Motion by Council Member Trujillo second by Mayor Pro Tem Scott and carried by a 5-0 vote to Close the Public Hearing.
0o0
Community Development Manager Gonzalez commented on the offsite improvements that will be added to the projects such as sidewalks and parkways. The location of the drive-thru is as far east as possible which will allow traffic away from Ayala and Casmalia. There is a minimum of a 10-car stacking distance onsite. There is no standard for stacking .
Seven cars is typical for stacking and there will be more opportunity for more cars.
0o0
David Hammer, City Engineer, addressed Public Speaker comments related to traffic impact analysis and development impact fee program. 0o0
City Manager Fuller stated the Renaissance Specific Plan already did a thorough traffic impact analysis report part of the environmental impact report approved by the City Council that established all the mitigation measures for traffic which is consistent with the zoning and prior analysis adopted by the City.
0o0
Mayor Pro Tem Scott commented on fees. He stated Rialto needs to establish their own fees versus neighboring cities. Rialto needs to be competitive. It is based on socio -economic formulas and sometimes need to be competitive with fees.
He asked about how the number of trips was generated and the basis for it.
0o0
City Engineer Hammer explained how the trip generations were derived from a common manual to estimate the number of trips. There are a lot of variables involved.
0o0
Mayor Pro Tem Scott asked about a specific variable between Del Taco and Starbucks and which fast -food restaurant would generate more traffic.
0o0
City Engineer Hammer stated he would suspect Sta rbucks would generate more traffic.

January 26, 2022
Mayor Pro Tem Scott asked if this formula would comply with the Starbucks.
0o0
City Engineer Hammer stated it is on the average to not hit the peak with these facilities.
This was used for determining whether to do a traffic impact analysis. 0o0
Mayor Pro Tem Scott asked if the site plan design included sidewalks. 0o0
City Engineer Hammer stated yes.
0o0
Mayor Pro Tem Scott asked if there will be a widening of Casmalia Avenue. What does the widening change the street?
0o0
City Engineer Hammer stated the widening will occur on the frontage of the property. It will be consistent with other development east of this site. The project will abide by the Renaissance Specific Plan requirement.
0o0
Mayor Pro Tem Scott asked if that is allowed by two lanes. 0o0
City Engineer Hammer stated he does not believe it will. The Northside that would require future widening.
0o0
Mayor Pro Tem Scott asked how the Northside of the street would anticipate be widened if it is residential.
0o0
City Engineer Hammer stated it would not happen immediately, but it is being abided by the Specific Plan.
0o0
Mayor Pro Tem Scott asked if it was all based on the Specific Plan. 0o0
City Engineer Hammer stated correct. The Plan also requires a raised median, but not likely built due to the additional spacing. 0o0

Public Hearing for the Appeal of the
Planning Commission Decision on
January 26, 2022
Mayor Pro Tem Scott emp hasized that he never believed that the Specific Plan should have shown the property conversion from residential to commercial. He does not believe commercial belongs on this side of the street.
He also stated Mr. Awad proposes a commercial entity next door. Does staff know what the proposal is of that commercial property? 0o0
Mr. Awad stated the zone was freeway from Day 1. I used to own all the properties from Ayala to Spruce. We changed the zone from 75 to 80 percent of projects to residential to match the neighborhood. A corner space was left to serve for commercial purposes. 0o0
Mayor Pro Tem Scott asked what he is proposing to build. 0o0
Mr. Awad stated a gas station.
0o0
Mayor Pro Tem Scott stated the gas station would generate more traffic than a fast-food restaurant.
0o0
Mr. Awad stated a traffic study will be conducted as well as widening of the street.
0o0
Mayor Pro Tem Scott stated he only wants to discuss what is being proposed for the commercial property next door, a gas station? Thank you, that answers my question. He expressed his concerns and asked why that was not pulled back during the development. He asked if there was a way to widen the road into two lanes.
0o0
Community Development Manager Gonzales stated the parcel that is sticking out. Whenever the property was developed, it is required to dedicate that property.
0o0
Mayor Pro Tem Scott emphasized there is a house and they are not going to develop that land.
0o0
Community Development Manager Paul Gonzales stated it is possible to negotiate with the property owner to take a portion along the frontage to complete the street.
0o0
Mayor Pro Tem Scott asked why it was never done.

Public Hearing for the Appeal of the
Planning Commission Decision on
January 26, 2022
Community Development Manager Paul Gonzales stated that can be investigated.
0o0
Mayor Pro Tem Scott expressed his concerns about having a single lane. He was under the impression that it was going to be widened, It will p resent a problem. In his opinion it should have been kept residential all along. It should not have been rezoned.
He asked City Attorney Vail if there was a justification to deny this project based on what was presented tonight.
0o0
City Attorney Vail stated we can as k Assistant City Attorney Robert Messinger. The reason the Resolution of approval went back to the Planning Commission was because my office and the Planning Department had reviewed and it had met all the standards for the Renaissance Specific Plan which had been adopted by the City Council.
When the Planning Commission makes its decision, it considers the views of the public, but it has to make a decision consistent with policy and zoning documents that the City Council previously approved. This project met all the thresholds.
0o0
Mayor Pro Tem Scott asked if that was explained to the Planning Commission.
0o0
City Attorney Vail stated the City Council may want to consider the appeal itself. The appeal is not filed by community members. The appeal is by Mr. Awad. Mr. Awad does not bring up traffic or any other error or abusive discretion of the Planning Commi ssion. His sole contention is Notice, whether appropriate Notice was given. 0o0
Mayor Pro Tem Scott asked if appropriate Notice given.
0o0
City Attorney Vail stated absolutely. Mr. Messinger will address that also.
0o0
Mayor Robertson brought about the other concern about lighting and signal for this project will be set back. And there are improvements on the sidewalk on the curb area. There would be a need to move part of that traffic light.

Public Hearing for the Appeal of the
Planning Commission Decision on
January 26, 2022
Mayor Pro Tem Scott stated the current site plan shows the new improvements but not the existing, so it is difficult to tell what is being set back and what is not being set back.
0o0
Robert Messinger, Assistant City Attorney, with Burke, Williams and Sorenson stated City staff prepared resolutions of approval. The project met all of the thresholds and standards. They were presented at the Planning Commission in January 12, 2022. The Planning Commission made a motion and voted 4-0 to deny the project.
At the time, it was requested that the Planning Commission with findings of denial and the Chairman granted that. The meeting on January 12, 2022 was Noticed as a Public Hearing. The Public had an opportunity to speak, and the Applicant. The Public Hearing was closed.
The subsequent meeting at which it was to be brought back, did not require Public Hearing Notice. It only required Brown Act Notice, 72 hours prior to the meeting, which occurred.
At the meeting, rather than adopt a resolution denying the project, one of the Planning Commissions made a motion to reconsider and subsequently voted 4-0 to approve the project.
0o0
Mayor Pro Tem Scott asked what was the reason for denying it in the very beginning.
0o0
Assistant City Attorney Messinger stated the concerns were related to traffic.
0o0
Mayor Pro Tem Scott asked if that is a justifiable reason to deny the project.
0o0
Assistant City Attorney Messinger stated Planning Commissions have wide discretion. That is the reason the resolution and a subsequent meeting was asked. In order to approve a project, you must tie the facts and evidence that’s been presented to your decision. That’s the findings that are made when you approve a project.
My concern was that there was inadequate evidence presented at that meeting for a denial. That was the reason behind my request. 0o0
Mayor Pro Tem Scott asked if this project was denied for traffic, would it be logical that the property to the west would also be denied for traffic especially if it had bigger traffic impacts than this property. 0o0

January 26, 2022
Assistant City Attorney Messinger stated that would be a supposition. I would want to rely on the evidence that is presented in connection to that project.
0o0
Mayor Pro Tem Scott asked Mr. Daniel Rosas, Planning Division, who was involved in the process of this Specific Plan for the Renaissance from residential to commercial.
0o0
Mr. Rosas, Planning, stated he was part of City staff but not involved in the project.
0o0
Mayor Pro Tem Scott asked if he is aware of any residents objected to rezoning of this property from residential to commercial. 0o0
Mr. Rosas, Planning, stated he would look further into it. 0o0
Mayor Pro Tem Scott stated he would like that information. 0o0
Council Member Perez expressed her concerns with the school around the corner and asked if it was taken into consideration. 0o0
City Engineer Hammer he stated it generated a small amount of traffic not requiring a traffic impact analysis. It did not meet the threshold to meet the study.
0o0
Mayor Robertson asked Mr. Awad if he had the rights to this property and why had he not proceeded.
0o0
Mr. Awad stated they had attempted to purchase the property several times and contacted the previous owner. The asking price was too high.
Now it is being sold for half of the originally asking price. The previous owner was given an offer, and it was not accepted.
0o0
Mayor Robertson asked if the property on the corner was a residential house.
0o0
Mr. Awad stated correct but from the beginning, it was a commercial zone.

Public Hearing for the Appeal of the

January 26, 2022
Mayor Robertson stated when the resident resided in the house, it remained residential while it was occupied. Then the specific plan and incubator, that’s what made the area and the vacant property. Until the property owner left house, moved out and sold it, it was residential. 0o0
Mr. Awad stated that Specific Plan was identifying this property and all the surrounding ones as freeway incubator. All property located between Ayala and Spruce and south of Casmalia . We used to own them all and we changed the zone on all of them to residential to match the surrounding area and left the corner that is being addressed. 0o0
Mayor Robertson emphasized it was left as a commercial incubator.
You changed it and brought in residential. She expressed her concerns with the Planning Commission’s vote’s revision. They approved the project based on the fact that the project met all of its qualifications to proceed. Mr. Awad filed an appeal to that. But the first appeal wasn’t about Notice. I thought it was about something else.
Can you clarify that?

Mayor Pro Tem Scott stated I find it pretty appalling for you to make statements like that.
Mr. Fuller, would you like to address Ms. Camacho on the reason for this item which I don’t think has anything to do with anything she got up and stated.
0o0
City Manager Fuller stated in the staff report, I have an exhaustive presentation on January 11, 2022 on pavement management program.
Based on that and our assessment, we identified 52 new streets that based on their pavement condition, we recommended to be rehabilitated and reconstructed. It is a new scope of work and new project. To get this advanced quickly, we decided to negotiate with a consultant who is already underwork with the Riverside projects for the same type of work. It’s a new scope of work adding to the contract. It is not that we changed the scope of work on an existing contract. It’s a list of 52 new streets that were reviewed and approved by the City Council on January 11, 2022.
0o0

Norman’s comments regarding the width. That is the signature piece.
She wants the trail to be wide for multiple mobilities, running jogging, and scooters. Most of our projects are built with financial constraint. Let us think about what we want not what we can build with what we have.
She looks forward to everyone’s input and design.
