APPROVAL OF EXPENSE REIMBURSEMENT FOR COUNCILMEMBER FAST Paul A. Melikian, Assistant City Manag,-1~
APPROVED: Nicole R. Zieba, City Manager W
RECOMMENDATION
Request the City Council approve a mileage expense reimbursement request from Councilmember Fast for miles driven for official City business.
EXECUTIVE SUMMARY
A mileage reimbursement was submitted on October 8, 2024, for miles driven for official City business.
Upon review, several of the dates fall outside of the 30-calendar day submission requirement as set forth in Section 5 of the Expense Reimbursement and Travel/Conference Policy for Elected and Appointed Legislative Body Officials that was adopted in December 2018. The dates range from June 27, 2024 to October 5, 2024. Out of the 341 miles driven for City business during this period, 213 miles fall outside of the 30-day requirement, representing $142.71 at the 2024 IRS mileage rate of $0.67 per mile.
Section 5 of the policy states: "Officials must submit their expense reports within thirty (30) calendar days of an expense being incurred, accompanied by receipts documenting each expense. Restaurant receipts, in addition to any credit card receipts, are also part of the necessary documentation. Any expenses submitted after 30 days of being incurred will be required to be approved by a majority of the City Council at a regularly scheduled Council meeting. Expenses not approved by the majority of Council shall be borne by the official who incurred the expense. "
FISCAL IMPACT
No new appropriations are needed for this reimbursement as mileage reimbursements for elected officials are included in the annual City budget.

APPROVE AND AUTHORIZE THE CITY MANAGER TO SIGN AN
AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH
INTERWEST CONSUL TING GROUP TO CONTINUALLY PERFORM
ADDITIONAL ON-CALL PROFESSIONAL SERVICES FOR THE
COMMUNITY DEVELOPMENT DEPARTMENT - BUILDING DIVISION
Rodney L. Horton
Community Development Director
Nicole R. Zieba ~
City Manager
RECOMMENDATION
Approve and authorize the City Manager to make non-substantive changes to the attached amendment, and sign final amendment to the professional services agreement with lnterwest Consulting Group, Inc. (lnterwest) to perform on-call professional services for the Community Development Department - Building Division.
BACKGROUND
The Community Development Department consists of the Planning and Building Divisions.
Each division is responsible for highly technical and complex assignments associated with the approval and development of structures proposed to be brought into the built environment.
The Building Division is responsible for processing building permit applications in a timely fashion, conducting building inspections, and ensuring new construction is complaint with the Reedley Municipal Code and the California Building Code.
Currently, as part of a longstanding professional services agreement, lnterwest provides plan review and inspection support to the department. Staff is proposing to extend the professional services agreement to November 1, 2025. The agreement amendment includes a wholesale replacement of Exhibit B, which reflects an inflationary adjustment in hourly rates for services performed by I nterwest.
On August 28, 2018, City Council approved the original on-call contract with lnterwest Consulting Group to provide Building Division support services. At this time, staff anticipates
utilizing support services due to the recent staff changes and the consistently strong development activity.
FISCAL IMPACT
There is no negative fiscal impact to the City given that the costs of service are determined per-project on an as-needed basis. Additionally, cost for services will be significantly defrayed by fees paid by permit applicants.
PRIOR COUNCIL ACTIONS
City Council approved the original on-call contract with lnterwest Consulting Group on August 28, 2018.

RECOMMENDATION
Approval of items pertaining to the Airport Capital Improvement Program (ACIP):
A) Adopt Resolution No. 2024-079 authorizing the City Manager to execute and submit a fiscal year 2025 Airport Improvement Program (AIP) Grant Application to the Federal Aviation Administration (FAA) for design of the Installation of Runway End Lights Project for $95,018.
B) Adopt Resolution No. 2024-080 authorizing the City Manager to execute and submit a fiscal year 2025 Airport Improvement Program (AIP) Grant Application to the Federal Aviation Administration (FAA) for design of the Aviation Fuel Facility Replacement Project for $144,063.
EXECUTIVE SUMMARY
Staff met with FAA representatives in October to discuss the ACIP for the Reedley Municipal Airport. There are two design projects slated for fiscal year 2025 which include the Installation of Runway End Lights and Aviation Fuel Facility Replacement. Both projects have been identified on the ACIP for the past few years and continue to stay a high priority for the airport operations.
The preapplications are due October 31, 2024. By submitting the preapplication, this does not guarantee funding will be approved for the projects, but instead this document communicates with the FAA the Sponsors (City) intention to spend these funds in the project year. The FAA grant funding will be available in late spring of 2025. Once the design work is done, the City will apply for the construction funding for the 2026 fiscal year.
FISCAL IMPACT
FAA funds 90% of approved projects with the local match (City) being responsible for 10% of the approved project cost. City is entitled to be reimbursed for administrative time, not to exceed two percent of the project cost which reduces the actual City match. All matches and staff expenses are covered by the Airport Enterprise Account, not the General Fund.

1 - Project Schedule
In addition, the sponsor must develop a realistic project schedule that will ensure that the grant can proceed in a timely manner. The sponsor must coordinate_ this schedule with the ADO upon ADO request. The schedule must set realistic sponsor deadline dates for key steps in the grant process because a sponsor's failure to complete these ste sin a timely manner may seriously impact or delay project funding (see attached form).

2 - Grant Application Package
Application for Federal Assistance (SF 424)
Application form SF 424 is the Application for Federal Assistance, more commonly known as the "Grant Application." The SF 424 can also be used as the Pre-application or a Changed/Corrected Application. We will validate your project for the upcoming fiscal year by using the SF 424.
When you are filling out the SF 424, number 15, "DESCRIPTIVE TITLE OF APPLICANT'S PROJECT," provide all the details of what is going to be funded. Provide all the details and costs for all the specific elements of work that are going to be funded (for example runway extension, taxiway extension, and lighting).
For the funding portion, use accurate numbers. If there is a question on the federal dollar amount, give either your respective state office a call or call us at the ADO. Make sure your federal, state, and local dollar figures add up to the total you are showing.
Application for Development Projects (Part II through IV) (FAA Form 5100-100) FAA Form 5100-100 must be submitted for all projects.
This form provides supporting grant information such as the source of the sponsor share, detailed cost estimate, and confirmation that items such as coordination with on airport users has been accomplished.
Application for Planning Projects (Parts II through IV) (FAA Form 5100-101) For planning projects, sponsors can submit FAA Form 5100-101.

Project Sketch
Sponsors must provide an 8 ½" x 11" or larger sketch for each of the projects. The project sketch is used to identify the project as described in the grant application description.
If multiple construction items are part of the project (runway, apron, etc.), make sure they are identified on the project sketch and are detailed enough to determine eligibility.
Ensure that all project components shown in the sketch are on the approved airport layout plan (ALP); and, furthermore, all aspects of the project(s) have been reviewed and approved within the applicable environmental finding.

3 - Form 5100-100 - Program Narrative (Justification)
Please include answers to the following questions in your justification for each project in the Grant:
1. What is the project? (Please provide a separate narrative for each project item in the Grant.) a. If a construction project, is the project rehabilitation or reconstruction? b. If rehabilitation, what type ofrehabilitation?
c. If pavement, include PGI or each pavement branch and pavement condition explanation. d. Provide dimensions of all construction area in feet for runways, taxiways, and square yards for aprons.
2. Why is the project being done? 0f'/hy is the project needed now?)
3. Is this project phased?
a. If yes, what phase is this?
b. If yes, how does this phase fit into the larger development need?
4. What are the total AIP funds spent on the project to date, including this projecUgrant?
5. What are the total AIP funds needed to complete the project? The ADO must not fund projects or project elements that are not justified based on the following three tests:
• The Project Advances an AIP Policy.
The ADO must verify that the project advances one of the AIP policies contained in 49 USC§ 47101.
The basic goals and objectives in these policies include airport safety, airport security, airport capacity, meeting an FAA standard, preserving airport infrastructure through reconstruction or rehabilitation, protecting and enhancing the environment, minimizing aircraft noise impacts, and airport planning. AIP funds must not be used for a project that does not specifically advance one of the AIP policies. • There is an actual "True Need."
Per FAA policy, the ADO must determine if there is an actual true need for the project at the airport within the next five years (per the definition near-term development per the current version of Advisory Circular 150/5070-6, Airport Master Plans). This includes all subcomponents of the project. • The Project Scope is Appropriate.
The ADO must determine that only the elements that are required to obtain the full benefit of the project are included in the project scope. Any elements that do not meet these criteria must stand on their own separate merit and justification. The current version of FAA Order 5100.39, Airports Capital Improvement Plan, discusses this concept in further detail in the discussions on overall development objective.
Project narratives 0ustification) should be written so a person completely unfamiliar with the project will understand what the project is and why we are doing it now.
In the case of justifying rehabilitation projects, each state provides pavement management services for all the NPIAS airports. Information about the pavement condition should be used in your justification.
If a grant is to conduct on Environmental Assessment, then the project being evaluated in the Environmental Assessment needs to be justified as needed within the 1-5 year planning horizon.
Sample Narratives (Justifications):
Pavement Rehabilitations - The pavement associated with runway 12/30 is 27 years old and has reached the end of its useful life. The latest Pavement Condition Index (PCI) is 65. Pavement rehabilitation (three-inch mill and overlay of 60' x 3,000') is necessary to extend the useful life of the runway. Provide total dimensions of the project area being rehabilitated and type of rehabilitation (include associated items like drainage, in-pavement runway lights, relocating signs, markings etc.).
Updated
September
2019 Page 4 of
Land - Acquisition of the Runway Protection Zone is necessary to ensure compatible land use and maintain clear approaches. A total of 6.82 acres will be acquired.
Expand Apron- Apron expansion is needed to accommodate aircraft currently using the airport. The existing apron i§_ 12 years old and the number of based aircraft have increased from 12 to 34. A total of 2,000 (1 O' x 200') square feet (or square yards) of additional apron space is being constructed (including associated items like markings, lighting, signs and tie-downs). Ensure you provide the total, along with the dimensions, of the project area being constructed.
Install PAPls - Precision Approach Path Indicators (PAPls) are being installed as a result of a Part 139 certification initiative to provide vertical guidance on opposite runway ends that have an ILS.
Ensure flight inspection and PAPI certification costs are included in an ATO Reimbursable Agreement (RA). Submit a copy of the RA or Draft RA to the ADO.
Runway Edge Lights - The existing medium intensity runway lighting (MIRL) system is 25 years old and has outlived its useful life. Frequent repairs are required to maintain the lighting system. A new system is necessary to maintain a reliable system.
Revenue Producing Projects (hangars, fueling facilities} - Revenue producing facilities, such as fuel farms (AV-GAS or jet) and hangars (60' x 80') (ensure you provide the dimensions of the building).
It is important to note that a project for a revenue-producing facility will not be approved if the airport's CIP shows unmet airside needs, penetrations to approach surfaces (identified on the 5010 Airport Master Record), or projects that rely on discretionary funding or state apportionment in the succeeding 3 years. Prior to submittal, please consult the ADO on eligibility of the project. New leases may require additional Compliance review.
General Aviation Terminal.:. GA terminals are eligible for construction using nonprimary entitlements.
GA terminals are limited to meet the basic needs of public users unless sufficient justification for additional area is approved. (Ensure you provide the dimensions of the building.) Wildlife Fence - The USDA or qualified wildlife biologist has identified deer as a potential threat to aircraft operations. The installation of a wildlife fence is necessary to keep animals from entering aircraft operations areas. Attached is documentation from the USDA or qualified wildlife biologist supporting the need for a wildlife fence (see Order 5100.38 for required documents). (Ensure you provide the dimensions of the fence (length and height) and sketch of location.

Per 49 USC§ 47106(c), any airport project funded with AIP funds requires an environmental finding (Categorical Exclusion, Finding of No Significant Impact, or Record of Decision) prior to initial programming.
The requirements for environmental findings are included in the current version of FM Order 5050.4, National Environmental Policy Act (NEPA) Implementing Instructions for Airport Projects. 5 - Construction Safety Phasing Plans (CSPP)/Airspace
The most current version of Advisory Circular 150/5370-2, Operational Safety on Airports during Construction, outlines when a sponsor is required to submit a construction safety phasing plan. The ADO must review and approve or disapprove all required Construction Safety Phasing Plans (CSPP) in writing. This ADO responsibility cannot be delegated and is not covered by sponsor certification.
For further guidance in preparing the CSPP, please see the FM Evaluation of Sponsor's Construction Safety and Phasing Plans Funded by the AIP or PC Programs Standard Operating Procedure (SOP) located at http:// www.faa.gov/airports/resources/sops/.
6 - Exhibit A
A current Exhibit A (airport property inventory map) must be on file with the ADO. The primary intent is to identify all land that is designated airport property and to provide an inventory of all parcels that make up the airport. An Exhibit A must be included with each application unless there has been no change in the Exhibit A since the last AIP project and/or last Exhibit A submittal. If there has been no change, the previous Exhibit A must be referenced within the grant application (Part 111, Section E - Remarks). New airports receiving a grant for the first time must submit an Exhibit A depicting the land required to support the facilities needed to operate the airport.
7 - Airport Layout Plan (ALP)
Proposed projects must be clearly and accurately depicted on a current FM-approved Airport Layout Plan.
For AIP projects that impact the Airport Layout Plan (ALP), the sponsor must obtain an FM airspace determination for the Updated ALP. This stems from two requirements found in 49 USC§ 47107(a)(16). The first requirement is that the sponsor must maintain a current ALP. The second is that the sponsor must not make an alteration to the airport unless the ADO has determined that it will not adversely affect the safety, utility, and efficiency of the airport.

14 ADO Issues Grant Offer (GO) to Sponsor. After Grant Announcement & If Ready "Required with Application" Instructions
1 - Project Schedule
In addition, the sponsor must develop a realistic project schedule that will ensure that the grant can proceed in a timely manner. The sponsor must coordinate this schedule with the ADO upon ADO request. The schedule must set realistic sponsor deadline dates for key steps in the grant process because a sponsor's failure to com lete these steps in a timel manner may seriously impact or delay project funding (see attached form). atlJ.
Application for Development Projects (Part II through IV) (FAA Form 5100-100) FM Form 5100-100 must be submitted for all projects.
This form provides supporting grant information such as the source of the sponsor share, detailed cost estimate, and confirmation that items such as coordination with on airport users has been accomplished.
Application for Planning Projects (Parts II through IV) (FAA Form 5100-101) For planning projects, sponsors can submit FM Form 5100-101.

Standard Operating Procedures
The FM Review and Approval of an Airport Improvement Program (AIP) Grant Application Standard Operating Procedures (SOP) was signed and is effective October 1, 2015.
You can find the SOP at http://www.faa.gov/airports/resources/sops/. The SOP will assist in completing the Application.
Project Cost Breakdown
Form 5100-100, Budget Information - Construction, is an outline of the cost components of the grant. Include all items that the grant is funding (engineering, environmental, construction, etc.).
Updated
September 2019
Project Sketch
Sponsors must provide an 8 ½" x 11" or larger sketch for each of the projects. The project sketch is used to identify the project as described in the grant application description.
If multiple construction items are part of the project (runway, apron, etc.), make sure they are identified on the project sketch and are detailed enough to determine eligibility.
Ensure that all project components shown in the sketch are on the approved airport layout plan (ALP); and, furthermore, all aspects of the project(s) have been reviewed and approved within the applicable environmental finding.
A typical sketch for the above cost summary sample would look like the figure below:

3 - Form 5100-100 - Program Narrative {Justification)
Please include answers to the following questions in your justification for each project in the Grant:
1. What is the project? (Please provide a separate narrative for each project item in the Grant.) a. If a construction project, is the project rehabilitation or reconstruction? b. If rehabilitation, what type ofrehabilitation?
c. If pavement, include PCI or each pavement branch and pavement condition explanation. d. Provide dimensions of all construction area in feet for runways, taxiways, and square yards for aprons.
2. Why is the project being done? (Why is the project needed now?)
The existing apron l.§__ 12 years old and the number of based aircraft have increased from 12 to 34.
Revenue Producing Projects (hangars, fueling facilities) - Revenue producing facilities, such as fuel farms (AV-GAS or jet) and hangars (60' x 80') (ensure you provide the dimensions of the building).
General Aviation Terminal.: GA terminals are eligible for construction using nonprimary entitlements.

2019 Page 5 of 6
4 - Environmental
Per 49 USC§ 47106(c), any airport project funded with AIP funds requires an environmental finding (Categorical Exclusion, Finding of No Significant Impact, or Record of Decision) prior to initial programming.
The requirements for environmental findings are included in the current version of FAA Order 5050.4, National Environmental Policy Act (NEPA) Implementing Instructions for Airport Projects. 5 - Construction Safety Phasing Plans {CSPP)/Airspace
For further guidance in preparing the CSPP, please see the FAA Evaluation of Sponsor's Construction Safety and Phasing Plans Funded by the AIP or PC Programs Standard Operating Procedure (SOP) located at http:// www.faa.gov/airports/resources/sops/.
If there has been no change, the previous Exhibit A must be referenced within the grant application (Part Ill, Section E - Remarks). New airports receiving a grant for the first time must submit an Exhibit A depicting the land required to support the facilities needed to operate the airport.
7 - Airport Layout Plan {ALP)
Proposed projects must be clearly and accurately depicted on a current FAA-approved Airport Layout Plan.
For AIP projects that impact the Airport Layout Plan (ALP), the sponsor must obtain an FAA airspace determination for the Updated ALP. This stems from two requirements found in 49 USC § 47107(a)(16). The first requirement is that the sponsor must maintain a current ALP. The second is that the sponsor must not make an alteration to the airport unless the ADO has determined that it will not adversely affect the safety, utility, and efficiency of the airport.

PROJECT: Design Aviation Fuel Facility Replacement
AIRPORT: (032) Reedley Municipal Airport
1. Objective:
0MB CONTROL NUMBER: 2120-0569
0MB EXPIRATION DATE: 12/31/2026
This project will include the design of three above-ground storage tank systems (one 12,000-gallon Jet-A AST; one 12,000-gallon 1 00LL AvGas AST; and one 12,000 gallon Unleaded AvGas AST). The proposed facility will accept fuel pumped from over-the-road supply vehicles, and will provide for self-service dispensing of fuel into aircraft over-wing via an interface with a card reader system. Concrete tank foundations will also be included.
This project will also include the closure and removal of the two existing underground storage tanks (USTs).
2. Benefits Anticipated:
The existing fuel tanks are aging and requiring continuous maintenance of the tanks which is costly. Modern fuel farms are designed to meet stringent safety and environmental standards, reducing the risk of spills and other hazards. This ensures compliance with current regulations and enhances overall airport safety.
3. Approach: (See approved Scope of Work in Final Application) This project will be completed through a traditional design contract. C&S Engineers, Inc. of Sacramento, CA will serve as the City's consultant to lead this effort. The design is anticipated to be completed January 2026, and bidding is anticipated to be completed by March/April 2026.
A copy of the design scope and fee is attached following this page.

SCOPE OF SERVICES
Design
C&S will provide the necessary engineering disciplines to design the features noted above. We anticipate aviation, environmental, site/civil, structural, mechanical, and electrical engineers will be required. We propose the following design services:
1. Kickoff Meeting: Up to three C&S representatives will attend a project kick-off meeting and site visit. The meeting will be to confirm the project scope and City's expectations. The site visit will be to gather existing information. Additional site visits may be required and will be determined based on scope needs. Additional meetings with the greater project team and / or jurisdictional agencies will be via conference calls.
2. Survey: C&S will subcontract the services of a licensed land surveyor and underground utility locating firm to provide a topographical survey as a base plan and clear proposed boring locations.
3. Geotechnical: C&S will subcontract a firm to complete a geotechnical investigation (structural).
In order to determine the suitability of existing soils for structural and seismic purposes in the location of the proposed fuel facility, we assume two borings up to 50-ft deep.
4. Geoenvironmental: C&S will subcontract a firm to complete a geoenvironmental investigation.
In order to determine the presence or absence of petroleum impacted/ contaminated soil in the existing fuel facility area, C&S will implement a one-day boring program to advance up to six borings to estimated depths of 16 to 20 feet below ground surface. Soil/fill from the borings will be assessed in the field for visible impairment, olfactory indications of impairment, and total volatile organic compounds (VOCs) using a photoionization detector (PIO). Up to 18 soil samples will be submitted to a certified laboratory and analyzed for VOCs and semivolatile organic compounds (SVOCs).
5. Due Diligence: C&S will investigate permits, approvals, and notification requirements required for construction.
6. Conceptual Design: C&S will generate up to two conceptual designs of the proposed fuel facility showing the layout of major equipment items and connections. For this item, we will include recommended equipment catalog cut sheets. We will submit the design and facilitate a virtual meeting to review the design and solicit input.

TITLE: ADOPT RESOLUTION NO. 2024-078, A RESOLUTION OF THE CITY

ACCESSORY DWELLING UNIT STANDARD PLANS PROGRAM AND

SUBMITTED: Rodney L. Horton /)\ L

RECOMMENDATION
Adopt Resolution No. 2024-078, a Resolution of the City Council of the City of Reedley creating a pre-approved accessory dwelling unit standard plans program and directing staff to further implement the program.
BACKGROUND
For the last ten years, the California Legislature has passed over 1,000 housing laws. Many of the laws are unfunded requirements that local jurisdictions must implement in an effort to increase the production of housing units. As such, the California Legislature passed Assembly Bill 1332 (California Government Code Section 65852.27) during the 2023 legislative cycle.
This law requires local jurisdictions to develop a streamlined approval process for accessory dwelling units by offering pre-approved standard plans for the construction of such units.
To be compliant with the requirements of Assembly Bill 1332, staff is recommending accepting and adopting pre-approved accessory dwelling unit standard plans from the City of Visalia, the City of Kingsburg, and the City of Los Angeles, subject to compliance with Title 10 of the Reedley Municipal Code (Zoning Code). Assuming the permittee does not make changes to the plans, the pre-approved standard plans from the cities mentioned above will not require additional plan review, and will allow Building Division staff to expeditiously approve the permit application.
Staff is requesting authorization to further implement the program by engaging with local draftspersons, architects, engineers, and design professionals to add an additional prePage 1 of 2 approved standard plan for accessory dwelling units. The additional pre-approved standard plan(s) will be specific to the City of Reedley. Adopting Resolution No. 2024-078 ensures that the City of Reedley will meet the requirement of AB 1332 by the compliance deadline of January 1, 2025.
FISCAL IMPACT
There is no negative fiscal impact to the City. There is no cost for accepting the pre-approved plans from the cities mentioned above. Building permit costs and design will be borne by the permit applicant.

RECOMMENDATION
Staff recommends that the City Council approve the introduction and first reading of Ordinance No. 2024-009, an Ordinance of the City Council of the City of Reedley amending Chapter 4 of Title 9 of the Reedley Municipal Code concerning building regulations of lighting fixtures.
BACKGROUND
Ordinance No. 2024-009 amends Section 9-4-4-E to clarify performance standards for outdoor lighting on all structures. Currently, the zoning code limits the regulation of outdoor lighting to new construction. Additionally, the property maintenance standards provides for standards on security lighting of vacant property. Staff discovered that the property maintenance standards for outdoor lighting on occupied buildings is limited to operating in a safe manner and being maintained in a good working condition.
The first recommended change to the property maintenance standards require outdoor lighting fixtures be directed downward or toward onsite structures. This change is recommended to help prevent glare and or light to trespass onto adjacent properties. The second recommended change is to prohibit lighting fixtures from being operated in a manner to pose a safety threat to the general public.
FISCAL IMPACT
There is no negative fiscal impact to the City.
PRIOR COUNCIL ACTIONS
On September 10, 2024, City Council adopted Ordinance No. 2024-003, an Ordinance of the City Council of the City of Reedley pertaining to adding Chapter 4 of Title 9 to the Reedley Municipal Code, relocating the Property Maintenance Standards Chapter in its entirety from Chapter 16 of Title 10 to Chapter 4 of Title 9, and deleting Chapter 16 of Title 10.

INTRODUCTION OF ORDINANCE NO. 2024-010 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REEDLEY AMENDING SECTION 1-5-9 OF CHAPTER 5, OF TITLE 1 OF THE REEDLEY MUNICIPAL CODE
INCREASING COMPENSATION FOR COUNCIL MEMBERS PURSUANT TO GOVERNMENT CODE SECTION 36516
APPROVED: Nicole R. Zieba / 1_ ~ City Manager vvy
RECOMMENDATION
That the City Council introduce and hold a public hearing on Ordinance No. 2024-010, an Ordinance of the City Council of the City of Reedley amending Section 1-5-9 of Chapter 5 of Title 1 of the Reedley Municipal Code increasing City Council salaries in accordance with Government Code Section 36516.
BACKGROUND
City Council stipends are established in the Reedley Municipal Code Section 1-5-9. The last time this Code was amended was in 1989. At that time, the stipend for Council was set at $150 per month.
State law governs the maximum amounts that can be set for cities, based on population. The last time that law was amended was 1984. In recognition of the inflation that has occurred from 1984 to present, Governor Newson recently signed into law SB 329, which amends Section 36516 of the State Government Code, increasing the cap for City Council stipends, based on size of population. The new caps are as follows:
• Up to $950 per month for cities up to and including 35,000 in population. • Up to $1,275 per month for cities over 35,000 and up to and including 50,000 in population. • Up to $1,600 per month for cities over 50,000 and up to and including 75,000 in population. • Up to $1,900 per month for cities over 75,000 and up to and including 150,000 in population. • Up to $2,550 per month for cities over 150,000 and up to and including 250,000 in population. • Up to $3,200 per month for cities over 250,000 in population.
Staff surveyed surrounding cities and found that the City of Dinuba is currently undertaking this same process to reset their stipend from $300 per month to $500 per month. The City of Kingsburg has finalized their process to move their stipends from $250 per month for Council and $300 per month for Mayor to $700 per month for all City Council including the Mayor. Other cities surveyed include Parlier, which had a stipend of $795 per month that was lowered to $500 in 2023, and Sanger at $300 per month with a $400 per month car allowance.
According to the author of SB 329, the reset of stipend recognizes that serving on a City Council requires a significant investment of time and effort for the benefit of the community. Specifically, Senator Dodd wrote:
"City Counci/members have one of the hardest jobs in California government. They deal with a wide range of issues, from street maintenance to emergency response duties. And all too often, they do this job with very little financial compensation. No one runs for City Council in order to make money. But the low levels of pay make it much harder for them to balance their careers and personal obligations with the calling to serve their community. The Legislature has not raised the base pay amounts for City Councilmembers since 1984. It's time those amounts caught up to the present economic reality, especially with the rapid increase in inflation we've seen recently. Raising the pay will also make it easier for members of marginalized communities to serve. City Councils should be reflective of the communities they represent and I believe raising their compensation is an important step to achieving that equitable outcome."
The attached Ordinance would revise the Reedley Council stipend to $500 per month, beginning in January 2025. The City Council may decide upon a higher or lower amount, as long as it does not exceed $950 per month. The $500 recommendation from staff would put the Reedley Council stipend on par with the neighboring City of Dinuba, and is close to what the stipend would currently be if it had been adjusted annually for inflation since it was set in 1989.
The Ordinance, if adopted, will return to the City Council for a second public hearing on November 12, 2024. If adopted at that time, the Ordinance would be effective 30 days from its adoption. However, according to State law, the increase in stipend or compensation of Council can only take full effect upon the commencement of the term of Councilmembers elected at the next regular Council election.
FISCAL IMPACT
Increasing the Council stipend to $500 per month would impact the General Fund by an additional $22,606 annually (this includes the additional stipend with associated Medicare and Social Security taxes that are paid on these amounts). If adopted, a budget appropriation increasing City Council compensation accounts would be included in the mid-year budget review and subsequent annual budgets.

APPROVE RESOLUTION 2024-077 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF REEDLEY APPROVING THE DATE CHANGE OF THE REGULAR COUNCIL MEETING FROM DECEMBER 10, 2024, TO
DECEMBER 17, 2024
APPROVED: Nicole R. Zieba •_A~
City Manager VVO
RECOMMENDATION
That the City Council approve Resolution No. 2024-077 calling for the December 10, 2024, regular meeting of the City Council be changed to December 17, 2024.
BACKGROUND
Each December of an election year where City Councilmembers are elected to serve the City, the City is required to approve the Certificate of Election prior to swearing in new City Councilmembers. The Certificate is provided by the County Registrar of Voters to the City after they have finalized all election matters and certify the election results.
In December 2022, the City did not receive the Certificate until just before the first regular Council meeting of December, almost missing the timeframe in which to approve the Certificate and install newly elected Councilmembers. Assembly Bill 3184 was recently passed as urgency legislation that now lengthens the time in which the County Registrar of Voters must certify election results. The Registrar now cannot certify election results until after December 3rd , and must accept signature cure forms until December 1st. These changes mean that a Certificate of Election may not be issued by the Registrar until as late as December 10, 2024. If that were to occur, it would be impossible for the City to receive the Certificate and have it ready for Council approval at the regular meeting of the City Council on December 10, 2024. Complicating matters, the Certificate cannot be approved at the second regular meeting of December, as the second regular meeting of December must be canceled because it falls on Christmas Eve. Under Section 1-5-1, a regular Council meeting cannot be held on a holiday or Christmas Eve or New Year's Eve. Due to these complications with the dates and necessary legal paperwork, staff is recommending that the City Council take action to move the regular meeting
date of December 10, 2024, to December 17, 2024. The attached Resolution, if approved, will formally change the date of the meeting.
FISCAL IMPACT
There is no fiscal impact associated with this item.
