ITEMNO: 2,
TITLE: RECOMMENDATION OF REJECTION OF CLAIM - JOSEPHINE PARAGUAS SUBMITTED: Amar Bains, Accountant A'b
APPROVED: Nicole R. Zieba. City Manager

RECOMMENDATION
That the City Council reject the claim filed by Suzanna Abrahamian Law Firm on behalf of Josephine Paraguas on March 20,2025. The claim was referred to Acclamation Insurance Management Services (AIMS) for investigation and recommendation to the City.

BACKGROUND
According to the Claim Form, on September 26, 2024, Ms. Paraguas was walking on sidewalk in front of 1526 Manning Avenue, Reedley, CA. Claimant alleges she tripped and fell due to a sunken metal cover embedded in the walkway. The fall caused injuries to Ms. Paraguas' hands and feet and the treatment is ongoing. The preliminary estimate for damages is $275,000.

Based on their investigation, AIMS concluded the loss occurred on privately owned property within the Reedley Shopping Center. As such AIMS found no evidence of negligence and/or liability on the part of the City of Reedley and has recommended that the claim be rejected.

Pursuant to Government Code Section 912.4, the City Council must act upon a claim within 45 days after receipt. If there is no official action by Council, the claim is deemed to be rejected on the last day. Denial by minute order action provides a clearly defined rejection date and allows AIMS to begin their investigation and take appropriate action to resolve the claim in a timely manner.

RECOMMENDATION OF REJECTION OF CLAIM- ELENA LOPEZ
Amar Bains, Accountant ~
Paul A. Melikian, Assistant City Manager~
Nicole R Zieba. City Manager ~

RECOMMENDATION
That the City Council reject the claim received from Elena Lopez on April 08, 2025. The claim was referred to Acclamation Insurance Management Services (AIMS) for investigation and recommendation to the City.

BACKGROUND
According to the Claim Form filed by Elena Lopez hereinafter referred to as "Claimant", on February 16, 2025, Claimant was walking to get her mail when she tripped over an uplift in the sidewalk and fell on her knees and her right palm/wrist. Claimant alleges that the fall left her with deep cuts and swelling in her knees and hands that made it difficult for her to drive. Claimant further alleges that she had previously informed the City that the sidewalks in her neighborhood needed repair and it was only some months later that the City grinded them down. Ms. Lopez is seeking $5,000 in monetary damages.

Based on their investigation, AIMS found no evidence of negligence and/or liability on the part of the City of Reedley. The City had no prior notice of the subject defect. Claimant did not specifically report the subject uplift in front of her residence when she notified the City that the sidewalks in her neighborhood had areas of concern, and the City did not grind down the subject uplift. Claimant herself has significant comparative liability for her fall as she had complete knowledge of the subject defect in front of her home well before her accident. In addition , the staff acted promptly once made aware of an issue, and repaired all areas of concern. AIMS has therefore recommended that the claim be rejected .

Approve and authorize the City Manager to sign the Summer Work Experience Program (SWEP) Agreement Form with Kings Canyon Unified School District (KCUSD) and Valley Occupational Program (Valley ROP).

EXECUTIVE SUMMARY
There are no significant changes proposed for the 2025-2026 school year within the ELP budgets and services. A primary focus will remain on enhancing professional development opportunities to support staff growth and effectiveness. The High School Intern Program has demonstrated continued success and will remain as a program option this next school year.

Program quality continues to be a key priority, with an emphasis on incorporating engaging activities, educational field trips, and vendor-provided services which supports student learning.

The City of Reedley will maintain its support during the regular school hours by providing two (2) employees at Washington Elementary and three (3) employees at T. L. Reed School. These staff members work closely with school administration to address and respond to daily operational needs. The City of Reedley is responsible for hiring, training , and on-going supervision of these employees.

Since the agreements cover the summer programs, funding to offer recreation swim opportunities to ELP has been included in the ELP MOU. The funding requested will cover costs for 12 days from July 1-17, 2025 and 11 days from June 15-30, 2026. City of Reedley Aquatics Staff are scheduled to supervise the recreation swim events.

During 2025 summer ELP, the City of Reedley accepts interns through the Summer Work Experience Program (SWEP) at both Washington Elementary and T L Reed School. This program functions differently than the ELP High School Intern Program with KCUSD being the lead agency for student recruitment, orientation, and compensation. The City of Reedley schedules these workers in the summer ELP to work along-side paid staff in support roles. 2 SWEP interns are limited to 100 hours from June 9-June 30, 2025. The City of Reedley has experienced success with this program and would like to continue serving as a placement site.

BACKGROUND
Since 2006, the City of Reedley has played a pivotal role in delivering services in the ELP at T.

L. Reed School and Washington Elementary. Over the years, these programs have evolved to align with the district's shifting priorities and funding sources, ensuring that student needs remain at the forefront of services offered.

Historically, funding for these initiatives was primarily provided through the After School Education and Safety (ASES) program. However, in the 2021-2022 academic year, the State introduced the Expanded Learning Opportunity Program (ELOP) funding. This new funding model was designed to supplement Proposition 49 ASES funding, eliminating waiting lists, facilitating transportation to and from program sites, and expanding services to include Transitional Kindergarten students. This evolution has significantly enhanced program accessibility and comprehensiveness, ensuring that a greater number of students can benefit from extended learning opportunities.

FISCAL IMPACT
Program details and budget amounts are assumed in the City of Reedley Proposed 2025-26 Fiscal Year Budget.

TITLE: PUBLIC HEARING REGARDING PROPOSED AMENDMENTS TO CERTAIN

DEPARTMENTAL FEES AND CHARGES FOR SERVICES IN THE CITYWIDE

MASTER FEE SCHEDULE (NO ACTION)
REVIEWED: Paul A. Melikian, Assistant City Manager ~
APPROVED: Nicole R. Zieba, City Manager ·

RECOMMENDATION
That the City Council hold a public hearing on proposed amendments to certain departmental fees and charges in the Citywide Master Fee Schedule as presented in the attached fee schedule, to take effect July 1, 2025. A public hearing notice was published in the Mid-Valley Times on March 27, 2025. The amended Master Fee Schedule will be brought forward for City Council consideration and approval on April 22, 2025.

EXECUTIVE SUMMARY
Staff conducts an annual review of all fees contained in the City Master Fee Schedule to ensure that services are equitably priced and costs are appropriately recovered. The attached Master Fee Schedule is categorized by the individual Departments in charge of assessing and collecting the fees. The current fee charged by the City is shown in one column along with any proposed amendments next to it. All changes are shown in bold font and italicized for ease of review. Any removal of fees has been shown in strikethrough. The attached Master Fee Schedule is intended to include all fees currently charged by the City; although in some cases a fee may not be included if it is established by the State of California or otherwise stipulated in the Reedley Municipal Code. The following discussion summarizes proposed changes to fees by category or program area in the order in which they appear in the Master Fee Schedule.

City fees are based on the actual cost of providing a wide variety of services, whether that be offering a youth sports league, conducting a building inspection, or delivering clean and safe drinking water. Services like these - and many more - are provided by City staff and supported by literally hundreds of vendors that provide materials, supplies and services to the City of Reedley such as electricity, fuel, repairs, software, equipment and office supplies. The high inflation experienced in the national and local economy over the last several years have increased costs, sometimes dramatically, to the City to provide services. For those services that depend on fees (instead of taxes) to continue, the City must review if the fee continues to cover the cost of providing the service. Therefore, many of the fees proposed for revisions this year are simply being adjusted for the effects of recent and ongoing inflationary pressures.

PROPOSED FEE REVISIONS
Fire Department Fees
Most of the fees under the purview of the Fire Department are proposed to be increased by the most recent annual change in the Consumer Price Index (CPI). A new fee line item is requested for the use of the department's electric vehicle fire suppression blanket of $2,279. The fee will cover the replacement cost of this one-time use blanket plus the cost for personnel.

Fr eld Lighting
Staff proposes to increase field light fees as a result of the increase in PG&E costs. All other fees and deposits remain unchanged.

Youth Sports Late Registration
Staff continues to survey neighboring cities for their program fees. Current fees for Youth Sports are competitive, so no increases are recommended for all but one fee. An increase of $5.00 is requested for the late registration fee. This will only impact those who miss the registration window. Late registrations have a big cost impact on the program due to additional staff time to special order uniforms, update rosters and in some cases, requiring new teams to be formed.

Holidav Da~ Camps & Classes
Daily fees for holiday day camps and Paint Night fees are proposed to be increased by more than the CPI increment to capture the significant increase in the direct cost of food and supplies.

Senior Activities

Staff :recentry co pleted a 1ve-year finandal forecast for the Airport Enterprise Fund, Hangar fees - the primary source o-f opera ing revenue for the airport - have simply not kept pace with •operating costs.

Although fees for tie -downs, shade covers and City-operated -rcraft angar.s. have conslsten ly bee adjus, ted for -h•e official percentage change to the Consumer Price rndex (CPI), actuai inflationary increases t,o airport operating oosts have grown considerably faster. As a resu:lt. sta are pro po-sing to Increase most airport storage fees by approximately 10% effecUve July 1st Staff recently pr.esented this set a,f circumstances to the Airport Commission, and hey concur with the recommended fee increase_ It is important to highlight that this increase will not completely address the structural deficit. Staff plans to revisit the forecast next year to determine how much of an additional adjustment is needed before reverting to the traditional CPI increases.

Staff also survey hangar and tie down fees charged by nearby airports. Reedley currently enjoys strong demand for its hangars with a waiting list. Lastly, staff is recommending to increase the deposit amount for hangars and tiedowns to $500. Currently the deposit is equal to one month's rent.

Communjty Devel1opment Services
Staff propose to remove the fees related to notary services because it is actually a duplicate fee since it is already part of the document preparation process. Also recommended to be removed is the Accessory Dwelling Unit fee since this process is done through the zone clearance process; therefore, a separate fee is not needed. A minor text change noted to an existing fee is the name change under the Entitlements section from "Change of Zone" to "Rezone."
A new fee of $2,500.00 is proposed to recover the staff time associated with review of an environmental analysis provided by an outside party. In the interest of time, the property owner/developer can perform their own environmental analysis, and this fee is to cover the staff time necessary to ensure the analysis meets all environmental land regulatory requirements.

Lastly, a new series of discounted (subsidized) fees are proposed to incentivize development of properties located on G Street, between 91h and 13th streets, whereupon specific fees for an Administrative Review, Conditional Use Permit, Master Sign Application, and Site Plan Review are only charged 10% of the normal fee for these items. As an exampls, a new Site Plan Review is currently $3A00 which fully recovers the average cost to provide this service. Eligible properties in the downtown area would now be charged $340.00. The average annual cost to conduct a Site Plan Review will still be $3,400; however, the difference will reflect a policy decision of the City to subsidize development in this specific zone.

Peveloement lmoact Fees
Development Impact Fees (DIF) fees are now adjusted each year based on the inflation factor which is the Annual All Urban Consumer Price Index for the San Francisco-Oakland-Hayward, CA area. This is the same CPI index that is used by many other City fees, and the annual adjustment helps to mitigate large increases to fees when a new fee study is conducted several years from now.

DIF are due at the time a Certificate of Occupancy is issued and are used to fund capital improvement projects, expanded infrastructure and new equipment that is needed to accommodate the new development. The i·ntent of Development Impact Fees is to en -ure that new development pays Its fair share for impacts imposed on the City's public facilities. In June 2022, the City Council adopted a new Development Impact Fee Study which resulted in adjustments to Development Impact Fees that had last been revised in 2015.

Engineering Services
Two new fees are being requested for expedited plan checking fees for new development. Engineering staff reviews improvement plans for commercial/single family residential projects along with subdivision/parcel map projects. The turnaround time for these reviews is anywhere from 60-90 days. If developers request that these reviews be expedited and staff do not have the capacity to do so, the dep.artment can arrange to have a con ultant review these plans , The fees would cover the h gher costs needed for the consultant to complete plan checks on an expedited timeline. Lastly, an approximate 4% increase is proposed to all other fees following the combination of the annual change in CPI and an increase in fully burdened holirly rates for department staff Police Fees
The addition of a Subpoena Fee would allow for reimbursement for an officer who is subject to testify in a non-criminal case . The $275.00 fee would cover staff tirne, the backfill of an officer (or overtime rate) and travel expenses if needed

Page 3 of 5 ends

Staff is also proposing to add several Animal Control fees to memorialize services that have been informally provided over the years, and allow for appropriate cost recovery of staff time, increases in food cost in the shelter, vaccinations, and housing costs. One example is the fee for Emergency Animal Pickup for $100.00. On rare occasions, owners request to pick up their animals after hours when the City's Animal Control Officer has to be called out as an overtime expense. Another example is the Spay/Neuter fee of $125.00. This fee, although rarely used, would be to assist someone who would like to have their pet spayed/neutered but perhaps does not have the means to transport the animal to a veterinarian.

All other department fees remain unchanged.

Water Utility Rates
In 2024, a water rate study was performed by HOR Engineering group and the results concluded that due to high inflation and substantial increases in operational costs, water rates would need to be increased in order for the water enterprise fund to remain solvent. The City Council passed Resolution 2024-050 which previously authorized spreading the necessary rate increases over two years, followed by CPI adjustments in the subsequent years. Rates were increased July 1, 2024, and the second increase is scheduled to be effective July 1, 2025.

Wastewater (Sewer) Utility Rates
Per California State law, the City's utility rates must be established through a comprehensive study of the City's operations and costs . The established rates cannot exceed the actual cost of providing water and wastewater services. After rates are established, the City must keep pace with new unfunded State mandates, rising costs to water operations in order to keep the water enterprise fund solvent, and finally, to maintain compliance with minimum debt service coverage ratios as required by the City's utility revenue bond issuances.

To keep pace with increases in cost of providing wastewater (sewer) services, the City Council adopted Resolution 2022-040 which states that wastewater rates will be adjusted annually on July 1st each year following the change in Consumer Price Index during the 12-month period of December through December of the previous calendar year. This rate was 2. 76% for December 2023 through December 2024. Pursuant to this Resolution, all monthly wastewater (sewer) rates will be increased by 2. 76% effective July 1, 2025.

The resolution was passed to help the City keep pace with rising costs and ease the need for substantial rate increases in the future.

The removal of Laboratory fees is being recognized in the Master Fee schedule for FY 2025-26. With the increase of costs to keep the Laboratory certified by the State, the City has decisioned to decertify the Laboratory. With this, the services for public testing are no longer offered. Lastly, fees for the Industrial Pre-treatment program have not been increased in over 1 O years. The increases are needed to appropriately cover staff time cost associated with conducting inspections and documentation.

Solid Waste Fees
Effective July 1, 2021, all solid waste collections and operations were privatized under a Franchise Agreement with Mid Valley Disposal, LLC. The transition resulted in a significant reduction in solid waste rates to Reedley residents and business owners. Under the terms of the existing Franchise Agreement, rates were lowered and fixed for the first two years of the agreement which resulted in Reedley's solid waste rates being among the lowest in the region.

The franchisee is now entitled to a cost-of-living adjustment to rates similar to water and wastewater rates.

At the time the Franchise Agreement was developed, staff limited annual increases to not exceed 5.0% unless specific approval is sought and granted by the City Council. Annual inflation above 5.0% is banked for application to rates in a future year.

Page 4 of 5 ends

Re turn to TOC ·-: ==

As previously stated, the 12-month annual change to the Consumer Price Index from 2023 to 2024 was

2.76%, so a rate increase of 2.76% is scheduled for July 1, 2025. Even with this increase, Reedley's solid waste rates will remain among the lowest in the region .

BACKGROUND
The annual review of fees is a key component to maintaining financial control, equitably pricing services and offerings, and identifying core programs, facilities, and services for an agency. A regular review of fees usually avoids the large increases to fees necessary when it is discovered years later that a particular fee or group of fees is not meeting cost recovery targets.

When reviewing City "fees, it Is important to understand who is benefrting from a specific servtce to determine how that service should be paid for. The basic premise used by many agencies is that the higher the benefit is to an individual from a City service, the higher the cost recovery ratio should be; and the more service benefits the community as a whole, the lower the cost recovery ratio should be (or in some cases no fee at all).

It is also impontan to note that reviewing the fee schedul:e does not always mean fees wi .I be increased. lni .s.o e oases, fees are rec, ommended to be lowered ibecause the cost of providing a particular service has fallen due to operating efficiencies. In other cases, indiv•idual fees may be lowered o bring, them in line with fees for comparable services or completely r,emoved becat1se the service is no longer provided, And finally, revisions may take the form o text ch,;1.nges to how a fee ls prese te.d in the doc ment; either to clarify its purpo,.se or specify po,licies affecting coUectlon of the fee.

The attached schedule is a compilation of current fees charged by the City for services and products provided by the City and is referred to as the Master Fee Schedule. The Master Fee Schedule is posted on the City website for easy public and staff access. A best practice of municipal governments is to review all fees on an annual basis and publish the Master Fee Schedule annually. This ensures that multiple objectives are met, such as:
• The Council and public are informed and can participate in the fee review process; • Cost recovery ratios for specific fees are reviewed;
• Changes in constituent use and/or demand for services is reviewed annually; and • Additional revenue from fee revisions can be quantified and built into the following year's budget to offset increasing or decreasing costs of providing certain services.

FISCAL IMPACT
The majority of the revised fees will generate additional revenue to the City to offset the increased costs of providing those services . If approved as proposed, the anticipated level of new revenue for each service/operation will be incorporated into the FY 2025-2026 Proposed Budget.

TITLE: RECEIVE, REVIEW, AND FILE THE QUARTERLY INVESTMENT REPORT FOR THIRD QUARTER ENDING MARCH 31, 2025 FOR FISCAL YEAR 2024-25
SUBMITTED: Paul A Melikian, Assistant City Manager
APPROVED: Nicole R. Zieba, City Manager ,

RECOMMENDATION
That the City Council receive, review, and file the Quarterly Investment Report for 3rd Quarter Fiscal Year 2024-25, ending March 31, 2025, as required by the City's Investment Policy last adopted on January 14, 2025. No action is required other than to receive, review, and file the report.

EXECUTIVE SUMMARY
Portfolio earnings, net of fees , for 2nd quarter ending March 31, 2025 total $1,258,798. Prior 3rd quarter net portfolio earnings for the same 12-month period one year ago were $1 ,108,219, the result of a stable cash position and improving interest earnings. This year's Adopted Budget assumed $644,925 in interest earnings for the entire fiscal year; therefore, actual earnings are about 195% of budget after the third quarter.

Interest earnings are expected to be strong in the interim; however, the City has a large number of capital projects underway and in the planning process, therefore, the treasury pool amount and corresponding interest earnings could be reduced over time. In addition, in December 2024, the Federal Reserve ('Fed') reduced its benchmark rate by 0.25 percentage points amid cooling, but persistent, inflation. The Fed has now trimmed rates by 1 percentage point since September 2024, and it is projected that they will start cutting interest rates in June 2025 and deliver a total of three quarter-point reductions to the policy rate by October. As a result, staff expects to continue earning strong interest earnings on idle public funds, though not quite at the same level as the last couple of years.

The attached investment/pooled cash report shows additional detail for cash balances by City fund. The 'treasury pool' for the City, representing the cumulative balance of all funds, totals $31 ,092,636 as of March 31, 2025, similar to cash on hand of $31,045,234 from last quarter ending December 31, 2024. The treasury pool from the same 12-month period one year ago was $30,138,302 as of March 31, 2024. The cash balances in individual City funds are at a point in time only, and do not reflect pending receivable or payable amounts.

BACKGROUND
All financial investment instruments are constantly monitored and assessed for safety, liquidity, and yield, in that order. It is important to note that the City's principal value of these investments is always secure, and the values that are being reported are the market values at a specific point in time. All investments in the portfolio are compliant with the City's current Investment Policy, and staff does not anticipate any issues regarding the City's ability to meet expenditure requirements for the next six months. (Government Code section 53646)
On January 14, 2025 the City Council approved the annual statement of investment policy. The policy includes a self-imposed, 'best practice' reporting requirement to implement a Government Finance Officers Association (GFOA) recommendation that an agency's investment policy explicitly require periodic reporting. The attached Pooled Cash Report for the end of 3rd quarter fiscal year 2024-25 shows cash balances/market value and interest earnings for every cash account and investment vehicle as of March 31, 2025. It is important to note that the pooled cash report also includes restricted funds such as American Rescue Plan Act funds , deposits in trust, funds held for groundwater treatment, and RDA Successor Agency funds. Full account statements for all accounts are on file with the Administrative Services Department and available for inspection at any time.

Cash balances are pooled for investment and banking purposes, as it is not practical to have separate investment accounts for each City fund. Interest earnings are apportioned to each City fund based upon the percentage that a particular fund balance makes up of the total. For instance, if the City's General Fund balance was 10% of the total cash balances of the City, it would be credited with 10% of the investment interest earnings for the period.
