Administrative
Report
H.10., File # 24-0620 Meeting Date: 5/21/2024
To: MAYOR AND CITY COUNCIL
From: ANDREW WINJE, PUBLIC WORKS DIRECTOR
TITLE
APPROVE AN AMENDMENT TO THE AGREEMENT WITH FRANCISCO AND ASSOCIATES, INC.

TO PROVIDE CONSULTING AND ADMINISTRATIVE SERVICES FOR THE CITY’S PROPOSITION 218 REFUSE RATE PROCESS AT A COST OF $38,095 FOR A NEW NOT TO EXCEED AMOUNT OF $220,602 WITH NO CHANGE IN TERM

EXECUTIVE SUMMARY
City Council approved an agreement with Francisco and Associates, Inc. (Francisco and Associates) on February 20, 2024 to allow the consultant to conduct and submit tax assessments to the Los Angeles County Auditor-Controller’s Office on behalf of the City.

It is recommended that annual activities related to the Street Landscaping and Lighting Assessment District, Wastewater Fund, and the Solid Waste Fund also be conducted by Francisco and Associates to help ensure timely submittal and collection of the associated fees.

BACKGROUND
On April 23, 2024, City Council initiated the Proposition 218 process for Solid Waste rate adjustment.

Every five years, as part of this process, the City is required to mail a Proposition 218 notice to identify proposed maximum solid waste rates. Francisco and Associates assisted staff with this process and facilitated preparation and mailing of all required notifications. If approved, the First Amendment to the Agreement increases the not to exceed amount by $38,095 to cover the cost of the Proposition 218 project. These new costs will be paid from the Public Works Solid Waste Operating budget.

Proposition 218 requires that all property owners, or those responsible for paying the refuse bill, receive a notice 45 days prior to the Public Hearing, which Council has set for June 18, 2024.

Following City Council initiation of the process at the April 23, 2024 City Council meeting, staff worked with the consultant Francisco and Associates to meet all requirements, prepare documentation, and mail notifications prior to the May 3, 2024 deadline.

If approved, this action increases the not to exceed amount of the Agreement to include the cost of the additional Proposition 218 work. The final total document preparation, printing, and mailing was $38,095, which would increase the total not-to-exceed amount to $220,602. The term, and all other provisions of the Agreement, would remain unchanged by the amendment.
