0o0
Deputy City Manager Brown stated there are three Tier 1 providers in the area, Frontier, AT& T and Spectrum for Tier 1.

AT&T did not make sense since that is what the Police Depart ment currently contracts with. At some point, the City will partner with AT&T so we will be covered across the board so that is why the other two made the most sense. It made more economic sense during negotiations.
0o0
Mayor Pro Tem Scott also asked if there is another provider other than Spectrum or Frontier.
0o0
Deputy City Manager Brown stated not in Tier 1, so we had to move down to a Tier 2.

Adopt Resolution No. 7934
Updated Rules and Procedures
for Conduct of City Council Meetings
Request City Council to Adopt Resolution No.7934 Adopting Updated Rules and Procedures for the Conduct of City Council Meetings. 0o0
Mayor Pro Tem Scott stated he was not present when the Item was first presented. He expressed great concerns with the Item.

I want to start with the history I believe we are doing this, a resident that comes in a speaks on every single Item of which I personally don’t have a problem with.

Additionally, we have a group of people that have come in representing an individual, who was shot by a police officer that have become extremely vocal and speak quite often.

The reason I have a problem with these changes, is that we are making changes to the time limit people can speak based on two issues that some of us may have a problem with. But frankly, it’s our own fault. We have sat here as a City Council and not spoke about this shooting that took place and have allowed people from outside of this community to come in here and attack our Police Chief. Shame on us for letting anybody attack our Police Chief. They have come in here and attacked the City Council and made threats. It has gotten to the point where we have to have security out front that frankly scares people away from coming in here and speaking. I don’t believe as a City Council we have a responsibility or obligation to curtail people from speaking because of outsiders from this City. These individuals do not live in this City. I don’t think it’s proper for us to start curtailing everybody else to speak.

I have been on this City Council first elected in 1996 when Oral Communications were at the end of the meeting. What transpired was a lot of people sitting in the audience throughout the whole meeting, to be able to speak – residents – that should not have been waiting to speak – and they would get vocal on every Item sometimes chanting.

Adopt Resolution No. 7934
Updated Rules and Procedures for
Conduct of City Council Meetings
Mayor Pro Tem Scott stated we changed the Oral Communications to the first of the meeting so residents could get up and speak. I think it was respectful to allow them to do that. But to also change this to allow to say that people can only speak for three minutes. The agenda has 10 Items tonight. And you are going to use three minutes to speak on all 10 Items? Or let’s say there is Public Hearing Items, and you feel you need to speak on all three of them. We are going to stop people from speaking on that because they only have three minutes. I just don’t think that’s proper.

We are living in a country right now where people are trying to stop people from their First Amendment rights. You see it on school boards, city councils, where the communities are being threatened because they are up and speaking. What we are doing here tonight by voting on this and allowing this to happen, in my opinion, is violating the First Amendment rights of every resident of this City. I just think it is wrong and improper. I have a huge issue with it.

I think this country is in deep trouble when local governments, State governments, County governments, start telling its residents, the people that vote for us – we’re here to represent those people. When we start telling them they can’t come in here and speak or they only have three minutes, or they have to sit in the audience three or four hours waiting to speak to us.

I just have a real problem with that, and I cannot vote on this Item tonight, not in a positive way. There are some things in there that may be all right, but to curtail people from speaking , to say that people can only speak three minutes that they can’t speak on every single Item is not the right way for us to go.

What is happening in this country is, the community is rising up on school boards, rising up on City Councils, and saying no. We will take you out of office because we have a right to come in here and speak our mind and say what we want to have. We may not like what people say sometimes, but we still need to listen to them. What we’re missing in this country is listening to each other. That’s what we’re missing. I think we’re going backwards and going in the wrong direction.

I’m urging my fellow City Council Members to vote against this. I think this needs to go to a committee. Th ere needs to be further discussion and refinement of it.

Madam City Clerk, was there a Council Committee assigned to this? 0o0
City Clerk McGee stated no.

Mayor Pro Tem Scott stated I don’t understand on rules that are in regard to us and rules that are in regard to the residents of this community why we would allow staff decide what they want in this.

We’re not here to work for staff. We’re not here to represent staff. We’re here to represent the people of this community, and they have a right to speak and should be allowed to speak.

I am encouraging the City Council tonight to kill this Item. 0o0

Council Member Carrizales agreed with Mayor Pro Tem Scott and suggests tabling the Item.
0o0
Mayor Pro Tem Scott stated he does not want to table. He want s it voted down.
0o0
Council Member Carrizales agree d a committee needs to be set to be reviewed closer.
0o0

Mayor Pro Tem Scott stated he is in favor of directing a committee to be set up when Mayor Robertson returns. But I believe, that we should call for the vote tonight, and we should vote against this.

And if we want to set up a committee and bring something back that the City Council has some involvement in it, is the way to do it. 0o0
Council Member Carrizales stated there is a small feedback that was in here but a lot of it was on here. I don’t believe it was said to move the comments to the end of the meeting. That was never said. I believe that is telling the community that we don’t want to hear from them. Perhaps that is the direction that was heard, but I don’t believe that was the consensus of the last conversation we had.
0o0
Council Member Perez stated we discussed limiting Oral Communications at the beginning of the meeting and any overage to be continued at the end of the meeting.
0o0
Council Member Carrizales stated that is still limiting the public to speak. 0o0

Council Member Trujillo stated his comments related to signage reminding the public of rules of conduct during a City Council meeting.

He also suggested having a timer during public comments to make the speakers aware of the time they have left.

He suggested more visuals than restrictions.
0o0
Mayor Pro Tem Scott stated when people get up and speak improperly, you use the gavel. This is what this is used for. The City Attorney or the City Manager should stop people and inform the m that they cannot speak to the City Council and certainly the Police Chief in that manner and we should not allow it. To change the rules for everybody is the wrong thing to do.

Fellow Council Members, we need to start speaking up when people get disrespectful. We need to start speaking. And if our City Manager or our City Attorney don’t want us to speak, that is too bad because it our right to speak, and we need to say what’s on our mind.

I’m proud of this City; I’m proud of the police department. I am tired of people bashing it.
