TITLE: APPROVE AND AUTHORIZE THE CITY MANAGER TO SIGN ADDENDUM NO. 2 TO THE NON-EXCLUSIVE LICENSE AGREEMENT BETWEEN

RECURRING FOOD TRUCK EVENTS WITHIN THE CITY OF REEDLEY

RECOMMENDATION
Approve and authorize the City Manager to sign Addendum No. 2 to the License Agreement between Fresno Street Eats and the City of Reedley to provide recurring food truck events within the city of Reedley.
BACKGROUND
The first food truck event, now known as Reedley Street Eats, occurred on August 18, 2022 in Pioneer Park. The City subsequently entered into a license agreement with Fresno Street Eats to hold these monthly events at Pioneer Park. The current license agreement expires on October 1, 2025, and an addendum to the existing agreement is needed to extend the agreement termination date. Staff is proposing to extend the license agreement to October 1, 2027. Events will be held on the last Friday of every month, unless extenuating circumstances exist.
Under the agreement, Fresno Street Eats is required to acquire an annual business license, provide a certificate of insurance, and to provide a site plan and security plan to the Chief of Police to review and approve should a beer garden be incorporated in any of the events.
ENVIRONMENTAL FINDINGS
Staff has conducted a review and has determined that it is exempt from CEQA pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15061 (b)(3) under the common-sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Because the proposed action is for Council to approve an agreement with Fresno Street Eats for the purposes of providing recurring community events, it can be seen with certainty that there is no possibility that approving an addendum to an existing agreement with Fresno Street Eats will have a significant effect on the environment. Therefore, this action is exempt from CEQA pursuant to CEQA Guidelines Section 15061 (b)(3).
FISCAL IMPACT
There is no fiscal impact to the City of Reedley.

RECOMMENDATION
Staff recommends that the City Council approve the introduction and first reading of Ordinance No. 2025-003, an Ordinance of the City Council of the City of Reedley amending Chapter 2 of Title 4 of the Reedley Municipal Code concerning unlawful dumping of garbage on public or private property.
BACKGROUND
Unlawful dumping goes beyond neighborhood deterioration; it is also a health and safety hazard for the public. The proposed ordinance provides a tool for code enforcement to use to discourage individuals from unlawfully dumping waste within the public right-of-way and or private property. Ordinance No. 2025-003 amends Section 4-2-2 to provide definitions for the following terms: blight, garbage, and unlawful dumping. Additionally, Ordinance No. 2025-003 prohibits unlawful dumping within the public right-of-way and on private property.
The existing language within Section 4-2-5 of the Municipal Code limits the City's ability to properly enforce on someone that is illegally dumping. Currently, the penalty for unlawful dumping starts at $50. The current penalty amount is low enough that it would not discourage someone from repeatedly dumping on public and or private property. The new ordinance penalty for violations result in an immediate $1,000 administrative citation for the first violation and any subsequent violations. Lastly, the proposed ordinance also allows the City to hold the owner of the vehicle and or trailer liable and responsible for penalties associated with illegal dumping of garbage, regardless of whether that person was the one who illegally dumped garbage.
FISCAL IMPACT
There is no negative fiscal impact to the City.

Les Travali reported a break-in at his hangar about three months ago, resulting in over $100,000 worth of equipment stolen, including a new truck. The stolen truck was recovered with $8,500 in damage, located via GPS in Orange Cove. The method of break-in involved ramming the hangar door with a quad. Les Travali questioned what the City and Airport Commission are doing to improve security, referencing issues like the old metal trash can holding the gate open and the walk-through gate handle. Director Reid described previous security upgrades: deactivating unknown gate cards, requiring agreements for reactivation, changing walk-through gate pads, repairing perimeter fences, and installing knox boxes for emergency access. Plans to address vulnerabilities include ensuring the BMX gate is closed and adding a plate behind the walk-through gate handle so it can't be opened through the fence. Staff is considering an of upgrade to a computer-controlled card system for the front gate to allow remote activation/deactivation, as the current system requires manual updates at the airport.
Discussion of a new battery-operated electric pass-through gate, gate code rotation practices, card audits, and issues with unauthorized access via the BMX. Travali proposed to add surveillance signage to deter intruders. Travali wanted confirmation about the RC fly-in event canceled ; some tenants were disappointed, others relieved that the organizers opted not to hold the event in Reedley. Director Reid shared that the City is not responsible for the break-in of the hangar and damages caused but is taking every measure to prevent this. Director Reid shared that there is a claims process that he can follow if he decides to.
