RECOMMENDATION
Ratify the authorization for City Manager to execute an agreement with the Giants Community Fund allowing the City of Reedley to provide the Junior Giants Baseball Program for the 2027 season. The program hasn't changed, but the Giants Community Fund requires that the City of Reedley enter into an agreement annually. Staff is requesting for the approval to continue offering this program.
BACKGROUND
Junior Giants Baseball is a free summer program offered to children ages 5-13. In previous seasons, the program has served up to 270 players. Throughout the seven-week season, participants focus on character development, health, education, bullying prevention, and the fundamentals of baseball.
For the 2027 season, the Junior Giants organization plans to operate a league from June 7 through August 6. The Giants Community Fund provides the necessary equipment, uniforms, and hats for participants.
In previous seasons, funding for Junior Giants Ambassadors was typically provided through AmeriCorps. However, this funding was threatened to continue last season, prompting the Giants Community Fund to provide limited financial support for Ambassador positions while reducing available hours. As the season approached, funding was ultimately restored by Junior Giants program.
1 Ambassadors play an important role in supporting the program by assisting with coach recruitment, coordinating required parent and player meetings, overseeing games, and distributing Junior Giants materials and incentives.
For the 2027 season, the level of Ambassador support remains uncertain and is not expected to be determined until closer to the start of the season. Regardless of the level of support available, the City of Reedley will remain responsible for player recruitment, team organization, and overall program supervision.
FISCAL IMPACT
Staff time is allocated in the City of Reedley 2026-27 Fiscal Year Budget.

RECOMMENDATION OF REJECTION OF CLAIM -ANDREA RIOS NAVA

Nicole R. Zieba. City Manager w:=
RECOMMENDATION
That the City Council reject a claim received from Andrea Rios Nava on September 17, 2026. The claim was referred to Acclamation Insurance Management Services (AIMS) for investigation and recommendation to the City.
BACKGROUND
The claim form alleges that on July 26, 2026, Ms. Nava was operating motor vehicle when she was stopped by Reedley Police for failing to make a complete stop, and further search of the vehicle led to her arrest. Claimant alleges that she was falsely arrested and detained, and officers conducted an unjustified search of the vehicle, violating her constitutional rights. Ms. Nava also alleges denial of medical care, unauthorized medical intervention, and severe emotional distress. Claimant is seeking $24,900 in damages, and lists missing personal cash and mobile device, time spent in jail, and selling a car to cover expenses. Also included was the claimant's stated value of a stereo system.
The claim was forwarded to AIMS for further investigation and recommendation to the City. Based upon their preliminary investigation, AIMS found no evidence of negligence and/or liability on the part of the City of Reedley and has therefore recommended that the claim be rejected.
Pursuant to Government Code Section 912.4, the City Council must act upon a claim within 45 days after receipt. If there is no official action by Council, the claim is deemed to be rejected on the last day.
Denial by minute order action provides a clearly defined rejection date and allows AIMS to begin their investigation and take appropriate action to resolve the claim in a timely manner.

APPROVE AND AUTHORIZE CITY MANAGER TO RENEW THE ANNUAL
SERVICES AGREEMENT WITH DAVID WELLHOUSE & ASSOCIATES, INC. IN AN AMOUNT NOT TO EXCEED $5,250 FOR PREPARATION AND FILING OF CLAIMS FOR STATE MANDATED COST (SB 90) REIMBURSEMENT
Amar Bains, Sr. Accountant ~
Paul A. Melikian, Assistant City Manager ~
Nicole R. Zieba, City Manager ~
RECOMMENDATION
Request Council approval of the attached consulting agreement with David Wellhouse & Associates, Inc. in an amount not to exceed $5,250 for preparation and filing of claims for State mandated cost reimbursements for fiscal year 2025-26.
EXECUTIVE SUMMARY
State law (SB 90) provides for reimbursement of costs incurred by local agencies for various Statemandated laws and requirements, such as procedures related to Domestic Violence Arrests & Victim Assistance and Rape Victims Counseling Center Notices once approved by the Commission on State Mandates as a reimbursable mandate. The remainder of State mandated services that claims will be filed for are detailed in the attached consulting agreement; however, the majority of claims historically submitted by the City have been for mandates under the purview of the Police Department.
The City has historically paid $4,500 to David Wellhouse & Associates for the preparation and filing of SB 90 reimbursement claims on the City's behalf. This year, the compensation is increasing by $750 to prepare and file claims for a new mandate, Stops: Notification by Peace Officers for claims during the period of January 1, 2024 through June 30, 2026. Claims totaling $59,584 were filed last fiscal year.
The latest State budget appropriated $93,866,000 for payment of mandates filed through 2025-26, which is 3.5% less than the amount appropriated last year. All claims which were submitted for reimbursement last year are again reimbursable this year.
FISCAL IMPACT
Typically, reimbursement revenue from prior year claims is more than sufficient to cover the cost of filing current year claims, resulting in net additional revenue to the General Fund. As an example, last fiscal year (2025-26), the City received $51,319 in reimbursements and paid $4,500 to file new claims, for a net benefit to the General Fund of $46,819. No new appropriations are needed for this Agreement.
The total amount of prior year claims the State owes the City is $578,407 not including the value of the 2025-26 claims that will be filed this year.

APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A THREE-YEAR AGREEMENT WITH BLUE VOICE, INC., FOR A LAW ENFORCEMENT SPECIFIC ARTIFICIAL INTELLIGENCE (Al) PLATFORM FOR THE POLICE DEPARTMENT, IN A TOTAL AMOUNT NOT TO EXCEED $32,100.
SUBMITTED: Marc A. Ediger, Chief of Police
APPROVED: Nicole R. Zieba, City Manager
RECOMMENDATION
That the City Council Approve and Authorize the City Manager to execute a three-year agreement with Blue Voice, Inc., for a law enforcement specific Artificial Intelligence platform for the Police Department, in a total amount not to exceed $32,100.
BACKGROUND
A department-wide Al platform would help sworn and professional staff find approved policies, laws and procedures, summarize documents, and complete authorized administrative work more efficiently. Expected benefits include more consistent information, less time searching reference materials, and more time available for public service. Blue Voice offers cited reference search and administrative tools. Police Officers in the field are also often faced with decision making based on case law/ legal updates. The Blue Voice platform would consistently research and provide the most up to date information for accurate, real-time legal decision making.
An approved closed- loop platform, supported by policy and training, would also reduce reliance on unapproved Al services that may expose protected information or limit City control over records . The platform will also create fillable form fields on everyday forms used across all levels of employees. This would allow for more fillable forms to be accessed and completed in the field without returning to the station to print or retrieve documents. Employees will remain responsible for verifying sources and accuracy. Blue Voice will not independently determine enforcement actions .
Case analysis and review for the Investigations Unit would provide for a summary overview, review important evidence items, statements, and correlate numerous written reports on a single criminal case. This type of analysis would enhance ability to identify "gaps" in cases and better prepare criminal filings for the District Attorney.
The Blue Voice platform would also be valuable in providing crime analysis based on crime trends of a specific type or area of the city. It would quickly determine similarities such as time of day, method, location information and potential evidence to look for, allowing for officers and investigators to more quickly put together the pieces of the puzzle.
SECURITY AND IMPLEMENTATION
The FBI Criminal Justice Information Services (CJIS) Security Policy establishes safeguards for criminal justice information. California DOJ requires agencies with CLETS access to adhere to the CJIS Security Policy and CLETS requirements. A compliant deployment is essential before any authorized processing of CJI, and the Blue Voice platform is built around this level of security and compliance. Blue Voice provides a shared-responsibility compliance program, encryption, U.S. processing, and no use of customer data for model training. It also does not store, transmit, or process CJI, while describing sensitive-data processing for their workspace.
The Police Department will designate an administrator that will maintain current source materials, train users, and evaluate a limited pilot after 90 days for accuracy, use, time savings and any potential security concerns.
FISCALIMPACT
The three-year cost will not exceed $32,100, averaging $10,700 annually. Yearly installments will follow the terms of the agreement, with the first-year installment to be $5,000. This first-year cost will be covered from the approved 2026-27 FY Police Department budget.

RECOMMENDATION
Staff recommends that the City Council take the following action:
A) Adopt Resolution No. 2026-068 Initiating proceedings for the annexation of territory (Tract 6267) into the City of Reedley Landscaping and Lighting Maintenance District (LLMD) No. 1 I as Zone HH, the establishment of a maximum annual assessment commencing in Fiscal Year 2026/2027 and the levy and collection of annual assessments commencing in Fiscal Year 2027 /2028 pursuant to the provisions of part 2 of division 15 of the California Streets and Highways Code, and ordering the preparation of an Engineer's Report in connection therewith.
B) Adopt Resolution No. 2026-069 declaring the intention to annex territory (Tract 6267) into the City of Reedley LLMD No. 1 as Zone HH, to establish a maximum annual assessment beginning in Fiscal Year 2026/2027 and to levy and collect assessments commencing in Fiscal Year 2027 /2028, pursuant to the provisions of part 2 of division 15 of the California Streets and Highways Code and calling for a property owner protest proceeding to submit to the qualified property owners the question of levying such assessments for said annexation territory pursuant to the provisions of the California constitution, article XIIID and preliminarily approving the Engineer's Report and setting a time and place for a public hearing.
EXECUTIVE SUMMARY
A condition to annex into the LLMD was imposed on new developments being processed by the City in November 1989, when the District was established. Since that time, properties that receive benefit from landscaping and lighting improvements are assessed for such improvements in proportion to the benefit received to maintain, operate, service and administer the landscaping, irrigation and lighting within each zone. The approval of the attached resolutions and Engineer's Report initiate the process for the Annexation and sets a date for the public hearing as required by the conditions of approval of Tract 6267.
BACKGROUND
On November 7, 1989, the City Council adopted Resolution 4202, which established the City of Reedley's LLMD No. 1. LLMD No. 1 was established to sustain on-going maintenance, operation and servicing of the local pocket parks, open spaces, landscaping and irrigation in local area buffers, entryways and median islands, street trees, block walls and local street lighting within said District. The LLMD provides and ensures the continued maintenance, servicing, administration and operation of various landscaped and lighting improvements and associated appurtenances located within the public rights-of-way and dedicated landscape easements in the various zones annexed into the LLMD throughout the City. Each of the landscaped maintenance areas is identified within a distinct Zone with differing costs and benefits to the parcels within each Zone. The spreading of the improvement costs is based upon the total cost of the improvements within each Zone. Each property is assessed only for the cost of the improvements from which benefit is received. The benefit formula used within each of the Zones in the LLMD may vary. The formula used for each Zone reflects the composition of the parcels, and the improvements and services provided, to fairly proportion the costs based on the special benefit to each parcel.
To initiate the process for annexation of a territory into the LLMD, the Council must approve a resolution of intention to annex territory into the LLMD. Resolution No. 2026-068 includes various actions necessary for the annexation to the LLMD. The attached Engineer's Report provides details for the proposed assessment of $157.14 per Equivalent Benefit Unit (EBU) within Tract 6267. The 59.0 EBUs are comprised of thirty-four (34) single-family residential lots with each lot assessed 1 EBU and ten (10) multi-family lots containing approximately 80 multi-family units with each multi-family lot assessed 2.5 EBUs. The assessment will commence with fiscal year 2026/2027. Resolution No. 2026-069 preliminarily approves the Engineer's Report for Tract 6267 and the assessments as detailed above and sets the public hearing date to November 10, 2026. At that time the ballots will be counted, and if there is no majority protest, the Engineer's Report and resolution to be heard at the public hearing on November 10, 2026 will confirm and levy the assessments placed on each parcel for the maintenance costs beginning in fisca l year 2027/2028.
FISCAL IMPACT
The City will collect approximately $9,271.00 annually to offset the cost of maintaining landscaping and street lighting in Zone HH . The cost to process this annexation is funded by the Developer of Tract 6267 as required by the conditions of approval.

• An Assessment Diagram outlining the boundaries of the Annexation Territory. • An Assessment Roll containing the maximum assessments for Fiscal Year 2026/2027 for each Assessor Parcel Number within the Annexation Territory.
2. Engineer's Report Approval: The Engineer's Report is hereby approved on a preliminary basis as submitted or amended by the direction of this City Council and is hereby ordered to be filed in the Office of the City Clerk as a permanent record and to remain open to public inspection.
3. Intention: The City Council hereby declares its intention to annex the development known as Tract 6267 Chateau Estates to the City of Reedley Landscaping and Lighting Maintenance District No. 1 pursuant to Chapter 2, Article 2 of the Act, to establish a maximum annual assessment effective beginning in Fiscal Year 2026/2027 and to levy and collect annual assessments against APN 363-090-89 and 363-090-90 commencing with Fiscal Year 2027/2028 in accordance with the Act and the provisions of the California Constitution Article XIIID. Resolution No. 2026-069
6. Assessments: The City Council hereby determines that to provide the improvements described in Section 5 of this resolution, it is necessary to levy and collect assessments against lots and parcels within the Annexation Territory commencing in Fiscal Year 2027/2028. The Engineer's Report referred to in Section 1 of this resolution establishes the proposed maximum assessment including an inflationary adjustment to the maximum assessment rate for Fiscal Year 2026/2027 and an estimate of assessment necessary to provide for the annual operation, administration, services, and maintenance of the improvements for Fiscal Year 2026/2027.
7. Consumer Price Index: If the assessments proposed by this resolution are approved by the property owners pursuant to a mailed ballot election conducted in accordance with Article XIII D of the California Constitution, the City Council in subsequent fiscal years may thereafter impose the assessment at any rate or amount that is less than or equal to the amount authorized for fiscal year 2026/2027, increased each year based upon the Consumer Price Index, All Urban Consumers, for the San Francisco - Oakland - Hayward, CA ("CPI"), as determined by the United States Department of Labor, or its successor without conducting another mailed ballot election. Should the Bureau of Labor Statistics revise such index or discontinue the preparation of such index, the Engineer shall use the revised index or a comparable system as approved by the City Council for determining fluctuations in the cost of living.
8. Compliance with the Constitution: Pursuant to California Constitution Article XIIID, an assessment ballot proceeding is hereby called on the matter of confirming the proposed new assessments for the Annexation Territory. The ballots and notices so authorized shall be distributed by first class mail to the property owners of record as of the last County equalized roll, and each property owner may return the ballot by mail or in person to the City Clerk no later than the conclusion of the public hearing for this matter.
While provisions of the California Constitution Article XIIID require that the City conduct a public hearing not less than forty-five (45) days after mailing a notice of the proposed assessment to record owners of each parcel which will have a special benefit conferred upon them and upon which an assessment will be imposed , California Civil Code, Section 3513 allows anyone to waive the advantage of a law intended solely for their benefit, and the forty-five (45) day mailed ballot period before the scheduled public hearing is not established for a public reason, but is solely for the advantage of the parcels having a special benefit conferred upon them and which an assessment will be imposed .
9. Mailed Notice and Ballot: The City Council hereby authorizes and directs the City Clerk or their designee to prepare and mail the Notice of Public Hearing, and in the same or separate mailing, mail the property owner protest ballot(s) to the subject property owner(s) regarding the proposed levy of assessments and the assessment range formula outlined in the Engineer's Report, for return receipt prior to the date and time of the public hearing set forth in this resolution.
10. Public Hearing: The City Council hereby declares its intention to conduct a public hearing concerning the Annexation Territory, the improvements, and the levy of assessments. At the public hearing, all interested persons shall be afforded the opportunity to hear and be heard.
11. Determination of Majority Protest: The property owner protest ballot proceeding conducted for the Annexation Territory shall constitute the property owner's approval or rejection of the annual levy of assessments and assessment range formula. The property owner may return the ballot by mail or in person to the City Clerk no later than the conclusion of the public hearing on Tuesday, November 10, 2026. After the close of the public hearing, pursuant to Section 4, Sub-Section 4 (e) of the California Constitution, the City shall tabulate the ballots returned to determine if majority protest exists. The ballots shall be weighted according to the proportional financial obligation of the affected property. Majority protest exists if, upon the conclusion of the hearing, ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment.

INTRODUCTION
Pursuant to the provisions of the Landscape and Lighting Act of 1972, being Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section 22500 (hereafter referred to as the "1972 Act"), this Engineer's Report (hereafter referred to as "Report") is prepared in compliance with the requirements of Article 4, Chapter 1, of the 1972 Act regarding the annexation of territories into the City of Reedley's (referred to as "City") existing Landscaping and Lighting Maintenance District No. 1 (hereafter referred to as "LLMD No. 1" or "District").
The City Council of the City of Reedley (referred to as "City Council") being the legislative body for LLMD No. 1, may, pursuant to the 1972 Act, annex territories and levy annual assessments for the operation and administration of LLMD No. 1. Section 22608 of the 1972 Act states "right of majority protest shall be limited to the territory proposed to be annexed ... ".
In addition, the 1972 Act provides for the levy of annual assessments after annexation into or formation of an assessment district for the continued maintenance and servicing of the improvements. The 1972 Act further allows various areas to be annexed into an existing district when the territories in the annexation receive substantially the same proportional special benefits from the improvements. The costs associated with the installation, maintenance, and servicing of the improvements may be assessed to properties, which benefit from the installation, maintenance, and servicing of such improvements.
This Report specifically addresses the proposed annexation of Assessor's Parcel Numbers (APNs) 363-090- 89 and 363-090-90. Development of these parcels is currently anticipated to consist of approximately thirtyfour (34) single-family residential homes and ten (10) apartment buildings, containing a total of approximately eighty (80) apartment units. This description is based on the plans and information available at the time this Report was prepared and may be revised as development of the land proceeds.
The annexation area is more specifically identified as:
• Tract 6267 Chateau Estates, comprised of APNs 363-090-89 and 363-090-90, generally located to the east of South Frankwood Avenue, south of East South Avenue, and north of East Parlier Avenue.
This area is legally described as Parcels 89 and 90 of Parcel Map No. 2951, according to the map thereof recorded in Book 20, Page 87 of Parcel Maps, Fresno County Records. This area is proposed to be annexed into LLMD No. 1 as Annexation Zone HH (referred to as "Annexation Territory"), with the establishment of a proposed maximum annual assessment amount to be effective in Fiscal Year 2026/2027. This Report addresses the levy and collection of annual assessments beginning in Fiscal Year 2027/2028.
The properties associated with and identified herein as Annexation Territory are shown within the Assessment Diagrams incorporated herein as Part D of this Report.
BALLOT PROCEEDINGS
As part of this annexation proceeding, pursuant to the provisions of Article XIIID, Section 4 of the California Constitution (referred to as "Article XIIID"), the City shall conduct a property owner protest ballot proceeding (referred to as "Ballot Proceeding") for the proposed levy of new assessments described in this Report. In conjunction with the Ballot Proceeding, the City Council will conduct a noticed public hearing, scheduled for November 10, 2026, to consider public testimony, comments, and written protests regarding the levy of the proposed new assessments.

The record owner of all parcels within the Annexation Territory executed a Consent and Waiver dated December 17, 2025. The Consent and Waiver acknowledges the proposed annexation and waives the otherwise applicable 45-day notice period to the extent permissible. It does not modify the special benefit analysis, general benefit contribution, method of apportionment, or proposed assessments described in this Report. The executed document is on file with the City Clerk.
Upon conclusion of the public hearing, property owner protest ballots received will be opened and tabulated to determine whether a majority protest exists:
"A majority protest exists if, upon the conclusion of the hearing, ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment. In tabulating the ballots, the ballots shall be weighted according to the proportional financial obligation of the affected property." After completion of the ballot tabulation, the City Council will confirm the results of the Ballot Proceeding. If a majority protest exists, further proceedings to implement the proposed new assessments (including the inflationary adjustment) and to annex the Annexation Territory to the District shall be abandoned at that time.
If tabulation of the ballots indicates that a majority protest does not exist for the proposed assessment and assessment range formula presented and described herein, the City Council may, by resolution, approve this Report (as submitted or amended), order the annexation of the Annexation Territory to the District, approve the assessment diagram, and confirm the assessments. The City Council may order the levy and collection of the assessments for the Annexation Territory with the assessments for other properties in the District during the annual assessment approval process for Fiscal Year 2027/2028. The assessments for the Annexation Territory for Fiscal Year 2027/2028 shall be submitted to the Fresno County Auditor/Controller for inclusion on the property tax roll for each parcel within the Annexation Territory, as approved and ordered by the City Council.
Each subsequent fiscal year, an Engineer's Report for the District including the Annexation Territory shall be prepared and presented to the City Council to address any proposed changes to the improvements, budget, and assessments for that fiscal year. The City Council shall hold a noticed public hearing regarding these matters prior to approving and ordering the levy of such assessments.

Describes the basis on which the costs have been apportioned to each parcel of land within the Annexation Territory, in proportion to the estimated costs of the special benefits to be received by such lots and parcels and a separation of costs considered to be of general benefit (and therefore not assessed). This section also identifies and outlines an Assessment Range Formula that provides for an annual adjustment to the maximum assessment rate initially established by this Report. This Assessment Range Formula limits increases on future assessments but also provides for reasonable cost adjustments due to inflation without the added expense of additional property owner protest ballot proceedings.
PART C - ESTIMATE OF COST OF THE IMPROVEMENTS
An estimate of the annual expenditures and revenues budgeted for the maintenance and servicing of the landscaping and streetlight improvements installed and constructed in connection with the development of properties within the Annexation Territory and/or shared with other properties in the District that benefit from similar improvements. The budget(s) include an estimate of anticipated direct maintenance costs and incidental expenses associated with the improvements, including but not limited to administration expenses and the collection of appropriate fund balances. The maximum assessment rates established for the Zones are based on similarities in property developments, improvements, services, and expenses. The maximum allowable assessment rate (Rate per Benefit Unit) for each Zone of the District, as approved by a vote of the property owners in a protest ballot proceeding, includes an assessment range formula that provides for an annual Consumer Price Index adjustment to the maximum rate.
PART D - ASSESSMENT DIAGRAMS
Contains a diagram of the exterior boundaries of the Annexation Territory along with the lines and dimensions of each lot or parcel of land within the area to be annexed into the District.
PART E - ASSESSMENT ROLL
Identifies the maximum assessment to be levied on each benefited lot or parcel of land within the Annexation Territory.
DISCLAIMER
If any section, subsection, subdivision, sentence, clause, phrase, portion, or zone of this Report is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of the Report and each section, subsection, subdivision, sentence, clause, phrase, portion, or zone thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, portions, or zones might subsequently be declared invalid or unconstitutional.

PART A - PLANS AND SPECIFICATIONS
DESCRIPTION OF THE DISTRICT
On November 7, 1989, the City of Reedley Landscaping and Lighting Maintenance District No. 1 was formed under the provisions of the 1972 Act and in compliance with the substantive and procedural requirements of the California Constitution Article XIIID (the "California Constitution"). The District consists of twenty-eight (28) benefit zones (Zones A, E, G through U, W through Z, AA, BB, CC, DD, EE, FF, and GG) (referred to collectively as the "Zones"), such that properties receiving special benefit from a particular improvement are assessed for such improvements in proportion to the benefit received. The assessments provide funding for the ongoing maintenance, operation and servicing of the local pocket parks, open spaces, landscaping and irrigation in local area buffers, entryways and median islands, street trees in park strips block walls and local street lighting within the District.
DESCRIPTION OF THE ANNEXATION TERRITORY
The Annexation Territory identified within this Report incorporates the lots or parcels of land within and/or in proximity to the development and improvement areas associated with Tract 6267 Chateau Estates.
Specifically, the Annexation Territory can be found on the Fresno County Assessor's Parcel Map within Book 363, Page 9.
The Annexation Territory is generally located to the east of South Frankwood Avenue, south of East South Avenue, and north of East Parlier Avenue. The area is identified by the Fresno County Assessor's Office as APNs 363-090-89 and 363-090-90, totaling approximately 13.470 acres. Development of the Annexation Territory is anticipated to consist of approximately thirty-four (34) single-family residential homes and ten (10) apartment buildings, containing a total of approximately eighty (80) apartment units.
DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED AND SERVICED The improvements to be installed, maintained, and serviced within the Annexation Zone HH are generally described as streetlights, landscaping, and irrigation improvements within or adjacent to the Annexation Territory and surrounding properties. Together these improvements provide special benefits to those individual parcels located within the Annexation Territory. These improvements collectively may include, but are not limited to: landscaping, lighting, planting, shrubbery, trees, grass, bark, other ornamental vegetation, irrigation systems, hardscapes, and fixtures; as well as facilities which are appurtenant to any of the foregoing or which are necessary or convenient for the maintenance or servicing thereof, including, but not limited to, clearing, removal of debris, the installation or construction of curbs, gutters, walls, sidewalks, paving, or water, and irrigation, drainage, or electrical facilities.
The Annexation Territory, as part of LLMD No. 1, will fund costs in connection with the maintenance and servicing including, but not limited to, labor, electrical energy, water, materials, contracting services, administration, and other expenses necessary for the satisfactory maintenance and servicing of these improvements.

PART B - METHOD OF APPORTIONMENT
BACKGROUND
The 1972 Act provides that assessments may be apportioned upon all assessable lots or parcels of land within an assessment district or annexation in proportion to the estimated benefits to be received by each lot or parcel from the improvements. In addition, the California Constitution Article XIIID requires a parcers assessment may not exceed the reasonable cost of the proportional special benefit conferred on that parcel.
Article XIIID further provides that only special benefits are assessable, and the City must separate the general benefits from the special benefits conferred on a parcel. A special benefit is a particular and distinct benefit over, and above general benefits conferred on the public at large, including real property within the district or annexation. The general enhancement of property value does not constitute a special benefit.
SPECIAL BENEFIT ANALYSIS
LANDSCAPING
The ongoing maintenance of public landscape areas within the District provides aesthetic benefits to the properties within each respective Zone and more specifically, those improvements identified in Part A of this Report provide aesthetic benefits to the properties within the Annexation Territory and create a more pleasant environment to walk, drive, live, and work. The primary function of these landscape improvements and related amenities serve as an aesthetically pleasing enhancement and green space for the benefit of those parcels and developments for which the improvements are to be constructed and installed for the benefit of those parcels and developments within the Annexation Territory. These improvements are an integral part of the physical environment of parcels within the Annexation Territory and the associated District, providing a positive enhancement of the communitis character, attractiveness, and desirability. Collectively the improvements to be provided by the District and specifically for the Annexation Territory as part of Annexation Zone HH represent a physical extension of those parcels, and if the improvements are not properly maintained, it is these parcels that would be aesthetically burdened. Additionally, street landscaping serves as a pleasant aesthetic amenity that enhances the approach to the parcels and in some cases, serves as both a physical buffer as well as a sound reduction buffer between the roadways and the properties within the District/Zone. Likewise, the landscaped areas for some of the Zones within the District may include landscaped parks, green spaces, slopes, or trails that provide visually pleasing open space areas that serve as an extension of the physical attributes of the parcels assessed, such as their front or rear yards and may also provide a greater opportunity for recreation. As a result, the maintenance of these landscaped improvements and amenities provides a particular and distinct benefit to the properties and developments within each respective Zone, including the proposed Annexation Territory.
STREET LIGHTING
Street lighting in the District is primarily useful for illuminating the streets that provide access to the properties in the District as well as the sidewalks and parking lanes associated with those properties. While it is recognized that both streetlights and traffic signals serve in part to enhance traffic safety, installation and construction of these improvements were clearly required by the development of properties within the District/Zone and these improvements provide three main special benefits to those properties: (i) property security benefit, (ii) pedestrian safety benefit, and (iii) parkway/roadway egress benefit. Furthermore, because traffic circulation in the City is largely the result of local traffic to and from these properties by the City of Reedley

property owners and guests, it is reasonable to assume that these properties derive a particular and distinct benefit from the streetlights and traffic signals that support the safe access to the properties and essentially all pedestrians and parked vehicles in the lit areas will, after dark, be directly associated with the assessed properties. As a result, the maintenance of these lighting improvements is a particular and distinct benefit to the properties in Zone H H.
GENERAL BENEFIT ANALYSIS
Pursuant to the 1972 Act and the provisions of the California Constitution, the costs of the District/Zone are apportioned by a formula or method that fairly distributes the net amount to be assessed among all assessable parcels in proportion to the special benefit to be received by each such parcel from the improvements. Article XIIID requires that a parcel's assessment may not exceed the reasonable cost of the proportional special benefit conferred on that parcel. Article XIIID also requires the agency to separate the general benefit from special benefit and that only special benefit is assessable.
The landscaped areas and related improvements funded by the proposed assessment for Zone HH were installed in connection with the development of properties within the Annexation Territory and are designed to directly serve those properties. The maintenance of these improvements provides a particular and distinct benefit to the parcels within the Annexation Territory by enhancing aesthetics, functionality, and overall neighborhood environment.
In the absence of a special funding Zone, the City would typically provide only limited tree management, weed abatement, rodent control, and erosion control services for the various landscape easement areas.
This baseline level of service would typically provide for periodic servicing of the improvement areas (generally twice annually) or on an as-needed basis to address health and safety concerns. Such baseline services are intended to protect the general public and adjacent properties from potential hazards, including fire risk, obstruction of visibility, or damage to roadways and infrastructure. However, this limited level of maintenance results in a substantially less maintained and less visually appealing environment than the enhanced, regular landscape maintenance provided through the District. The enhanced level of service represents a particular and distinct benefit to the properties within the Annexation Territory beyond that minimal public safety baseline.
To ensure compliance with Article XIIID and to maintain a conservative allocation, a nominal general benefit component of $92 annually has been identified to account for incidental public advantages associated with the improvements. This amount has been deducted from the total annual costs prior to apportionment. The remaining balance represents the proportional special benefit conferred upon the parcels within the Annexation Territory.
APPORTIONMENT
The method of apportionment (method of assessment) is based on the premise that each assessed parcel receives a proportional special benefit from the improvements maintained, serviced, and funded by the assessments and specifically, the lighting, landscape and irrigation improvements installed in connection with the development of these parcels. The functionality, safety, and aesthetic environment of properties within the District is enhanced by the presence of well-maintained lighting and landscaping improvements in close proximity to those properties.

The cost to provide maintenance and servicing of the improvements within or adjacent to the original area and each annexation area represent a zone of benefit (referred to throughout as "Zone") and provide a distinct and special benefit to each parcel in the Zone. The cost to provide maintenance and servicing of the improvements for each Zone are determined and are fairly and equitably distributed among each assessable parcel in the Zone based upon the estimated proportional special benefit received by each parcel. Expenses associated with the preparation of the Engineer's Report and District administration are fairly and equitably distributed to each District Zone, including those that have no improvements or that are fully or partially selfmaintained.
In addition to the use of Zones, the method of apportionment established for the District utilizes a weighted methodology commonly referred to as an Equivalent Benefit Unit ("EBU") methodology to reflect the proportional special benefit of each parcel.
For the purposes of this Engineer's Report, an EBU is the quantum of benefit derived from the District improvements by a single-family residential parcel. The single-family residential parcel has been selected as the basic unit for calculation of assessments. Thus, the "benchmark" property (the single-family residential parcel) derives one EBU of benefit and is assigned 1.00 Equivalent Benefit Unit.
An assessment amount per EBU ("Rate") for the Zone improvements is established by dividing the total balance to be levied for the Zone by the total number of EBUs assigned to parcels benefiting from such improvements.
Total Balance to Levy/ Total EBUs = Levy per EBU ("Rate") This amount is then applied back to each parcel's individual EBU to determine each parcel's proportionate benefit and assessment obligation.
Rate x Parcel EBU = Parcel Levy Amount
LAND USE CLASSIFICATIONS
Every parcel within the District is assigned a land use classification based on available parcel information obtained from the County Assessor's Office. It has been determined that parcel use and size are the appropriate factors necessary to identify and calculate the proportional special benefits conveyed to each property within the District and respective Zone for the cost of improvements associated with that property.
The following provides an overall description of the various land use classifications assigned to properties in the proposed Zone HH and the proportional special benefit (weighted allocation) for those land uses. The proposed Zone HH will be comprised of lots identified as Residential Single-Family Parcels and Residential Multi-Family Parcels.
Residential Single-Family Parcels (SFR) - This classification may include but is not limited to all subdivided residential tract lots (with or without structures); town homes; condominiums; or other single-family residential units on a single parcel. The single-family residential parcel has been selected as the basic unit for calculation of assessments, and each is assigned one (1.00) Equivalent Benefit Unit.
Multi-Family Residential Parcels (MFR) - This land use classification identifies properties that are used for residential purposes but contain more than a single residential unit on the parcel (parcels with more than one dwelling). Based on an overall evaluation of the proposed development within Zone HH - Tract 6276 Chateau Estates, it was determined that the average-sized SFR parcel yielded approximately four (4) dwelling units per acre of land. In comparison, 1.7 of a proposed multi-family (apartment) building could be City of Reedley

accommodated on one (1.0) acre of land. Thus, a weighted proportional special benefit factor of 2.5 EBUs has been assigned per MFR building/complex on a parcel of land.
Vacant/Undeveloped Parcels (VAC/UNDV) - This classification includes properties that are identified as parcels with no development but have development potential. Although it is recognized that the improvements provided within the various Zones of the District were primarily constructed and installed as the result of property development, it is also recognized that the majority of these improvements were constructed in part to support the overall development of properties within the District and/or Zone to their full and best use, including vacant undeveloped properties. Therefore, parcels identified as Vacant/Undeveloped Parcels shall be assigned a proportional EBU that is twenty-five percent (25%) of the developed non-residential property, or 1.75 EBU per acre, up to a maximum of five (5) acres per parcel.
Exempt Parcels - The following are exempt from the assessment: areas of streets, avenues, lanes, roads, drives, courts, alleys, public easements, rights-of-way, parkways, and drainage/pond basins. Also exempt are utility rights-of-way used exclusively for utility transmission, common areas (such as in condominium complexes), land dedicated as open space or parks, landlocked parcels, and small parcels vacated by the City, as these parcels do not benefit from the improvements. In addition, public schools, government agencies, and parcels with no road frontage will not be assessed.
The following table identifies the defined land use classifications and corresponding EBU assignments.

ASSESSMENT RANGE FORMULA
Any new or increased assessment requires certain noticing and public meeting requirements by law. Prior to the passage of Proposition 218 (California Constitution Articles XIIIC and XIIID), legislative changes in the Brown Act defined a "new or increased assessment" to exclude certain conditions. These conditions included any assessment that does not exceed an assessment formula or range of assessments previously adopted by the agency or approved by the voters in the area where the assessment is imposed. This definition and condition were later confirmed through Senate Bill 919 (the Proposition 218 implementing legislation).
The purpose of establishing an assessment range formula is to provide for reasonable and predictable annual adjustments to the maximum assessments without requiring costly noticing and mailed ballot procedures each year. Commencing with Fiscal Year 2027/2028, the maximum assessment may be increased annually to account for rising labor and material costs.
The maximum assessment amount allowed for each fiscal year shall be adjusted annually by an amount equal to the percentage increase of the CPI for the San Francisco-Oakland-Hayward area for Urban Consumers, as developed by the U.S. Bureau of Labor Statistics, annually. The Assessment Range Formula shall be applied to the maximum assessment rates developed for Fiscal Year 2026/2027 and shall be applied in each subsequent fiscal year unless the City Council formally suspends its application.

PART C - ESTIMATED COST OF THE IMPROVEMENTS
The 1972 Act provides that the estimated costs of the improvements shall include the total cost of the improvements, including incidental expenses, which may include reserves to operate the District until assessment revenues are collected on the County tax rolls and remitted to the City, typically in December or January of the applicable fiscal year.
The 1972 Act also provides that the amount of any surplus, deficit, or contribution be included in the estimated cost of improvements. The net amount to be assessed on the lots or parcels within LLMD No. 1 is the total cost of installation, maintenance, and servicing with adjustments either positive or negative for reserves, surpluses, deficits, and/or contributions.
The budget on the next page outlines the estimated costs to maintain the improvements at build-out and establishes the initial Maximum Assessment per EBU (Maximum Assessment Rate) for Fiscal Year 2026/2027. Commencing with Fiscal Year 2027/2028, the Maximum Assessment Rate may be adjusted annually in accordance with the Assessment Range Formula described herein. The actual annual levy for each fiscal year shall be based on the estimated net cost of maintaining and servicing the improvements for that fiscal year, not to exceed the applicable Maximum Assessment Rate as adjusted.

RECOMMENDATION
Consideration of items pertaining to the construction of the Aviation Fuel Facility Replacement Project at the Reedley Municipal Airport: A) Approve and authorize the City Manager to execute the Public Improvement Agreement and all supporting documents with Gems Environmental Management Services, Inc. in an amount not to exceed $2,728,497.78, B) Adopt Resolution NO. 2026-071 amending the 2026-27 Adopted Budget appropriating $2,969,209 in the Airport Enterprise Fund and C) Approve and authorize the City Manager to execute an agreement and all supporting documents with C&S Companies to provide Construction Management Services.
EXECUTIVE SUMMARY
Staff recommends that the City Council approve the award of a contract to Gems Environmental Management Services, Inc in an amount not to exceed $2,728,497.78 and authorize the City Manager to execute the Public Improvement Agreement for the construction of the Aviation Fuel Facility Replacement Project. Execution of the Agreement is subject to the submittal of the required bonds, insurance certificates, and other documents as required by the specifications, special provisions and applicable State and Federal laws.
This project includes three approximately 12,000-gallon aboveground storage tank (AST) systems. The proposed facility will include one AST for Jet-A fuel, one AST for low-lead aviation gasoline (1 00LL Avgas) with the capability to convert to unleaded Avgas in the future, and one AST for unleaded aviation gasoline (UL Avgas).
The proposed Avgas tank systems will accept fuel delivered from over-the-road supply vehicles, and will provide for self-service dispensing of fuel into aircraft via over-wing fueling nozzles through an interface with a card reader system. The proposed Jet-A fuel tank system will include a pumping system to offload fuel from supply vehicles and will provide for selfservice dispensing of fuel into aircraft via over- and under-wing fueling systems through an interface with a card reader system.
The Aviation Fuel Facility Replacement Project will replace the existing fuel systems, which consists of underground storage tanks and currently offers only two fuel options: Jet-A fuel and low 1 O0LL Avgas. The addition of UL Avgas is new to the Reedley Municipal Airport and will make the airport one of only a few airports in California and around the nation to offer this fuel.
With the transition of Reedley College Flight Science Program to the Reedley Municipal Airport, there is an increased need for UL Avgas for the college's fleet of five Skyleader aircraft. These aircraft operate more efficiently with UL Avgas, which also substantially reduces routine maintenance requ irements. The availability of UL Avgas at Reedley Municipal Airport wi ll provide this benefit to the college fleet as well as other aircraft that are capable of using the fuel.
This project aligns with the Federal Aviation Administration (FAA) EAGLE initiative's goal of safely eliminating leaded aviation fuel from piston-engine aircraft by the end of 2030 without adversely affecting the safe and efficient operation of the applicable general aviation fleet.
The project positions Reedley Municipal Airport to provide access to this emerging fuel source.
A stand-alone item will be brought before the City Council in the near future to accept and authorize the City Manager to sign the Measure C New Tech Grant Agreement with Fresno County Transportation Authority for this funding portion of the project.
BACKGROUND
Design of the Aviation Fuel Facility Replacement Project was completed in January 2026, and the project was advertised for construction bids in early spring 2026. Bids were due on April 17, 2026, and the City received one bid from Gems Environmental Management Services, Inc.
Staff worked with the City's airport consultants to identify comparable aviation fuel facility projects and evaluate the competitiveness of the submitted bid . Staff also met with the FAA to discuss the single bid received. Following this discussion, the FAA confirmed that the City could proceed with submitting a construction grant application based on the single bid received.

WORKSHOP TO CONSIDER CHANGES TO THE PROCEDURE FOR THE
SELECTION OF THE MAYOR AND MAYOR PRO TEMPORE - NO ACTION TO
BE TAKEN
Nicole R. Zieba, City Manager ✓
In 2015, the City Council approved Resolution 2015-004, subsequently incorporated into Resolution 2026-031, also known as the City Council Protocols, which outlines the procedure for selecting the Mayor and Mayor Pro Tempore for the City of Reedley.
Under the Reedley Municipal Code, the Mayor and Mayor Pro Tempore have no additional powers than those of other Councilmembers but are responsible for presiding over meetings of the City Council and representing the City on outside committees and boards, such as the Council of Governments, and attending ceremonial functions on behalf of the City as the presiding officer of the Council.
Resolution 2015-004 calls for a rotation of Mayoral duties on a two-year basis, according to Council District number. The Resolution also has other criteria and requirements associated with the position of Mayor.
The City Council has the discretion to determine how it wishes to select a presiding officer. There are a few criteria that staff have found to be beneficial over the years and would suggest be incorporated into any new policy of the Council. These include:
• Ensuring that any Councilmember selected as Mayor or Mayor Pro Tempore have at least one year of experience as a Councilmember. This is to make sure that whomever runs the meeting is knowledgeable about the Brown Act, Robert's Rules of Orders, and other procedures for running a smooth formal governing body meeting.
• Having a two-year term for the Mayor and Mayor Pro Tempore. When the presiding officer rotates, there are many behind-the-scenes changes that must occur, such as new signing authority cards at the City's financial institutions, formal notification to the Secretary of State and other bodies, rotation of the formal Council of Governments representative, and others.
Rotating on an annual basis would require all of these additional administrative burdens to happen every year.
• The current seated Councilmembers who are next to serve as Mayor should have the opportunity to be Mayor, as they were brought in when Resolution 2015-004 was in effect and have been preparing for their rotation as presiding officer. A new policy could include a statement allowing any currently seated Councilmember to have their opportunity to rotate into the seat prior to the new procedure becoming effective. Councilmembers in Districts 3 and 4 would be next in the rotation policy and should have the opportunity to serve as presiding officer, assuming both members remain on the Council until their appointed time to rotate into the seat of Mayor and Mayor Pro Tempore.
• Staff would also recommend that the position of Mayor be filled by the same person for no more than a two-year term. When that Councilmember's term of service has completed, that Councilmember shall wait at least the subsequent two-year term before being eligible to serve again as Mayor. This best practice would prevent the community from misunderstanding the role of Mayor, as the Mayoral position in the City of Reedley is only to serve as presiding officer and is not independently elected nor has additional powers of other Councilmembers. Having the same Councilmember in the role of Mayor for a lengthy period of time may lead to the perception that Reedley has a strong Mayor or independently elected Mayor.
During the workshop session, Council can discuss how it wishes to select its presiding officer. No vote is requested or allowed on a workshop item. After gathering comments and suggestions from Council, staff will then place an item on a subsequent meeting agenda with the formal policy in Resolution form for the City Council to consider and adopt or amend.
ATTACHMENT
Existing Section Ill of Resolution No. 2026-031, Procedure for the Selection of Mayor and Mayor Pro Tempore
III. PROCEDURE FOR THE SELECTION OF THE MAYOR AND MAYOR PRO
TEMPORE
1. At the first meeting of December in each even-numbered year, the office of Mayor shall automatically rotate to the next successive Council Member in the rotation according to Council District number order.
2. If the Councilmember who is next to serve as Mayor has less than one year of experience as a Councilmember for the City of Reedley, the rotation shall automatically rotate to the next Councilmember by Council District number in the rotation and the recently elected/appointed Councilmember who lacks the one year of experience shall be placed at the end of the rotation.
3. Should any Councilmember decline to serve when it is his or her turn to serve, based on rotation, the office of Mayor shall automatically rotate to the next Councilmember, by Council District number, in the rotation.
4. When a Councilmember's two-year term of service as Mayor has been completed, that Councilmember shall be placed at the end of the rotation, except as otherwise designated by the Mayor-elect in accordance with Section 3 of this policy.
5. The office of the Mayor Pro Tempore shall also be selected based on Council District number order, in accordance with the foregoing formula. The Mayor Pro Tempore shall automatically become Mayor following completion of the Mayor's term of service, as outlined above, and the new Mayor Pro Tempore shall become the Councilmember next in rotation.
6. If the Mayor or Mayor Pro Tempore position becomes vacant at any time during the year of service, the Councilmember next in the rotation, by Council District number, shall fill the position and serve as Mayor or Mayor Pro Tempore for the remainder of the vacant term.
7. Completing the term of Mayor or Mayor Pro Tempore on behalf of another Councilmember due to an unexpected vacancy shall not be considered when determining seniority to serve as the Mayor or Mayor Prop Tempore in the proper and normal line of succession, nor preclude such Councilmember from serving as Mayor or Mayor Pro Tempore in his or her own right in the proper and normal line of succession.
(Adopted, Resolution No. 2015-004)
