Re: Annexation of River Ranch into LMD LLMD #2 (Tracts 20204 through 20209 and 20092)

Dear Mr. Fuller,

Please consider this letter to serve as Lennar’s intent to annex the River Ranch community into LLMD #2, for the purposes of street lighting maintenance only.

We have reviewed the draft engineer’s report, which calculated the cost for the LLMD to maintain the landscape and hardscape along River Ranch Parkway. The maintenance costs for the parkways per square foot used by the City are estimated at a conservative rate that would result in an overall tax rate for the project that would create an intolerable tax burden on our homeowners. As such, we request that the landscape maintenance costs be excluded from this cost estimate, and that it would only include street lighting.

Lennar intends to have the River Ranch Home Owners Association maintain all landscape in the City Right of Way. Future homeowners will benefit from the economies of scale and efficiencies that the HOA will have in maintaining the parkways as they maintain the larger open space areas adjacent to it.

We will request that the City enter an agreement with the owner that would allow for the landscape within the right of way to be maintained by the HOA. Such an agreement will provide for HOA access for maintenance and will also ensure that the City will be able to ensure that the HOA will maintain the landscaping to the City’s standards

Further, it is our understanding that City will establish a ‘zero-cost’ line item in the LLMD to serve as a placeholder for the future annexation of the landscape area in the unlikely event that the HOA is unable to do so based on the terms of the pending agreement. It is crucial that this dormant assessment will not affect the effective tax rate for our future homeowners, and will be set up in a way that does not affect CFD revenues in our bonded CFD.

Sincerely,
Ryan Combe
Director of Forward Planning
