ORDINANCE NO._____
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, AMENDING SECTION 10.32.050 OF THE RIALTO MUNICIPAL CODE TO ESTABLISH PRIMA FACIE SPEED LIMITS WHEREAS, in accordance with California Vehicle Code Sections 22352, 22357, 22358, 40802, and related sections, (hereinafter referred to as the “Vehicle Code”), and in accordance with the State of California Manual on Uniform Traffic Control Devices, Part 2, Chapter 2B, Section 2B.13, (hereinafter referred to as the “MUTCD”), an Engineering and Traffic Survey, (hereinafter referred to as the “E&TS”), must be performed before the use of radar or other electronic devices is authorized for the purposes of regulating the speed of vehicles on certain streets or portions thereof; and WHEREAS, on September 25, 2012, the City Council of the City of Rialto did adopt Ordinance No. 1516, establishing speed limits on certain City streets or portions thereof; and WHEREAS, since the adoption of Ordinance No. 1516, the City Engineer has conducted and completed a review of the previous E&TS as well as conducted and completed a new E&TS with data collected in 2021 and reviewed and completed in 2022 on various City streets in accordance with the Vehicle Code and the MUTCD; and WHEREAS, the results of the E&TS conform to the requirements of the Vehicle Code and the MUTCD and the results are required to be adopted by Ordinance; and WHEREAS, the City’s police officers’ training and use of radar, laser, or other electronic devices used to measure the speed of vehicles comply with Section 40802(c)(1) of the Vehicle Code; and WHEREAS, pursuant to Section 40802(c)(2)(B)(i), the speed limits to be established pursuant to this Ordinance shall be effective for 7 and up to 14 years and the City Engineer has concluded and recommends that the speed limits to be established pursuant to this Ordinance are justified; and WHEREAS, in accordance with Section 40802(c)(2)(B)(i)(II) of the Vehicle Code the effective date of speed limits established pursuant to this Ordinance extend speed limits to a total of 14 years through September 25, 2026, on the following listed roadway segments with speed limits established pursuant to Ordinance No. 1516 on the basis that the City Engineer has determined no significant changes in roadway or traffic conditions have occurred, including, but not limited to, changes in adjoining property or land use, roadway width, or traffic volume:

40 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY ORDAIN AS FOLLOWS:
Section 1: The recitals set forth above are true and correct and are adopted herein as findings.
Section 2: Section 10.32.050 of the Rialto Municipal Code is hereby deleted and replaced with the following:
10.32.050 Prima facie speed limits established.
In accordance with Section 10.32.020 and 10.32.030, and when signs are erected giving notice thereof, the prima facie speed limit shall be as set forth in this Section upon the follow streets or portions of streets:
