RECOMMENDATION
Approve and authorize the City Manager to sign an agreement with Yamabe & Horn Engineering, Inc. to perform on-call professional services for the Engineering Department as needed.
EXECUTIVE SUMMARY
The Engineering Department is currently responsible for reviewing all improvement plans for development projects within the City of Reedley. To complete such activities engineering expertise is needed and familiarity with the City Standard and Specifications. Due to the complexity of development projects and the existing work load of the department the standard review time for the first submittal improvement plans is approximately 90 working days. Developers have asked if there are ways to expedite the review time and if they could pay an expedited fee to have the plans reviewed more quickly. Since the request came into the department a few times, a new fee was added to the master fee schedule in preparation for using outside consultants to perform the expedited review. The on-call consultant will only be used on an as-needed basis when developers are willing to pay the expedited fee to review the plans.
Yamabe & Horn Engineering, Inc. is familiar with municipality plan reviews as they are consultant City Engineers for nearby cities within Fresno County and have also designed projects within the City of Reedley so they are well versed with the City Standards and Specifications. In addition, they have the staff capacity as well as the expertise and certifications necessary to review and approve of improvement plans at an expedited rate. Staff desires to maintain a contract with Yamabe & Horn Engineering, Inc. for three years, allowing staff to analyze consultant performance and recommend changes to contract terms or service providers as appropriate. The review time will be billed at an hourly rate as shown in the agreement and their services will only be used when requested by developers.
In May of 2025 and February of 2026, similar contracts were brought forward to Council with two other
engineering firms to provide plan review services and both contracts were approved by Council. Staff informed Council that in the future one other firm would be brought forward for approval to perform the same services so that Staff could have multiple consultants to choose from to ensure the City could provide expedited plan reviews. As of now this is the final firm that Staff is bringing forward to perform plan review services as this gives an adequate amount of firms to select from to perform these services.
The Department desires to provide residents and developers this added expedited plan review service as an additional customer service measure. Staff does anticipate utilizing the services of Yamabe & Horn, Inc. due to consistently strong development activity projected to continue for the next few years.
FISCAL IMPACT
There is no negative impact to the City given that the costs of service are determined per-project, and are paid by the applicant needing their improvement plans approved.

TITLE: ADOPT RESOLUTION NO. 2026-012 DECLARING LISTED VEHICLE AS SURPLUS SUBMITTED: Michael Canales, Fire Chief ~
APPROVED: Nicole R. Zieba, City Manager
RECOMMENDATION
It is recommended that the City Council adopt resolution 2026-012 declaring the vehicle listed below as surplus. City policy requires the council to adopt a resolution identifying all equipment and vehicles valued over $1,000 before it can be surplused.
BACKGROUND
In September 2013, Reedley Fire Department purchased a Summit NEV cart through a Clean Air Board Grant program. Since it's acquisition, the vehicle has been utilized by the Reedley Fire Department and has provided valuable service. However, due to its age and increasing maintenance and repair needs, the vehicle has exceeded its practical usefulness for departmental operations.
The Reedley Valley ROP Program, a strong community partner, has expressed interest in utilizing the vehicle as part of its Urban Firefighting Program. Donating the NEV will allow the City to support workforce development and public safety training efforts while repurposing equipment that is no longer operationally efficient for the department.

ADOPT RESOLUTION NO. 2026-013 ESTABLISHING THE FISCAL YEAR 2026-27 RATES FOR COMMUNITY FACILITY DISTRICT 2005-01, INCREASING RATES
FROM CURRENT LEVELS BY CPI, AND SETTING DEPARTMENT ALLOCATIONS APPROVED: Nicole R. Zieba, City Manager
RECOMMENDATION
That the City Council adopt Resolution No. 2026-013 establishing the Fiscal Yea( ("FY") 2026-27 annual tax amount for properties within the Reedley Community Facilities District No. 2005-1. Staff recommends that the current tax rate be raised from the CPI instead of the maximum allowable rate, and to allocate the funds for the 2026-27 fiscal year at the existing 15% for Fire, 7 4% for Police, 9% for Parks, and 2% for Administration costs.
BACKGROUND
The Mello-Roos Community Facilities Act of 1982 allows a City to establish a Community Facilities District (CFO) to finance a variety of services. The Reedley Community Facilities District 2005-1 was established in 2005 to finance operational expenses associated with public safety (police and fire) and park maintenance. Services provided within the CFO area do not supplant General Fund activities which are established at a baseline historic spending level using 2005-06 appropriation levels.
RATES
In March 2025, the City Council set the maximum tax rate for Reedley Community Facilities District No. 2005-1 in accordance with the procedures for establishing rates in the enacting resolution. Each year, the City Council must review the percentage change in the Consumer Price Index for San FranciscoOakland-Hayward area and adopt the upcoming year's tax rates. The CPI change over the last 12 months was 2.18%, and an increase to the rates is proposed for the 2026-27 fiscal year. Per Council Resolution No. 2005-109, the proposed rates are brought forth each year for consideration of two items:
1) setting the annual CFO tax amount for the upcoming fiscal year; and 2) establishment of the allocation of revenue to City Departments for the upcoming fiscal year. The following table summarizes the tax rates adopted for FY 2025-26 and the proposed FY 2026-27 tax rates based on recommended change to the Category I tax rates. If a lower tax rate is considered, it must be universally applied to each development type within Category I within the CFO.
Current Adopted Proposed Rate
Building Type Rate (2.18% increase)
Single Family Home $1,083.32 per unit $1,106.91 per unit Multi-Family Residential $806.58 per unit $824.15 per unit Affordable Housing $546.72 per unit $558.63 per unit
Non-Residential $0.29 per square foot $0.30 per square foot Infill Non-Residential $0.15 per square foot $0.15 per square foot Undeveloped $879. 70 per acre $898.86 per acre
Under existing Council policy, each year as properties develop, they are annexed into the district. For FY 2026-27, it is anticipated that the District will serve 48 units from the property owner of parcel 370- 020-078, which has a legal settlement with the City, 1,010 single family homes, 118 multi-family units, 227 affordable housing units, non-residential properties totaling 196,195 square feet, infill nonresidential totaling 612,411 square feet and 226.13 acres of vacant land. If additional properties develop, they will also be served, and the City will levy for FY 2026-27. The projected FY 2026-27 revenue is approximately $1,717,502 based on the recommended increase to current tax rates.
Although the rate may be set by the City Council at any amount as long as it is applied uniformly within each of the two Tax Categories, staff recommends that the current rate increase by CPI, instead of the maximum allowable rate. The recommendation is based on the anticipated costs to provide services to the CFO areas, which includes those incremental cost increases for personnel costs and those that vendors pass to the City. According to the attached memos covering Police, Fire, Parks Maintenance Services, and Administration Services, the anticipated costs to service the CFO area are $1,199,430, $344,844, $135,508 and $27,757 respectively, for a total of $1,707,539. The amounts collected at the proposed rate's do not fully cover the costs of providing services. The anticipated difference of $87,219 not including prior year CFO activity, will come from the General Fund; therefore, setting the rate at less than the proposed tax rates will further impact the General Fund budget for next fiscal year.
The maximum special tax rates are to be increased every year by CPI in accordance with the Rate and Method of Apportionment that established the CFO. The City increased rates in FY 2025-26 since public services to the CFO have continued to grow and outpaced the estimated revenue every year since inception of the special district. This funding deficit has required an annual subsidy offset from the City's General Fund. For the FY 2026-27, should Category I properties in the CFO (all properties except undeveloped land) be levied at the maximum special tax rates, the remaining funding deficit to service the CFO would be less than the estimated revenue from a maximum assessment on parcels of Category II properties (undeveloped land). In other words, if CFO tax rates were increased to their maximum allowable levels for next year, the General Fund would not have to offset the funding deficit from CFO assessment revenue to cover the cost of providing police, fire and parks maintenance services.
ALLOCATIONS
The Special Tax Report establishing the CFO identified the use of CFO funds at a specific allocation amount for each service. The City Council has the annual discretion to change the amount based upon budgetary needs and requirements. The following table summarizes the prior years and proposed allocation for next year, which remains unchanged from the last five fiscal years.
Current Proposed
FY 2021-22 FY 2022-23 FY 2023-24 FY 2024-25 FY 2025-26 FY 2026-27 Fire Services 15% 15% 15% 15% 15% 15%
Police Services 74% 74% 74% 74% 74% 74%
Parks Services 9% 9% 9% 9% 9% 9%
Administration 2% 2% 2% 2% 2% 2%
Each service receives its appropriate share of the adopted revenue amount each year and that balance is restricted and carried over each year if/ when revenues exceed expenditures. The following table summarizes estimated CFO fund balances as of June 30, 2026, the estimated revenue for next year broken out by Department percentage allocations, then netting out the estimated expenses to get to the required General Fund offset.
Estimated FY 2026-27 FY 2026-27 FY 2026-27
Balance on Estimated Estimated Required General
June 30, 2026 Revenue Expenditures Fund Offset
Fire $ 378 $257,625 $344,844 $87,219
Police 2,354 1,270,952 1,199,430 0
Parks 494 154,575 135,508 0
Administration 684 34,350 27,757 0
Total $3,910 $1,717,502 $1,707,539 $87,219
FISCAL IMPACT
If the proposed rate is established, which is recommended to increase by CPI from the current year, the FY 2026-27 General Fund budget will realize an estimated expenditure relief of $1 ,717,502 for Fire, Police and Park services for parcels within the CFO boundary.

RE: Community Facilities District Projected Expenditures FY 2026 / 2027 The CFO as adopted per Resolution 2005-109 and governed by Section 53311.5 of the Government Code of the State of California (The Act) specifically states that the first priority for the funds is for fire and emergency medical services, then police and public safety, and finally park maintenance. More specifically: (i) fire protection and suppression services; (ii) emergency medical services including ambulatory services; (iii) community information with regard to public safety; (iv) earthquake and other emergency relief programs; (v) other public safety services, including police protection services, authorized to be funded under Section 53313(a) or (b) of The Act; (vi) park operation and maintenance expenses; and , (vii) repair and replacement of park facilities .
Based on current estimates, the impact on the Fire Department to provide services for the district is estimated to be $344,844. This is based on applying Fire Department personnel costs and associated operating expenses for administration, equipment, training, planning and maintenance to respond within the district. Any balance is reserved to provide an allowable buffer and funding of future Fire Department services and maintenance.

Re: Community Facilities District- Parks Maintenance Services The City of Reedley anticipates that approximately 1,010 single family units, 118 multiple family units, 227 Affordable Housing Units, and 612,411 square feet of non-residential properties will be served under the CFO in the 2026-2027 budget year.
In review of services provided, it is determined that the Parks Maintenance Department will provide services in excess of $135,508 for the 2026-2027 fiscal year. This amount was calculated by applying the cost of personnel (part time and full-time parks maintenance workers), equipment, fuel, and vehicle maintenance costs.

Subject: Community Facility District Budget Needs: 2026-27 Fiscal Year In reviewing the housing forecast assessment for the fiscal year 2026-27, it is projected that 101 O single-family homes (increase of 134 units}, 227 affordable housing units (increase of 32 units}, and 118 multi-family units will be assessed. Additionally, 808,606 sq. ft. of commercial and non-residential space is projected to be assessed. Based on these projections and using the average Fresno County household size of 3.16 individuals, it is estimated that Reedley's population could increase by roughly 500 residents.
In 2025, the Reedley Police Department handled 26,736 service calls, equating to about (1.0) calls per resident, given the estimated population between 26,000 and 27,000. The service call numbers were consistent with the previous year, with no notable increase. Assuming full occupancy of the new housing, this would elevate the population beyond 27,000 and potentially lead to an estimated (1.0) service calls per new resident annually. The added commercial space would also present an increase in service calls for business locations.
In relationship to police response to calls for service, the population increase could equate to an additional 500 service calls. The cost of handling a service call is estimated at an average of $348.20, marking a 2.2% increase from last year. Considering the increases, a total service cost of approximately $1,199,430 is estimated. The increase covers various operational costs, including officer response time, dispatch operations, record-keeping, fuel, and supervisory duties. It is important to note that this figure is conservative and does not account for the potential increase in standard patrol hours, the impact of additional traffic from new housing, or the increased demand from commercial establishments.

The City of Reedley received an Active Transportation Program grant for the Project that includes Lincoln Avenue from East to Pecan Avenues, Washington and Jefferson Avenues from East to Columbia Avenues and Sunset and Columbia Avenue from Dinuba to Duff Avenues. The Project is scheduled to begin construction in the summer/fall of 2026, pending funding authorization from Caltrans, and is anticipated to be completed by Spring 2027.
The project will install sidewalk, curb ramps, alley approaches and minor driveway
approaches to remove access barriers and improve student and pedestrian safety adjacent to Jefferson Elementary School. In order to construct some of these ramps, sidewalk, curb and gutter, it is necessary to encroach on the existing AID easement on Columbia Avenue from Lincoln Avenue to Dinuba Avenue.
The City Engineering Department worked with AID during the project planning to locate their easement and irrigation main. The City must now enter into an Encroachment Agreement with AID in order to obtain approval to complete the improvements within their easement.
FISCAL IMPACT
AID Encroachment Agreement fees are $11,500 which include 3 encroachments and a deposit for plan check and inspections related to the Project. Fees for the encroachment agreement are eligible for reimbursement from state aid funds for this project.

RECOMMENDATION
Adopt Resolution No. 2025-087, approving the Final Map for Vesting Tentative Subdivision Map No. 6488, and authorizing the City Manager to make non-substantive changes, and sign the final version of the Subdivision Improvement Agreement.
EXECUTIVE SUMMARY
The owner of Vesting Tentative Subdivision Map 6488 is requesting the City Council approve the final map associated with the project in accordance with Reedley Municipal Code Section
11.04.140, and approve entering into a Subdivision Improvement Agreement for timely completion of the public facilities associated with servicing the project site, in accordance with Reedley Municipal Code sections 11.04.130, 11.04.180, and 11.04.200.
BACKGROUND
Vesting Tentative Subdivision Map No. 6488 was filed with and deemed complete by the Community Development Department by D.R. Horton CA3, Inc., on August 6, 2024. Vesting Tentative Subdivision Map No. 6488 pertains to the subdivision of 12.33~ acres of land and proposed street dedications and improvements. The proposed land subdivision is to accommodate development of single-unit residential homes. The proposed project includes the development of 55 single-unit residential homes on lots with varying sizes. The size of the proposed lots will vary from a minimum of 6,000 square feet to a maximum of approximately 8,252 square feet. The average lot size is approximately 6,512 square feet. The proposed project also includes one temporary basin on proposed lots 13, 14, 15, 34, 35, and 36. Two access points off South Buttonwillow Avenue are proposed at the future extensions of East North Avenue and
East Linden Avenue.
The parcel has an R-1-6 (Low Density Residential) zone district designation. The intended purpose of the R-1-6 (Low Density Residential) zone district is to allow for a mixture of housing types and densities in newly developing and predominantly low-density residential areas of the city. The density range in the R-1-6 (Low Density Residential) zone district is four to eight dwelling units per acre with a minimum parcel size of 5,000 square feet. The creation of each lot is consistent with the development standards prescribed within the Zoning Code, the Subdivision Ordinance, and the State Map Act. Vesting Tentative Subdivision Map No. 6488 was approved by the Reedley Planning Commission on February 6, 2025, via Resolution 2024-14.
Currently, DR Horton is requesting City Council approve the final map for the associated project in accordance with Reedley Municipal Code Section 11-2-13. Additionally, DR Horton is requesting the City Council also approve entering into a Subdivision Improvement Agreement for timely completion of the public facilities associated with servicing the project site, in accordance with Reedley Municipal Code sections 11.04.130, 11.04.180, and 11.04.200. The City Engineer has reviewed the final map submission for conformance to boundaries, public easement locations, dedications, closure calculations and other required information. The City Engineer has consequently found the map to be in substantial compliance to the tentative map approval, has determined that the improvements required for project have been properly identified, and submits said map to the Council for their approval consideration.
In regards to the completion of public improvements associated with Vesting Tentative Subdivision Map 6488, the developer has requested to enter into a Subdivision Improvement Agreement (Attachment 2) for the development with the City of Reedley, as authorized by Reedley Municipal Code section 11.04.130. This action will allow for the filing of a final map for the development with the assurance that outstanding site improvements and activities identified within the project's conditions of approval will be completed within a given timeframe acceptable to the City. All improvement activities shall be secured by surety bond and other specifications, as contained within the agreement and any consequent addendum. The agreement also contains details for reimbursable items to address the upsizing of utilities in accordance with the City's Integrated Master Utility Plan and reconstructing a portion of the western side of Buttonwillow Avenue due to the age and deterioration of the existing roadway. Council may approve, approve with conditions, or disapprove the agreement.
FISCAL IMPACT
The developer will pay for all development impact fees prior to issuance of a building permit.

Line-item descriptions for allowable reimbursement items are listed in Section City Reimbursement Calculations of the attached Exhibit 1.
The facilities for which reimbursement may be given as set forth herein are shown on the approved plans for the subject project on file in the office of the City Engineer, which plans incorporated herein by this reference as though set forth in full. Permits for all activities must be obtained prior to any work beginning.
Notwithstanding anything to the contrary elsewhere in this Agreement, the City will reimburse Subdivider without interest those amounts listed in Section City Reimbursement Calculations of the attached Exhibit 1. Reimbursement shall take place in one of the following forms:

completed in full, and confirmed via City inspection. Following successful inspection, Subdivider must submit invoicing records showing actual costs for reimbursable activities.
b) City shall review the submitted invoicing for concurrence with approved activities and estimates. Following review, City will provide Subdivider with a revised DIF Fee Estimate that includes DIF credits for the reimbursable amount(s).

actual costs has been submitted. Resulting credits would only be applied to the deferred amount due prior to
Ce1iificate of Occupancy, with all deposit amounts not
incorporating any DIF credit estimates.
6. The Subdivider shall protect, indemnify, and hold harmless the City of Reedley, its officers, employees and volunteers thereof from any and all liability or claims (in contract, tort, strict liability or otherwise, including but not limited to personal injury, death at any time or property damage), because of or ansmg out of Subdivider's performance of this 6 Agreement, or out of, any accident, occurrence, loss, damage or happening occurring upon or arising out of the construction of any of the improvements herein or the use by any person of any patent or patented articles in the construction of said work or improvements. The forgoing obligations shall survive completion or termination of this Agreement. The Subdivider agrees that the use of any and all streets and improvements herein above specified shall be, at all times prior to the final acceptance of said improvements by the City Council, the sole and exclusive risk of the Subdivider. The issuance of any occupancy permits by City for dwellings located within the said subdivision shall not be construed in any manner to be an acceptance and approval of any or all of said streets and/or improvements in said subdivision.
7. Subdivider, before commencing work pursuant to this Agreement, shall obtain and maintain in full force and effect during the performance of the work at his own expense and risk, policies of insurance as follows and shall furnish evidence of such insurance by filing a certificate of insurance with the City Clerk. Such insurance shall name the City of Reedley, its Council, officers, officials, employees and volunteers as insured or additional insureds, and shall indemnify the City and said persons against liability for loss or damage for personal injury including death, and property damage occasioned by the operations of the Subdivider or its employees, contractors or subcontractors under the terms of this agreement in the minimum limits as follows:
I. a) General Liability. $2,000,000 combined single limit per occurrence for bodily injury, personal injury and property damage. If Commercial General Liability Insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit. b) Automobile Liability. $2,000,000 combined single limit per accident for bodily injury and property damage.
c) Worker's Compensation and Employer's Liability. Worker's compensation limits as required by the Labor Code of the State of California and Employer's Liability limits of $1 ,000,000 per accident.
11. The policies are to contain, or be endorsed to contain, the following provisions:
a) General Liability and Automobile Liability Coverages. 7 i) The City, its officers, officials, employees and volunteers are to be covered as insureds as respects liability arising out of activities performed by or on behalf of the Subdivider, products and completed operations of the Subdivider, premises owned, occupied or used by the Subdivider, or automobiles owned, leased, hired or borrowed by the Subdivider. The coverage shall contain no special limitations on the scope of protection afforded to the City, its officers, officials, employees, or volunteers. ii) The Subdivider's insurance coverage shall be primary insurance as respects the City, its officers, officials, employees and volunteers. Any insurance or self-insurance maintained by the City, its officers, officials, employees, or volunteers shall be excess of the Subdivider's insurance and shall not contribute with it.
iii) Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the City, its officers, officials, employees or volunteers.
iv) The Subdivider's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability.
b) Worker's Compensation and Employer's Liability Coverage. The insurer shall agree to waive all rights of subrogation against the City, its officers, officials, employees and volunteers for losses arising from work performed by the Subdivider under this agreement.
c) All Coverages. Each insurance policy required by this clause shall be issued by a corporate insurer authorized to do insurance business in California and shall be endorsed to state that coverage shall not be suspended, voided, canceled by either party, reduced in coverage or in limits except after thirty (30) days prior written notice by ce1iified mail, return receipt requested, has been given to the City. Such notice requirement shall not contain "shall endeavor" , "best efforts" or similar qualifiers. Notwithstanding the foregoing, in the event such notice section does contain "shall endeavor", "best efforts" or similar qualifiers, such policy shall be acceptable; provided, however, Subdivider shall be obligated and hereby 8 Ill.
covenants and agrees: (i) Subdivider shall be obligated to and shall separately provide to City thirty (30) days prior written notice by certified mail, return receipt requested, before any suspension, voiding, cancellation, or reduction in coverage of such insurance, and (ii) Subdivider shall indemnify, defend and hold City harmless from any expense, costs, loss or damages directly or indirectly resulting from any failure to timely provide such notice.
Verification of Coverage. Subdivider shall furnish the City with certificates of insurance and with original endorsements effecting coverage required by this clause. The certificates and endorsements for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. Where by statute the City's worker's compensation-related forms cannot be used, equivalent forms approved by the Insurance Commissioner are to be substituted. All certificates and endorsements are to be received and approved by the City before work commences. The City reserves the right to require complete, certified copies of all required insurance policies, at any time. If such insurance is provided in either case by a policy or certificate which covers the Subdivider or other entity or person than the City of Reedley, such policy shall contain the standard form of cross liability endorsement. Such insurance shall also specifically insure contractual liability assumed by Subdivider under the terms of this agreement.
8. Time is of the essence of this Agreement; provided, however, that in the event good cause is shown therefor to the City by Subdivider, City may extend the time in which the aforementioned improvements may be made and completed under this agreement. Said extensions of time, if any, may be granted without notice to the surety and any extensions so granted shall not relieve the surety bond or other security deposited with the City given to secure Subdivider's performance under this agreement. City shall be the sole and final judge as to whether or not good cause has been shown to entitle Subdivider to an extension of time hereunder.
9. All pipes and monuments shown on the final map hereinafter referred to which are destroyed or displaced during construction operations shall be replaced by Subdivider by the time of the final inspection of the improvements hereunder by the City.
10. It is agreed that title and ownership of any improvements constructed hereunder by Subdivider shall vest absolutely in City upon completion and acceptance of such improvements 9 by the City Council.
11. It is mutually understood and agreed that neither Subdivider nor any of its agents, employees or contractors are or shall be considered to be agents of the City of Reedley m connection with the performance of Subdivider's obligations under this agreement.
12. Subdivider shall pay to the City, for all engineering, inspection and other services provided by City in accordance with this Subdivision, amounts as set forth by adopted City ordinance and resolution in effect at time of payment. City shall, at the completion of the improvements provided for herein, furnish the Subdivider with a statement of all charges for services performed by the City in the event said actual costs exceed the payment previously made by Subdivider for such services. The Subdivider shall complete payment for such charges within thirty (30) days after receipt of such statement of actual costs.
13. Subdivider agrees that if, within a period of one (1) year after final acceptance of the work done under this Agreement, any improvements or part of any improvement furnished and/or installed or constructed or caused to be constructed by Subdivider, or any of the work done under this Agreement, fails to fulfill any of the requirements of this Agreement or the Plans and other plans and specifications referred to herein, Subdivider shall, without delay and without any cost to the City, repair or replace or reconstruct any defective or otherwise unsatisfactory part or parts of the work or improvements. The terms of this section shall not apply to any damage caused by acts of God. Should Subdivider fail to act promptly or in accordance with this requirement, or fail to do the construction as agreed upon herein, or should the exigencies of the case require repairs or replacements to be made before the Subdivider can be notified, the City may, at its option, make the necessary repairs or replacements or perform the necessary work and the Subdivider shall pay to the City the actual cost of such repairs plus thirty percent (30%) to cover the City's indirect and overhead costs. If the Subdivider fails to pay to the City the cost repairs plus thirty percent (30%), the City may, without limiting the Subdivider's liability therefor, file a claim against the bond posted to guarantee and warrant the work.
14. The Subdivider and his contractors shall pay when due for any materials, wages, subcontracts, labor, provisions, or other supplies and items used in conjunction with the work performed for the subject subdivision including, but not limited to, unemployment insurance and any other incidentals arising out of any necessary work or labor.
15. The Subdivider shall comply with all Street, Plumbing, Building, Electrical, Zoning Codes 10 and any other applicable Codes, ordinances, standards and regulations of the City. Subdivider shall submit the proposed conditions, covenants, and restrictions to sales of lots within this subdivision to the City of Reedley for review and approval prior to any execution thereof.
16. If Subdivider fails to construct the improvements upon the terms and within the time required, City may complete or cause completion of the required improvements and assess the actual cost of completing the required improvements and file a claim against the bond posted to secure faithful performance of the works.
17. When the improvements are completely installed and accepted by the City Council and there is full performance pursuant to this agreement, City agrees to release Subdivider and the described property from further obligation under this Agreement, except for those obligations, including but not limited to Section 6 and 13, that by their nature continue after termination or completion of this Agreement.
18. All covenants in this Agreement shall pertain to and run with the described real property and shall apply to, bind, and inure to the parties and the contractors, heirs, executors, administrators, assigns or successors in interest of the respective parties hereto.
19. Any notice required by law or by this Agreement shall be given by personal delivery of first class U.S. Mail. Notice by personal delivery will be effective on delivery and notice by mail will be considered effective three days after it is deposited in the U.S. Mail, postage paid, addressed to the City of Reedley, 1733 9TH Street, Reedley, CA 93654 or to Subdivider, D.R. Horton CA3, Inc., 419 W. Murray Avenue, Visalia, CA 93291 , at their respective addresses as of the date of this Agreement, unless written notice of change or address has been received by the other party. If any action is required to enforce the provisions of this Agreement, the prevailing party shall be entitled to an award ofreasonable attorney fees to be determined by a Court.
20. The Subdivider shall have a record drawing prepared by a civil engineer which denotes the final disposition of the improvements as constructed for water, sewer, storm drain, curb and gutter, and streets. Said "as-built" drawing shall be prepared and submitted to, and approved by, the City Engineer prior to the City Council's acceptance of the improvements. 11 IN WITNESS WHEREOF, the parties have signed this agreement to be effective as of the Effective Date in the opening paragraph.
