PROCLAMATIONS

1. Certificate of Recognition to
The Legacy Bridges Foundation, Inc. –
Mayor Deborah Robertson
0o0
2 Presentation Cal – Recycle
0o0
Council Member Trujillo asked about the response to all the costs to lessen the impact to the community.
0o0
Cal-Recycle Representative stated the City of Rialto has a hauler that has existing processing infrastructure to keep the cost down compared to other jurisdictions. The Legislature approved grant funding for jurisdictions. We will see if they will approve additional funding. Rialto has been implementing for commercial businesses. There is infrastructure in place for that. There is a collection system for residents.

That will help keep costs down for the City. The City of Rialto is well positioned. Should the City implement its action plan, it will be protected from any penalties.
0o0
Council Member Trujillo asked about incentives rather than enforcement. Is there a way to waive certain fees to encourage composting?
0o0
Cal-Recycle Representative stated that opportunity will have to be explored more in detail. Cal -Recycle will b e implementing their next community composting grant. This would allow the City to apply for grant and allow some funding to expand on the community composting program. We expect the City not to have to issue penalties.

If those collection service s are being provided, generators going to participate.
0o0
Council Member Carrizales asked if renewal natural gas is available in the area.
0o0
Cal-Recycle Representative stated that there are a number of facilities that are generating renewable natural gas. The City of Rialto has the Anaergia facility.
0o0
Mayor Robertson stated that the City Manager has asked for guidance and direction from the City Council. By April 1, 2022, we need to take action or it will be imposed on us.

PRESENTATIONS AND

PROCLAMATIONS
City Attorney Vail stated you need to have a Resolution and a plan by March 1, 2022 in order to qualify for the two years. Otherwise the Ordinance will be effective April 1, 2022.

DocuSign Envelope ID: 2B50ADD6-3E5C-4F69-AB27-6E4BFCB965C0 ___________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Rialto City Council Meeting Minutes – February 8, 2022 Page 6 Council Member Perez asked if the two years is from January 1, 2022 as opposed submission date.
0o0
Cal-Recycle Representative stated that is correct. Should the City need additional time, we do have statutory authority to extend the timeline. 0o0
Mayor Robertson reiterated the item will have to be brought back to the City Council on February 22, 2022 to take action on the Resolu tion to have something in place April 1, 2022.
0o0
City Manager Fuller asked Cal -Recycle to clarify the Resolution to request the two-year delay. You still are requiring that the City will have adopted its enforcement mechanism by April 1, 2022?
0o0
Cal-Recycle Representative stated that is correct.
0o0
Mayor Robertson stated with that said, the Item is to bring it back for the second meeting in February 22, 2022.
0o0
Council Member Trujillo stated the emphasis should be on incentives rather than enforcement.
0o0
Mayor Robertson agreed with Council Member Trujillo. She stated that could be done with what the City provides them in the proposal. What I heard is we have to adopt the Resolution or not. We can work out some of the things we would like to put in place to determine if we can accomplish the same objective.

Anybody disagree that we should bring it back for the February 22, 2022 City Council meeting or wait March 8, 2022?
0o0
City Manager Fuller stated that that the Resolution had to be adopted by March 1, 2022. It would have to come to the next meeting. 0o0
Council Member Trujillo requested that the matter go through the Subcommittee to avoid a disconnect.
0o0
Mayor Robertson stated there is a Subcommittee.

PRESENTATIONS AND

PROCLAMATIONS
Council Member Trujillo stated the Solid Waste Subcommittee. 0o0
Mayor Pro Tem Scott asked Council Member Trujillo what kind of plan. 0o0
Council Member Trujillo stated it has to do with our Resolution and how we are going to implement this program. When plan is mentioned with the Resolution, I assumed it is our vision for this program. 0o0
City Manager Fuller stated we will be provided with a sample model plan, but it will be based on the roll out and implementation so it is less of an impact on the residents and community.
0o0
Mayor Pro Tem Scott stated we have to adopt their plan. Th ere’s no choice.
0o0
City Manager stated the model Ordinance folds all the regulatory requirements of SB13, we don’t have the discretion of adopting an Ordinance that picks and chooses what the minimum requirements are in that Ordinance.
0o0
Mayor Pro Tem Scott asked if we are going to have what the average cost will be to each resident in this community
0o0
City Manager Fuller stated I don’t think we will.
0o0
Mayor Pro Tem Scott asked how do you vote on something when you don’t have that cost.
0o0
City Manager Fuller stated that has been his question. What I have been told is that many cities are on the fly trying to figure out what the cost will be.
0o0
Mayor Pro Tem Scott stated he believed the City of Claremont is $9.00 a month. Is that true Chief?
0o0
Police Chief Kling stated almost $7.00.
0o0
City Manager recommends the City take on as much as possible so it doesn’t translate to a rate increase with costs that Burrtec has to incur such as Code Enforcement. There are ways to strategize. 0o0

PRESENTATIONS AND

PROCLAMATIONS
Mayor Pro Tem Scott asked if the City will have Code Enforcement checking people’s trash cans to make sure there are organic waste in their trash can.
0o0
City Manager Fuller stated that is one of the elements of SB 1383 that is required, yes.
0o0
Mayor Robertson believed there was an element that was voluntary.

Residents can attest that they are doing something in a voluntary basis with periodic spotting.
0o0
City Manager Fuller stated if someone is already voluntarily composting and practicing organic recycling onsite, we should have a mechanism to have that fee waived.
0o0
Mayor Pro Tem Scott who will that be verified.
0o0
City Manager Fuller stated there will be a checking of the waste stream to make certain there no organics waste in the solid waste bins. One way to help reduce the rate increase is to take on some of those costs internally.
0o0
Mayor Pro Tem stated there is not enough code enforcement staff already. There is no way around this.
0o0
Mayor Robertson stated the City receives funds back annually from Cal- Recycle for the environmental recycling already done. How can we offset cost associated to the residents or as a cash incentive? What do we do with that money?
0o0
Council Member Perez asked what other cities are doing to monitor its residents doing the program.
0o0
Cal-Recycle Representative stated most jurisdictions use a hauler.

Burrtec does “lid flipping” It’s up to the City to decide how many container they will flip for every route.
0o0
Council Member Perez asked if there was an additional cost in for service.
0o0
Cal-Recycle Representative stated she does not have all the information on how many routes but it can certainly can be discussed. 0o0

Council Member Perez stated they have continuous movement within no more than 10 minutes per hour. It is good that they continue to move around in different areas at different times.
0o0
Captain Vega stated accountability is the big factor with any security company. American Guard Services has multiple ways of verifying that staff is doing what they’re supposed to be doing and where they’re supposed to be at.
0o0
Mayor Robertson asked if there were any public comments on TAB 4. 0o0
City Clerk McGee stated no.
0o0

Council Member Trujillo complimented Captain Vega on his staff report.

He inquired about Park Rangers for Frisbie Park. Will there be more facilities covered? Is it part of this contract or will there be something additionally.
0o0
Captain Vega s tated that with this contract if park rangers were deployed at Frisbie Park, it can be amended and reduced at any time.

If we don’t need a particular portion and it is going to be covered by a different entity, we can reduce that from the contract. 0o0
Council Member Trujillo stated he would move for approval. 0o0
Council Member Carrizales second the motion.
0o0
Mayor Robertson expressed her concerns with the scoring of the firm.

Four years ago they raised concerns because they weren’t shortlisted as compared to other firms. The firm has a lot of features that were not presented four years ago. The company has been in business 24 years.

I suspect four years ago, the Police Department was part of the review panel, but it didn’t specify in the staff report. She referenced the bid list and stated a firm who didn’t make the list -- but who are under contract with Ontario International Airport --- brought it to the attention of the Mayor since th ey had not heard any word. I don’t see this selected company as having any business in San Bernardino other than an office on Archibald Avenue.

Mayor Robertson also questioned the company’s attorney fees and their litigation background and contract history. She asked the City Council to review the matter. Those are some questions. Would you like to start with answering or would you like for them to present wh y Mr. Gerald Gregory is listed for notices as President then signs as Executive Vice President.
0o0
Mr. Gerald Gregory, Executive Vice President, with American Guard Services stated the listing of President and Executive Vice President is an error. In 2016, American Guard did not have a lot of exposure to the government sector. In mid 2015, they acquired a company I founded Vets Securing America primarily hiring military and law enforcement veterans to serve primary government contracts. Sold the company to one of the largest women-owned companies, American Guard, founded and based in California, have several branches throughout and service in and around Rialto.
0o0
Mr. Gregory stated we always want to have an office local to our contract so we can properly serve those contracts.

I wanted to clarify those two points. The association for Vets Securing America One, which I am still the President of that company, and I am also the Executive Vice President of American Guards Services, Government Division. One of the purposes in buying my company was to get it into the government sector in the West Coast area. I was an East Coast company and went to the Mid -West. I too k charge of the government section in 2017. I run the government division, and I also continue to run VSA, which is primarily government contract and grown in our government sector business.

We listed five references, as per the RFP specs in relationship to size and scope. However, we have hundreds of government contracts in the state of California and the state of Arizona with public contracts for over six years. We are proud of our record of renewing government contracts including long -term contracts with the Department of Transportation agencies in different states with VSA and AGS.

I can assure you and the City of Rialto that the professionals that you will have working – if awarded this contract – are going to be specifically trained to not only you r specifications, but to working with the government and being the ambassadors representing the City of Rialto.

Regarding the litigation questions, we do have in -house counsel. We have had no litigation with our customers or our clients. We have a lot of insurance to protect our customers. We make sure we train the officers so we are not involved in litigation involving our services. The litigation most commonly involved in is workers’ compensation and slip- and-falls.

Mr. Gregory, stated that in 2016, AGS was not qualified for this contract because they did not have the infrastructure and the government specialist running government division separating all other divisions.

We don’t cross-use our officers from other divisions. They are only the government division that work on your contract.
0o0
Mayor Robertson thanked Mr. Gregory for his response and commended him on his law enforcement background. She asked if there were any lawsuits at the federal level that were lost. 0o0
Mr. Gregory stated no. Currently we have multiple federal contracts.

We have never been involved in any type of litigation or action or criminal.
0o0
Council Member Trujillo asked if AGS will be in connection with SWAG. 0o0

Captain Vega stated there will be an introduction with SWAG so the security officers have that contact. We will make sure that happens. 0o0
Mayor Robertson asked for clarification on the amount on the proposal for projection.
0o0
Captain Vegas stated it was a scope of work that was provided. AGS came up with their quotes based on the scope of work and the locations that were required for security and patrol services.
0o0
Mayor Robertson stated there’s a motion on the floor.
0o0
City Clerk McGee stated there’s a motion and a second.
0o0
City Attorney Vail clarified per the motion, it was to approve the contract.

I want to make sure it includes the four items that are articulated in it.

There’s a contract; a Second Amendment; a budget; and a Resolution.

I’m assuming it’s everything.
0o0
Council Member Carrizales stated yes, everything.
0o0
Mayor Robertson asked for a roll call vote.

Marcus Fuller, City Manager, presented staff report to Request City Council to Refer to Recreation and Parks Commission to Review and Recommend the Naming of the Rialto Historical Society
Museum after Jean Randall, and to Set a Public Hearing for March 8, 2022, to Approve the Facility Naming at the Historical Society Museum to the “Jean Randall Museum”.
0o0
Mayor Robertson stated she wanted to clarify it is referring to the “building” and not in any way taking away any parts of the Rialto Historical Society, which is a 501(c)(3) group. Naming it “Jean Randall Museum leaves it broad and open. It is historical. We can add the word “historical”. The church has an official de signation, and it is on the national register of historical facilities. This building was purchased by the City. In the spirit that I presented it, I hope that we give this recognition to her especially with her long history with the City of Rialto. 0o0

Mayor Pro Tem Scott stated Ms. Randall was a great statesman and a hardworking person of the community. She always gave her opinion but still loved you no matter what. She was a great lady and knew her for over 30 years. I wished we could have celebrated her birthday with her, but she is in a much better place. God rest her soul.
0o0
Council Member Trujillo stated Ms. Randall has a very special place in his heart. He asked if there was a distinction between the Kristina Dana Hendrickson Cultural Center sign, and museum name. However, online, it indicated as a museum.
0o0
Mayor Robertson stated the designation was designating both facilities.

Dr. Hendrickson donated the church to the City. The City purchased the building. There was a dedication naming the Kristina Dana Hendrickson Cultural Center for the two spaces, but it did not name the building. 0o0
Mayor Robertson stated we are just asking for the dedication and then to go through the Recreation & Parks Commission and come back to the City Council with appropriate recommendations.

She requested a copy of the agreement to determine if there was any action by the City Council.
0o0
Mayor Pro Tem Scott stated a copy of the agreement could be obtained through former Council Member Lynn Hirtz.
0o0
City Manager Fuller stated he is meeting with Ms. Hirtz this week and will ask for it.
0o0
