RE: 436 West Rialto Ave. Warehouse – Response to Community Letters

T&B Planning, Inc. (T&B Planning) is the environmental consulting firm that prepared the Mitigated Negative Declaration (MND) for the 436 West Rialto Ave. Warehouse project (hereinafter “Project”). This memorandum addresses the written comments provided by Ms. Ana Gonzalez and the Center for Community Action and Environmental Justice (hereinafter “Commenters”). This memorandum addresses the comments that are applicable to the Project’s environmental analysis and demonstrates that the MND that was prepared for the Project was conducted in good faith and is technically correct and, thus, the conclusions presented in the MND are considered valid and accurate. Responses are organized to correspond to the environmental topic issues that were mentioned in each comment letter.

Adequacy of MND
The Commenters assert that a MND is inadequate for the Project and that an E nvironmental Impact Report (EIR) should be prepared because MNDs , purportedly, are less thorough and provide a lesser analysis of potential environmental impacts. The Commenter’s gross characterization of the MND prepared for the Project is inaccurate. The information disclosed in the Project’s MND is based on data from 12 reports prepared by technical experts as well as research of over 15 other documents. The technical analysis and research that was performed for the Project’s MND was conducted to the same standard as an EIR. Put another way, had an EIR been prepared for the Projec t, the scope and level of detail of the environmental analysis would be identical to the analysis performed during preparation of the Project’s MND and the conclusions would be identical as well.

The Commenters also assert that an EIR is warranted to full y address air quality, noise, light pollution, and cumulative impacts that would result from the Project. As disclosed in the MND and supported by evidence in the public record, the Project would result in less than significant direct, indirect, and cumula tive impacts related to air quality (see MND pp. 4-10 to 4-18 & 4-79 and Technical Appendices A & B), noise (see MND pp. 4-51 to 4-57 & 4-81 and Technical Appendix K), and light pollution (see MND pp. 4 -6 to 4-7 & 4-79). Because the MND did not identify a potentially significant impact under any of the aforementioned topics, preparation of an EIR is not warranted. The Commenter s do not provide any evidence to disprove the analysis in the MND, thus no further response is necessary.

RE: 436 West Rialto Ave. Warehouse – Response to SCAQMD Comment Letter

T&B Planning, Inc. (T&B Planning) is the environmental consulting firm that prepared the Mitigated Negative Declaration (MND) for the 436 West Rialto Ave. Warehouse project (hereinafter “Project”). T&B Planning prepared this memorandum with assistance from the Project’s air quality expert, Urban Crossroads, Inc., to address the written comments provided by the South Coast Air Quality Management District (SCAQMD, hereinafter “Commenter”). As demonstrated herein, the air quality analyses for the Project are sound and were performed in good faith, and the conclusions presented in the MND are considered valid and accurate. Responses are organized to correspond to the environmental topic issues that were mentioned in the Commenter’s letter.

Cleanup Activities During Construction
Subsequent to preparation of the Project’s MND, a more detailed subsurface investigation of the Project Site was conducted which confirmed that no underground storage tanks (USTs) remained on the subject property.

Accordingly, there is no need for any site remediation during construction. Because no site remediation will occur during construction, the construction air quality analysis that was performed in support of the MND adequately captures the full scope of expected construction activities and no changes to the analysis are necessary.

Mobile Source Health Risk Analysis
Model Averaging Time
The Commenter states that the mobile source health risk analysis (HRA) should have been run utilizing the PERIOD and 1-Hour averaging time options in AERMOD as opposed to utilizing AERMOD’s ANNUAL averaging time option (which was done for the Project’s analysis). I f th e Project’s analysis model were re -run to utilize the PERIOD averaging time option, the results would be unchanged from the Project’s analysis because the meteorological data used in the data set is based on annualized data. Additionally, the 1 -Hour averaging time option is used for analyzing non-cancer acute health impacts, which are assumed to take place over a period of 1 hour. Because the only toxic air contaminant (TAC) emitted by the proposed Project would be diesel particulate matter, which does not have an acute reference exposure level (meaning there are no expected acute health impacts), the 1 -Hour averaging time option is not necessary.

436 WEST RIALTO AVE. WAREHOUSE – RESPONSE TO SCAQMD COMMENT LETTER June 29, 2023

Page 2 of 2 ends

Building Downwash and Truck Idling
The Commenter states that the analysis should have been performed utilizing the building downwash option in order to account any impacts buildings may have on ground level concentrations. It should be noted that emissions from volume sources (including line volume sources) are not affected by building downwash. As such, truck movement and idling emissions sources would not be impacted by building downwash.

Additionally, the Commenter states that truck idling emissions should be modeled using point sources rather than line volume sources. However, given that idling emissions are expected to occur in a line adjacent to the building loading docks, and specific parameters unique to point sources such as exhaust temperature, flow rate, and stack diameter are not known, line sources are appropriate for modeling emissions from idling trucks.

Based on the foregoing responses, no revisions are needed to the MND or its supporting air quality analyses.

Project Trip Generation
The Commenter’s statement that the MND and its supporting technical analyses use inconsistent values for Project-related traffic trips is incorrect. As noted in the MND (see Page 4-65), the Project is calculated to generate 310 passenger vehicle trips and 208 truck trips; these values are also utilized in the Project’s air quality analyses (see the CALEEMod output files associated with Technical Appendices A and B) and the Project’s traffic report (see Technical Appendix L, Page 46). The figures cited by the C ommenter came from the scoping agreement to the Project’s traffic report and not the report itself. The scoping agreement was prepared under the previous version of the City of Rialto’s traffic analysis guidelines. The City updated t heir City-wide traffic analysis guidelines during the course of the Project’s entitlement review and the Project’s traffic report was updated to reflect the new City guidelines, thereby superseding the trip calculations in the scoping agreement. Accordingly, the inputs used for the analysis in the MND are internally consistent and no revisions are warranted to the MND or its supporting technical analyses.

California Emissions Estimator Model Analysis
The Commenter states that the user -defined industrial land use type was modeled in CalEEMod in addition to unrefrigerated warehouse-no rail land uses, and expresses concern that because the acreage, building ar ea, and landscape area values are set to zero for the user-defined industrial land use, emissions may not be calculated for this land use. CalEEMod was set up with a “user-defined industrial land use” for the Project’s analysis in order to separate passenger car and truck vehicle trips for analysis purposes. The Project’s “user-defined industrial” land use accounts for emissions resulting from truck trips only and allows the model’s default truck trip lengths to be adjusted to be consistent with SCAQMD’s guidance. Passenger car trips as well as area, energy, water, and waste emissions were modeled under the unrefrigerated warehouse land use type.

Land Use Compatibility
Contrary to the claims of the Commenters, the proposed Project is not inconsistent with the City’s General Plan.

As disclosed in the MND, the subject property is designated by the City’s General Plan for “Light Industrial (LI)” land uses and zoned for “Li ght Industrial (M -1)” land uses. Further, the Project represents a re-development proposal for a property that was operated as an industrial use (i.e., lumber yard) for approximately 50 years.

Operations at the lumber yard included the delivery of lumber and related materials to the Project Site by rail and heavy trucks, the unloading of lumber by cargo equipment, the operation of a saw mill, and the sale and transport of lumber to end users by heavy truck – all of these activities produced air quality and noise effects similar to, or more severe, than the effects from the Project.

Additionally, the Commenters claim that alternative land uses would be preferable to the proposed Project due to a purported reduction in air pollution. The Project’s air quality consultant performed an analysis to quanitfy the actual air quality effects from alternative land uses, specifically from a shopping center, a residential development with detached single-family homes (at a density comparable to existing homes adjacent to Bud Bender Park), and a residential development with low -rise apartments. As shown by the analysis, the air pollution levels (including greenhouse gases) from a shopping center and a low -rise apartment residential project would be more severe than the Project. The Project’s air pollution levels are comparable, although slightly greater, tha n what would be expected from a similarly-sized, detached single-family home development. The supplemental air quality analysis is provided as an attachment to this memorandum.

6. Climate Risk Detailed Report

6.1. Climate Risk Summary
Cal-Adapt midcentury 2040–2059 average projections for four hazards are reported below for your project location. These are under Representation Concentration Pathway (RCP) 8.5 which assumes GHG emissions will continue to rise strongly through 2050 and then plateau around 2100.

Climate Hazard Result for Project Location Unit
Temperature and Extreme Heat 26.4 annual days of extreme heat Extreme Precipitation 4.90 annual days with precipitation above 20 mm Sea Level Rise 0.00 meters of inundation depth
Wildfire 0.00 annual hectares burned
Temperature and Extreme Heat data are for grid cell in which your project are located. The projection is based on the 98th historical percentile of daily maximum/minimum temperatures from observed historical data (32 climate model ensemble from Cal-Adapt, 2040–2059 average under RCP 8.5). Each grid cell is 6 kilometers (km) by 6 km, or 3.7 miles (mi) by 3.7 mi.

Extreme Precipitation data are for the grid cell in which your project are located. The threshold of 20 mm is equivalent to about ¾ an inch of rain, which would be light to moderate rainfall if received over a full day or heavy rain if received over a period of 2 to 4 hours. Each grid cell is 6 kilometers (km) by 6 km, or 3.7 miles (mi) by 3.7 mi.

Sea Level Rise data are for the grid cell in which your project are located. The projections are from Radke et al. (2017), as reported in Cal-Adapt (2040–2059 average under RCP 8.5), and consider different increments of sea level rise coupled with extreme storm events. Users may select from four model simulations to view the range in potential inundation depth for the grid cell. The four simulations make different assumptions about expected rainfall and temperature are: Warmer/drier (HadGEM2-ES), Cooler/wetter (CNRM-CM5), Average conditions (CanESM2), Range of different rainfall and temperature possibilities (MIROC5). Each grid cell is 50 meters (m) by 50 m, or about 164 feet (ft) by 164 ft. 14430 - 436 W Rialto (Shopping Center) Detailed Report, 5/23/2023 23 / 28
Wildfire data are for the grid cell in which your project are located. The projections are from UC Davis, as reported in Cal-Adapt (2040–2059 average under RCP 8.5), and consider historical data of climate, vegetation, population density, and large (> 400 ha) fire history. Users may select from four model simulations to view the range in potential wildfire probabilities for the grid cell. The four simulations make different assumptions about expected rainfall and temperature are: Warmer/drier (HadGEM2-ES), Cooler/wetter (CNRM-CM5), Average conditions (CanESM2), Range of different rainfall and temperature possibilities (MIROC5). Each grid cell is 6 kilometers (km) by 6 km, or 3.7 miles (mi) by 3.7 mi.

The sensitivity score reflects the extent to which a project would be adversely affected by exposure to a climate hazard. Exposure is rated on a scale of 1 to 5, with a score of 5 representing the greatest exposure.

The adaptive capacity of a project refers to its ability to manage and reduce vulnerabilities from projected climate hazards. Adaptive capacity is rated on a scale of 1 to 5, with a score of 5 representing the greatest ability to adapt.

The overall vulnerability scores are calculated based on the potential impacts and adaptive capacity assessments for each hazard. Scores do not include implementation of climate risk reduction measures.
