A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, AMENDING RESOLUTION NO. 7766 AND 7781 TO IDENTIFY THE LIST OF POSITIONS EXEMPT FROM THE COMPETITIVE SERVICE PURSUANT TO RIALTO MUNICIPAL CODE SECTION 2.50.060.
WHEREAS, Ordinance No. 1660 modified section 2.50.060 of Chapter 2.50 of the Rialto Municipal Code to grant City Council the authority to identify positions that are exempt from the competitive service by resolution; and WHEREAS, on August 10, 2021, the City Council adopted Resolution No. 7766 to identify the positions that are exempt from the competitive service; and WHEREAS, October 12, 2021, the City Council adopted Resolution No. 7781 to amend the list positions that are exempt from the competitive service; and WHEREAS, the City Council has by prior action created new positions that are considered exempt from the competitive service and it is now necessary to amend the list of exempt positions by adding the Director of Engineering Services/City Engineer, Director of Information Technology, Assistant to the City Manager, and Engineering Manager positions; and WHEREAS, as detailed in Ordinance No. 1660, City employees not included in the competitive service shall serve at the will and pleasure of their appointing authority and may be terminated from employment at any time without cause and without right of appeal or hearing, except where such right is expressly provided by law.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Section 1 of Resolution No. 7766 and Section 1 of 7781 are hereby revised to read as follows:
Pursuant to Rialto Municipal Code section 2.50.060, as modified by Ordinance 1660, the following offices, positions, and employers in the service of the city, are exempt from the competitive service:
(a) Executive Management Positions
(i) City Manager
(ii) Community Development Director
(iii) Community Services Director
(iv) Deputy City Manager
(v) Engineering Services Director/City Engineer
(vi) Finance Director
(vii) Fire Chief
(viii) Human Resources / Risk Management Director
(ix) Information Technology Director
(x) Maintenance and Facilities Director
(xi) Management Services Director
(xii) Police Chief
(b) Management Unrepresented Positions
(i) Assistant to the City Manager
(ii) Building Official
(iii) City Manager’s Assistant
(iv) City Manager’s Executive Assistant
(v) Community Development Manager
(vi) Deputy Finance Director
(vii) Deputy Human Resources / Risk Management Director (viii) Deputy Maintenance and Facilities Director
(ix) Economic Development Manager
(x) Engineering Manager
(xi) Information Technology Manager
(xii) Principal Budget & Financial Analyst
(xiii) Public Relations Officer
(xiv) Utilities Manager
(c) Other Positions
(i) Elective Officers
(ii) Members of appointive boards, commissions and committees (iii) Persons engaged under contract to supply expert, professional, and technical services for a definite period of time (iv) Volunteer personnel such as volunteer firemen and reserve policemen who receive no regular compensation from the city (v) City Attorney
(vi) Part time personnel
(vii) State or federally subsided personnel
Section 2: This Resolution shall be effective upon its adoption.
