RESOLUTION NO._____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPROVING THE PUBLIC IMPROVEMENT AGREEMENT FOR PUBLIC IMPROVEMENTS ALONG RENAISSANCE PARKWAY AND LOCUST AVENUE RELATED TO THE PRECISE PLAN OF DESIGN (PPD) 2021-0063 FOR THE construction of a 116,060 Square-Foot Industrial WAREHOUSE Building.
WHEREAS, the City Council of the City of Rialto, at its meeting of July 26, 2022, approved PPD 2021-0063 subject to conditions; and WHEREAS, CRP/LOVETT RIALTO INDUSTRIAL OWNER, LLC, a Delaware limited liability company, as successor in interest to Orbis Real Estate Partners, LLC, (hereinafter the “Developer”), has submitted a Public Improvement Agreement with security; and WHEREAS, not all public improvements have been completed by the Developer prior to issuance of building permits, and the Developer has requested that the City enter into a Public Improvement Agreement with the Developer to secure the cost of public improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Requisite conditions associated with PPD 2021-0063 have been satisfied or supported with the necessary security for construction of improvements.
Section 2: The City Council hereby approves a Public Improvement Agreement for PPD 2021-0063 with the Developer, and accepts public improvement securities in conformance with the requirements therein for public improvements. The City Manager is hereby authorized to execute the Public Improvement Agreement on behalf of the City.
Section 3: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Public Improvement Agreement. \\\\
WHEREFORE, this Resolution is passed, approved and adopted this 26th day of September 2023. _______________________________
