TITLE
APPROVE A MODIFIED AGREEMENT WITH PLAYCORE WISCONSIN INC., DBA GAMETIME,

FOR DESIGN BUILD SERVICES FOR THE DOMINGUEZ PARK PLAYGROUND EQUIPMENT IMPROVEMENT PROJECT, JOB NO. 30730, FOR AN AMOUNT NOT TO EXCEED $531,543

EXECUTIVE SUMMARY
The Dominguez Park Playground Equipment Improvement Project, Job No. 30730 (Project), includes two distinct scopes of work; civil construction and new playground equipment purchase and installation. Playcore Wisconsin Inc. (dba Gametime) was selected to address the second component of the project and to specifically provide and install new custom designed play equipment and rubberized surfacing. Approval of the proposed agreement will allow for completion of that work.

BACKGROUND
Last summer, after extensive community and commission outreach, staff completed a solicitation for design-build services for new playground equipment at Dominguez Park. That effort culminated on September 5, 2023, when the City Council selected the design presented by Playcore Wisconsin, Inc., dba Gametime, and awarded a contract to the company for an amount not to exceed $531,543.

The contract, as proposed, authorized Gametime to design, build, and install new play equipment and rubber surfacing.

After receiving the contract, Gametime requested modifications to some of the design-build terms.

For the past few months, staff in the City Attorney’s Office and Public Works Department, along with the City’s Risk Manager, have worked with Gametime personnel to negotiate terms that are acceptable to both parties. The final modifications to the agreement are fairly minor and staff is happy to report that the document has been signed by Gametime and is now recommended for approval by the City Council. It should be noted that there is no modification to the play equipment design, or the price.

Civil construction of the Project is expected to begin this month. Installation of the new playground equipment and rubber surfacing is expected to be complete in 6-8 months.

COORDINATION
The modified Agreement was negotiated/prepared by the City Attorney’s Office, the City’s Risk Manager, and staff in the Public Works Department.
