A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPROVING TRACT MAP 20108 FOR THE SUBDIVISION OF LAND INTO 30 RESIDENTIAL LOTS LOCATED ON THE EAST SIDE OF SYCAMORE AVENUE AT ALRU AVENUE; AND APPROVING AN ASSOCIATED SUBDIVISION IMPROVEMENT AGREEMENT.
WHEREAS, the Planning Commission of the City of Rialto, at its meeting of October 13, 2021, approved Tentative Tract Map 20108 subject to conditions; and WHEREAS, Richmond American Homes of Maryland, Inc., a Maryland corporation, (hereinafter the “Subdivider”), has filed Tract Map 20108 with the City Council of the City of Rialto, (hereinafter the “City”), in accordance with Section 66456 of the California Government Code; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, the public in general, and public utility companies, an easement for streets and public utility purposes in, under, over, through and across Sycamore Avenue, subject to improvement, as shown on Tract Map 20108; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, the public in general, and public utility companies, an easement for public utilities, sewer, emergency access, and ingress and egress in, under, over, through and across Lots “F”, “G”, “H”, “I”, “J”, and “K”, subject to improvement, as shown on Tract Map 20108; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, an easement for emergency access, in, under, over, through, and across Lot 17, subject to improvement, as shown on Tract Map 20108; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, all vehicular access rights to Lot “A” where it abuts Sycamore Avenue, as shown on Tract Map 20108; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, a 5 feet wide easement for public utility purposes, in, under, over, through, and across Lots 1 through 30, inclusive, Lots “C”, “D”, and “E”, subject to improvement, as shown on Tract Map 20108; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, a 10 feet wide easement for sanitary sewer, in, under, over, through, and across Lots “B” and “C”, subject to improvement, as shown on Tract Map 20108; and WHEREAS, not all public improvements have been completed by the Subdivider as of the filing of Tract Map 20108, and the Subdivider has requested that the City enter into a Subdivision Improvement Agreement with the Subdivider to secure the cost of public improvement in accordance with Section 66462 of the California Government Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Tract Map 20108 is in substantial conformance with the approved Tentative Tract Map 20108 Section 2: Requisite conditions associated with Tentative Tract Map 20108 have been satisfied.
Section 3: Tract Map 20108 is in conformance with the General Plan.
Section 4: Tract Map 20108 conforms to all applicable requirements of the Subdivision Map Act of the State of California.
Section 5: In accordance with Section 66477.1 of the California Government Code, the offers of dedication to the public on Tract Map 20108 shall be accepted by the City Clerk, subject to improvement, who shall certify acceptance by signature on the map thereof.
Section 6: The City Council hereby approves a Subdivision Improvement Agreement for Tract Map 20108 with Richmond American Homes of Maryland, Inc., a Maryland corporation, and accepts subdivision improvement securities in conformance with the requirements therein for public improvements. The City Manager is hereby authorized to execute the Subdivision Improvement Agreement on behalf of the City.
Section 7: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Subdivision Improvement Agreement.
Section 8: Tract Map 20108 is hereby approved for the purposed therein defined. \\\\
