Provide Direction on the City of Rialto’sProposed Strategic Water and Wastewater Value of Water Marketing Campaign.

BACKGROUND:

Staff developed a draft strategic water and wastewater marketing initiative to review and improve Rialto Utility Authority (RUA) and Rialto Water Services (RWS)’sbrand based on a marketing strategy focused on the community’sunderstanding of the value of water. The primary objective is to ensure customers understand the full value of the services provided by RUA and RWS and the need for an evaluation of future services.

ANALYSIS/DISCUSSION
For 2023, staff has developed a robust Value of Water Marketing Campaign that will culminate with a Strategic Marketing Plan based on a SWOT (Strengths, Weaknesses, Opportunities, and Threats) Analysis, stakeholder interviews, and a communication platform review.

The Value of Water Campaign will include extensive work feedback loops that identify marketing goals and objectives based on current City capital improvement initiatives, needs assessments, and opportunities to expand the reach of water and wastewater educational messaging to students K-12, adults, and seniors. The table below identifies the Value of Water Timeline Tasks to be completed during 2023. The tasks are color-coded in relation to Council related tasks, public engagement tasks, and social media engagement tasks.

The Value of Water Marketing Campaign’sgoal in the first year is to establish trust, awareness, and education. Under the trust, the focus is to increase trust in the safety, quality, and value of water service, and the fiscal diligence used in planning for the future. Under awareness, the focus is on building awareness and support for capital projects and ongoing maintenance investments in the system. And under education, the focus is to educate and engage customers on the importance of water service to every aspect of life and how they can efficiently use this precious resource.

FISCAL IMPACT:

Funds budgeted in account number 670-500-7960-2021 water rebates are available for this campaign.

RECOMMENDATION:

Staff recommends that the Water Subcommittee provide direction on the City of Rialto’sproposed Value of Water and Wastewater Campaign.

TO: Honorable Water Subcommittee Members
APPROVAL: Thomas J. Crowley, P.E., Utilities Manager
Toyasha Sebbag, Assistant to the City Manager
Provide Direction on the City of Rialto’s Proposed Water Rate Study to be completed by April 2023.

BACKGROUND:

The City of Rialto (City) provides water and wastewater services to residences and businesses within City limits. The City provides these services through the Rialto Utility Authority (RUA). The approximate wastewater service area is comprised of the entire City limits with additional services outside the City limit from portions of Fontana and Bloomington. The water service area is generally the central portion of the City and currently has approximately 12,500 connections.

In 2012, the City Council/Rialto Utility Authority adopted resolutions approving a Concession Agreement with Rialto Water Services (RWS). The Concession Agreement outsourced the operations and maintenance of the City’sWater and Wastewater enterprise to a private contractor for a term of thirty years.

Per the Concession Agreement, the City maintains ownership of all assets and the authority and responsibility for setting utility rates subject to contractual obligations and financial performance standards.

In 2012, the City adopted a five-year rate schedule through the Proposition 218 process. The water and wastewater rates were last adjusted on January 1, 2018. The multi-year rate adjustments approved in 2012 allowed for the financing and implementation of $41 million in improvements and repairs that improved system reliability and efficiencies for both the water and wastewater systems. $13 million was approved for water infrastructure investments and $28 million was approved for wastewater infrastructure investments in the following projects

ANALYSIS/DISCUSSION
On November 12, 2019, staff presented for the City Council’sconsideration a request to conduct a Public Hearing and Approve Resolution No.7575 and RUA Resolution No.09-19 Approving the Proposed Consumer Price Index Rate Adjustments for Water and Wastewater Utility Services as supported by the FG Solutions Financial Planning Analysis Report. The Resolutions would have provided for an increase in water and wastewater rates on January 1, 2020, 2021, 2022, 2023, and 2024. After the comprehensive calculation of January 1, 2020, adjustments, future water, and wastewater adjustments were to be calculated equating to the smaller of:
· Previous Rate multiplied by Most Recent September Riverside CPI-U Value divided by the City of Rialto Printed on 1/20/2023Page 1 of 3

· Previous Rate multiplied by Most Recent September Riverside CPI-U Value divided by the Previous September Riverside CPI-U Value, or
· Previous Rate multiplied by 1.015.

The City Council moved to not approve staff recommendation for a water and wastewater rate multi- year adjustment.

On April 2, 2020, Governor Newsom signed Executive Order N-42-20 authorizing a moratorium on water disconnections/penalties to assist residents and businesses who lost income due to the COVID -19 pandemic. This resulted in Rialto’snormal arrearages of $500,000 monthly growing to slightly over $2 million by January 2023. Starting February 1, 2023, Rialto’s water moratorium will end allowing for arrearages to be brought down within the normal monthly operating amount of $500,000.

However, looking closely at the arrearages, the 2022 consumer price index for Riverside-San Bernardino-Ontario is at 9.2%, and the last water adjustment was on February 1, 2018, for 0.589% and 1.503% for wastewater services, staff has received a proposal from FG Solutions, LLC to conduct a multi-year Water Rate Study.
2023 Water Rate Study Fee Proposal
Staff solicited a proposal from FG Solutions, LLC because, in 2018, the consultant completed a comprehensive water and wastewater multi-year rates analysis and for their background in the Concession Agreement Financial Obligations. The fee proposal is for $98,858 and falls within the City Manager’s signature authority.

2023 Water Rate Study Fee Proposal
At this time, staff recommends focusing the rate study on water rates and will reassess the wastewater fee structure later. The urgency for moving forward with a water rate study is that the City’srate structure will be assessed to apply for and receive a State Revolving Fund (SRF) Loan. If the Water Infrastructure Finance and Innovation Act (WIFIA) loan application is filed under Rialto Water Services (RWS) then only the Concession Agreement is required to secure the WIFIA Loan.

However, if the WIFIA loan application is filed under the City’sname then a water rate study will need to be completed to secure loan payment terms. The timing for the SRF, WIFIA, and Water Rate Study are outlined to be completed by January 2024 with some project costs made prior to the issuing of the loan reimbursable.

For Water Subcommittee Meeting [January 25, 2023]
TO: Water Subcommittee Members
APPROVAL: Thomas J. Crowley, P.E., Utilities Manager
First Amendment to the Final Construction Work Authorization for the additional costs for the Sycamore Sewer Lift Station Project.

BACKGROUND:

The Sycamore Lift Station is located south of the I-210 freeway at Sycamore Street. The lift station was constructed in 2007 and boosts the sewer effluent from the area north of the 210 freeway, down to the Sycamore line, which eventually conveys the effluent to the Rialto Wastewater Treatment Plant. This lift station is at the end of its life and in need of upgrades in order to continue functioning at optimum levels.

In 2019, the City/RUA retained the services of West Yost Associates to prepare the drawings and specifications for the work to upgrade the lift station. The drawings and specifications were completed in April 2021. The Sycamore Lift Station Upgrade Project includes removal and replacement of existing submersible pumps, removal and replacement of existing pump discharge piping and valving including replacement of existing pipe supports inside the wet well, minor concrete repairs to above grade portions of the wet well, recoating existing vent cover, install new electrical equipment and demolish old electrical equipment, installation of an emergency power generator, remove and replace chain link fence and gate, install flow meter and concrete vault, and other appurtenances.

Based upon direction from the City/RUA, on the Veolia Capital Program Management team issued the Request for Bids documents to nine (9) local contractors who were registered in Veolia’s database and had previous experience performing similar work. The successful bidder was Ferreira Construction. The City/RUA issued a Final Construction Work Authorization (FCWA) to RWS/Veolia in January 2022 in the amount of $1,056,875

ANALYSIS/DISCUSSION
As the contractor, Ferreira Construction, began preliminary work on the Sycamore Sewer Lift Station, a few of the project submittals were received which needed further design clarification or additional design. Veolia held a design meeting with City staff and design consultants in the second quarter of 2022, reviewed the current design that was used to bid by West Yost, and identified the issues that needed to be addressed and re-designed. It was decided to engage the services of the City’son-call design engineer, Engineering Resources of Southern California (ERSC), to help address the contractor’s Requests for Information and Submittals.

The areas for additional cost are:

1. Requirements of AQMD on the DPF exhaust system for the dedicated back-up generator.

2. Additional electrical scope based on design developed by ERSC to respond to the Request for Information regarding the VFDs.

3. Additional scope based on additional design developed by ERSC regarding the generator pad design, shade structure, existing vault rehabilitation and realignment for a flow meter, electrical pad layout changes, and material and fencing changes.

4. Additional construction phase design services by ESRC.

5. Credit for not having to bypass the flows. Bypass to be covered by Veolia.

You will find a more detailed explanation of the additional costs in the attached justification memo from RWS/Veolia dated January 5, 2023.

Below is a breakdown of additional costs.

FINANCIAL IMPACT:

Total First Amendment to the FCWA for the Sycamore Sewer Lift Station is in the amount of $173,347, as shown in above table. Staff has confirmed sufficient Development Impact Fees (DIF) revenues are available and deposited with the Concession Agreement Restricted Capital Fund.

RECOMMENDATION:

Staff recommends the approval of the First Amendment to the Final Construction Work Authorization for the additional costs in the amount of $173,947 for the Sycamore Sewer Lift Station Project.

As the Contractor, Ferreira Construction, began preliminary work on the Sycamore Sewer LiftStation, a few of the project submittals were received which needed further design clarificationor additional design. Veolia held a design meeting with City of Rialto Utilities Manager, TomCrowley in the second quarter of 2022, reviewed the current design that was used to bid by WestYost, and identified the issues that needed to be addressed and re-designed. It was decided toengage the services of the City’s on-call design engineer, Engineering Resources of SouthernCalifornia (ERSC), to help address the contractor’s Requests for Information and Submittals.Further design was needed to address design and regulatory compliance issues, resulting inadded additional scope to the project as follows:

Detail of Additional Scope

1. DPF Exhaust System- For the project, Ferreiraprepared and submitted, on behalf of theCity of Rialto, an AQMD permit for the new diesel generator. As part of the permit reviewprocess within AQMD, they required a DPF exhaust system to be added due to the proximity ofthe generator to the residence located near to the lift station. The cost listed is to provide andinstall the DPF on the generator.

2. Electrical Scope Additions- Additional scope basedon additional design developed byERSC in May of 2022. Scope was initiated due to RFI # 005 regarding the VFDs. (attached)● Myers Pacific Utility Products Scope: Modify the meter pedestal to change thespace for the RTU to accommodate the ATS that has already been purchased as awall mounted unit.● Tesco Scope to add PCTP: Per attached scope of supply Tesco willmake a new PCTP with VFD's integral. Ferreira will need to install this uniton the pad which is an entirely new installation. Conduit and cabling is per thesingle line drawing and instrumentation drawings. Additional programming isincluded.Credit for the VFD's and enclosure included.NOTE: 10-12 weeksneeded for submittals● Controls Scope Changes:Credit back for 2 ea pressuretransducers and 3 eachfloat/level switchesand add 1 each ultrasonic levelsensor, 1 each float levelswitch including engineering and programming.● Misc Drawing Changes: Pull box size changed including excavation, added 1 more ground well and additional ground length, modifications to Page1of 4
22 the existing pump well, additional coordination with SCE, add 2 each60A NF in the existing electrical panel with seal offs, demo as shownexisting electrical.

3. Civil Scope Additions- Additional scope basedon additional design developed by ERSCin May of 2022. Scope was initiated due to RFI # 003 & 004 regarding the Generator Pad andShade Structure and RFI #00. (attached)● Generator Pad Design - On the original drawings, the generator pad is shown tobe 8.2’x3.5, the actual size of the generator is 12’x4’. Further design revisionswere needed to accommodate the generator size and weight, which led toadditional cost.● Shade Structure - ERSC provided a detail on footings as required by City ofRialto Engineering (Plan Check) Department when responding to the shadestructure submittal. Changes to the footings resulted in additional cost.● Existing Vault Rehab/Realignment of flow meter - the existing vault will berehabbed as opposed to a new vault being installed - credits for new vault shownwithin the change order backup documentation.● Electrical Pad - layout changes with new cabinets● Material and Fencing changes

4. Additional Design- Engineering Resources of SouthernCalifornia (ERSC) was engagedin early April 2022 to assist with additional design needed to address Requests for Informationand Submittals from the contractor. Significant redesign was needed to ensure a successfulproject, which included a complete site layout redesign, evaluation and determination ofcontrolling right-of-way property lines, additional coordination with CalTrans, relocation of theproposed flow meter, and a complete redesign of the proposed electrical and control system. Theredesign is complete and the Contractor is awaiting delivery of materials prior to the beginningof construction, which is slated for 2023. As such, the original budget of $45,000 has beenexhausted and the additional funding requested herein will allow ERSC to support the projectthrough the remainder of construction.

To offset some of the design changes that were necessary to complete the project, Veolia workedclosely with Veolia Operations team to put the Sycamore pump station in full bypass mode anddemonstrated that the bypass mode works. This helps eliminate the bypass pumping line item(and associated costs) from the project scope of work resulting in a credit for bypassing scope ofwork included by Ferreira Construction. Veolia Wastewater Operations team conducted a testbypass in early December and the bypass was successful with no issues and hence the bypasscredit from the Contractor is shown in the cost detail below.

This memo is to memorialize the additional scope and services from ERSC and FerreiraConstruction and obtain appropriate City of Rialto/RWS approvals for the project.

There is no off-loading, installation, or anchoring of this equipment included in our proposal.2. All electrical and mechanical connections are to be done by others.3. There is no fuel included.4. There are no permits of any kind included.5. There are no services of any independent testing agency included.6. Your local air board may require you to have a PM Filter. See Emissions Note below.7. There is no special lugging included only the manufacturer's standard lugs.Emissions NotesThe California Air Resource Board (CARB) and local Air Quality Management Districts (AQMDs) regulate emissions for emergency standby engines. Based on the installation site, some generators may require the use of a particulate filter based on the sites distance from a school or sensitive receptor. Particulate filters may also be required for Title V and major polluting sites. Consult the local air district for permitting and more information on the required emission controls required.Emergency generators are permitted to run a maximum of 50 hours per year but this could be less depending on the permit and site specific conditions. Should a particulate filter be installed, generator loading, run time, # of cold starts/execising can be a factor. Passive diesel particulate filters regenerate when the engine is ran at approximately 60% loaded. If the generator is ran at low or no loads, the customer should consider the following options:1. Do not oversize the generator compared to building load. Allow for a building load test to run the generator at 60% or greater load.2. Have the generator load banked throughout the year. The number of times depends on the particulate filter brand and the numbers of cold starts.A load bank can be included in this quotation as part of the equipment offering or we can provide a preventative maintenance contract which can include load bank testing.3. Purchase an active particulate filter which regenerates on its own when the generator is running.

Signatory Payment Milestones01) DPF is disassembled for shipping purpose; re-assemble and interconnection required at site by Site Contractor. Collicutt support added.

Thank you Kate!

Team,
Please see the below information from Kate at SCAQMD.

My suggestion is to add the DPF and I have reached out to Collicutt to get pricing.

I believe relocating the generator or adding additional controls would be more expensive and time consuming but please let me know your thoughts.

Thank you

Hi Kathy,

Yes, it works.

Based on the map, however, it looks like the engine will be located within 50 meters of the nearest sensitive receptor (a house in this case), making it subject to PM emission standard of 0.01 g/bhp‐hr in Rule 1470, Table 1. The proposed engine emits PM at a rate of 0.10 g/bhp‐hr and will need additional control such as a diesel particulate filter (DPF) to meet 0.01 g/bhp‐hr.

The applicant can either:
 Propose a different location for the engine so that there is no sensitive receptor within 50 meters. (Provide a new aerial map showing the new proposed location.)
 Propose additional control for the engine which would reduce the engine’s emission rate to < 0.01 g/bhp‐hr. (Provide make, model, type, specification for the control being proposed.)

Please let me know by this Friday how the applicant would like to proceed.

Thank you.

Kate

SUBJECT: SYCAMORE AVENUE SEWER LIFT STATION

ADDITIONAL SERVICES PROPOSAL

Dear Michelle:

Engineering Resources of Southern California, Inc. (ERSC) is again pleased to submit our proposal to City of Rialto (c/o Veolia) for Subject project. As you know, ERSC was engaged by Staff in early April 2022 to assist with Subject project (after it had been designed, bid and awarded for construction) by reviewing some contractor RFIs. After reviewing said RFIs together with a preliminary review of the supporting contract documents, it became apparent that many elements of the original design were flawed and required significant re -engineering to ensure a successful project outcome.

Nonetheless, we provided an approximate scope and fee (by mid- April) with intentions to allow us to thoroughly review said original design and determine the best course of action to reconcile its deficiencies. After considerable effort, including a complete site layout re -design, evaluation and determination of controlling right -of-way and p roperty lines, additional coordination with Caltrans (Re. sound wall foundation type /limits & surplus property), relocation of the proposed flow meter, a complete re- design of the proposed electrical and control system, and countless conferences / correspondence with proje ct Team, we believe the project is now viable for construction.

As such, the original budget of $45,000 has long been exhausted and we formally request an amendment to allow us to continue providing support through the remainder of construction as follows:

1. Beyond Scope services to date: $6,400

2. Estimated Cost-to-Complete: $14,200
$20,600

As shown in the preceding summary, our estimated fees to bring the Project’s construction to fruition is $20,600. Upon authorization, we will continue to provide ongoing construction support and ensure uninterrupted professional service.

As always, we look forward to the opportunity of working with the City and Veolia on this matter, and appreciate our continued relationship. If you have any questions or require additional information, please call me at 909.890.1255 (Ext. 126). Thank you.

Sincerely,

For Water Subcommittee Meeting [January 25, 2023]
TO: Water Subcommittee Members
APPROVAL: Thomas J. Crowley, P.E., Utilities Manager
Cooperative Agreement Between the City of Rialto and San Bernardino County for Bohnert/Banyon Rialto Area Sewer Project.

BACKGROUND:

In 2019 Cal State San Bernardino was awarded a grant from the SAWPA Disadvantage Communities Involvement Program Technical Advisory Committee (DCI TAC) to partner with the City of Rialto (City) to assist in the preliminary design of the Bohnert/Banyon Septic to Serwer Project area. A preliminary design report was completed in March 2021 and the project was awaiting funding for other sources.

DISCUSSION:

In October 2022 staff was contacted by the San Bernardino County (County) that they had received and dedicated some funding from the American Rescue Plan Act (ARPA) for the design and construction of sewer mains within the Bohnert/Banyon Project area. This area is a County pocket surrounded by the City. There are approximately 100 residential parcels that can be served by this project.

The County wishes to enter into a Cooperative Agreement (Agreement), with the City for the development of sewer mains and laterals and to define the respective roles and responsibilities of the Parties throughout the design/engineering, environmental, right-of-way services and acquisition, project management, construction, and post-construction acceptance and maintenance phases of the project. Draft agreement is attached to this staff report.

The County intends to construct sewer mains and laterals in the unincorporated Bohnert/Banyon area within the City of Rialto, the scope of work of which shall include design and construction of approximately 1,400 lineal feet of 12" VCP sewer main and approximately 6,600 lineal feet of 8" VCP sewer with all required laterals, manholes, tie-ins, and appurtenances in collaboration with the City. See the following figures for the location of the new sewer lines.

LEGAL REVIEW:

Legal counsel assisted staff in preparing the Draft Agreement with the County.

FINANCIAL IMPACT:

There is no cost to the City for the implementation of the project. The County will be providing approximately $8 Million of ARPA funds for the design, bidding, and construction of this project. If in the event the project costs exceed the design as proposed, the the project will be sized to the availble funds. Or, the County will seek additional funding to complete the project as proposed.

The City will provide inspection service at their own expense and not cost encroachment permits to the County.

RECOMMENDATION:

Staff recommends approving Cooperative Agreement Between the City of Rialto and San Bernardino County for Bohnert/Banyon Rialto Area Sewer Project.

ANALYSIS/DISCUSSION:

The closets connection point to the City’s sewer system is at the intersection of Larch and San Bernardino Avenues. To connect, the developer will be required to extend an 8-inch sewer line easterly to the intersection of Cedar and San Bernardino Avenues, approximately 1,200 linear feet.

The existing City’ssewer line and the wastewater treatment plant have sufficient capacity to accept the proposed sewer connection for the proposed project.

It should be noted that an Extraterritorial Service Agreement is required to be approved by the City Council and the Local Area Formation Commission prior to the project being completed. This agreement describes the duties and responsibilities of the City of Rialto, and the property owner.

There are no costs to the City to construct this project.

FINANCIAL IMPACT:

To connect to the City’s Wastewater system, the owner will be required to make a one-time Development Impact Fee payment at the Extraterritorial Rate of 1.3 times the standard rate. The required connection fees are determined by the planned use of the facility and are estimated at $119,645.85 for both Wastewater Collection and Treatment fees. The calculations are shown in Table 1 below. Fees may vary due to the final layout of the project.
