RESOLUTION NO._____
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO DECLARING PROPERTY TO BE PUBLIC RIGHT OF WAY AND ACCEPTING THE PROPERTY INTO THE CITY STREET SYSTEM.
WHEREAS, on September 22, 2020, the City Council approved a Purchase and Sale Agreement and Escrow Instruction and License and Maintenance Agreement concerning property to be used for entry into the Tract No. 20092 El Rancho Verde Development off Highland Avenue, which is more particularly described in Exhibit A, attached hereto and incorporated herein (“Subject Property”); and WHEREAS, under the Purchase and Sale Agreement, El Rancho Verde Golf, LLC paid for the acquisition costs associated with the Subject Property, and the Subject Property was conveyed to the City in fee; and WHEREAS, in accordance with the License and Maintenance Agreement approved by the City, El Rancho Verde’s successor in interest, AG Essential Housing CA 4, LP., will be constructing the roadway entrance to the development and the Subject Property, and maintaining those improvements until the project is complete and ready to be dedicated and accepted by the City; and WHEREAS, so that the Subject Property is part of the city street system and can be used by utilities companies as public right of way, the City Council adopts this Resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Recitals. That the recitals set forth hereinabove are true and correct in all respects, and are incorporated herein.
Section 2: Declaration of Public Right of Way and Acceptance into City Street System. The Subject Property is hereby declared to be public right of way, and pursuant to Section 1806 of the Streets and Highways Code, is hereby accepted by the City of Rialto into the City street system.
WHEREFORE, this Resolution is passed, approved and adopted this 11th day of January, 2022. _______________________________
