2020-2021 Annual Action Plan
Cynthia Alvarado-Crawford, Community Services Director and Lissette Montoya with Avante Garde presented staff report to Request City Council to: (1) Conduct a Public Hearing and Solicit Public Comments from Interested Citizens, and (2) Approve the City’s Substantial Amendment No. 5 Revised Budget Amounts to CDBG -CV Activi ties within the 2020-2021 Annual Action Plan.

0o0
Motion by Mayor Pro Tem Scott second by Council Member Trujillo and carried by a 5-0 vote to Close the Public Hearing.
0o0
Mayor Robertson asked about the number of qualified applicants versus how many have been received.
0o0
Ms. Montoya stated the issue was that not all the necessary documentation was collected to pass a HUD audit. They are working with City staff to identify the Rialto Assistance CARES Programs to fund applications already paid.
Moving forward, it will be easier for residents to apply for the CARES Program than the CV because of the documentation required by HUD to be collected to qualify for the program.
We are attempting to reprogram the funds to other programs or projects and ensure that funds are spent in a timely manner as required by HUD. 0o0
Mayor Robertson emphasized on the number of applications received and processed.
0o0
Ms. Montoya stated the City processed 467 applications for rental mortgage and utility assistance transactions totaling $620.476.00.
One hundred applications were sampled out of the 467. That is how the number of eligible applicants was determined to meet the HUD requirements where the City would be reimbursed for funds and not risk repayment due to proper documentation was not collected. That is where $59,000 has been identified.
0o0
Mayor Robertson asked if only $59,000 was eligible expenditures.
The balance is being charged to the CARES Act?
0o0
Ms. Montoya stated correct. The recommendation is that it be charged to the CARES Act budget.

Ms. Montoya clarified the different budgets in the staff report. 0o0
Mayor Robertson emphasized again how much has been expended to date under the CARES Act.
0o0
City Manager Fuller stated there is $1.5 million dollars out of the ARPA- funded Rialto CARES Program for rental, mortgage, and utility assistance, which will fund these applications that did not qualify under the CDBG-CV Program.
0o0
Mayor Robertson understood there to be a breakdown of the $1.5 million towards rental and utility assistance out of the CARES Act funds 0o0
City Manager Fuller stated there were other programs. For rental, mortgage, and utility assistance, it was half of the $3 million allocated for social services.
0o0
Mayor Robertson clarified that the funds that were already disbursed out of CDBG will be subtracted due to not being processed properly. 0o0
City Manager Fuller stated applicants are directed toward the CDBG Program if they qualify. Rialto CARES Program is an easier application process, that is where most of them are qualifying.
0o0
Mayor Pro Tem Scott requested a report on the CARES Act funds disbursed. A bus iness owner shared her application process was delayed to receive assistance. He’s requesting to know how many applicants that has occurred to, if they are all caught up on applications, and the timeframes to receive assistance. He would like a full report on what the City has funded, what has been done, and where the City stands.

0o0
City Manager Fuller stated he would provide a formal report to the City Council.

Council Member Perez requested date received and date paid out be reflected in the report.

0o0
Mayor Robertson requested transition timelines between LDM and Avant Garde companies be stated in the report.

There has to be a complete assessment on each of these projects to help move them forward and so they can be delivered.
0o0
Mayor Robertson understood there were ongoing projects in the final phase ready to be rolled out. She is requesting a list to determine their current status. If they are in Public Works, they are ready to go.
Is that correct?
0o0
City Manager Fuller stated any capital project goes through various stages though Public Works.
0o0
Mayor Pro Tem Scott asked why this Item has taken this long to get on the agenda and what the hold up was.
0o0
City Manager Fuller stated that was the time required to negotiate a contract, legal review and in a position onto the agenda. 0o0
Mayor Pro Tem Scott expressed his concerns with the evaluation panel.
Five people on this panel are no longer employed by the City. He is concerned with in-house panelists.
0o0
City Manager Fuller stated they are attempting to obtain outside panelists for all of the RFP processes.
0o0
Mayor Robertson stated she did not understand what the top three meant. It was Harris & Associates, HR Green and Transtech? 0o0

Most have been between $10 -30 million. That is a market will be continued to be explored.
0o0
Council Member Trujillo asked about the pension obligatory bond. 0o0
Mr. Myer stated the restructuring, and the projected interest rate is what is being viewed at the moment. The Section 115, the City can continue exploring.

She asked if this is an action to proceed with the executed agreement with Pyros Spectacular.
0o0
City Manager Fuller stated he had indicated an alternative vendor. It would not be with Pyro Spectacular. The amount of that contract would be approximately $40,000. Ballot Measure Relating to Fireworks;
Confirm date of the Holiday Fireworks
Event
Mayor Robertson stated it is unfortunate the City did not reserve the corporation that is headquartered in Rialto for this year’s firework show.
She is not certain what the fireworks survey conveys other than if a ballot is to take place or not.
The reco mmendation on the Item is to provide direction regarding a potential ballot measure relating to fireworks. If there is a vote for holding a fireworks show today for this year, with a vendor, I will vote for that, but I am not going to vote for not proceed ing with holding a ballot measure at some point on the matter of fireworks.
She is confirming the date of the holiday firework event. 0o0
City Manager Marcus Fuller stated it has changed. At the time, there was no vendor committed to the Monday, July 4th Holiday. 0o0
Mayor Robertson confirmed that the fireworks show will take place on Monday, July 4th, 2022.
0o0
City Manager Fuller stated it is not suggested the date change now that a second provider has been secured.
The real issue is to discuss if the City Council would like to proceed with the ballot measure.
0o0
Council Member Trujillo asked if other municipalities in the State have sued directly the distributors of illegal fireworks.
0o0
City Attorney Vail stated he will investigate and research further. 0o0
Council Member Carrizales stated those distributors are from Arizona. 0o0
Mayor Robertson asked what other efforts are surrounding cities doing to eliminate fireworks because of illegal fireworks. Some cities do not allow safe and sane fireworks.
0o0
Mayor Pro Tem Scott agreed with Council Member Carrizales, illegal fireworks are being sold out of other states.
Suing the distributors would be a very expensive lawsuit for this City.
I am not sure we want to go there. The poll speaks for itself. Sixty-four percent are in favor to maintain the current laws to allow legal fireworks.
Thirty-three percent want to ban them. I don’t know of any City who has put this item on a ballot and has succeeded. I believe it is to the contrary.

City Attorney Vail stated he is not familiar with how many Cities have done ballots. I am familiar that Cities have passed Ordinances prohibiting safe and sane fireworks.
0o0
Mayor Pro Tem Scott emphasized for the record that he is against illegal fireworks. He does not believe it will resolve the issue by banning safe and sane.
Out of 14 items listed, fireworks came in at No.9 as one of the biggest issues facing the City of Rialto. The important issues for our community are crime and public safety. We need to prosecute those shooting illegal fireworks. We need to enact ordinances that address it and give our police and fire department the manpower and resources. That is the key to dealing with this issue. It is like a war zone every year where most of us live. A ballot measure is not the solution.
0o0
Council Member Carrizales stated he will move for approval without a ballot measure.
0o0
Council Member Trujillo stated he will second the motion. 0o0
Motion by Council Member Carrizales second by Council Member Trujillo and carried by a 5-0 voted to not have a ballot measure relating to fireworks; and Confirm the Monday, July 4 th, 2022, for the Holiday Fireworks Event; and (3) Authorize the City Manager to Execute an Agreement with Fireworks America for the Holiday Fireworks Event. 0o0

Mayor Pro Tem Scott agreed with Mayor Robertson. He does not want to see this project delayed. A template from Riverside County is available. They have been very successful. The 90-day period should be sufficient. Should something happen, we come back to revisit. We need to move forward expeditiously. This is a long -awaited endeavor.
I am extremely proud we are moving forward with it. It is a great concept and a great idea and the right thing to do. Once this concept gets underway, we should get the same concept for a new City Hall facility.
He thanked the Police Department in support of this Item and in support of the City Council.

0o0
Council Member Trujillo asked about the projected capacity and longevity of the building.
0o0
City Manager Fuller stated the 100,000 square feet is an approximate projected size of a police department for full functionality of the City’s needs.

He also asked if the Hispanic Heritage Month event is separate from the Tamale Festival.

Personnel Changes
Mayor Pro Tem Scott asked about the windfall tax revenue expected to be received. What has the City done to address the trucks on the streets violating vehicle laws. Warehouses were built without anticipating the impact trucks would have on City streets.
I want to propose in this budget – and I propose that it come out of that sales tax money – that we add an additional four commercial traffic vehicles in this City that will be paid for out of that sales tax because the warehouses should be paying for it. The expense for vehicles and personnel would be $1 million a year.
0o0
Mayor Robertson asked if commercial officers were just recently hired. 0o0
Mayor Pro Tem Scott emphasized the City only has two vehicles on the road at any one time. There is no five days of coverage of code enforcement.
0o0
Police Chief Kling stated there are two. At the last budget, when the traffic bureau was expanded, two commercial officers were added.
There are six motors; two commercial officers. They work four days a week coverage with two officers. Both of those positions are not filled only one.
0o0
Mayor Pro Tem Scott suggested this proposal be funded from the sales tax. That the City add four additional vehicle enforcement officers.
It would pay for itself, but proposes the money generated for it and use it to pay the debt service on the new police station.
We have grown, but yet we don’t plan for the problems that this brings us. Warehouses are bringing in a lot of revenue as well as a lot of problems. I am not opposed to warehouses or truckers but we need to be able to address the issues they bring, which is vehicle enforcement.
0o0
Mayor Robertson stated there needs to be clarity on the truck study report. We are not enforcing the routes they should be on and not on. 0o0
Council Member Trujillo expressed his concern for the current 12 -hour window on business inspections. It is a lot of time to wait for a visit. He hopes the personnel additions will address these customer service issues. We want to project to be a more business-friendly City. 0o0

Mayor Robertson stated in reference to eliminating the Fitness Center, the City needs a building and a multi -purpose facility that can accommodate a minimum of 500 people.
In reference to the City Council Conferences she would like to know which ones the City Council has previously attended. She suggests Water Education Foundation. She commented SCAG is listed but SCAG General Assembly is not.
She inquired why the mid-year budget was not reflected in the report.
She asked how the improved level of service will be measured with the added personnel. The turn around time is snail -paced. Businesses should not have wait long.
Rialto has never done a State of the City event. We have not made decisions to secure regional or participation with other Chambers o f Commerce that would bring or provide us information. Small businesses are very important. There has not been a celebration of recognition. We need to spotlight our small businesses. 0o0
Council Member Trujillo asked about pass -through grants the City has been awarded and are they accounted for in the budget such as the Rialto Unified School District.
0o0
City Manager Fuller stated no. It is not considered general fund monies.
It is accounted for separately
0o0

0o0
City Manager Fuller stated no.
0o0
Council Member Trujillo asked if there were any pass -through funds received such as the State -derived CARES Act that will be included in this budget.
