PROJECT: Construct Aviation Fuel Facility Replacement (Fuel Facility Work) AIRPORT: (032) Reedley Municipal Airport
1. Objective:
0MB CONTROL NUMBER: 2120-0569
0MB EXPIRATION DATE: 12/31/2026
This project includes three approximately 12,000-gallon aboveground storage tank (AST) systems. The proposed facility will include one AST for jet-A fuel, one AST for low lead aviation gasoline (1 00LL Avgas) with the capability to convert to unleaded Avgas in the future, and one AST for unleaded aviation gasoline (UL Avgas).
This scope includes the installation of three 12,000-gallon aboveground storage tanks , a pump and filter assembly for the Jet-A fuel tank, an electronic level and leak monitoring system, and the existing self-service fuel management system. The work also encompasses all necessary testing, system startup, and training.
2. Benefits Anticipated:
The existing fuel tanks are aging and requiring continuous maintenance of the tanks which is costly. Modern fuel farms are designed to meet stringent safety and environmental standards, reducing the risk of spills and other hazards. This ensures compliance with current regulations and enhances overall airport safety.
3. Approach: (See approved Scope of Work in Final Application) This project will be completed through a traditional Construction Administration contract. C&S Engineers, Inc. of Sacramento, CA will serve as the City's consultant to lead this effort. The design is anticipated to be completed January/February 2026, and bidding is anticipated to be completed by March/April 2026. Construction is anticipated to begin August/September 2026.
A copy of the scope and fee is attached following this page. A Bid tabulation will be submitted with the final based on bids application, anticipated to be submitted April 2026.
4. Geographic Location:
The Reedley Municipal Airport is located north of the City of Reedley, California, five miles north of the town center, in the County of Fresno.
5. If Applicable, Provide Additional Information:
CATEX approved by the FAA 08/19/2024

i. The sponsor may prohibit or limit any given type, kind or class of aeronautical use of the airport if such action is necessary for the safe operation of the airport or necessary to serve the civil aviation needs of the public.
23. Exclusive Rights.
It will permit no exclusive right for t he use of the airport by any person providing, or intending to provide, aeronautical services to the public. For purposes of thi s paragraph, the providing of the services at an airport by a single fixed-based operator shall not be construed as an exclusive right if bot h of the following apply:
a. It would be unreasonably costly, burdensome, or impractical fo r more than one fixed-based operator to provide such services, and
b. If allowing more than one fixed-based operator to provide such services would require t he reduction of space leased pursua nt to an existing agreement between such single fixed-based operator and such airport. It fu rther agrees that it will not, either directly or indirectly, grant or perm it any person, fi rm, or corporation, t he exclusive right at t he airport t o co nduct any aeronautical activities, including, but not limited t o cha rter fl ight s, pilot t raining, aircraft rental and sightseeing, aerial photography, crop dusting, aerial advertising and surveying, air ca rrier ope rations, aircraft sales and services, sale of aviation petroleum products whethe r or not Airport Sponsor Assurances (4/2025) Page 11 of 19
conducted in conjunction with other aeronautical activity, repair and maintenance of aircraft, sale of aircraft parts, and any other activities which because of their direct relationship to the operation of aircraft can be regarded as an aeronautical activity, and that it will terminate any exclusive right to conduct an aeronautical activity now existing at such an airport before the grant of any assistance under Title 49, United States Code.
24. Fee and Rental Structure.
It will maintain a fee and rental structure for the facilities and services at the airport which will make the airport as self-sustaining as possible under the circumstances existing at the particular airport, taking into account such factors as the volume of traffic and economy of collection. No part of the Federal share of an airport development, airport planning or noise compatibility project for which a Grant is made under Title 49, United States Code, the Airport and Airway Improvement Act of 1982, the Federal Airport Act or the Airport and Airway Development Act of 1970 shall be included in the rate basis in establishing fees, rates, and charges for users of that airport.
25. Airport Revenues.
a. All revenues generated by the airport and any local taxes on aviation fuel established after December 30, 1987, will be expended by it for the capital or operating costs of the airport; the local airport system; or other local facilities which are owned or operated by the owner or operator of the airport and which are directly and substantially related to the actual air transportation of passengers or property; or for noise mitigation purposes on or off the airport.
The following exceptions apply to this paragraph:
1. If covenants or assurances in debt obligations issued before September 3, 1982, by the owner or operator of the airport, or provisions enacted before September 3, 1982, in governing statutes controlling the owner or operator's financing, provide for the use of the revenues from any of the airport owner or operator's facilities, including the airport, to support not only the airport but also the airport owner or operator's general debt obligations or other facilities, then this limitation on the use of all revenues generated by the airport (and, in the case of a public airport, local taxes on aviation fuel) shall not apply.
2. If the Secretary approves the sale of a privately owned airport to a public sponsor and provides funding for any portion of the public sponsor's acquisition of land, this limitation on the use of all revenues generated by the sale shall not apply to certain proceeds from the sale. This is conditioned on repayment to the Secretary by the private owner of an amount equal to the remaining unamortized portion (amortized over a 20-year period) of any airport improvement grant made to the private owner for any purpose other than land acquisition on or after October 1, 1996, plus an amount equal to the federal share of the current fair market value of any land acquired with an airport improvement grant made to that airport on or after October 1, 1996.
3. Certain revenue derived from or generated by mineral extraction, production, lease, or other means at a general aviation airport (as defined at 49 U.S.C. 47102), if the FAA determines the airport sponsor meets the requirements set forth in Section 813 of Public Law 112-95 .
b. As part of the annual audit required under the Single Audit Act of 1984, the sponsor will direct that the audit will review, and the resulting audit report will provide an opinion concerning, the use of airport revenue and taxes in paragraph (a), and indicating whether funds paid or Airport Sponsor Assurances (4/2025) Page 12 of 19
transferred to the owner or operator are paid or transferred in a manner consistent with Title 49, United States Code and any other applicable provision of law, including any regulation promulgated by the Secretary or Administrator.
c. Any civil penalties or other sanctions will be imposed for violation of this assurance in accordance with the provisions of 49 U.S.C. 47107.
26. Reports and Inspections.
It will:
a. submit to the Secretary such annual or special financial and operations reports as the Secretary may reasonably request and make such reports available to the public; make available to the public at reasonable times and places a report of the airport budget in a format prescribed by the Secretary;
b. for airport development projects, make the airport and all airport records and documents affecting the airport, including deeds, leases, operation and use agreements, regulations and other instruments, available for inspection by any duly authorized agent of the Secretary upon reasonable request;
c. for noise compatibility program projects, make records and documents relating to the project and continued compliance with the terms, conditions, and assurances of this Grant Agreement including deeds, leases, agreements, regulations, and other instruments, available for inspection by any duly authorized agent of the Secretary upon reasonable request; and d. in a format and time prescribed by the Secretary, provide to the Secretary and make available to the public following each of its fiscal years, an annual report listing in detail:
1. all amounts paid by the airport to any other unit of government and the purposes for which each such payment was made; and
2. all services and property provided by the airport to other units of government and the amount of compensation received for provision of each such service and property.
27. Use by Government Aircraft.
It will make available all of the facilities of the airport developed with Federal financial assistance and all those usable for landing and takeoff of aircraft to the United States for use by Government aircraft in common with other aircraft at all times without charge, except, if the use by Government aircraft is substantial, charge may be made for a reasonable share, proportional to such use, for the cost of operating and maintaining the facilities used. Unless otherwise determined by the Secretary, or otherwise agreed to by the sponsor and the using agency, substantial use of an airport by Government aircraft will be considered to exist when operations of such aircraft are in excess of those which, in the opinion of the Secretary, would unduly interfere with use of the landing areas by other authorized aircraft, or during any calendar month that:
a. Five (5) or more Government aircraft are regularly based at the airport or on land adjacent thereto; or
b. The total number of movements (counting each landing as a movement) of Government aircraft is 300 or more, or the gross accumulative weight of Government aircraft using the airport (the total movement of Government aircraft multiplied by gross weights of such aircraft) is in excess of five million pounds.

28. Land for Federal Facilities.
It will furnish without cost to the Federal Government for use in connection with any air traffic control or air navigation activities, or weather-reporting and communication activities related to air traffic control, any areas of land or water, or estate therein as the Secretary considers necessary or desirable for construction, operation, and maintenance at Federal expense of space or facilities for such purposes. Such areas or any portion thereof will be made available as provided herein within four months after receipt of a written request from the Secretary.
29. Airport Layout Plan.
a. The airport owner or operator will maintain a current airport layout plan of the airport showing:
1. boundaries of the airport and all proposed additions thereto, together with the boundaries of all offsite areas owned or controlled by the sponsor for airport purposes and proposed additions thereto;
2. the location and nature of all existing and proposed airport facilities and structures (such as runways, taxiways, aprons, terminal buildings, hangars and roads), including all proposed extensions and reductions of existing airport facilities;
3. the location of all existing and proposed non-aviation areas and of all existing improvements thereon; and
4. all proposed and existing access points used to taxi aircraft across the airport's property boundary.
b. Subject to subsection 49 U.S.C. 47107(x), the Secretary will review and approve or disapprove the plan and any revision or modification of the plan before the plan, revision, or modification takes effect.
c. The owner or operator will not make or allow any alteration in the airport or any of its facilities unless the alteration1. is outside the scope of the Secretary's review and approval authority as set forth in subsection (x); or
2. complies with the portions of the plan approved by the Secretary. d. When the airport owner or operator makes a change or alteration in the airport or the facilities which the Secretary determines adversely affects the safety, utility, or efficiency of any federally owned, leased, or funded property on or off the airport and which is not in conformity with the airport layout plan as approved by the Secretary, the owner or operator will, if requested, by the Secretary:
1. eliminate such adverse effect in a manner approved by the Secretary; or
2. bear all costs of relocating such property or its replacement to a site acceptable to the Secretary and of restoring the property or its replacement to the level of safety, utility, efficiency, and cost of operation that existed before t he alteration was made, except in the case of a relocation or replacement of an existing airport facility due to a change in the Secretary's design standards beyond t he control of the airport sponsor.

RECOMMENDATION
Staff and the Reedley Planning Commission recommends that the City Council take the following actions:
A) Adopt Ordinance No. 2026-001, an Ordinance of the City Council of the City of Reedley Approving Rezone Application No. 2024-01 and Authorizing the Amendment of the Official Zoning Map of the City of Reedley
EXECUTIVE SUMMARY
Ordinance No. 2026-001 (Rezone Application No. 2024-01) pertains to the pre-zone and reclassification of approximately 18.79 acres (APN 363-070-48) from AL-20 (Limited Agricultural) to R-1-6 (Low Density Residential). The proposed zoning designation is consistent with approved General Plan Amendment Application No. 2024-01. In addition , upon annexation into Reedley City Limits, approximately 34.78 acres (APN 363-070-46) would be pre-zoned and reclassified from AL-20 (Limited Agricultural) to MOR (Medium Density Residential), HOR (High Density Residential), and RCO (Resource Conservation and Open Space) consistent with the City's General Plan Land Use Map.
The first reading of Ordinance No. 2026-001 was introduced on February 10, 2026 along with Environmental Assessment No. 2024-08, Annexation Application No. 2024-01, General Plan Amendment Application No. 2024-01, Conditional Use Permit Application No. 2024-01 and Vesting Tentative Subdivision Map No. 6331, all pertaining to the Blossom Estates project.
PROJECT DESCRIPTION
The project site is situated within the County of Fresno's jurisdiction and is currently zoned by the County as Limited Agricultural (AL-20). The proposed project includes pre-zoning approximately 18.79 acres (APN 363-070-48) into the R-1-6 (Low Density Residential) zone district. With an approved General Plan Amendment Application No. 2024-01, the proposed pre-zoning for the proposed project remains consistent with the GPU Planned Land Use and Zoning District Consistency Matrix (GPU, Table 2-4, Page 30). In addition, approximately 34.78 acres (APN 363-070-46) would be pre-zoned MOR (Medium Density Residential), HOR (High Density Residential), and RCO (Resource Conservation and Open Space) consistent with the City's General Plan Land Use Map.
Through the adoption of Ordinance No. 2026-001 and upon the completion of the annexation process, the parcel would have a R-1-6 (Low Density Residential) zone district designation.
The density range in the R-1-6 (Low Density Residential) zone district is four to eight dwelling units per acre with a minimum parcel size of 5,000 square feet. According to Section 10.10.010 of the Reedley Municipal Code, the intended purpose of the R-1-6 (Low Density Residential) zone district is to allow for a mixture of housing types and densities in newly developing and predominantly low-density residential areas of the City. These zone districts allow one-unit dwellings and encourage missing middle housing types (i.e., two-unit and three-unit dwellings), as well as complimentary human services land uses on a variety of parcel sizes. For example, public and private schools are permitted by-right within the R-1-6 (Low Density Residential) zone district.
ENVIRONMENTAL REVIEW
The City of Reedley has conducted an environmental analysis for the above-described project (Environmental Assessment No. 2024-08). The project has been determined to be a subsequent project that is not fully within the scope of the certified Program Environmental Impact Report (SCH No. 2010031106) prepared for the Reedley General Plan 2030 Update (GPU). Therefore, the City of Reedley, as the lead agency, adopted a Mitigated Negative Declaration for this project through City Council Resolution No. 2026-006 on February 10, 2026.
FINANCIAL IMPACT
The project applicant has paid all applicable entitlement application fees. The Fresno Local Agency Formation Commission annexation application and processing fees will also be paid by the applicant.

RECOMMENDATION
Staff recommends that the City Council of the City of Reedley adopt Resolution No. 2026-008 approving and authorizing the City Manager to execute the purchase agreement and sign the grant deeds on behalf of the City of Reedley to accept street right of way and temporary construction easement from one property owner related to the Jefferson Elementary Safe Routes to School Project.
EXECUTIVE SUMMARY
The Jefferson Elementary Safe Routes to School Project (Project) is scheduled to begin construction in the spring/fall of 2026. The project will install sidewalks and curb ramps along Jefferson, Washington, Lincoln, Columbia and Sunset Avenues where there are currently no sidewalks or curb ramps. There will also be installation of alley approaches and replacement of some driveway approaches. The project fronts a total of one hundred nine properties. Of those properties, fourteen have required the acquisition of right of way (ROW) and twelve require temporary construction easements (TCE).
The City Council has approved these as the agreements have been negotiated. Bender Rosenthal, the City's right of way agent, has met and negotiated with the property owners of one of the last two parcels to acquire and they agreed to a total compensation equal to $900 for ROW to be dedicated for street purposes for the installation of curb ramps as well as TCE during construction. There was one additional property from which the City was not able to acquire the required ROW, as multiple attempts to contact the property owner were unsuccessful; so the ramp was redesigned to stay within the existing right of way, therefore this is the last request that will be brought before council.
BACKGROUND
The City of Reedley received an Active Transportation Program grant for the Jefferson Elementary Safe Routes to School project that includes Lincoln Avenue from East to Pecan Avenues, Washington and Jefferson Avenues from East to Columbia Avenues and Sunset and Columbia Avenue from Dinuba to Duff Avenues. The project is scheduled to begin construction in the summer/fall of 2026, pending acquisition of ROW and funding authorization from Caltrans, and is anticipated to be completed by early 2027.
The project will install sidewalk, curb ramps, alley approaches and minor driveway approaches to remove access barriers and improve student and pedestrian safety adjacent to Jefferson Elementary school. In order to construct the curb ramps, it is necessary to obtain ROW for street purposes from fourteen property owners and TCEs from twelve property owners.
The City hired right of way consultant Bender Rosenthal, Inc., to appraise the required ROW and TC Es and negotiate a reimbursement fee with the property owners.
The property information, amount of required ROW, amount of required TCE and appraised fee is shown below:
Project APN of Subject Address Amount Amount of Appraised fee Parcel No. Property of ROW TCE 1 370-201-09 675 E. Washington 72.0 SF 60.0 SF $900.00
The property owner has agreed to the offered purchase prices listed above. The owner has signed the purchase agreement, grant deed and/or TCEs. Staff is requesting that the City Council grant authority to the City Manager to sign all required documents, execute the agreement, and disburse to the property owner the amount agreed to in the purchase agreement. Staff will then work with Bender Rosenthal, Inc. to record all necessary documents with the County of Fresno Recorders office and update all City maps to show the newly acquired street right of way.
This is the last request for property acquisition for the project.
FISCAL IMPACT
The agreed to amounts shown in the purchase agreement and Bender Rosenthal's fee for performing their work are eligible fully for reimbursement from state aid funds for this project.

ADOPT RESOLUTION NO. 2026-009 REVISING THE MUNICIPAL UTILITY
BILLING & COLLECTION POLICY TO INCLUDE A NEW UTILITY PAYMENT
OPTION AND CLARIFY CURRENT PROCEDURE TO ENSURE CONTINUING COMPLIANCE WITH SENATE BILL 998 (2018)

Nicole R. Zieba, City Manager~
RECOMMENDATION
It is recommended that the City Council adopt Resolution 2026-009 revising the City's Municipal Utility Billing & Collection Policy, to include a new utility payment option (kiosks) and clarify current procedure to ensure continuing compliance with requirements set forth in Senate Bill (SB) 998 that became effective February 1, 2020.
BACKGROUND
California Senate Bill (SB) 998, Discontinuation of Residential Water Service, known as the Water Shutoff Protection Act was signed into law September 28, 2018 that required all public water systems with more than 200 service connections provide certain notices and options be given to customers before residential water service may be terminated for nonpayment of a delinquent account. The implementation of the requirements of SB 998 required significant changes to the City's utility billing and water shutoff practices, which were adopted by the City Council on January 14, 2020 with the establishment of a Municipal Utility Billing & Collection Policy.
Staff recently completed a review of the policy for any necessary revisions, resulting in several minor revisions to update available payment options, and to clarify current procedure to ensure that the policy continues to comply with statute. The revisions primarily serve to recognize the new payment kiosks located at City Hall and Community Center, and further integrate existing utility billing and collection practices into the policy into a clear and transparent document. The attached revised policy shows all proposed revisions in bold italic font.
FISCAL IMPACT
There is no additional fiscal impact to the City or change to existing utility billing and collection practices by adopting a revised Municipal Utility Billing & Collection Policy.

This written policy consolidates and summarizes various City of Reedley Ordinances, Resolutions and practices into a single document designed to advise municipal utility customers about current regulations. It is intended to provide as much information as possible on existing practice, but should not be considered as inclusive of all municipal service regulations as governed by Reedley Municipal Code and the State of California. Municipal utility services include water, wastewater (sewer) and solid waste (trash, recycle and green waste). The City's Administrative Services Department is responsible for customer accounts and is located at City Hall, 845 G Street, Reedley, CA 93654. Customer service representatives may be reached by calling (559) 637-4200 extension 218 during normal hours. Voicemail messages left during non-operating hours will be addressed by a customer service representative on the first available normal business day. E-mail correspondence may be sent to [email protected] and will be addressed by a customer service representative on the first available normal business day.
Section 1: Utility Service
Water and Sewer service shall be dependent upon connectivity status to municipal services (private water well and/or septic tank vs city connections). Solid Waste disposal service provided by the City or the City's authorized contractor is mandatory for each resident and business except for those industrial businesses who receive an exemption from the City and for governmental agencies who choose to exercise their exempt status from local government regulation. (RMC 4-1-3)
Section 2: Establishing New Service
Before utility service shall begin, a signed application along with supporting documents as identified on the utility application must be presented by the person(s) who will be financially responsible and any associated fees (as approved by the City's Master Fee Resolution) and account deposit, if applicable, must be paid. Tenants requesting utility service shall pay a deposit equal to three (3) times the estimated average monthly bill. Property owners requesting utility service may also be required to pay a deposit if the City deems their creditworthiness to be a financial risk, which may include prior bankruptcy activity. The City reserves the right to request and require proof of property ownership or residency documentation, such as a Deed of Trust/Escrow Closing Statement for owners, and a rental agreement/lease for tenants.
The deposit shall be retained by the City until the applicant has terminated the utility account. All outstanding fees and charges will be deducted from the deposit and the remaining deposit balance, if any, will be refunded to the applicant. A good faith effort will be made to collect any outstanding charges from the applicant, up to and including transferring of unpaid balance(s) from closed accounts to active utility accounts, credit collection firms and legal action. (RMC 8-1-4)
Any person may apply to establish new service at any location in the City, provided they meet all other requirements established by this policy.
Commercial Businesses requesting utility services in the business name must have an active City of Reedley Business License. Business owners that are not the property owner requesting utility service shall pay a deposit equal to three (3) times the estimated average total monthly bill. 21 Page
Individual Real Estate Agents & Property Management Companies will be permitted to obtain services in their own personal name with a government-issued identification/driver's license, and social security card, application fee and deposit.
Real Estate Investors. Companies or individuals engaged in real estate investment activities (i.e. purchasing, renovating and selling) requesting services must have an active City of Reedley business license. Such companies and individuals are eligible for a deposit waiver when they present required ownership documentation that matches the Business license on file (or being filed).
Credit Risk/Insufficient Identification. Businesses or individual customers who are deemed to be a credit risk to the City or do not furnish adequate identification documentation will be required to pay a deposit equal to four (4) times the estimated average total monthly bill. A prior bankruptcy filing that resulted in uncollectible revenue to the City may be used as a factor to determine credit risk.
Depending upon the specific circumstances at the service address and availability of City staff, the City cannot guaranty immediate access to all utilities. Typically, access to new services occurs within 48 hours of a completed application process.
Section 3: Utility Billing Cycle, Due Dates & Rates
Rates and fees for water, sewer and solid waste services are established by the City Council and are referenced in the City's Master Fee Schedule which is posted on the City's website at reedley.ca.gov. Customers utilizing City water service will have a water meter at their residence or place of business. The water meter consumption, or usage, is typically obtained on the 12th of the month and reflects an average 30-day cycle of use. Some consumption cycles may reflect fewer days due to short months, holidays and staffing levels. The monthly water consumption amount will also be used for customers who have a metered sewer rate charge.
Utilities are billed on a monthly basis at the first of each month with current base rate flat charges being assessed for the billing period, and consumption charges reflecting the actual cost for a prior timeframe. As an example, the billing period for June pt through June 30th will be created, dated and mailed or e-mailed on or before June ist. The current period charges will reflect base rate fees for the month of June and consumption charges for the approximate period of April 15th through May 15th .
Account aging will be reflected as Current Charges, 30 Day Past Due Charges, 60 Day Past Due Charges and 90+ Day Past Due Charges. This equates to Current Month Billing Cycle, Prior Month Billing Cycle, two (2) Months Prior Billing Cycle and three (3) or more Months Prior Billing Cycle.
Utility accounts are expected to be paid in full no later than six (6) days from the billing date to be considered in good standing (RMC 8-1-10 A). The published due date shall be the 6th day of each month by midnight PST.
Online payments must be received and posted on the utility record by this deadline. Late fees will not apply until an account is more than 60 days past due from the billing date. 3I Page
Section 4: Limits of Responsibility
The City of Reedley makes every effort to mail, e-mail, deliver and post all monthly billings, reminder notices, delinquent notices, and shut-off notices to the account holder and occupant in accordance with Reedley Municipal Code and California legislation . The City of Reedley is not responsible for lost, undeliverable or stolen bills and notices resulting from the United States Postal Service, invalid e-mail addresses, spam filter settings, issues from Internet Service Providers or interference from the public. Prompt postal and e-mail address updates are the responsibility of the account holder. The account holder is also responsible for insuring that payment is received and posted to the account by the due date and time deadline regardless of whether a bill or notice has been received or not. Time sensitive payments should be made in person or over the phone prior to any cutoff date and time, or by using the City of Reedley's online payment portal which posts payments in real-time to the utility account.
Section 5: Base Rate Fees, Volumetric Charges, Prorations, and Closing Bills Base rate (flat rate) charges for water, sewer and solid waste are billed on the pt of the month for services that will be rendered during that month. As an example, the billing dated July pt is for the period of July 1 through July 31st and will reflect current base rate charges for water, sewer and solid waste that are for the month of July. Consumption, or volumetric use charges, that are also included on the July pt bill would be in arrears and would be based upon the amount of water used during the consumption cycle of approximately May 12th through June 12th . New accounts will be prorated on a 30-day standard calculation and will be charged accordingly from the effective date referenced on the application for service. Terminated accounts will receive a closing bill that will include all consumption charges up to the date of scheduled termination, prorated base rate charges using the standard 30-day calculation, and a credit for any deposit that is being held. Closing bills that reflect a final status of money owed to the account holder will result in a refund check being issued, typically within 2-3 weeks, and mailed to the last known forwarding address associated with the utility account.
Section 6: Payment Methods
Payment of utility bills may be made in a variety of ways, outlined below:
• M ail - Customers may mail their payment using the return envelope provided with the monthly bill.
Payments should be sent to City of Reedley, 845 G Street, Reedley, CA 93654. When using this method, please submit a personal check made payable to "City of Reedley" or a money order • In Person - Customers may make payments at City Hall, 845 G Street, Reedley, CA 93654. Accepted payment types include cash, personal checks (payable to "City of Reedley"), debit cards, and credit ca rds • Kiosks - Payment kiosks are available at City Hall, 845 G Street, and the Reedley Community Center, 100 N. East Avenue. Kiosks accept debit cards, credit cards, and personal checks (payable to "City of Reedley"). Cash payments are accepted only at the City Hall kiosk • Drop Box - A secure drop box is located out side City Hall, 845 G Street, Reedley, CA 93654. Payments placed in t he drop box must be made by persona l check (payable to "City of Reedley") or money order. 4 1Page
The drop box is available 24 hours a day for customer convenience. Please note that the City of Reedley is not responsible for cash payments left in the drop box • Online through City's website - Online Payment can be made on the City's website at reedley.ca.gov The City's utility statements include a QR code in the top left-hand corner. When scanned, it directs customers to the online payment portal, where payments can be made using a debit or credit card or a checking or savings account. Some users may be required to complete a brief pre-registration process to create a secure login and password for accessing their utility account • Bill Pay through Your Financial Institution - Most major banks offer on line bill-pay services. If you choose this method, please ensure the payee is listed as City of Reedley, 845 G Street, Reedley, CA 93654. Your utility account number must be referenced for proper and timely processing; account numbers typically consist of three alphabetical characters followed by four numerical characters. Payments submitted through bank bill pay do not post immediately and may take up to five (5) business days to be received by the City. This method is not recommended for accounts that are past due, as delays may result in late fees and/or interruption of service for non-payment
• Phone - Customers may call (559) 637-4200 ext. 218 and pay by credit card . A convenience fee applies.
The amount of this charge can be found in the City's Master Fee Schedule • Paperless Billing and Auto Payment - The City offers convenient paperless billing and automatic monthly payments, both provided at no additional cost. These services are independent of each other. One-time payments may also be made through the online portal, accessible at reedley.ca.gov. Some services may require pre-registration by the account holder before activation. Automatic payments are processed on the 6th calendar day of each month. It is the account holder's responsibility to ensure that their email address and financial information remain accurate. All financial data entered through the portal is secu rely encrypted.
Section 7: Returned Payments
An additional fee will be applied to the utility account if any method of payment is not honored (e.g., insufficient funds, customer-initiated on line banking return, closed account, or denied transaction). Returned payments that were originally accepted in good faith to prevent late fees and/or service interruption will be subject to the returned payment fee and all actions that would have applied as if the payment was never received. Because all legally required service-termination notices have already been provided, no additional notice is required for the City to proceed with immediate service termination.
After two returned payments, the account holder is considered to have demonstrated a pattern of financial risk. At that point, the City reserves the right to no longer accept personal checks as a method of payment.
The account holder may be required to use cash, credit card, debit card or money order only for all future payments. This requirement will remain in effect for one full year, after which upon account holder's request, the City will review the account to determine whether personal checks may be accepted again.
SI Page
Section 8: Disconnection and Late Fees
Late fee amounts are established by the City Council and are referenced in the City's Master Fee Schedule which is posted on the City's website at reedley.ca.gov. There is no late fee or penalty assessed for accounts that are current or in a 30-day aged status. Accounts with any balance in a 60-day aged status will be assessed a $25.00 late fee and be subject to the disconnection process. Accounts that are being processed for disconnection will be subject to a $100.00 fee on the noticed date of termination if there remains any unpaid balance due.
Section 9: Procedure for Petitioning a Review of the Bill or Contesting or Appealing the Amount of the Bill City staff are available to explain the balance of a bill, how fees were assessed, and provide the account holder with a history of charges and payments. If a customer disagrees with the consumption calculation on their current bill, they should contact this office and request that a Public Works Complaint Service order be sent to the Public Works water staff to verify the most recent water meter reading and working condition of the water meter. After this step, if a customer is still in disagreement over the amount(s) billed, they may request a formal meeting, either in person or by telephone, with appropriate City staff to contest and appeal the amount of the bill. This process is only available to the customer before the account has reached the 60-day aged status. The outcome and decision by the Public Works Director or the Assistant City Manager shall be the final conclusion on the appeal. During the investigation and appeal process, water will not be shut off for non-payment until all findings have been issued. However, if a customer gives first notice to contest any amount of the bill after an account has reached the 60-day aged status, and has been slated for termination for non-payment, the appeals process will not be available to the customer until all past due charges have been paid. If the appeal process results in favor of the customer, the City shall immediately issue credit to the account.
Section 10: Deferred Payment Plan Agreement for Delinquent Balances on Residential/Multi-Family Accounts The City offers a Deferred Payment Plan Agreement (Payment Plan) for residential accounts only that have a past due balance and may be subject to discontinuation of services. The City does not offer any subsidized rate plans1 reduced rate plans1 alternative payment schedules or reduced payment schedules. If an account holder is unable to pay a past-due utility balance1 they may request to enter into a Deferred Payment Plan Agreement1 provided the request is made and the agreement is signed in person no later than the close of business day on the 6th day of the month or the next business day when the 6th falls on a Saturday1 Sunday1 or designated City holiday.
The Payment Plan, at the time of inception, will amortize the entire account balance, without any penalties or interest, over a period of 3, 6, 9 or 12 months of equal installment payments required to pay in full the delinquent balance. The repayment period is the sole choice of the account holder, and the due date of the installment payments will be the same as all future current services. The account holder will be responsible for paying, in full, the Deferred Payment Plan monthly amount in addition to the current month charges. Missed payment dates or amounts that are not paid in full by the due date will negate the Deferred Payment Plan and the account will be subject to the process of termination for non-payment. Residential service shall be discontinued no sooner than five (5) business days after the City posts a final notice of intent to disconnect service in a prominent and conspicuous location at the property. 6I Page
Only one outstanding Payment Plan will be allowed for a utility account at any given time. A copy of the signed Deferred Payment Plan Agreement will be provided to the account holder at the time of execution, and will clearly state all terms associated with the payment arrangements. Subsequent copies of the Deferred Payment Plan Agreement will be provided to the account holder upon verbal or written request.
Section 11: Discontinuation of Water, Sewer and Solid Waste Services for Non-Payment This is a summarized cycle of the City of Reedley's practice for accounts entering into a "Shut Off" status. The City reserves the right when a deadline date falls on a Saturday, Sunday or designated City Holiday to instead use the next available business day:
• Billing for current services are dated the first day of the month and distributed to the account holder • Payment for current services are due by midnight PST on the 6th of the month or the next business day when the 6th falls on a Saturday, Sunday, or designated City holiday • Reminder statements for accounts with a 60+ day aged balance are distributed to the account holder and the occupant of the physical location on or about the 3rd day of the month • Accounts that have a 60+ day aged balance after the 6th of the month at 11:59 pm PST will receive a $25.00 late fee and will be subject to the disconnection process and notice • For accounts that have a 60+ day aged balance on the ?fh of the month, a disconnection notice will be posted at the physical location that will disclose the amount owed, pending termination date, additional service charges and reinstatement process. For multi-unit complexes, City will make a reasonable, good faith effort to inform tenants of the disconnection by posting a written notice on the door of each residence
• A five (5) business-day grace period will be provided after a disconnection notice is posted before shut-off procedures begin. Multi-residential accounts, including apartment complexes, will receive a ten {10) calendar-day grace period, which includes weekends and holidays • Accounts that remain unpaid as of 8:00am on the next business day following the grace period will be assessed a $100.00 disconnection fee and will be shut off and terminated • Terminated accounts will receive a final billing for consumption used up through the date of termination.
Any deposit on file will be applied to outstanding charges. Once final billing has been processed, reinstatement of services may only be initiated through a new application process. All outstanding balances owed by the customer must be paid in full before new utility services are provided. See Section 12 for details
• An annual report on the number of discontinuations of residential services for inability to pay will be posted on the City's website
Section 12: Reinstatement of Services Following Shut-Off for Non-Payment Service reinstatement may be initiated on the day of shut-off by paying the full account balance along with the required deposit. A deposit is required because an account that has been shut off is considered delinquent. The deposit amount equals four months of the average base rate for utility services, as established in the City's Master Fee Schedule. Once the account has been closed, it cannot be reopened or reinstated. A new account application must be submitted to establish service following the termination . All outstanding balances owed by 71 Page
the customer and the required deposit must be paid in full. All necessary documentation and other applicable fees required by Reedley Municipal Code {RMC 8-1-5{E)) or the Master Fee Schedule will also apply.
Section 13: Voluntary Termination of Service
The established account holder or legally authorized person(s) must contact the City to initiate voluntary termination of service. The preferred method is either in person at City Hall, 845 G Street, Reedley, CA 93654 or by telephone {559) 637-4200 extension 218, however requests received by email may be accepted if appropriate supporting documentation is submitted that will allow verification of the account holder. A forwarding postal address must be provided at the time of termination.
The City of Reedley will take a final reading of the water meter at the physical location and the City's water valve will be turned off on the requested date. The City of Reedley reserves the right to restrict available dates and times due to scheduling and staffing constraints. The customer will receive a final closing bill for the consumption used up through the day of termination, and all base rate charges will be prorated as of the termination date. Any deposit on file will be applied to the final closing bill. If there has been an overpayment of fees reflected on the final closing bill, the City will issue a refund to the account holder that is typically processed within 2-3 weeks.
Section 14: Transfer of Service Deposit
For customers that are closing service at one location and opening at a new location, for which there is a deposit on file and a deposit required, the City will consider the transfer of deposit from the old account to the new account. Additional funds may be required from the customer to satisfy the current deposit requirement.
Consideration will only take place if all the following conditions are met: 1) the account holder's name is the same for both accounts, 2) the old utility account balance will be paid in full, and 3) the final closing bill will result in a credit balance with an overpayment refund owed to the customer.
Section 15: Unpaid Balances
Outstanding balances owed from a terminated account will be assigned and charged to an active utility account if the same customer has an account at a different location with the City of Reedley. If there is no active account, the City of Reedley will pursue all legal collection methods available to ensure timely payment. The City of Reedley reserves the right to refuse to initiate new services in the customer's name if the customer has unpaid balances from prior accounts.
Section 16: Account Holder and Occupant Privacy
California Senate Bill 998 "Discontinuation of Residential Water Service known as the Water Shutoff Protection Act" requires that the occupant of a physical address be provided with the account balance and history of charges and payments by the account holder should the account become delinquent and potentially be subject to disconnection from non-payment.

Section 17: Access to Utility Account Information

Response time is subject to staff availability.
Section 19: Water Conservation Restrictions
Approved Water Conservation Restrictions Levels (RMC 8-1-12) that are in effect will be identified on the City's website at reedley.ca.gov. These govern water waste, landscape irrigation, summer watering schedules and winter water schedules. Please refer to the Master Fee Schedule for specific rates associated with Level 1, Level 2, Level 3 and Level 4 Water Conservation Restrictions.
Section 20: Water Violations
The City of Reedley has the right to immediately shut off water to any consumer or premises if the water is being wasted or carelessly used (RMC 8-1-10 (A)). Civil violations will be issued for instances that include, but are not limited to, water waste, tampering with the City's water system, failure to comply with watering schedules, cross connection, or causing risk or adverse sanitary health conditions to the public water system.
Section 21: Average Winter Water Usage for Commercial/Industrial/Institutional Accounts Calculation of the Average Winter Water Usage (AWWU) will be 125% of the average consumption of what is billed on the customer's December, January, February, March, and April sewer bill. Customer must have consumption history with the City of Reedley for the aforementioned months. If a history is not available, then the customer will be billed per their actual consumption until the next AWWU calculation period. If a customer has O or 1,000 gallons of usage in a given month during the AWWU calculation period, those readings will not be included into the AWWU calculation. AWWU calculations will be rounded down to the nearest 1,000 gallons.
The billing for May, June, July, August, September, October, and November will be the lesser of either the calculated AWWU number or the actual consumption. Bills processed on December 1, January 1, February 1, March 1, and April 1, are based on actual consumption amounts during those billing periods, and not per an AWWU calculation. For All Commercial, Industrial, and Institutional accounts: If a separate "irrigation only" meter exists, then the AWWU calculation would only apply to the domestic meter. 9I Page
