2 A RESOLUTION OF THE PLANNING COMMISSION OF THE
3 CITY OF RIALTO, CALIFORNIA, RECOMMENDING THAT
THE CITY COUNCIL APPROVE ZONING CODE AMENDMENT
4 (ZCA) NO. 2023-001 ADOPTING AN ORDINANCE
AMMENDING OUTDOOR STORAGE USES (CHAPTR 18.104
5 OF THE RIALTO MUNICIPAL CODE "REGULATION
6 OUTDOOR STORAGE USES".
7 8 WHEREAS, there is a need to amend the Rialto Municipal Code to require additional 9 requirements for outdoor storage uses with a conditional development permit application and 10 demonstrate compliance with specific criteria and development standards prior to operating in the 11 city; and
12 WHEREAS, the Planning Commission desires to promote economic vitality and 13 sustainability of businesses within the community, while still protecting the general health, safety, 14 and welfare of the public, by regulating outdoor storage uses; and 15 WHEREAS, on August 30th, 2023, the Planning Commission held a public hearing on 16 Development Code Amendment 23-002, an amendment to Title 18 of the Rialto Municipal Code 17 to modify and clarify development standards for outdoor storage uses, where it heard testimony 18 19 and discussed the draft Ordinance and recommended to the City Council approval of the same. 20 WHEREAS, pursuant to Section 18.06.030(C) of the Rialto Municipal Code, the Planning 21 Commission shall hold a public hearing for a proposed zone change and forward a 22 recommendation to the City Council for action; and
23 WHEREAS, on August 30th, 2023, the Planning Commission of the City of Rialto 24 conducted a duly noticed public hearing, as required by law, on Zoning Code Amendment No. 25 2023-001, took testimony, at which time it received input from staff and the city attorney; heard 26 public testimony; discussed the Ordinances related to Zoning Code Amendment No. 2023-001; and closed the public hearing; and
27 28 WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. -1-
1 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Rialto as 2 follows:
3 SECTION 1. The Planning Commission hereby specifically finds that all of the facts set forth 4 in the recitals above of this Resolution are true and correct and incorporated herein. 5 SECTION 2. The adoption of the proposed Ordinances is exempt from the California 6 Environmental Quality Act (CEQA). Pursuant to Section 15378 of the California Environmental 7 Quality Act, a 'Project' means the whole of an action, which has a potential for resulting in either a 8 direct physical change in the environment, or a reasonably foreseeable indirect physical change in the 9 environment. A project does not include changes to development standards that will not result in 10 direct or indirect physical changes in the environment. The Planning Division will file a Notice of 11 Exemption with the Clerk of the Board of San Bernardino County in accordance with CEQA upon 12 completion of the Ordinances.
13 SECTION 3. The Planning Commission hereby recommends that the City Council approve 14 Zoning Code Amendment No. 2023-001 and adopt an amendment to the Outdoor Storage Uses 15 Ordinance (Exhibit 1).
16 17 SECTION 5. The Chairman of the Planning Commission shall sign the passage and 18 adoption of this resolution and thereupon the same shall take effect and be in force. 19 PASSED, APPROVED AND ADOPTED this 30th day of August 2023. 20 21
