BCHD MUST LIMIT ITS CLAIMS TO FACTS - AND NOT UNFOUNDED, UNSUPPORTED

SPECULATION
BCHD has previously replied to a CPRA request that BCHD has no ability to evaluate programmatic benefits to the community. That is beyond both the SCOPE and ABILITIES of the District's Board, Executive Management and Staff. As a result, BCHD has no possible ability or fact base to state that a 91% non-resident service area on allcove is more beneficial to residents than a resident only program.

BCHD must restrict its discussion to facts, and not unfounded speculation that contradicts its own statements on the record.

The full text of BCHD's CPRA reply is at
https://www.stopbchd.com/post/bchd-can-only-guess-which-programs-have-any-resident-taxpayer-benefits In brief, it stated,
During BCHD's Board sponsored meeting on 2/16/24, BCHD made the unfounded assertion that its "regional" programs such as allcove were more beneficial to residents of the District than resident restricted programs. BCHD has no evidence to support its false narrative From: Mark Nelson (Home Gmail)

Public Comment - Hermosa, Manhattan and Redondo Beach City Councils:

BCHD is planning to use a roughly $5M parcel for a minimum of 30 years for an allcove facility. The parcel is at Beryl and Flagler. allcove has a service area of LA County SPA8, which is Avalon to Long Beach and 1.4M population. Of that only 9% is the District.

The Councils have a fiduciary responsibility to assure that residents have fair value or compensation for use of taxpayer land, even if a careless Health District is attempting to donate it to 91% non-resident use.

Per LA County records, SPA8 consists of 91% non-residents of the District.

Provide documents demonstrating the annual land lease payment to be paid from the allcove building to the District and its taxpayers for the use of the C-2 zoned lot at Flagler & Beryl.

Public Comment - Metro Board, County Board of Supervisors, Redondo Beach City Council Please have the Metro IG investigate. Yet another 14 delay delay after 4 months of delay is clearly outside any reasonable interpretation of the CPRA.

1. On October 19, 2023 one of our active local citizens submitted a Public Records Act request to Metro. It was short and requested existing documents regarding Metro's declaration of a pipeline anomaly. The full text of the request is pasted below.

2. Currently, there has no informational response, only emails requesting further delay until at least February 16, 2024. The full text of the most recent delay email is pasted below.

I am rightfully concerned that Metro's 4 month delay is symptomatic of a cover-up of some sort. Existing documents are just that - existing documents and 4 months is excessive.

Please step in and require Metro staff to fulfill promptly - although - after 4 months the word "promptly" no longer has any real meaning.

Please see below. BCHD, an entity chartered for the benefit of the RESIDENTS WHO RESIDE IN THE DISTRICT, has exposed District taxpayers to a nearly $50M exposure with NO ANALYSIS. The Cities have a fiduciary responsibility to protect residents from a wayward special district that make $50M decisions without regard to the financial exposure it saddles taxpayers with. https://www.stopbchd.com/post/bchd-s-board-saddled-taxpayers-with-allcove-s-30-year-50m-obligation-with-no-analysis BCHD's Board Saddled Taxpayers with allcove's 30-Year, $50M Obligation with NO ANALYSIS allcove's service area is LA County Health's SPA8. That's 1.4M population from Avalon to Long Beach. District population is only 9%, meaning that 91% of the investment and cost is for the NON-RESIDENT service area.

HOWEVER - this is an UNFUNDED PROGRAM and the 30-year obligation is estimated at nearly $50M to DISTRICT TAXPAYERS.

Why is it estimated? Because BCHD was UNABLE or UNWILLING to conduct the analysis before signing TAXPAYERS UP FOR 30 YEARS.

The grant from the State for the allcove building REQUIRES that the building be operated for a minimum of 30 years as a mental health facility.

THAT IS A LIABILITY OF THE DISTRICT RESIDENT TAXPAYERS.

BCHD's Board and Executives ($2.3M per year payroll) have failed in their fiduciary responsibility to taxpayers by refusing to conduct any analysis of the 30-year liability obligation.

BELOW IS BCHD'S RESPONSE WHEN WE ASKED FOR THE PROGRAM

COSTS OF ALLCOVE
Please see below (in red) for the District’s response to your public records request received 11/2/23 that reads:

According to the grant for construction funding, the allcove building must operate for a minimum 30 years as a mental health facility.

1. Provide all analysis completed by BCHD to establish the PV cost of the facility to taxpayers, including but not limited to, taxes, utilities, operations, maintenance, etc.

BCHD Says: No records – See note below.

1. Provide all 30 year guaranteed funding that can offset the obligation incurred by taxpayers in #1 above.

BCHD Says: Current operating grant has been awarded through June 30, 2026.

Please find more information on the District’s allcove site about the current funding and note below. https://www.bchd.org/allcovebeachcities (through June 30, 2026 only)

1. Provide all analysis demonstrating the level of encumbrance of the 30 year obligation on District assets.

BCHD Says: No records – See note below.
