A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPROVING TRACT MAP 20294 FOR THE SUBDIVISION OF 2.77 NET ACRES OF VACANT LAND INTO 22 RESIDENTIAL LOTS AND THREE (3) COMMON LOTS FOR THE DEVELOPMENT OF DETACHED SINGLE-FAMILY RESIDENTIAL UNITS WHICH IS CONSISTENT WITH THE EXISTING R-3 ZONING AND RESIDENTIAL 12 GENERAL PLAN LAND USE DESIGNATION; AND APPROVING AN ASSOCIATED SUBDIVISION IMPROVEMENT AGREEMENT.
WHEREAS, the City Council of the City of Rialto, at its meeting of February 9, 2021, approved Tentative Tract Map 20294 subject to conditions; and WHEREAS, MV AMCV, LLC, a California limited liability company, (hereinafter the “Subdivider”), has filed Tract Map 20294 with the City Council of the City of Rialto, (hereinafter the “City”), in accordance with Section 66456 of the California Government Code; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, the public in general, and public utility companies, an easement for streets and public utility purposes in, under, over, through and across Cedar Avenue, subject to improvements, as shown on Tract Map 20294; and WHEREAS, the Subdivider offers for dedication to the City of Rialto, 5 feet wide easement for public utility purposes in, under, over, through, and across Lots 1 through 22, and Lot “B”; for the use of the several public utility companies authorized to serve within the Tract; and WHEREAS, the Subdivider offers to dedicate to the City of Rialto, all vehicular access rights to Lots 1 through 3, 20 through 22 and Lot “C” where they abut Cedar Avenue as shown on Tract Map 20294; and WHEREAS, the Subdivider offers to dedicate to the City of Rialto, the West Valley Water District, the public in general, and public utility companies, an easement for ingress and egress, public utilities, sewer, water, emergency access, in, under, over, through and across Lot “A”, as shown on Tract Map 20294; and WHEREAS, not all public improvements have been completed by the Subdivider as of the filing of Tract Map 20294, and the Subdivider has requested that the City enter into a Subdivision Improvement Agreement with the Subdivider to secure the cost of public improvement in accordance with Section 66462 of the California Government Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Tract Map 20294 is in substantial conformance with the approved Tract Map 20294.
Section 2: Requisite conditions associated with Tract Map 20294 have been satisfied or supported with the necessary bonds for construction improvements.
Section 3: Tract Map 20294 is in conformance with the General Plan.
Section 4: Tract Map 20294 conforms to all applicable requirements of the Subdivision Map Act of the State of California.
Section 5: In accordance with Section 66477.1 of the California Government Code, the offers of dedication to the public on Tract Map 20294 shall be accepted by the City Clerk, subject to improvement, who shall certify acceptance by signature on the map thereof.
Section 6: The City Council hereby approves a Subdivision Improvement Agreement for Tract Map 20294 with the Subdivider’s designee, MV AMCV, LLC, a California limited liability corporation, and accepts subdivision improvement securities in conformance with the requirements therein for public improvements. The City Manager is hereby authorized to execute the Subdivision Improvement Agreement on behalf of the City.
Section 7: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Subdivision Improvement Agreement.
Section 8: Tract Map 20294 is hereby approved for the purposed therein defined. \\\\
