RESOLUTION NO. CC-2608-066

A RESOLUTION OF THE CITY COUNCIL OF REDONDO BEACH,

CALIFORNIA, ADOPTING AN ADDENDUM TO THE CERTIFIED

PROGRAM ENVIRONMENTAL IMPACT REPORT (STATE
CLEARINGHOUSE NUMBER 2023050732) FOR THE REDONDO

BEACH FOCUSED GENERAL PLAN UPDATE, ZONING ORDINANCE

UPDATE AND LOCAL COASTAL PROGRAM AMENDMENT
PERTAINING TO THE PROPOSED C-2 AND C-2-PD DEVELOPMENT

STANDARD AMENDMENTS AND ROOF TOP DINING REGULATIONS

WITHIN THE ARTESIA AND AVIATION CORRIDOR AREA PLAN
WHEREAS, on November 5, 2024, the City Council of the City of Redondo Beach adopted Resolution No. CC-2410-105 certifying the Redondo Beach Focused General Plan Update, Zoning Ordinance Update and Local Program Amendment Final Program Environmental Impact Report (PEIR) (SCH No. 2023050732) (certified PEIR) pursuant to the California Environmental Quality Act (CEQA) (Pub. Resources Code § 21000, et seq.); and
WHEREAS, subsequently, the City of Redondo Beach has initiated additional analysis to be completed to study impacts associated with proposed amendments to the C-2 and C-2-PD development standards and roof top dining regulations (modified project) within the Artesia and Aviation Corridor Area Plan (AACAP). The “modified project” establishes development standards for properties within the corridor, within the maximum FAR of 1.50 studied under the approved project. Modifications include changes to maximum building height and story limits, setbacks, public open space requirements, commercial ground-floor standards, parking and circulation requirements, landscaping standards, and corridor-specific architectural and site design standards.

The amendments retain the existing C-2 and C-2-PD development standards for properties located outside the AACAP. The “modified project” also establishes a rooftop dining ordinance within the AACAP, subject to operational, noise, hours, and design standards. The rooftop dining deck area counts toward the maximum FAR of 1.50.

Additionally, no physical development of properties within the AACAP consistent with the proposed development standards is proposed under the “modified project”; and WHEREAS, pursuant to CEQA, and the CEQA Guidelines, the City of Redondo Beach is the lead agency for the Project, as the public agency with general governmental powers; and
WHEREAS, prior to approval of subsequent actions that constitute a “project” under CEQA and the State CEQA Guidelines, the City is required to determine whether the environmental effects of such actions are within the scope of prior environmental analysis, or whether additional environmental analysis is required; and RESOLUTION NO. CC-2608-066

ADOPTING AN ADDENDUM TO THE CERTIFIED PROGRAM EIR
PAGE NO. 2
WHEREAS, under CEQA, the lead agency or a responsible agency shall prepare an addendum to a previously certified EIR if some changes or additions are necessary to the prior EIR, but none of the conditions calling for preparation of a subsequent or supplemental EIR have occurred (Public Resources Code Section 21166; CEQA Guidelines Sections 15162 and 15164). Once an EIR has been certified, no supplement or subsequent EIR shall be prepared unless the lead agency or responsible agency determines that a specific condition has been met as required by CEQA Guidelines Section 15162(a)(1), (2), and (3); and
WHEREAS, the City has caused preparation of an Addendum for the “modified project” (Addendum) pursuant to CEQA and the State CEQA Guidelines on the basis that the “modified project” does not require preparation of a new, subsequent or supplemental EIR; and
WHEREAS, an addendum to a previously certified EIR need not be circulated for public review, but may be attached to a certified EIR in accordance with CEQA Guidelines Section 15164; and
WHEREAS, the City Council of the City of Redondo Beach has reviewed and considered the Addendum in conjunction with the certified Final PEIR; and WHEREAS, the City Council has determined, for reasons specified below, that the revisions proposed as part of the “modified project” are minor, would not result in any new or more significant environmental impacts, and thus qualify for an Addendum to the certified PEIR in accordance with Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15164; and
WHEREAS, the City Council has evaluated the potential environmental impacts of the proposed “modified project” against the criteria set forth in Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15164.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO
BEACH DOES HEREBY RESOLVES AS FOLLOWS:

SECTION 1. The above recitals are incorporated herein by this reference.

SECTION 2. Pursuant to the provisions of CEQA and the CEQA Guidelines, the City Council has reviewed and considered the Addendum prepared for the “modified project”.

SECTION 3. Based on that review, the City Council finds, in the exercise of its independent judgment and based on substantial evidence in the whole of the record, that the “modified project” does not require the preparation of a subsequent or supplemental Environmental Impact Report as none of the conditions described in RESOLUTION NO. CC-2608-066

ADOPTING AN ADDENDUM TO THE CERTIFIED PROGRAM EIR
PAGE NO. 3
Section 15162 of the CEQA Guidelines exist, and that preparation of the Addendum meets the requirements of CEQA. Specifically, the City Council finds as follows:
a. Major EIR revisions are not required: The “modified project” consists of administrative refinements to the previously approved project, including updates to C-2 and C-2-PD zoning regulations, and rooftop dining standards. These changes do not alter the overall development intensity, approved maximum floor area ratio, project footprint, or previously analyzed land use assumptions, and do not authorize new physical development beyond that evaluated in the certified PEIR. Accordingly, the “modified project” would not result in any new significant environmental effects or a substantial increase in the severity of previously identified significant effects. Therefore, no substantial changes to the project are proposed that would require major revisions to the previously certified PEIR pursuant to CEQA Guidelines Section 15162.
b. No substantial change in circumstances requiring major EIR revisions: The “modified project” would not facilitate development beyond that evaluated in the certified PEIR or increase approved development intensity, maximum FAR, or analyzed assumptions. The C-2 and C-2-PD amendments implement corridorspecific standards while retaining the 1.50 maximum FAR; and the rooftop dining ordinance establishes operational and design standards within the AACAP. The environmental setting and regulatory framework remain unchanged and thus, would not result in new or more severe impacts than what was disclosed in the certified PEIR. The certified PEIR analysis remains applicable because future development facilitated by the “modified project” must comply with the City’s General Plan, zoning regulations, development standards, design review requirements, and adopted mitigation measures. Accordingly, no substantial change in project circumstances has occurred that would require major revisions to the certified PEIR under CEQA Guidelines Section 15162. c. No new information showing greater significant effects than identified in the EIR:

As demonstrated in this Addendum, the “modified project” would result in the same significant impacts as those disclosed in the certified PEIR, and no substantially more severe impacts would occur. The policies and mitigation measures identified in the certified PEIR to reduce physical environmental effects would continue to apply to the “modified project”. Implementation of the “modified project” would not result in physical changes to the environment beyond those previously analyzed in the certified PEIR, nor would it introduce new development characteristics or circumstances that would increase the severity of previously identified impacts. Therefore, no new or substantially more severe significant impacts associated with implementation of the “modified project” would occur.

d. No new information showing ability to reduce significant effects identified in the EIR: The “modified project” consists of administrative General Plan and zoning refinements to the AACAP-related C-2 and C-2-PD amendments, and rooftop dining regulations. These changes do not warrant mitigation measures or alternatives to substantially reduce significant environmental effects beyond those analyzed in the certified PEIR. The “modified project” does not change the certified PEIR’s analysis, impact conclusions, or mitigation framework.

Accordingly, no considerably different mitigation measures or alternatives have been identified, and no additional mitigation measures or alternatives are required for the “modified project”.

SECTION 4. The City Council also finds that the “modified project” would not trigger any of the conditions under CEQA Guidelines Section 15162(a)(1)(3). The proposed changes would not cause new significant impacts, substantially increase previously identified impacts, or involve new information requiring major revisions to the certified PEIR. This Addendum provides the substantial evidence required by CEQA Guidelines Section 15164 to support the finding that a subsequent EIR is not required and that an addendum is the appropriate environmental document for the “modified project”.

SECTION 5. The City Council has reviewed the findings made in this Resolution and finds that they are based upon substantial evidence that has been presented to the City Council in the record of proceedings. The documents, staff reports, technical studies, appendices, and other materials that constitute the record of proceedings on which these findings have been based are on file in the Office of the City Clerk, located at 415 Diamond Street in the City of Redondo Beach and available for public examination during normal business hours.

SECTION 6. The Addendum to the Final Environmental Impact Report (SCH #2023050732) reflects the independent judgment of the City Council and contains, and is based on, substantial evidence and analysis to allow the City Council to make an informed decision as set forth herein.

SECTION 7. In light of the evidence presented at the hearing, and based on the findings set forth above, the City Council hereby adopts the Addendum (attached hereto as Exhibit A and incorporated herein by this reference) to the Certified Final Environmental Impact Report for the Redondo Beach Focused General Plan Update, Zoning Ordinance Update and Local Program Amendment.

SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and shall enter the same in the Book of Original Resolutions.
