, as well as to increase the allowable vessel size up to 100 feet in length. The pump out dock was also designed and constructed to be wider, creating a more stable walking surface for use in the open channel wave environment. In addition, the sewer pump out dock has been replaced with a new 1,200 sq. ft. concrete floating dock supported by 5, 24-inch, concrete guide piles. Inside the harbor wall, a new 3,600 sq. ft. concrete floating dock supported by 10, 18-inch, concrete guide piles was installed to meet the needs of the Harbor Patrol.
Project Plans and Specifications were approved by the City Council on June 8, 2021, and the Project was advertised for competitive bidding on June 17, 2021. On July 15, 2021, only one bid for the Project was received and publicly opened. The bid was submitted by BMI, totaling 2,990,267, and was deemed to be responsive. The bid was appropriately vetted by staff, and BMI was determined to be a responsible bidder.
The Project is now fully operational and has received exceptionally positive reviews from internal staff, as well as outside, tenant agencies. The new docks were successfully put to use shortly after opening as a 3-agency boater emergency response event took place, whereby the facilities provided good lighting, ample dock slip space, and comfortable landing area access. In addition, the new docks were able to handle the recent intensive storms with minimal damage. The new docks will improve the community’s ability to protect public health and safety, and meet all current building and safety codes.
The Project is now complete and ready for the City Council to: 1) accept it as complete; 2) authorize the City Engineer to file a Notice of Completion with the Los Angeles County Recorder; and 3) authorize the City Engineer to release contractor retention funds in the amount of $157,265.94 to BMI, upon expiration of the 35-day lien period after said recordation and no claims being filed upon the Project.
COORDINATION
Design of the Project was developed with input from the Harbor Commission along with the Fire, Public Works, and Waterfront & Economic Development Departments. Construction was coordinated through the Public Works Department, Fire Department (Harbor Patrol), and Waterfront & Economic Development Department.
