Resolution No. 8091
Council Member Scott thanked the City staff , department heads, and senior management for maintaining the status quo on the budget and making budget reductions. It is the responsible thing to do considering the current economic conditions in the country and State not necessarily the City.
He emphasized the ongoing customer service problem in the City.
Residents and businesses of the City are the heart of the City. They are responsible for any revenue the City receives. He requested that the City’s focus be on customer service. A resident is just as important as a big corporation or developer and deserve to be treated with upmost respect and deserve a quick response or be connected with the right person. He would like to know how calls are being answered. Rialto needs to be known as the City of customer service. He requested that it be reviewed further to determine if more recruitment is needed to answer phones in certain departments.
0o0
Council Member Trujillo appreciates that staff working on keeping a conservative budget. He wants to see a plan developed on how to improve customer service especially in departments with personnel changes and make customer focus a top priority.
0o0
Interim City Manager Garcia stated it is more of a systemic issue .
All Council Members have expressed their concern about the City’s level of customer service. The budget documents a plan to address the issue of customer service with a customer -centered focus primarily emphasizing with citizens who are the City’s number one constituent who deserves same respect and courtesy as businesses.
The City has a lot to improve on. The City is in the process of recruitment in departments such as Community Development. The whole purpose is to have staff readily available to respond to inquiries. 0o0
Council Member Trujillo commented on the events list and stated that there are events that don’t receive the same response from the community. The events list needs to be re -evaluated to determine where each event needs to be housed and find ways to draw interest.
He suggested partnering with the school district to create a transition.
He recommends being more conscientious on how resources are being distributed to determine if the City should be leading a certain event.
The events calendar needs to line up and not have simultaneous events to not compete for residents.

He will work with the director to determine how the events line up with the school district to establish where the partnership sh ould be and should the event be held at the City.
0o0
Council Member Trujillo also expressed concerns with the unfunded liability, funding the City’s police department.
0o0
Council Member Baca commended the Interim City Manager Brown for creating a savings budget for 2023 and 2024. He expressed his concern with the City’s customer service and need for a better response timeframe based on the needs of the community. Orientation and training for City employees needs to be established. The City is here to serve the community and make it better and will be based on the personnel hired, current staff. Standards of behavior need to be assessed.
A marketing plan needs to be est ablished for the City events and reassess how they are currently being marketed to achieve better community participation.
The Fire and Police Department budget needs to be projected based on the growth of the population to provide appropriate safety responses to the community. Fire and Police Department need continued funding to make certain they are equipped with adequate staff to respond to community needs.
0o0
Mayor Pro Tem Carrizales reiterated Council Members’ sentiments by commending the work on the budget. The budget reductions show departments are responsive to a foreseen economic slowdown.
He stated 40 percent of the budget is from taxes. Staff needs to understand customer service and how to provide it is vital to City business success. Investors are investing into the business of the City of Rialto. The narrative needs to change. Residents and business community should be treated with the highest respect.
He hopes the message is clear from the Council Members. City of Rialto needs to be known as the business-friendly in which everyone wants to conduct business with the City of Rialto.
He asked about the office specialist position in the Treasury Department and how it will benefit the City.
0o0
Interim City Manager Garcia asked if an offline answer can be provided related to the office specialist position.

Mayor Pro Tem Carrizales stated he is fine with an offline answer.
He asked Director of Finance Stevens to provide information on the GANN Limit, so the public understands.
0o0
Director of Finance Stevens expounded on the GANN Limits placed on the City in spending or budgeting tax revenue and the general fund.
It stops the City appropriating funds more than what the City is allotted for in growth. The City was able to b ring the restriction down and allow $3.2 million.
0o0
Mayor Robertson thanked Director Stevens for leading the path and the department to make this happen.
She requested last year’s expenditures toward staff training. It has not been a very large number. She also requested information on allocation for trai ning. She stated other than the mandatory training required by law, there has not been much staff training on customer service or relation building. The mandatory law training is not customer -service oriented.
She requested a spreadsheet of what was expended last year in staff training, which happens to be low and explains why the training is not occurring. Commissioners have also expressed the need for training. It is better to take time to adopt the budget than hurry through it. 0o0

Mayor Robertson wanted clarification related to this project being against air quality act standards. She stated the concerns for overriding consideration does not relate quality but the level of the vehicle mileage. 0o0
Mr. Casey stated correct. The experts who prepared the air quality assessment are available for questions.
0o0
Mayor Robertson asked Mr. Hill with Crow Holdings to
answer questions related to his presentation.
She asked for clarification related to the signal and referenced a letter from the City expressing staff’s concerns with the alignment of the full-access driveway with Idyllwild Avenue and how it would impact safety and traffic circulation for the community.
She commented on the fatal accident at that location and asked why the developer would not consider the best option rather than split signals that don’t benefit the community.
0o0
Mr. Hill stated the traffic analysis conducted by the consultants did not dictate a signal. There was no warrant or requirement for it. 0o0
Mayor Robertson asked if he believes a major project such as this would not require some traffic control.
0o0
Mr. Hill stated Baseline Avenue is designated as a truck street in Rialto. 0o0
Mayor Robertson stated it is with four-way light intersections. There are no T-intersection. This would be a T-intersection.

Mayor Robertson stated Caltrans does not have jurisdiction over Baseline Avenue. It’s one of the approved alternatives.
She asked why Crow would not address staff’s concerns asking for the intersection to be aligned with Idyllwild Avenue.
0o0
Mr. Hill stated they have. They have reviewed options and the issue is the layout of the buildings. He stated the EDC requested to break -up the buildings. He stated if the requested layout is to reduce the truck visibility from the street and the park, it limits the options.
If the intersection is offset down to Idyllwild Avenue, the flow of traffic does not work.
0o0
Mayor Robertson stated that the City staff believes there would be a better alignment for the benefit and safety of the community and does not understand why Crow Holdings would not explore other options.
Crow Holdings traffic engineer design plan was for Crow Holdings.
City Engineer made comments related to that design that he believed were not appropriate.
She stated that the signal will not be aligned with the main exit where the majority of the traffic will flow. If the median was not in, trucks will then be idle in the middle of the street to make the turn. She asked why a company cannot meet with City staff to make modifications.
She asked how many docks do the two buildings have.
0o0
Mr. Hill stated 70.
0o0
Mayor Robertson stated the circulating plan is concerning. She asked if he has heard from staff making the request and chose not to entertain the request.
0o0

Mr. Casey stated the initial submittal came in early 2020. The entire staff o f the former Development Review Committee reviewed the proposal and layout on the site plan. The group had concerns with the layout specifically related to the non-alignment of the center driveway to Idyllwild Avenue being offset.
Those comments were included in the original comment letter.
There were subsequent conversations between the staff and the Applicant, where the Applicant determined this is their best solution and would like to proceed further with this particular layout. After many years of processing, the layout has been the same.
0o0
Mayor Robertson reiterated and asked if Mr. Casey believed this is the best solution for the residents who already reside by the project and co-existing in the community.
She asked what the answer is to obtain mutual benefit. She would have to leave it to the Council Members to decide whether to lean favorably and bypass on this one request. She stated they are attempting not to impose on a mature, established community.
She asked how many residential homes are between Cedar Avenue and Cactus Avenue and Baseline Avenue down to Etiwanda Avenue which is the alternate exit in that area. Once it is built, Etiwanda Avenue will become a backup exit.
0o0
Mr. Casey stated approximately several hundred.
0o0
Mayor Robertson stated Crow could return with the understanding asking to return with design. Or return with a value engineering option to obtain a third opinion so it becomes a win -win for the community.
She asked if it were something Crow Holdings would entertain. 0o0
Mr. Hill stated that it has been three and-a-half years. They would like to get the project voted on the way it is.
0o0
Mayor Robertson asked if Crow Holdings has any plans to sell one of the parcels.
0o0
Mr. Hill stated they don’t have any tenants. It’s standard for every project they do. Every building is on its own lot. They would like the flexibility to sell a building, should they decide.

Mayor Robertson thanked Mr. Hill for his presentation and stated that Mr. Harlan Crow professes to be an environmentalist in Texas and why would someone as Mr. Crow not express any concern with a mature, residential community.
The land was originally residential, and it was re -zoned back to business/industrial during economic hard times. She is interested in minimizing the impact who have been paying their property taxes. 0o0
Mr. Hill stated they have studied this matter at great length. From a traffic consultant’s perspective, that the light is not warranted. that everything that the City is requiring, they have agreed to. 0o0
Mayor Robertson stated even if it is not warranted, Crow is not interested in good will. She is not aware of any industrial development in the community that would not require sidewalks and medians. 0o0
Mr. Hill stated they are not challenging sidewalks. Everything that the City is requiring, they have agreed to. They have allowed to have a signal at Idyllwild Avenue. It’s a signal that stops traffic. Traffic can turn left or right with traffic stopped at Baseline Avenue, which is a truck route.
0o0
Mayor Robertson stated th is is a big project with three ingres s and egress and a mature, existing community with two ingress and egress and not aligning with either one of them.
She stated she will make a motion to move forward with Crow Holdings’ requests and ask that Crow Holding return and work with the City in 30 days to redesign and align the Idyllwild Avenue within your property to avoid traffic from navigating on Baseline Avenue.
She will make a motion and hopes one of her colleagues will second the motion. They are not denying the project, but if they do not act on it , then the motion will die for a lack of interest.
She asked if she could get a second motion. If not, then it can be pulled. 0o0
Council Member Trujillo stated he has questions.
0o0
Council Member Baca requested that Mayor Robertson wait on her motion, and he will second it. He would like to discuss matter.

Council Member Trujillo stated this is not the only project on the strip.
This has traffic impact on the EIR as mentioned. He asked for the history on the projects adjacent to it and how the EIR was dealt within the same area.
0o0
Mr. Casey stated there was a program EIR for the entire Renaissance Specific Plan that analyzed traffic and concluded significant impact to traffic throughout the area. Similar mitigation measures that are before the City Council in the EIR tonight were imposed on those warehouse developments further to the west.
0o0
Council Member Trujillo asked if they were falling in line with the neighboring projects.
0o0
Mr. Casey stated it is being handled in a very similar manner. 0o0
Council Member Trujillo inquired about the medians and asked if this median is required by State law.
0o0
Ms. Casey stated the City’s General Plan called for a raised median along Baseline Avenue.
0o0
Council Member Trujillo inquired about the flow of the trucks and traffic signal on Baseline Avenue. He asked if with the median present, will the traffic light direct trucks westbound along Baseline Avenue. 0o0
Mr. Casey stated the trucks could go potentially east and west on Baseline Avenue since it is a truck route.
0o0
Council Member Trujillo asked specifically on this project, will trucks be travelling in one direction.

0o0
Council Member Scott asked if the medians were added, what is the stacking capacity of the turning pockets into the project. 0o0
Mr. Casey stated four full semi-trucks.
0o0
Council Member Scott asked if the intention on the Idyllwild Avenue, the four-way signal is for the community to exit safely.
0o0
Mr. Casey stated yes.
0o0
Council Member Scott asked if that community was noticed. 0o0

Mayor Robertson inquired about the three ingress and egress in the area and asked for the street names in addition to Idyllwild Avenue. 0o0
Mr. Casey stated Glenwood Avenue and west of Fitzgerald is Camphor Avenue.
0o0
Mayor Robertson commented on the various signals, one at Fitzgerald and one at Cedar Avenue and then two more.
0o0
Council Member Baca thanked Mr. Hill for having a labor agreement on this project. He expressed his concerns related with the one-time fee of $3 million dollars for the project. He believes the one -time fee is not enough to maintain roads and make improvements or provide enforcement in the area.
He inquired if there is a policy or procedure currently in place in the City that relates to warehouse building fees such as dock or square-footage fees that must be incurred by the developer.
0o0
Mr. Casey stated that currently Development Impact Fees are required specifically for traffic assessed on per square -foot basis at $2.80 per square foot. It is paid prior to the issuance of a building permit. 0o0
Council Member Baca asked if it is continued or a one-time fee. 0o0
Mr. Casey stated it is a one-time fee.
0o0
Council Member Baca stated the City Council still has the responsibility to continue with road improvement and enforcement today and in the future. The one-time fee is not enough. The City needs to establish this policy before approving mo re warehouse development.
He appreciates the trade labor performing the work during that period of time. He expressed his concern with safety, traffic conditions and close proximity to Jerry Eaves Park as well as environmental impact on the community.
0o0
Mayor Robertson stated she will withdraw her motion.
0o0
Mayor Pro Tem Carrizales inquired about the landscape and asked specifically about tree-planting adjacent to the park.

Mr. Casey stated no additional trees are shown. In the Resolutions before the City Council will require the planting o f trees in the area around the perimeter.
0o0
Mayor Robertson asked if it is already stated in the Resolution. 0o0
Mr. Casey stated yes. The planters will require trees.
0o0
Mayor Pro Tem Carrizales asked Mr. Briggs about the two traffic signal lights and asked if it would be prudent to have one intersection specifically for the housing and another for the entrance of the building. 0o0
Mr. Briggs stated it is an offset intersection and based on their analysis, it would operate at acceptable levels of service. It would work acceptably for both driveways.
0o0
Mayor Pro Tem Carrizales stated he believes separating the traffic entering the neighborhood is safer than making one intersection that intermingles both the traffic entering the warehouse and the traffic entering the community.
0o0
Mr. Hill stated t hat the signal exiting the residential area, stops all the traffic. There’s no traffic going east or west when coming out of the residential area. It has its own signal.
0o0
Mayor Pro Tem Carrizales stated he understands. He believes it is safer to have a separate signal for the entering community and another directly to the warehouse.
0o0
Mr. Briggs stated that particularly with trucks and how they turn, there could be a potential concern if it was a four-way approach so having the offset does help with truck turning.

Council Member Scott reminded the City Council that the EDC is working on a formula for community benefit under the situation of development agreement versus community benefit program. They have looked at a number of alternatives.
He cautioned the City Council in supporting a door tax. To bring a door tax would be put on all warehouses in the City. You could have a situation where you could chase off a point-of-sale warehouses such as Amazon to other communities who do not have door taxes. The benefit of point-of-sale warehousing in the City is that it brings sales tax.
In 2014, the City sales tax was approximately $11 million dollars.
Today, it is roughly $53 million. Most of that is from Amazon and point of sale. It is not from the Renaissance Shopping Center. It’s from point of sale of facilities in the City.
Annual payment going into the City comes from property tax. There is significant increase for not only to the City of Rialto but the County of San Bernardino as a result of the growth of warehouses in these communities. It’s been up since 2014. Before we make decisions or hold off projects to review this, we need to more studies on how to generate revenue.
Trucks and all vehicles buying $6.00 diesel and gasoline are paying State taxes and that money goes into Measure I and that money is supposed to be used for streets and cannot be used for anything else.
There should be a significant amount of money based on the incredible charges by the State of California for gas and diesel tax. There should be a large windfall in the next year or two on those fees.
All those needs to be considered, before making decisions. 0o0
Mayor Robertson stated that comments have been heard. She withdrew her motion because she would hope that the developer would see the concern. Not one Council Member is a licensed traffic engineer, and their opinion may matter or may not. Some streets ha ve four-way intersections, and still have difficulty exiting the communities.
This is the action. She would have hoped the developer would have considered it. She does not understand the reservation on the part of the developer but appears their decision has been made.
Should any Council Member make the motion to pass the project, it will move forward. She made the request on behalf of the community. The community did not come out. As far as the public is concerned, the City Council is moving straight ahead and why should they bother. Residents are now concerned about gopher problem s so there should be vector control when conditioning a project during construction.
In reference to community benefit, she does not believe a traffic signal to be cons idered a community benefit because the City does not construct any warehouse on the main corridor without a signalized intersection.

PUBLIC COMMENT
Claudia Cuevas addressed the City Council related to TAB 3 in opposition to the project. She stated she was mocked by people outside City Hall in favor of the project all because they want to keep children safe and healthy.
The City Council voted in favo r of a developer who will bring illnesses, accidents, and traffic. She is a former RUSD employee who cares about children’s welfare and believes they deserve a better quality of life and future. She stated there are a lot of vacant warehouses in Fontana and does not understand why Rialto continues to build more warehouses. 0o0
Luis Carretero Cuevas addressed the City Council related to TAB 3 in opposition to the project. He suggested the area be rezoned as is and find other alternatives. He does not believe this is the best for the community. He is fighting because he cares for the health and safety of the citizens of Rialto and the Inland Empire.
0o0
Eric Rojas addressed the City Council related to TAB 3 in opposition to the project and cited a Native American quote. He is disappointed in the City Council’s action. He is sad to see the disregard for local communities.
0o0
Ana Gonzalez addressed the City Council related to TAB 3 in opposition to the project. The cumulated impacts of the project remain. She cited an article published in the Orange County Registrar on August 12, 2023, titled “Southern California Warehouses Triple in Two Years”.
Forty-seven million square feet of officially empty warehouse space.
Rialto is becoming a warehouse city. Studies show that warehouses have a 25-year life span and what will the City do after in the long run after the developers have exploited co mmunities and have taken their profits elsewhere.
0o0
Maria Velazquez addressed the City Council related to TAB 3 in opposition to the project. The community is developing negative views of the City Council who is supposed to represent the residents.
The community believes they are not receiving the appropriate support from its leaders thanks to the same community that e lected them.
The City Council is supposed to serve the community. She asked why build schools and parks if they will be surrounded by warehouses.
She suggested the City Council take time to drive and walk around City streets to witness and experience careless drivers and ask the City Council to try to understand what they are going through and make a good decision based on humanity and not monetary gains.

Mr. Casey stated on Valley Boulevard and Willow Avenue but not on Alice Avenue.
0o0
Council Member Trujillo expressed concerns with their Community Benefit Agreement and not knowing what the developer’s idea of giving back would be. Council Member Baca expressed his concerns about the truck traffic flow exiting the 10 Freeway that will i mpact Valley Boulevard and Rialto Village Shopping Center.
0o0
Mr. Casey stated there will be new additional trips that will impact the streets.
0o0
Council Member Baca emphasized that Riverside Avenue is the nearest exit to turn on Valley Boulevard or Cedar Avenue to arrive at the immediate area. He expressed his concern s with the road conditions and potholes considering there is no tentative Labor Agreement, no Community Benefit Agreement. There is no policy in place that addresses warehouses procedures.
There are 177 warehouses in the City of Rialto and 72 vacancies in the area with more additional warehouse projects. The burden is left on the citizens of Rialto that will eventually pick up the additional costs related to road improvements and enforcement.
0o0
Mayor Robertson stated the area on Valley Boulevard zone has been changed to a commercial area and ha s not drawn any commercial activity. The area needs to be consistent. The project will be a benefit.
