RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA AUTHORIZING UPDATES TO THE CITYWIDE RECORDS RENTENTION SCHEDULE AND RECORDS MANAGEMENT POLICY MANUAL WHEREAS, the maintenance of numerous records is expensive, slows document retrieval, and is not necessary after a certain period of time for the effective and efficient operation of the government of the City of Rialto (“City”); and WHEREAS, Section 34090 of the Government Code of the State of California provides a procedure whereby any City record which has served its purpose and is no longer required may be destroyed; and WHEREAS, the City Council of the City of Rialto has established the Records Management Policy Manual to set forth and identify policies which may not otherwise be established in ordinances of the City regarding the City’s Retention Schedule; and WHEREAS, the City Council of the City of Rialto previously adopted Resolution Nos. 4843, 4849, 4859, 4856, 4907, 4908, 4909, 4910, 4911,4916, 4849, and 4356 establishing the City’s Retention Schedule; and WHEREAS, the City Council now desires to keep in line with changes in state law and current best practices by repealing Resolution Nos. 4843, 4859, 4856, 4908, 4911, 4910, 4849, 4909, 4907, 4356, 4849, and 4356 and adopting Exhibit “A”, the City of Rialto Records Retention Schedule; and WHEREAS, the City Council further desires to keep in line with current best practices by adopting Exhibit “B”, Records Management Policy Manual.
THEREFORE, BE IT RESOLVED by the City Council of the City of Rialto as follows:
SECTION 1. The City Council hereby repeals Resolution Nos. 4843, 4849, 4859, 4856, 4907, 4908, 4909, 4910, 4911, 4916, 4849, and 4356 SECTION 2. The City Council hereby approves the City of Rialto Retention Schedule, as attached hereto as Exhibit “A”, and incorporated herein by this reference, as if fully set forth herein.
SECTION 3. The City Council further approves the City of Rialto Records Management Policy Manual, as attached hereto as Exhibit “B”, and incorporated herein by this reference, as if fully set forth herein.
SECTION 4. The term “records” as used herein shall include documents, instructions, books, microforms, electronic files, magnetic tape, optical media or papers, as defined by the California Public Records Act.
SECTION 5. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared unconstitutional.
SECTION 6. This Resolution shall become effective immediately upon adoption.
