A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, STATE OF CALIFORNIA, APPROVING PARCEL MAP 20107 FOR THE CONSOLIDATION OF SIX PARCELS OF LAND INTO ONE PARCEL TO FACILITATE THE DEVELOPMENT OF AN INDUSTRIAL WAREHOUSE BUILDING LOCATED AT THE NORTHEAST CORNER OF BASELINE ROAD AND PALMETTO AVENUE, AND APPROVING AN ASSOCIATED SUBDIVISION IMPROVEMENT AGREEMENT WITH CIVF V – CA1 W04, LLC, A DELAWARE LIMITED LIABILITY COMPANY.
WHEREAS, the Planning Commission of the City of Rialto, at its meeting of July 8, 2020, approved Tentative Parcel Map 20107 subject to conditions; and WHEREAS, CIVF V – CA1 W04, LLC, a Delaware limited liability company, (hereinafter the “Subdivider”), has filed Parcel Map 20107 with the City Council of the City of Rialto, (hereinafter the “City”), in accordance with Section 66463 of the California Government Code; and WHEREAS, not all public improvements have been completed by the Subdivider as of the filing of Parcel Map 20107, and the Subdivider has requested that the City enter into a Subdivision Improvement Agreement with the Subdivider to secure the cost of public improvements in accordance with Section 66411.1(b) and Section 66462 of the California Government Code; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, the public in general, and public utility companies, an easement for streets and public utility purposes in, under, over, through and across Baseline Road and Palmetto Avenue, subject to improvement, as shown on Parcel Map 20107.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Parcel Map 20107 is in substantial conformance with the approved Tentative Parcel Map 20107.
Section 2: Requisite conditions associated with Tentative Parcel Map 20107 have been satisfied.
Section 3: Parcel Map 20107 is in conformance with the General Plan.
Section 4: Parcel Map 20107 conforms to all applicable requirements of the Subdivision Map Act of the State of California.
Section 5: The City Council hereby approves a Subdivision Improvement Agreement for Parcel Map 20107 with the Subdivider, and accepts subdivision improvement securities in conformance with the requirements therein for public improvements.
Section 6: In accordance with Section 66445(j) of the California Government Code, the offers of dedication to the public on Parcel Map 20107 shall be accepted by the City Clerk, who shall certify acceptance by signature on the map thereof.
Section 7: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Subdivision Improvement Agreement.
Section 8: Parcel Map 20107 is hereby approved for the purposes therein defined.
