APPROVE AND AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND ENTER
INTO A PROFESSIONAL SERVICES AGREEMENT FOR ON-CALL
CONSTRUCTION MANAGEMENT SERVICES WITH FOUR SEPARATE FIRMS Marilu Morales, P.E. \ \
City Engineer JJ\
Nicole R. Zieba
City Manager
RECOMMENDATION
Approve and Authorize the City Manager to negotiate and enter into a Professional Services Agreement for On-Call Construction Management Services with four separate firms.
EXECUTIVE SUMMARY
In order to ensure that locally funded construction contracts as well as residential developments within the City are constructed per plans and specifications, it is vital to have oversight of the contractors performing the work. Depending on the size of the project, funding availability and staff availability, it is sometimes necessary to contract out the construction management services. With the support of construction managers, Staff is able to prioritize other needs within the Department while ensuring the construction of projects are being delivered on time, within budget, and per the approved improvement plans and specifications.
Staff requested qualifications (RFQ) from local construction management firms for On-Call Construction Management Services on August 4, 2026. Six firms responded to the RFQ. Engineering Staff reviewed each of the firm's proposal and decided to interview five of the firms due to qualifications each firm submitted in their statements of qualifications (SOQ).
Virtual interviews were held on September 11, 2026 and September 14, 2026 with the five firms to clarify the depth and breadth of available services and firm availability to assist the City in a timely manner. Upon completion of the interviews NV5, Inc., Accenture Infrastructure and Capital Projects, LLC, and Yamabe & Horn Engineering, Inc. and A&M Consulting Engineers were selected as the firms to meet the City's needs regarding on-call Construction Management Services.
The consulting services contract will support the Engineering Department with construction management, quantity verification, quality assurance, construction inspection services, construction staking (if necessary), materials testing (if necessary) and technical construction oversight of design
projects throughout the construction of transportation projects as well as private commercial and residential development inspections. The construction management services will be funded with the same local project funding paid for the transportation project or by developers for the commercial and residential development inspections.
The term of the attached draft agreement is for a period of three (3) years beginning after Council approval of the agreement, and ending in calendar year 2029 with an option for up to two (2) one-year extensions ending in calendar year 2031. The agreement will be updated for each of the three consultant firms selected. Work will be assigned to the consultant per task order on an as needed basis. The task orders will be submitted to the consultants for a proposal to perform the work. A consultant will then be selected based on the proposal submitted and the scope will be finalized and the associated costs will be negotiation prior to issuing a task order and starting the work.
BACKGROUND
All construction projects require oversight by the City to ensure that all local and state guidelines are incorporated into the work, contractual guidelines are followed and met and to ensure the quality of the final product. Many of these projects have direct oversight by City Staff, however, due to the size of a project, the funding type or availability of City Staff it is often necessary to hire consultants to perform this work on behalf of the City.
The Engineering Department issued an RFQ for On-Call Construction Management Services on August 4, 2026 and received SOQs from six interested firms. Engineering Staff reviewed each of the firm's proposals and interviewed five of the firms. Upon completion of the interviews NVS, Inc., Accenture Infrastructure and Capital Projects, LLC, and Yamabe & Horn Engineering, Inc. and A&M Consulting Engineers were selected to perform on-call construction management services. The initial contract is for three (3) years with an option for up to two (2) one-year extensions.
Some of the tasks performed by the firms will include, but are not limited to reviewing and approving submittals and pay requests, tracking requests for information, preparing daily diaries of work completed, attending and running pre-construction meeting and weekly or bi-weekly meetings, performing employee interviews, general inspection of daily work, inspection of traffic control plan, collecting certificates of compliance and weigh tickets, resolving construction issues and citizens complaints, verification of slopes, coordination with City Departments and outside agencies and any other reasonable and customary construction management function as necessary.
FISCAL IMPACT
The majority of the construction management services to be performed by the consultant firms are eligible for reimbursement from the funding that will be used to pay for the construction expenses for the projects. The services performed for private commercial and residential development will be charged to the development applicant via the current master fee schedule.

RECOMMENDATION
Approve and Authorize the City Manager to negotiate and enter into a Professional Services Agreement for On-Call Construction Management Services for State and Federally Funded Transportation Projects with three separate firms.
EXECUTIVE SUMMARY
In order to ensure that all federally and state funded construction contracts within the City are constructed per plans and specifications, it is vital to have oversight of the contractors performing the work. Depending on the size of the project, funding availability and staff availability, it is sometimes necessary to contract out the construction management services. With the support of construction managers, Staff is able to prioritize other needs within the Department while ensuring the construction of projects are being delivered on time and within budget.
Staff requested qualifications (RFQ) from local construction management firms for On-Call Construction Management Services for State and Federally Funded Transportation Projects on August 4, 2026. Eight firms responded to the RFQ. Engineering Staff reviewed each of the firm's proposal and decided to interview seven of the firms due to qualifications each firm submitted in their statements of qualifications (SQQ).
Virtual interviews were held on September 11, 2026 and September 14, 2026 with the seven firms to clarify the depth and breadth of available services and firm availability to assist the City in a timely manner. Upon completion of the interviews NV5, Inc., Accenture Infrastructure and Capital Projects, LLC, and Yamabe & Horn Engineering, Inc. were selected as the firms to meet the City's needs regarding on-call Construction Management Services for State and Federally Funded Transportation Projects.
The consulting services contract will support the Engineering Department with construction management, quantity verification, quality assurance, construction inspection services, construction staking (if necessary), materials testing (if necessary) and technical construction oversight of design projects throughout the construction of transportation projects. The construction management services are eligible for grant reimbursement and local funds will be used as the grant match.
BACKGROUND
All infrastructure construction projects require oversight by the City to ensure that all Local, State and Federal guidelines are incorporated into the work, contractual guidelines are followed and met and to ensure the quality of the final product. Many of these projects have direct oversight by City Staff, however, due to the size of a project, the funding type or availability of City Staff it is often necessary to hire consultants to perform this work on behalf of the City.
The Engineering Department issued an RFQ for On-Call Construction Management Services for State and Federally Funded Transportation Projects on August 4, 2026 and received SOQs from eight interested firms. Engineering Staff reviewed each of the firm's proposals and interviewed seven of the firms. Upon completion of the interviews NV5, Inc., Accenture Infrastructure and Capital Projects, LLC, and Yamabe & Horn Engineering, Inc. were selected to perform the on-call construction management services for state and federally funded projects.
The majority of the construction management services to be performed by the consultant firms are eligible for reimbursement from the state or federal fund grants that will be used to pay for the construction expenses for the projects. Measure C, Development Impact Fees, and/or SB1 funds will be used to pay for the required grant matching portion of the services and any items that are nonparticipating within the federal fund requirements.

TITLE: ADOPT RESOLUTION NO. 2026-060 APPROVING AND ADOPTING THE CITY
OF REEDLEY CROSS-CONNECTION CONTROL PROGRAM PLAN (CCCPP)
AND AUTHORIZE THE PUBLIC WORKS DEPARTMENT TO IMPLEMENT AND ENFORCE ITS PROVISIONS.
SUBMITTED: Russ Robertson, Public Works Director
APPROVED: Nicole Zieba, City Manager
RECOMMENDATION
Staff recommends the adoption of Resolution 2026-060 approving and adopting the City of Reedley Cross-Connection Control Program Plan (CCCPP) as mandated by the State of California Water Resources Control Board.
BACKGROUND
The City of Reedley operates a public water system and is subject to all applicable State of California laws and regulations governing public water systems. State law requires every public water supplier to establish and maintain an active Cross-Connection Control Program to protect the potable water distribution system from potential contamination.
In 2024, the State Water Resources Control Board (SWRCB) updated statewide requirements, mandating that water suppliers adopt a formal Cross-Connection Control Program Plan consistent with the Cross-Connection Control Policy Handbook, the California Health and Safety Code, and the California Plumbing Code. Adoption of a formal program plan is required for regulatory compliance and is subject to review and approval by the State Water Board.
Staff provided a workshop to the City Council on January 27, 2026, during a regularly scheduled City Council meeting, outlining the new CCCPP requirements and the City's obligations under the updated regulations.
Cross-connections, which are any actual or potential connection between the City's potable water system and a non-potable source, pose a risk to public health if not properly controlled .
Some examples of potential cross-connections include irrigation systems without backflow prevention, swimming pool or spa fill lines directly connected to potable water, leaving a hose in a bucket of water when washing your car, etc.
The attached plan fulfills these state requirements and establishes a comprehensive framework for hazard assessment, backflow prevention, testing, enforcement, and incident response.
FISCAL IMPACT
The cost of this State mandate is anticipated to be in the range of $20,000 per year and will be funded through customer water service rates. California Government Code Section 17556 explicitly defines when a mandate is not reimbursable by the State. Under subsection (d) of this statute, the Commission on State Mandates will not find a reimbursable mandate if the local agency has the authority to levy service charges, fees, or assessments sufficient to pay for the mandated program.
Program implementation, monitoring, and reporting will be supported by water division staff.
Costs associated with testing, repairs, or installation of assemblies on private property are borne by the property owner, consistent with state law.

EXECUTIVE SUMMARY
The City of Reedley Cross-Connection Control Program (CCCP) is established to protect the City's potable water distribution system from contamination and pollution caused by actual or potential cross-connections. This program establishes requirements for hazard assessments, installation and maintenance of approved backflow prevention assemblies, inspection procedures, enforcement actions, public outreach, and emergency response activities.
The program applies to all water service connections supplied by the City of Reedley Water System and is intended to ensure compliance with applicable state regulations and industry standards while protecting public health and maintaining water quality throughout the distribution system.
The City of Reedley owns and operates a municipal groundwater system that serves as the primary source of potable water for customers within the City's service area. The system is supplied by seven groundwater wells located throughout the community. These groundwater sources are operated as part of an integrated municipal water system designed to provide a reliable and continuous supply of drinking water while maintaining compliance with applicable federal and State of California drinking water requirements.
Three of the City's seven groundwater wells are equipped with granular activated carbon (GAC) filtration systems. GAC treatment provides an additional treatment barrier for the removal of certain organic contaminants and other constituents that may be present in the groundwater supply.
These treatment facilities are operated and maintained in accordance with established water quality monitoring, operational, and regulatory requirements.
The City routinely operates, monitors, and maintains its groundwater production and treatment facilities to support system reliability and the continued delivery of safe drinking water. The availability of multiple groundwater sources, combined with GAC treatment at designated well sites, provides operational flexibility and enhances the City's ability to manage water quality while meeting the needs of its customers. The City of Reedley remains committed to maintaining its water facilities in a manner that protects public health and supports continued compliance with applicable drinking water standards.
The City's municipal water system provides potable water service to customers throughout the City's designated service area. The system currently includes a total of 6,470 service connections, consisting of 5,634 single-family residential services, 253 multi-family residential services, 412 commercial services, 12 industrial services, 115 landscape irrigation services, 30 school services, and 14 construction water services. The City of Reedley does not utilize or maintain any auxiliary water supply associated with its municipal water system.

RECOMMENDATION
That the City Council adopt Resolution No. 2026-061 appropriating an additional $5,500 from Landscape Lighting and Maintenance District (LLMD) fund balance in order to underground irrigation lines.
EXECUTIVE SUMMARY
Staff is requesting approval of a budget amendment to provide funding for the installation of new underground irrigation within Landscape Lighting Maintenance District (LLMD) Zone DD along Kingswood parkway. The existing irrigation system utilizes above-ground drip lines that have experienced ongoing issues due to the proximity of the river which has made it subject to animals and squirrels chewing through the lines. These recurring issues have resulted in irrigation failures, increased maintenance needs, and inconsistent watering of the landscaped areas within the Zone.
Undergrounding the irrigation system will provide a more reliable and durable irrigation solution by protecting the irrigation lines from damage. The improvements are expected to reduce recurring repairs and maintenance costs while improving irrigation efficiency and the overall condition of the landscaped areas.
FISCAL IMPACT
The LLMD fund balance would be reduced by $5,500.

RECOMMENDATION
It is recommended that the City Council approve and authorize the City Manager to execute the attached five-year professional services contract with Revize Software Systems, LLC for the development, maintenance, and hosting of a new City website that will be compliant with regulations for Title II of the Americans with Disabilities Act (ADA), necessary to ensure that web content are accessible to people with disabilities.
EXECUTIVE SUMMARY
In April, 2026, the U.S. Department of Justice published an Interim Final Rule regarding specific requirements about how public entities are to ensure that web content and mobile applications are accessible to people with disabilities. The regulations were updated for compliance with Title II of the ADA. Importantly, the Interim Final Rule extended the compliance date for local government entities with a total population of 50,000 or less to April 26, 2028.
The City's current website and content within it does not currently meet these approaching ADA access requirements since it was developed in 2019. In response to this upcoming deadline, staff contacted two prominent government website providers to evaluate their technology, approach, customer service, and pricing. From this process, Revize Software Systems, LLC (Revize) emerged as the clear option for the City's needs. Revize has clients nationwide, however, some of their California clients include: Clovis, Selma, Porterville, Corcoran, Bishop, Hollister, Soledad, Agoura Hills, and Roseville, among others.
Key Features of New Website
Round the clock server monitoring
Large support staff
Automatic security upgrades and enhancements
Remote backup of website assets
Language Translator to over 95 languages
Website Content/Announcement Scheduling
Full ADA Accessibility
Dedicated website chatbot
Improved search features
News Center with social media integration
Website redesign in Year 4
Expandable features available as the city grows
Importantly, all of these features are available at a cost that is comparable to the amount the City is spending now on its website, as discussed further below.
Behind the scenes, a significant change will be that staff will take over the hands-on updates to the website, something that a vendor performs currently. Prior to 2012, staff directly updated the website; however, making updates was more complicated back then. Advantages of making changes to the website include a faster turnaround and staff 'ownership' of their respective areas. Every department will have at least one person trained to make updates, with safeguards in place for inadvertent/malicious actions.
BACKGROUND
State and local governments provide many of their services, programs, and activities through websites and mobile apps. When these websites and mobile apps are not accessible, they can create barriers for people with disabilities. For example, individuals who are blind may use a screen reader to deliver visual information on a website or mobile app as speech. A state or local government might post an image on its website that provides information to the. public. If the website does not include text describing the image (sometimes called "alternative text" or "alt text"), individuals who are blind and who use screen readers may have no way of knowing what is in the image because a screen reader cannot "read" an image.
Websites and mobile apps that are not accessible can make it difficult or impossible for people with disabilities to access government services that are quickly and easily available to other members of the public online. Sometimes, inaccessible websites and mobile apps can keep people with disabilities from joining or fully participating in civic or other community events like meetings or programs.
FISCAL IMPACT
The annual cost for the City's current website is between $15,000 and $16,000, and utilizes three vendors. The agreement with Revize would consolidate the services to a single vendor with an annual cost of $16,640; therefore, the annual increase to the City will be less than $1,000. The additional cost is essentially limited to year one, because Revize is paid while the City maintains its existing website.
The one-time development and transition costs to Revize total $23,700; however, the vendor has offered to spread this equally over the five-year term at no additional cost instead of incurring an upfront cost of $35,600.

Generalized dissatisfaction with aesthetic elements or previously approved deliverables does not constitute a breach of contract unless Revize fails to cure a material functional defect.
CLIENT may elect to postpone or reprioritize certain deliverables in favor of an earlier go-live date, subject to mutual agreement.
Enterprise Revize CMS License
As part of this Agreement, Revize LLC ("Revize") grants CLIENT a limited, non-exclusive, non-transferable license to access and use the Enterprise Revize CMS software ("Software"), hosted on Revize's cloud servers, solely for the purpose of maintaining the website(s) identified in this Agreement. The Software is proprietary to Revize and remains the sole property of Revize.
CLIENT may terminate this Agreement by providing at least sixty (60) days written notice prior to the applicable annual renewal date. All fees incurred or scheduled through the effective termination date remain due and payable.
Early termination does not relieve CLIENT of payment obligations for services already rendered .
CLIENT may not sublicense, share, or otherwise provide access to the Software to any third party not expressly authorized under this Agreement.
During the term of this Agreement and while CLIENT remains current on all payment obligations, Revize will host, maintain, and provide updates to the Software as part of the applicable annual subscription.
Upon termination or expiration of this Agreement for any reason, CLIENT's access to the Software will be discontinued. Upon written request and provided all amounts due under this Agreement have been paid in full , Revize will make CLIENT's website content available to CLIENT in a reasonable electronic format.
Notice of termination must be in writing and delivered to the non-terminating party in accordance with the notice provisions of this Agreement.

WCAG Accessibility and Compliance Terms
1. Revize will build the website to highly conform with the Web Content Accessibility Guidelines WCAG 2.1 Level AA ("WCAG 2.1 AA") at the time of delivery while actively incorporating WCAG 2.2 AA best practices as standards evolve using current industry-recognized approaches. This includes keyboard access, semantic markup, ARIA where appropriate, color contrast, focus management, and accessible forms for the delivered templates.
2. Conformance does not extend to: (i) third-party modules, plug-ins or integrations not provided by Revize (e.g., payment gateways, third-party calendars, embedded third-party widgets), (ii) content authored, uploaded, or maintained by the Client (including documents such as PDFs), and (iii) legacy pages or archives unless specifically included in the Statement of Work.
3. CLIENT website editors are responsible for ensuring they have an understanding of WCAG compliance principles. CLIENT agrees they are responsible for the content they post and shall make reasonable efforts to avoid posting content that does not conform to these guidelines. This includes, but is not limited to, posting non-compliant PDFs, failing to include descriptive ALT descriptions on photos, etc.
4. CLIENT agrees and understands accessibility compliance is not a fixed or absolute standard. It is more of a spectrum rather than a pass/fail standard. Because testing tools and methodologies may produce different results, Revize and the CLIENT agree to focus on accommodating user needs and maintaining a continuing, good-faith approach to accessibility and regulatory compliance.
5. Revize provides tools and features designed to support website accessibility and best practices. However, Revize does not guarantee legal compliance with WCAG, ADA, or other regulations . Ongoing compliance requires active participation by CLIENT, including content management and policy decisions.
6. For an additional fee, Revize offers an ongoing WCAG scan and remediation service. This service will scan the website at regular intervals after the website goes live and remediate any WCAG compliance issues with an allocated bucket of additional development hours. Remediation priorities can be set by CLIENT and may include content remediation (e.g., PDFs, Flyers, etc.). Revize also includes an accessibility checker within the Revize CMS editor. This utility will alert users of suspected accessibility issues.
7. If PDF remediation is included in this agreement, completion time is highly dependent on the number and the complexity of PDFs.
8. Additional development hours may be necessary to complete remediation to CLIENT's satisfaction and are available at a rate of $125 per hour.
9. Additional PDF remediation may be requested at a rate of $5 per page. 100 Minimum
10. PDF remediation is priced by page, not by individual file e.g., PDF of 10 pages would be billed $50

RECOMMENDATION
Staff recommends that the City Council Adopt Resolution No. 2026-064, accepting the public improvements for Phase 2 of Tract 6229, Rancho Vista, and authorize the City Engineer to file a Notice of Completion with the County of Fresno Recorder's Office.
EXECUTIVE SUMMARY
The Subdivision Map Improvement Agreement and Final Map for Phase 2 of Tract 6229, Rancho Vista, was approved by City Council on July 25, 2023. This phase of the subdivision consisted of 90 single-family residences located on the southeast corner of South Buttonwillow Ave. and East Springfield Ave. The public infrastructure improvements consisting of water, sewer, and storm drain facilities as well as street paving and ADA improvements have been completed. The one outstanding item that has not been completed as required for the development is the installation of the Alta Irrigation District (AID) irrigation pipeline. Century Communities goal is to install the AID pipeline as soon as they receive approved plans from AID as they have contracted with a contractor to perform the work and a majority of the pipeline is onsite ready for installation. Staff recommends that the City Council accept the improvements that have been installed with the exception of the installation of the AID pipeline and authorize the City Engineer to file a Notice of Completion (NOC) with said exception added to the NOC and release the payment and performance bonds.
This development has reimbursable items that have been completed by Century Communities that City Staff is finalizing with Century, therefore, there is adequate collateral to install the AID pipeline with the release of the payment and performance bonds. Staff will bring forward the final reimbursement amounts at a future meeting for City Council's approval.
A requirement of the subdivision improvement agreement is for the developer to supply the City with a one (1) year warranty bond in the amount of $237,892.66 prior to the acceptance of the subdivision improvements and release of the performance and payment bonds. Century has delivered said warranty bond to the City.

RECOMMENDATION
Staff recommends that the City Council take the following actions Adopt Budget Amendment Resolution No. 2026-065 amending the fiscal year 2026-2027 adopted budget appropriating $45,489 for the Local and Collector Street Improvements Project.
EXECUTIVE SUMMARY
Staff is requesting that the City Council adopt Budget Amendment Resolution No. 2026-065 in the amount of $45,489 to fund materials testing, staff time for construction management, and construction expenses for the Local and Collector Street Improvements Project (Project). The Project is located on North Avenue from G St. to Frankwood Avenue, Hollywood Avenue and Birch Avenue from North Avenue to Myrtle Avenue, Acacia Avenue from North Avenue to Manning Avenue, Myrtle Avenue from Hollywood Avenue to Frankwood Avenue, and Linden Avenue from the alley to Frankwood Avenue. Improvements included 6" HMA dig outs, and grind and overlay with pavement fabric along North Avenue, roadway excavation and new pavement section on Hollywood, Acacia, Birch, Myrtle and Linden Avenues, adjusting of manhole and water valve frames and covers to grade, water main upsizing and replacement, sewer main replacement, concrete improvements, and pavement delineation and signage.
The Project is nearing completion with minor improvements being completed. Due to the duration and size of the project, material testing costs as well as staff time to perform the construction management associated with the Project exceeded original estimates. In addition, due to construction occurring within close proximity to the Valley Regional Occupation Program (VROP), Kings Canyon Unified School District (KCUSD) Staff requested that the City's contractor for the Project remove and replace the existing damaged driveway approach to the VROP building and KCUSD would reimburse the City for the expenses associated with the improvements. City Staff agreed to this request and the expenses associated with the driveway improvements are reflected in the budget amendment.
FISCAL IMPACT
The additional authorization request for construction costs associated with the Project is $45,489, which includes materials testing, staff time for construction management and construction expenses. The additional construction costs are funded by Measure C Street Maintenance funds in the amount of $35,000 and KCUSD in the amount of $10,489.
