A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPROVING TRACT MAP 20199 FOR THE SUBDIVISION OF LAND INTO FIFTY-SIX (56) RESIDENTIAL LOTS AND TEN (10) LETTERED LOTS AND APPROVING AN ASSOCIATED SUBDIVISION IMPROVEMENT AGREEMENT.
WHEREAS, the Planning Commission of the City of Rialto, at its meeting of May 29, 2019, recommended approval of Tentative Tract Map 20199 subject to conditions; and WHEREAS, the City Council of the City of Rialto, at its meeting of November 10, 2020, approved Tentative Tract Map 20199 subject to conditions; and WHEREAS, Century Communities of California, LLC, a Delaware limited liability company, (hereinafter the “Subdivider”), has filed Tract Map 20199 with the City Council of the City of Rialto, (hereinafter the “City”), in accordance with Section 66456 of the California Government Code; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, the public in general, and public utility companies, an easement for streets and public utility purposes in, under, over, through and across the intersection of Bonnie View Drive and Willow Avenue, subject to improvement, as shown on Tract Map 20199; and WHEREAS, the Subdivider offers for dedication to the City of Rialto and public utility companies an easement for public utilities, sewer, water, and emergency access purposes, in, under, over, through, and across Lots A, E, F, G, H, I, and J, (Belloro Drive, Bonita Lane, Gardena Avenue, Huntington Court, Alice Avenue, Palm Avenue, Carson Court, and Orange Avenue), subject to improvement, as shown on Tract Map 20199; and WHEREAS, the Subdivider offers for dedication to the City of Rialto all vehicular access rights to Lots B and 20 through 47, inclusive, where they abut Bonnie View Drive and Willow Avenue, as shown on Tract Map 20199.
WHEREAS, not all public improvements have been completed by the Subdivider as of the filing of Tract Map 20199, and the Subdivider has requested that the City enter into a Subdivision Improvement Agreement with the Subdivider to secure the cost of public improvement in accordance with Section 66462 of the California Government Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Tract Map 20199 is in substantial conformance with the approved Tentative Tract Map 20199 Section 2: Requisite conditions associated with Tentative Tract Map 20199 have been satisfied.
Section 3: Tract Map 20199 is in conformance with the General Plan.
Section 4: Tract Map 20199 conforms to all applicable requirements of the Subdivision Map Act of the State of California.
Section 5: In accordance with Section 66477.1 of the California Government Code, the offers of dedication to the public on Tract Map 20199 shall be accepted by the City Clerk, subject to improvement, who shall certify acceptance by signature on the map thereof.
Section 6: The City Council hereby approves a Subdivision Improvement Agreement for Tract Map 20199 with the Subdivider and accepts subdivision improvement securities in conformance with the requirements therein for public improvements. The City Manager is hereby authorized to execute the Subdivision Improvement Agreement on behalf of the City.
Section 7: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Subdivision Improvement Agreement.
Section 8: Tract Map 20199 is hereby approved for the purposed therein defined. \\\\\
