provisions are exempted by State Law as it pertains to the Housing Element process; City Attorney Webb narrated an Article XXVII Proposed Charter Amendments PowerPoint presentation; explained and described the information given in the presentation.
Mayor Light noted he is the only remaining original proponent of Measure DD or Article XXVII; presented background of the item; noted the intent was to stop the piecemeal and dramatic up zoning of the City that was occurring at the time and give residents a voice in those major decisions and changes in land use; talked about the need for more specificity as to the exemptions that were in the original Article XXVII in order to protect residents’ right to weigh in on zoning changes for the future . He reported he has been working with City Attorney Webb to define the exact wording , including a sunset law clause as presented tonight; he expressed his full support of the version, adding that it is necessary to protect the City from losing all control of projects, zoning and the threats represented by State laws such as “Builders Remedy”.

STATUS AND POSSIBLE DECRIMINALIZATION OF PSILOCYBIN
MUSHROOMS IN THE CITY OF REDONDO BEACH
CONTACT: ELIZABETH HAUSE, ASSISTANT TO THE CITY MANAGER Assistant to the City Manager Hause referenced the April 2, 2024 City Council meeting where Staff was directed to return with discussion regarding the potential to decriminalize psilocybin mushrooms in the City of Redondo Beach; stated Staff had worked with the City Attorney’s office to produce this report; narrated a PowerPoint presentation with details of the item; noted that at the city level, psilocybin mushrooms are not criminalized so they cannot be decriminalized, but the City can enforce State law and proposed that Council consider directing the City lobbyist to pursue decriminalization at the State and/or Federal level.
Councilmember Obagi spoke about Mental Health Awareness month; referenced a 60 Minutes segment about experiments taking place at John Hopkins University with psilocybin mushrooms for treatment of depression and anxiety; felt the City does not need to apply resources for that at this time but noted there is significant research that indicates that benefits could evolve from psilocybin treatment and referenced various studies related to psilocybin treatment.
Motion by Councilmember Obagi to prepare a resolution expressing the City Council’s support for further research into psilocybin as a treatment for depression, PTSD, anxiety, and other mental disorders and calling for State laws that advance this critical medical research and a cover letter sending the resolution to the City’s State Assembly member and Senator asking support for this research.
The motion died for lack of a second.
Councilmember Nehrenheim narrated PowerPoint slides regarding psilocybin and mental health treatments; presented research done in other countries and states in favor of the treatment; stated results of treatments showed to help with postpartum, depression, and traumatic brain injuries; discussed how war brought about PTSD, brain injuries, and opioid addictions; noted the positive outcomes the treatment has brought to people with mental health issues as well as to those suffering from endof-life diseases; stated that it will be a $6.85 billion business by 2027; listed the pros of legalizing psilocybin using research studies from various sources; addressed the industry’s medical and economic potential and talked about resolutions and policies; highlighted suicide rates of men due to mental health issues; stated he has prepared a resolution that is ready to go and will send the presentation to the City Clerk to include in the record.
Councilmember Behrendt spoke about the importance of addressing mental health; felt unclear as to whether promoting the use of psylocibin mushrooms is a good idea; opined that taking a wait-and-see approach is critical; noted they have not gotten any input from their local law enforcement, school districts, or medical experts;

Mayor Light invited public comments.
Carissa Robinson, Marriage and Family Therapist ( via Zoom), spoke in support of the item; noted that as a mental health professional, she has witnessed the profound positive impact of psilocybin assisted therapy on individuals struggling with depression, PTSD and other mental health issues; noted this is a pressing issue and patients have waited far too long for effective treatments and urged City Council to advocate for psilocybin decriminalization at the State level.
Joan Irvine, District 1, via Zoom, agreed that decriminalization of psilocybin should be considered; expressed concerns with the City’s limited resources; she stated she is not for the decriminalization of psilocybin until the cannabis ordinance moves forward first.
There were no other public comments on this item.
Substitution motion by Councilmember Nehrenheim , to receive and file the documentation presented for this item and direct Staff to return with a resolution expressing the City Council’s support for further research into psilocybin as a treatment for depression, PTSD, anxiety and other mental disorders.
Mayor Light stated that Staff is swamped; asked if it would be possible that Councilmember Obagi and Councilmember Nehrenheim work on the resolution.
Councilmember Obagi offered a friendly amendment to return with a draft resolution developed by a subcommittee, himself and Councilmember Nehrenheim (noting it requires Council votes to pass), supporting the research into psilocybin as a treatment for depression, PTSD, anxiety and other mental disorders.
Discussion ensued regarding the resolution and rules needed to pass.
Amended substitute motion by Councilmember Nehrenheim, seconded by Councilmember Obagi, that a subcommittee of Councilmember Nehrenheim and Obagi return with a draft resolution supporting the research into psilocybin as a treatment for depression, PTSD, anxiety and other mental disorders.
