To: MAYOR AND CITY COUNCIL
From: LUKE SMUDE, ASSISTANT TO THE CITY MANAGER
TITLE
ADOPT BY TITLE ONLY ORDINANCE 3271-24, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, REPEALING SECTIONS 9-20.01 THROUGH 9-20.08 OF TITLE 9, CHAPTER 20 OF THE REDONDO BEACH MUNICIPAL CODE REGARDING THE HANDICAPPED ACCESS APPEALS BOARD, AND AMENDING TITLE 2, CHAPTER 9, ARTICLE 4, SECTIONS 2-9.402 AND 2-9.403 REGARDING THE PUBLIC WORKS AND SUSTAINABILITY COMMISSION. FOR SECOND READING AND ADOPTION

EXECUTIVE SUMMARY
The proposed ordinance was approved for introduction on June 4, 2024 and is now ready for second reading and adoption. The ordinance, if adopted, will amend the Redondo Beach Municipal Code (RBMC) to eliminate the Handicapped Access Appeals Board and reassign its responsibilities to the Public Works and Sustainability Commission.

BACKGROUND
Currently, the Handicapped Access Appeals Board is unstaffed, and Council directed staff to eliminate the Handicapped Access Appeals Board and add its responsibilities of this board to the Public Works and Sustainability Commission, which is well-staffed, meets regularly, and deals with public works and construction standards.

The Ordinance presented for second reading and adoption would incorporate guidelines that ensure, where possible, members of the Public Works and Sustainability Commission fit the criteria established by California Health and Safety Code Section 19957.5, which establish that “two members shall be persons experienced in construction, two members shall be physically handicapped persons, and one person shall be a public member.” The Ordinance also establishes the appeals process and places the Chief Building Official as an ex officio member of the commission that is not entitled to a vote.

Adoption of the proposed Ordinance would eliminate the Handicapped Access Appeals Board and assign its responsibilities to the Public Works and Sustainability Commission.

COORDINATION
This item was coordinated with the Public Works Department and the City Attorney’s Office prepared the Ordinance.
